1. SUBJECT
First Amendment to the Contract with La Rocque Better Roofs, Inc. for the Park Facility Roof Repair Project.

2. SUMMARY
In April 2023, the City Council awarded a contract to La Rocque Better Roofs to complete the Park Facility Roof Repairs project (20507). As roof repairs were being made to the La Veta, Olive, and Santiago Hills Parks buildings and the City owned concession/restroom building at Sycamore Elementary School, the contractor encountered several unanticipated structural issues, including significant termite damage and dry rot. The change orders to complete the unforeseen repairs totaled $42,618, which resulted in costs of $17,027.90 over the allowable contract amount of $153,546. Staff is recommending that the City Council approve the proposed First Amendment to the Contract with La Rocque Better Roofs to cover the increased expense.

3. RECOMMENDED ACTION
Approve amendment with La Rocque Better Roofs, Inc. in an amount not to exceed $17,027.90 for construction services for Park Facility Roof Repair (20507); and authorize the Mayor and City Clerk to execute on behalf of the City.

4. FISCAL IMPACT
The total expenditure for this contract is $170,573.90 and will be funded in Park Facility Roof Repairs project (20507) through Park Acquisition (Infill) (510) in account 510.7021.56020.20507 - CIP - Building and Improvements.

5. STRATEGIC PLAN GOALS
Goal 1: Provide for a safe community.
b: Provide and maintain infrastructure necessary to ensure the safety of the public.

Goal 3: Enhance and promote quality of life in the community. a: Renovate, maintain, develop, and/or expand public use places and spaces.

6. DISCUSSION AND BACKGROUND
Maintenance of park building roofs is critical to the overall preservation of the buildings. Most park building roofs are generally in good to fair condition due to ongoing replacement efforts over the last several years. Based on a roof evaluation completed in 2021, it was determined that reroofing was City of Orange Printed on 1/4/2024Page 1 of 3

several years. Based on a roof evaluation completed in 2021, it was determined that reroofing was needed at the following locations:
· Picnic Pavilion at Olive Park
· Picnic Pavilion and Restroom Building at La Veta Park · Restroom Building at Santiago Hills Park
· City Owned Concession and Restroom Building at Sycamore Park (adjacent to Sycamore Elementary School)
The City Council approved the Park Facility Roof Repairs project (20507) in Fiscal Year 2022- 2023 and the Council awarded a contract to La Rocque Better Roofs (La Rocque) on April 25, 2023 to complete the work.

Once the work began and existing roof shingles and sheathing were removed, the contractor encountered unexpected structural issues at each roof location, including significant termite damage and dry rot. The extent of the damage exceeded the total cost of the contract. Change orders therefore surpassed the contracted amount. To keep the project on schedule and ensure park safety, staff worked with La Rocque to quickly address the additional roofing damage. The following table outlines the resulting project change orders (CO):

Table: Park Facility Roof Repairs Change Order Summary

CONTRACT STATUS AMOUNT
Base Contract Amount $127,955
20% Contingency $25,591
CONTRACT TOTAL: $153,546

PROJECT CHANGE ORDERS AMOUNT REASON

Change Order 5 $2,100 Unforeseen dry rot at Santiago

To address the remaining expenses, staff is recommending the City Council approve the first amendment to the contract with La Rocque in the amount not-to-exceed $17,027.90 for the expenditures related to unforeseen damage at these park locations. The project is funded in Park Facility Roof Repairs project (20507) through Park Acquisition (Infill) (510) in account 510.7021.56020.20507 - CIP - Building and Improvements.
