6. DISCUSSION AND BACKGROUND
California Waters Development Inc. (CA Waters) currently provides routine maintenance for all City fountains located in city parks and facilities. The vendor also provides emergency service and repairs as needed, which has recently included the replacement of a pump stand, vault control repairs, water pump repairs, and electrical equipment troubleshooting. In addition, due to the aging infrastructure supporting all City fountains, the vendor recently identified critical supplemental repairs City of Orange Printed on 8/17/2023Page 1 of 2

infrastructure supporting all City fountains, the vendor recently identified critical supplemental repairs and deep cleanings that will be needed at each individual fountain within the next 24 months. While this additional service was not budgeted for in FY24, staff believes sufficient funding exists to cover the first-year cost. Staff will adjust the budget in FY25 to account for the second-year cost.

Staff is recommending that the City Council approve the Second Amendment with CA Waters for unforeseen additional City fountain repairs and maintenance. The total amount included in the proposed Second Amendment is $61,215. The Second Amendment also includes a 10 percent contingency of $6,121.50, for a total of $67,336.50. The Second Amendment would bring the total contract not-to-exceed amount to $154,241.30. The total expenditure for the Second Amendment will be funded through the General Fund (100). The current agreement expires in February 2026, at which time, services for City fountains will be put out to bid. This Second Amendment does not include repairs to the Plaza fountain that are necessary as a result of the March 2023 Plaza drive through.
