6. DISCUSSION AND BACKGROUND
The City acquired surplus property located on the south side of 2045 East Palmyra Avenue (the “Property”)through the delinquent property tax sale from the Orange County Tax Collector for $10.00 in 1970 (recorded document number 16589, book 9355, page 756, recorded July 24, 1970).
The property is a parcel of land located at the end of Palmyra Avenue, adjacent to Santiago Creek near the 55 Freeway underpass and a residential triplex on the north side. The parcel is triangular, having a net land area of approximately 871 square feet. The parcel does not meet the minimum size for a residential lot, and the only use for the property is to become a joiner to an adjacent property.
The owner of the triplex property on the north side, Mr. Hamed Soltari, has contacted the City many times in the past regarding nuisance activity on the property. In addition, vandals cross the property to access the Santiago Creek channel. Mr. Soltari has recently offered to purchase the property from City of Orange Printed on 10/5/2023Page 1 of 2

the City so he could fence it and include it as a joiner to his parcel.
The City declared the property surplus to City needs through Resolution No. 11491, adopted by the City Council at the September 12, 2023 meeting. The parcel is exempt from the Surplus Land Act (Government Code sections 54220, et seq.) based on the following: (1) is surplus land because it is not necessary for the City’suse; (2) is exempt, pursuant to Government Code section 54221(f)(1)(B) (i) because it is less than 5,000 square feet; (3) the City intends to offer the Property for sale to contiguous property owners; and (4) that the noticing requirements of the Act pertaining to surplus land are not applicable.
The City rarely has surplus remnant parcels where the only viable purchaser would be the adjacent property owner who intends to join it to their existing property. The last surplus remnant parcel was Well Site #3 on Tiller Street in 2019, and prior to that, there were four remnant parcels on Cannon Street after the street widening. All those previous surplus parcels were sold for $10 per square foot.
This was considered fair compensation to the City in lieu of the City owning and maintaining the parcels. As a result, the City offered Mr. Soltari $10 per square foot for the property, or a total amount of $8,710. Mr. Soltari has agreed to the purchase price pending City Council approval.
Staff is recommending approval of the sale of the property to Mr. Soltari in the amount of $8,710, as well as authorizing the Mayor and City Clerk to execute the Quitclaim Deed and related documents on behalf of the City.
