space for additional walking paths and exercise equipment, the Capital Improvement Project (CIP) titled Hart Park Pickleball and Fitness Circuit was approved for $2,750,000 in Fiscal Year 2022-23.

Project elements include:
· Multiple lighted pickleball courts, including fencing and windscreens · Shaded outdoor fitness equipment
· Paved access to courts and amenities
· Area and pathway lighting
· Shaded spectator seating
The City Council awarded a contract to RHA Landscape Architects Planners, Inc. (RHA) for design services on November 15, 2022.

Design services were divided into two phases. Phase 1 involved the process of designing the pickleball courts and amenities, including completing the California Environmental Quality Act (CEQA) Notice of Exemption (NOE). As this project has received funding through a federal earmark, the City was also required to complete an additional environmental review, a Finding of No Significant Impact (FONSI), consistent with the National Environmental Policy Act (NEPA). CEQA and NEPA are anticipated to be completed and approved in early 2024. Phase 2 of design services included the development of biddable construction documents.

Once CEQA, NEPA, and the biddable construction documents are finalized, a Request for Bids (RFB) for construction can be drafted. Due to workload capacity and in an effort to produce a comprehensive RFB, select a construction bid most responsive to the RFB, and efficiently coordinate the construction process, staff is recommending the City amend RHA’s agreement to provide construction administrative services for the project.

Construction administrative services include bidding coordination, bid submittal review (in conjunction with staff), construction coordination, site visits during construction, field reports, and review and coordination of requests for information and change order requests. The proposed cost for construction administrative services is $31,710. In addition to providing construction administrative services, the amendment also includes a fee of $2,900 to address changes to electrical needs based on revised design plans.

Staff is recommending the City Council approve the first amendment to the agreement with RHA in the amount not-to-exceed $34,610 for the Hart Park Pickleball and Fitness Circuit project.

Construction administration and design services for the project are funded in Hart Park Pickleball and Fitness Circuit Project (20315) through Park Acquisition (Infill) (510) and Park Acquisition and Development (Quimby) (511). The current appropriation is sufficient to cover this expense. Two million dollars secured in federal funding will be used for construction.
