1. SUBJECT
Second Amendment to the Contract with Charles McCandless Tile Contractor, Inc. for Plaza Park Fountain repair.
2. SUMMARY
The historic Plaza Park fountain was damaged during a vehicle collision on March 13, 2023. Under the authorization of the City Manager, a contract with Charles McCandless Tile Contractor, Inc. was executed in the amount of $21,900 in April 2023 to start the initial repairs, including removing damaged tile and grout and paying the deposit for the new tiles. The First Amendment, with City Manager’sauthorization, was executed in November 2023 for $8,100 to ensure timely payment of the specialized tiles. With the First Amendment, the contract authority is still insufficient to cover the full cost of tile installation and labor expenses including the complete purchase of over 1,100 new tiles.
As a result, staff is recommending the approval of a Second Amendment to the Contract with Charles McCandless Tile Contractor, Inc. to purchase and finish installation of the new tiles.

Upon approval of this appropriation, the estimated fund balance in fund 510 at June 30, 2024, will be approximately $4,025,844. 6. DISCUSSION AND BACKGROUND
On March 13, 2023, the fountain was damaged during a vehicle collision. The vehicle impact destroyed a section of the fountain basin and damaged some of the adjacent historic tiles on the interior and exterior of the basin. Due to the fountain’shistoric nature, the work performed on the fountain must meet the Secretary of Interior’sStandards for Historic Rehabilitation. Particular care is required in the selection of materials, attention to detail, and installation methods to ensure that the restoration work achieves the desired aesthetic outcome upon completion, can withstand the test of time, and maintains the historic integrity of the fountain as a historic character defining feature of The Plaza.
In April 2023, the City entered into a contract with Charles McCandless Tile Contractor, Inc. (McCandless) under the City Manager’ssigning authority in the amount of $21,900 to complete initial repairs which included removal of damaged tile, grout, and setting bed; salvaging any full tiles for reinstallation; installing new mortar setting bed, tile, and grout to match the existing historical pattern.
The contract also included funds for the deposit of the tiles. McCandless has a unique connection to the Plaza Park fountain as Charles McCandless installed the original tile on the fountain in the 1930s.
Given the historic nature of the fountain, the City engaged its historic preservation consultant, Chattel, Inc., Historic Preservation Consultants (Chattel) to provide guidance on the reconstruction and repair of the basin including selection of materials, method of installation, and finish details. As such, the City Council approved an agreement in October 2023 with RLA Conservation (RLA), to complete the specialized conservation treatment of the fountain.
Chattel also provided guidance for tile color and glaze matching of the new tiles prior to tile fabrication, to ensure a seamless appearance. In order to meet the requirements for the historic tiles, McCandless sub-contracted with California Pottery, a specialty ceramics company, to manufacture the new tiles. Once the color and glaze matches were approved and a tile quantity had been determined, the First Amendment was executed under City Manager authority in the amount of $8,100, to ensure timely payment of the specialized tiles and allow for the initial installation of the new tiles, bringing the total amount of the contract to $30,000.
The Second Amendment would add $46,559.36 to the contract for a total not-to-exceed of $76,559.36 (including a 10% contingency) to cover the remaining expenses for tile installation and for the total purchase of over 1,100 new tiles. The new tiles include:
· Replacement of the damaged tiles
· Replacement of approximately 120 tiles (per the recommendation of RLA) that have been damaged or vandalized over the years, unrelated to the 2023 vehicle collision · Extra tiles (should more tiles be needed in the future) Staff is also recommending that the City Council approve an appropriation of $60,000 from the Park Acquisition (Infill) fund (510) unreserved fund balance to fund the remaining costs of the project. The current appropriation request will fund almost $31,000 of this agreement, as well as additional services needed, or items purchased in order to bring the fountain back to an operational state.
