1. SUBJECT
First Amendment to Contract with Towo Enterprise, Inc., for Annual Concrete Replacement at Various Locations, Phase I.
2. SUMMARY
The City of Orange has entered into a Contract with Towo Enterprises, Inc., for the Annual Concrete Replacement at Various Locations, Phase I project (Bid No. 22-23.09). Additional locations have been added at the agreed bid unit prices in the amount of $76,665.00.
3. RECOMMENDED ACTION
Approve the First Amendment to the Contract in the amount of $76,665.00 with Towo Enterprises, Inc. for additional work; and authorize the Mayor and City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The total expenditure for this project is $563,000 and will be funded in CIP - Streets-Citywide Sidewalk Assessment Program (204410) and Operating expenditures through Measure M (263).
5. STRATEGIC PLAN GOALS
Goal 1. Provide for a safe community. Provide and maintain infrastructure necessary to ensure the safety of the public.
Goal 4: Provide outstand public service facilities and service to meet customer expectations.
6. DISCUSSION AND BACKGROUND
The City Council awarded the Annual Concrete Replacement at Various Locations, Phase I on November 15, 2022, to Towo Enterprises, Inc. The scope of work consists of replacing sidewalk displacements and lifted curb and gutter at various locations throughout the City.
The unit bid prices from Towo Enterprise, Inc., were very favorable to the City and we have the ability to increase the scope of work. As such, Staff recommends adding approximately 4,000 square feet of sidewalk, 140 linear feet of curb and gutter and 335 square feet of driveway approaches.
The original awarded contract amount for Towo Enterprises, Inc. was $486,335 including the 15% contingency. The First Amendment to the contract represents 18% increase from the original City of Orange Printed on 3/9/2023Page 1 of 2
