1. SUBJECT
Attorney Services Agreement with Liebert Cassidy Whitmore to provide legal services related to active police disciplinary and investigative matters.
2. SUMMARY
The agreement with Liebert Cassidy Whitmore for an amount not to exceed $160,000 is for legal services to an active police disciplinary and investigative matter.
3. RECOMMENDED ACTION
Approve the Agreement with Liebert Cassidy Whitmore in the amount of $160,000; and authorize the Mayor and City Clerk to execute on behalf of the City.
4. FISCAL IMPACT
The total expenditure for this agreement is $160,000 and will be funded through General Fund (100).

6. DISCUSSION AND BACKGROUND
While the City Attorney’sOffice does handle most of the day-to-day personnel legal matters, the City does contract with outside counsel when there is a need for a particular expertise or the workload requires it.
The City has retained the law firm of Liebert Cassidy Whitmore to provide legal services with respect to police investigatory and disciplinary matters. Liebert Cassidy Whitmore advises regarding highly technical and confidential labor and employment matters. Staff considers it reasonable to request $160,000 due to pending arbitration and potential trial.
