Epic rain and snowfall melt have increased the possibility of a 100-year flood from the Santiago Creek, which the mayor and many of us want to protect and preserve. Enhancing flood protection along the Santiago Creek was the subject of a meeting last week at which Orange County Public Works and the U.S. Army Corps of Engineers heard public comments to their proposed plans. Much of the work has already been completed, except for the final part involving the creek from the Villa Park Dam north of us and extending downstream through Orange, with the recent meeting mainly focused on proposed changes from the 5 Freeway to the Santa Ana River.
The proposal includes removal of natural green space vegetation such as mature trees, many at least 75 years old and 50 feet tall, that support wildlife including owls and hawks. A broad- based bipartisan coalition of Orange citizens and non-profit groups concerned with the flood plain is advocating to protect and preserve the land along the creek for the health of our entire community and for future generations to enjoy. Instead of concrete riprap to stabilize creek slopes, they believe a natural channel design as proposed by the U.S. Environmental Protection Agency is a much healthier approach and will cost less in the long term. Preserving and creating additional green space adjacent to the creek in Orange would create safety valves for excess stormwater. The temporary wetlands created during periods of high rain would also allow water to percolate into the ground to replenish groundwater supplies and help purify the water.
You are urged to do all you can to provide us with a healthy environment, to adopt a climate action and adaptation plan that would include protecting and preserving Santiago Creek. Strategic habitat restoration would help serve as a carbon sink to counteract global warming and protect our drinking water and native flora and fauna. It would also promote biodiversity and protect endangered and threatened species, limit erosion and damage from flooding, and provide an aesthetic, natural, sustainable environment for recreation and passive use. Acquiring land with grants and other funding sources would preserve open space and prohibit further development encroachment on the watershed.

eComment: I can't believe what I've heard! The council is considering increasing the number of STR's? Once again you're throwing the tax paying citizens of Orange under the bus. Dan, I had a conversation with you before your election and you said you were opposed to them. Ms.
Barrios prior to your election you stated your opposition. You voted to allow them. I understand the reasoning for allowing them but to add insult to injury is unfathomable. I also suggest that through attrition we issue no new permits. Please no more STR's in Orange. Don Dawson View and Analyze eComments

eComment: I am opposed to adding more short term rentals. Our city has enough transient people with Chapman students, homeless folks and the current short term renters. As a 21-year resident of Orange, the potential negative effects of these rentals include increased noise, traffic, parking, overcrowded streets, and litter. These issues negatively affect the quality of life for us, the long-term residents, as well as the safety of the community as a whole. I urge you to oppose the increase. Thank you, Diana Zdenek

eComment: I am opposed to the increase of Short Term Rental (STR) licenses from 125 to 200 as it simply adds to the further commercialization of our neighborhoods. In addition to the STRs, there are approximately 35 boardinghouses in/around Old Towne Orange (5-10 Bedroom properties catering exclusively to college students) and countless 4BR (or fewer) properties that also exist exclusively for the purpose of housing college students on a rotating basis - all are commercial enterprises existing within residential neighborhoods. When will this commercialization of our neighborhoods end? Tony Trabucco Old Towne Orange Resident View and Analyze eComments

eComment: Honorable Mayor Slater and City Council Members, happy May and hope this finds you all well. I'm writing on behalf of the Orange Short Term Rental Alliance, which is comprised of permitted, law-abiding and tax paying home hosts in the City of Orange. We first want to commend the City of Orange for doing a great job across the last few years working collaboratively with us and the community on code that allow guidance for responsible management of an STR program in Orange. Together, we moved from a position of all-out ban based on complaints against a few bad actors to a compromise that was a win-win-win for Orange small businesses, our neighborhoods and the City. Unfortunately, since the program was instituted, many in our group have noticed illegal STRs continue to be listed on rental platforms, and we believe the City could do more to leverage existing code to control for this. To be sure, according to City Council discussions as we were establishing the program, some of the revenue from our STR permit fees were meant to be dedicated to code enforcement on illegal STRs.
Actioning this would deter bad actors, preserve peace in our neighborhoods and continue a program that's gotten off to a great start so-far. We do understand Code Enforcement has been under-resourced for the majority of the STR program's lifetime but, with help from Host Compliance, we feel confident the City could easily identify and serve notice to these bad actors, dually driving yet-to-be-realized revenue in TOT and fines and supporting those of us who are legitimately running STRs with business licenses, STR permits and paying taxes on our rentals.
Our group adheres to the vision that we, as Orange home hosts, are ambassadors for our great city. As such, we welcome compliance first in order to ensure a solid foundation, and then, the phased approach recommended in the City Staff report. We believe this is the best path for sustainable growth and continuation of the win-win-win scenario. We also support updating the language in the existing code when the Council is ready to review. Thanks for your service to our city and for your consideration on this issue. Susan Tillou Orange Short Term Rental Alliance (OSTRA)

You don't often get email from Learn why this is important I would like to voice my opposition to increasing the number of short term rentals in Orange. Many of those that currently exist create horrific issues for the homeowners in the surrounding homes. The STR owners are absentee landlords who do nothing to curtail the obnoxious and in many cases illegal activities that take place. Adding additional STR when there are already so many issues with those that currently exist is a terrible idea. These continue to erode the small town feel of Orange and should be extremely limited.

I oppose Item #6.3 increasing short term rentals from 125 to 200. Short term rentals bring noise and safety concerns, parties, cause a loss of housing, increase rent, take away from the fabric of our neighborhood and displace long-standing residents.

eComment: I oppose the STR permit because, my family and closeby neighbors are annoyed by the late night noises and unfamiliar vehicles mistakenly parking in our driveways, assuming our houses for AirBnB house. These guests parked in my driveway reasoned they were waiting for their friends from the rental home. These unfamiliar cars take up more street parkings when, we're already dealing with the influx of cars taking up our parkings from the adjacent apartment complex. enjoy living in my quiet family-oriented neighborhood where everyone knows each other. Now with an AirBnB on our street, we all have to keep vigilant and this kind anxiety is unnecessary when I need to have more focus on my family and home.

Item: 8.1. Second Reading and adoption of an Ordinance of the City Council of the City of Orange adding Chapter 1.10 to the Orange Municipal Code relating to administrative citations.
Ordinance No. 04-23. (Continued from April 11, 2023)
eComment: I supported this proposed ordinance as written during the 1st reading. During the second reading, a number of concerns were raised by several council members that resulted in the language included in this meeting's (May 9, 2023) proposed ordinance. It seems that substantive changes are being proposed, which makes me question whether it should revert back to a first reading -- i.e. is this process even allowed? My concerns are with regard to the proposed language that states: "....excluding any nonobjective design or aesthetic standard imposed by discretionary review" -- the term "nonobjective" implies "subjective" -- isn't virtually all discretionary review subjective? This essentially renders any discretionary review unenforceable.
If that's the case, then we're back to the current enforcement protocol of voluntary compliance, with the only remedy being litigation, which is costly and time-consuming for both the City and the resident or business owner (and rarely, if ever, happens). If this clause in question were removed I would be in support of the proposed ordinance. And the goal isn't to utilize Administrative Citations as a first strike -- it should be a last resort for those situations where voluntary compliance doesn't seem to be working, and litigation is only on the distant horizon.
And, not to over-use the word, but it should be discretionary, based upon the individual circumstances.

Ordinance No. 04-23. (Continued from April 11, 2023)
eComment: The redlined version of Ordinance No. 04-23 includes revisions that exclude "any nonobjective design or aesthetic standard imposed by discretionary review." There are existing local historic districts with design standards, such as the three Eichler tracts. Can you explain the implications of these changes in regards to enforcement of the design standards with reference to code violations? Will this weaken existing protections? What is the motivation for this change? I'm concerned that the change will basically render these design standards as purely optional, with no recourse for the City or communities/neighbors to enforce them through code. -Adrian Turner, Orange, CA

Respectfully, the importance of a quality of life in our fair city is more important than satisfying a few developers who are mainly interested in lining their pockets. The quaint city my husband and I moved into is rapidly being endangered with traffic issues and the loss of its original Old Towne charm. Please reconsider voting on the original ordinance.

The council recently heard a reading of an historic preservation ordinance that preserved the integrity of our National Register Historic District. This new ordinance sets historic preservation back. It removes the provisions that protect historic design and aesthetic standards. The ordinance, as originally written, preserves Old Towne Design Standards.
Why are the citizens of Old Towne constantly fighting to preserve our historic district? This has been going on for 36 years. The jewel in the crown in our city is our historic plaza and the surrounding well maintained historic homes.
I was looking up David Fletcher, who was born in Orange and plays middle infield for the Angels. At the bottom of all his stas was the comment that Orange is known for it's collection of historic homes! And we are talking about baseball! Not In closing, the ordinance, as originally written and read aloud during the first reading, is what should be brought back, voted on, and passed by this council.
On another note, agenda #6.3 is looking to increase short term rentals from 125 to 200. NO we don't need more transient housing and over crowding. Enough giving in to Chapman and it's too large student population. These short term rentals will be for parents visiting.

The City of Orange is a unique community, largely because there are community members and council members who care about maintaining stringent historic guidelines for the protection of the Historic District and community.
This has allowed our community to be seen as a leader in preservation, allowing homes here to increase in value, through protection of the codes. Please do not take this step backward.

I oppose the revised Ordinance No. 04-23 (agenda Item 8.1) as it is currently written. The proposed language appears to diminish the City's ability to administer the Orange Eichler Design Standards (OEDS); the OEDS were supported by a majority of homeowners and ultimately adopted in order to protect the tracts as unique historic resources. Please strike the references to "design or aesthetic standards" from the redlined draft that is under consideration at the May 9, 2023 meeting.

If not, in addition to the Historic Preservation Element having no value the same is true for urban design. We see this with the attack on our plan for housing. Don't take the road of ease and complacency. Are you with the community or not?

You don't often get email from • Learn why this is important Our family is opposed to Item #8.1 ( code enforcement ordinance) as it is currently written for the second reading.
Design Review Committee is an advisory group; even if they stand in opposition to a project, they have no teeth.
Code enforcement should be able to write citations for violations.

I am writing to oppose Item #8.1 as it is currently written for the second reading of the Code Enforcement ordinance.
I think removing design and aesthetics from this ordinance would only hurt preservation and embolden those that seek to continue to ignore the design standards. The ordinance, as originally written and read aloud during the first reading, is what should be brought back, voted on, and passed by this Mayor and Council.
I am saddened to see that after 30 years some citizens and council members cannot see the value of maintaining the integrity of Old Towne Orange. It is under constant assault. Keeping the area historical has been good for all property owners and ultimately the city. Destroying it one bite at a time will ultimately cost us all.
I am asking that you pass the original ordinance as presented at the first reading.
Thank you,
Sue Vaurs

eComment: I oppose the revised Ordinance No.

Item: 8.1. Second Reading and adoption of an Ordinance of the City Council of the City of Orange adding Chapter 1.10 to the Orange Municipal Code relating to administrative citations.
Ordinance No. 04-23. (Continued from April 11, 2023)
eComment: Honorable Mayor Slater and Councilmembers, RE: Item 8.1 I am writing to oppose Item #8.1 on the 5/9/2023 City Council Agenda as it is currently written for the second reading of the Code Enforcement ordinance. Specifically, the definition of "Code" "Code" includes: (1) the entire Orange Municipal Code and any other Code or regulation incorporated therein by adoption or reference, excluding any nonobjective design or aesthetic standard imposed by discretionary review, (2) any uncodified ordinance adopted by the Orange) City Council, and, (3) any and all applicable county and state laws, codes or regulations. The definition is vague and not well defined. I am really not sure of the reason for this change, (excluding any nonobjective design or aesthetic standard imposed by discretionary review), as it moves us backwards in regards to historic preservation. I don't have to remind this council that we have the largest historic district in the state and it is up to us to make sure it is well protected. This ordinance makes those efforts more difficult. It also contradicts the preservation standards ordinance. I feel that by excluding design and aesthetics from this ordinance would have a negative impact and weaken historic preservation measures outlined by the Old Towne Preservation Standards and the Secretary of Interior Standards. This would also encourage those that seek to continue to ignore these standards (ordinance/code). The city has struggled in the pass enforcing the city's preservation ordinance and this provision seems like it would only make it harder to enforce by creating this huge loophole. I and Old Towne Preservation Association have worked diligently for many years to strengthen the city's preservation measures. This ordinance, as written, only weakens their enforcement. I would think that the city would want to draft an ordinance that is straight forward and easily enforced rather than one that has vaguely written definitions that may be interpreted in multiple ways. I would strongly encourage this council to revert back to the way the ordinance was originally written and read during the first reading, and be brought back, voted on, and passed by this Council. Respectfully, Jeff Frankel (past OTPA President/Preservation Chairman) Jrange CA.
