1. SUBJECT
Employment Agreement with City Attorney Michael J. Vigliotta.
2. SUMMARY
Pursuant to Resolution No. 11410, or as superseded, the City Council determines the City Attorney’s compensation and benefits. The proposed Employment Agreement with City Attorney Michael J.
Vigliotta provides for a three-year term effective July 3, 2023, through July 2, 2026.
3. RECOMMENDED ACTION
Approve Employment Agreement with City Attorney Michael J. Vigliotta.
4. FISCAL IMPACT
The Agreement provides for a monthly salary of $19,583.34 plus benefits as outlined in the Executive/Senior Management Resolution No. 11410, or as superseded.
Funds are budgeted and available as follows: General Fund (100) will pay 90% of the expenses related to this Agreement, with 5% from Self Insurance - Workers’Compensation (730), and the remaining 5% from Self Insurance - Liability (740).

6. DISCUSSION AND BACKGROUND
Current City Attorney Mary Binning will retire on July 14 and the City conducted a recruitment for her replacement. Michael J. Vigliotta is the successful candidate for City Attorney.
In recognition of Mr. Vigliotta’ssignificant experience, the City will provide 80 hours of vacation and 40 hours of sick leave upon his employment. Applicable rules and regulations for Executive Directors within Resolution 11410 and the Orange Municipal Code, or as superseded, govern all other benefits or terms of employment.
