6. DISCUSSION AND BACKGROUND
On October 10, 2023, the Orange City Council first considered the introduction of Ordinance No. 14- 23, creating the regulatory framework and requirements for lobbyist registration and reporting. At the same meeting, the Orange City Council expressed concerns with select ordinance provisions and created a City Council Ad-Hoc Committee with the intent of revising the draft ordinance for future City Council discussion. At the November 28, 2023, City Council meeting, the Ad-Hoc Committee’s revised ordinance was reviewed and approved for First Reading by the Orange City Council with the second reading and adoption occurring on December 12, 2023.
Included in the newly adopted ordinance is Section 2.13.030 - Registration and Annual Reporting Required. Under this section, any person/firm engaging in lobbyist activities (as defined in the ordinance) must register with the City Clerk on a per project basis and pay a registration fee to cover the cost to administer the program.

The City Clerk’soffice, in collaboration with the Human Resources Department and Payroll Division, has calculated the fully burdened staff rate to be $190. This fee, in part, includes the cost to review the lobbyist registration forms, address any corrections, log the registration forms, and process the renewal forms. This amount represents the staff time (assuming two hours per lobbyist) and salary costs to administer the program only - it will not generate additional revenue for the City. The proposed fee is highlighted and included on page one (under City Clerk) of the Master Schedule of Fees.
Pursuant to California Government Code, unless adopted as an urgency ordinance, once an ordinance is approved upon second reading, the ordinance will go into effect 30 days thereafter. This means that Ordinance No. 14-23 will go into effect on January 12, 2024. By adopting Resolution 11517, the City will have adopted the final regulatory component to fully implement the new lobbyist registration program.
