Conditional Use Permit Findings:
A Conditional Use Permit shall be granted upon sound principles of land use and in response lo services required by the community (OMC 17. I 0.030.F. 1).
The granting of this Conditional Use Permit is based upon sound principles of land use and in response to services required by the community in that consideration has been given to whether the proposed use will detrimentally affect adjacent land uses. The subject property is presently vacant. The site is developed with a two-story Victorian historic residence that has been used as a commercial building in more recent years and a detached accessory structure. The church use is the primary use on the property and will not conflict with the other proposed coffeehouse use. In addition, consideration has been given to noise levels and all sound will be enclosed within the building and will be primarily acoustic. There are six parking spaces on site but the applicant is not required to provide parking because it is located within % mile of public transit. Although parking is not required per AB 2097, the applicant plans to provide parking direction to guests in order to mitigate parking on the residential streets (N. Pixley Street and N. Parker Street).
The applicant will be directing visitors to walk, take public transportation, or park in the City's public parking structure on N. Lemon Street. Conditions of approval have been included in this resolution to address potential parking impacts and noise levels to surrounding residences and businesses.
The project is not expected to detrimentally affect adjacent land uses or create special problems in the area. The site is surrounded by residential development to the north, and commercial uses to the west, east, and south. The proposed site layout will not be altered. The services will be conducted within the building and will not impact bordering properties. Sound will be within the buildings and will primarily be acoustic without drums or bass. With the parking plan proposed by the applicant for patrons to park in the public [ots. walk, or to take public transportation, it is not anticipated that the project witl 2 I
provides a broad range of housing and business opportunities as well as recreational, institutional and cultural activities that enhance the overall living environment." The project is also consistent with the goals and policies in the City's General Plan Economic Development Element which encourages "continu[ing] to protect and enhance Old Towne's historic character" and encourages the "adaptive re-use of existing commercial areas." In addition, the City's General Plan Cultural Resources Element identifies historic presenation as a "significant factor in the revitalization and economic vitality of downtown Orange," which results in "increased property values and low vacancy rates." The project is consistent with the City's General Plan in that the operation of the church with classes. community enrichment. and coffeehouse helps to provide a service that contributes to a diversified mix of land uses in the surrounding community and provided economic vitality to a major arterial in the Otd Towne Orange Historic District.
A Conditional Use Permit shall not be granted if it will cause deterioration ofbordering land uses or create special problems for the area in which it is located (OMC t7.10.030.F.2).

create special problems for the residential neighborhood to the north ol the project site.
Conditions of approval have been included in this resolution to address potential parking impacts and noise levels to surrounding residences and businesses.
A Conditional Use Permit must be considered in relationship to its effect on the community or neighborhood plan for the area in which it is locoted (OMC
17.10.030.F.3).
The church use will occupy an existing vacant two-story historic building and will better serve the community. One of the objectives and policies of the Santa Fe Depot Specific Plan is "to bring new vitality to the Santa Fe Depot area, while taking advantage of the transit-orientation of the area" and "make it a vibrant part of Old Towne Orange." The proposed remodel will occur within the existing building and not create construction impacts to adjacent prope(ies. The building will remain in the existing location and will not change the existing character of the street frontage. The property will retain its historic appearance while allowing for the opportunity for adaptive re-use. The proposal is not anticipated to have adverse impacts on neighboring land uses within the area because the church use is compatible with the mixed uses that occupy the property and the surrounding neighborhood. Acoustic music and amplified music will be played inside the building only and in relation to the size of the room it is playing. The applicant wilt not have drum kits or bass guitar. which tends to increase percussive decibels. The applicant has taken into consideration that the property is adjacent to a multi-flamily residential neighborhood to the no(h. Although the property is exempt from parking requirements by AB 2097, the applicant will provide parking instructions and commute options to guests in order to mitigate guests potentially parking on the residential streets.
A Conditional Use Permit, ifgranted, shall be made subject to those conditions necessary to preserve lhe general welfore, not the individual welfare of any particular applicant (oMC t7.10.030.F.1).
All project conditions preserve the general wellare of the City and community.
Conditions specifically serve to manage project construction impacts, provide for site maintenance, and accommodate disabled person site access. Condition No. l4 addresses noise control. Condition No. l8 addresses a parking plan. With these conditions in place, the operation of the church will not negatively impact the general welfare of the surrounding neighborhood.

SECTION 2 - ENVIRONMENTAL REVIEW
The proposed project is categorically exempt from the provisions of CEQA per State CEeA Guideline 15301 (Class I - Existing Facilities) because the project consists of permitting a religious institution within an existing commercial building, consistent with the property's zoning and General Plan designation. There is no environmental public review or notice required for a categorical exemption.

6. PROJECT DESCRIPTION
The applicant proposes to operate a church and a coffeehouse within an existing vacant commercial building in the Old Towne Mixed Use -15S (OTMU-15S(SP)) zoning district. The property is a contributor to the Old Towne Orange Historic District and is located within the boundaries of the Santa Fe Depot Specific Plan. The property is developed with a 2,827 square foot two story Victorian house constructed in 1908 and a 700-foot detached garage located at the rear northwest corner of the property. The existing building was previously used for commercial and retail purposes.
Cedarhouse does not operate as a traditional church as it will not operate any form of family ministry and will not offer a Sunday service. The intent is to operate a space to help people in spiritual, emotional, and psychological health. The coffeehouse, which is permitted by right at 611 W.
Chapman Avenue, is intended to connect the ministry with the community and will be open to the general public.
Proposed hours of operation for the coffeehouse will be Monday through Saturday, 7:00 a.m. to 4:00 p.m. The proposed hours of operation for the gatherings will be on Friday nights, 7:00 p.m. to 10:00 p.m. for approximately 40-80 people. Counseling and prayer appointments for approximate 5-6 people per week will occur Monday through Saturday, 9:00 a.m. to 9:00 p.m. Once a quarter, the applicant proposes to operate a 2-day intensive workshop on Friday night from 6:00 p.m. - 9:00 p.m. and Saturday from 8:00 a.m. to 6:00 p.m. for approximately 50 people. A leadership meeting will take place once a month on a Wednesday from 6:30 p.m. to 8:30 p.m. for approximately 12 to 20 people.
Once a month on Tuesday evenings from 6:30 p.m. - 9:30 p.m., the applicant proposes to host community art classes for 15 individuals. Kids movie nights will be hosted once every other month on Saturday evening for 40 individuals, and marriage enrichment will be hosted twice a year, every City of Orange Printed on 11/30/2023Page 2 of 4

Wednesday for 4 weeks, from 6:30 p.m. - 9:00 p.m. for 40 individuals.
The applicant is proposing to remodel the interior space by removing walls in order to make space for the coffeehouse and as a gathering space, and provide ADA access and other associated improvements. Proposed plans are included in this staff report as Attachment 4. No changes are proposed to the exterior of the building or the site except replacement of doors at the rear (north) elevation and removal of onsite parking spaces.
7. ANALYSIS AND STATEMENT OF THE ISSUES
The subject property is located in the Santa Fe Depot Specific Plan area where a mixed of land uses is encouraged and a flat parking rate of 4 spaces 1,000 square foot is required for non-residential land uses. The introduction of the proposed uses to the site would bring new vitality to a property that has had an understated presence along West Chapman in a gateway location to the Depot and Plaza. While there are aspects of the proposed operations that the site conditions can reasonably accommodate given on-site parking, the key issue for the requested CUP is consideration of the manner in which activities involving 40-80 participants can be accommodated so as not to impact the adjacent residential and commercial uses.
Issue 1: Parking
The site currently has six parking spaces; four located in the front and two located at the rear, accessed through the rear alley. All parking spaces will be removed.
Per Assembly Bill 2097, a public agency may not impose any minimum automobile parking requirements on any residential, commercial, or other development project if it is located with ½ mile of public transit. 611 W. Chapman Avenue is located one block West from the Orange Transportation Center (Metrolink) station. Due to the property’s proximity to public transit, the applicant is not required to provide any parking.
However, the applicant is conscious of the residential zone to the north of the subject property and intends to direct visitors to walk, take public transportation, or park in the City’s public parking structure on N. Lemon Street so that visitors do not park along the residential streets on N. Parker Street and N. Pixley Street when they stay over two hours.
A condition of approval has been added requiring the Ministry and Coffeehouse staff to monitor the neighborhood prior to services and for applicant to provide parking information on social media and with movable signage. In addition, conditions of approval have been included in the attached Resolution (Attachment 1) that upon removal of the parking spaces at the front of the property, the curb cut shall be filled in and the sidewalk re-established per the City standards and that street trees shall be planted in coordination with the City’s Street Tree Coordinator.
Issue 2: Noise
The block to the north of the project site is zoned R-3 for multi-family development, separated from the project site by an alleyway. According to the applicant, all services will be enclosed in the garage or structure and will not cause any impact to the residential properties.
Amplified live music will occur on Friday nights, but it will be indoors only and in relation to the size of the room. The sound is primarily acoustic and the applicant does not intend to have a drum kit or bass guitar. A condition of approval has been included in the Planning Commission Resolution requiring that noise not be audible from outside of the building.

8. PUBLIC NOTICE
On November 21, 2023, the City sent a Public Hearing Notice to a total of 224 property owners/tenants within a 400-foot radius of the project site and persons specifically requesting notice.
The project site has been the notification on that same date.
9. ENVIRONMENTAL REVIEW
Categorical Exemption: The proposed project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per State CEQA Guidelines Section 15301 (Class 1 - Existing Facilities) because the request consists of a Conditional Use Permit for the operation of a religious institution in an existing private structure.

Dear Ani,
You requested an example of a letter or notification that we might send to people who attend CedarHouse and CedarHouse Coffee. Please see the example below.
Dear Valued Customer – we are so thankful that you choose CedarHouse to be your communal coffee beverage/Ministry space.
Because we are community minded we desire to be a blessing to our neighbors so we would ask that if you are desiring to settle in and enjoy this space for more than an hour that you would park at the Train Station West parking lot or the Public Parking structure on Lemon (See map below). Keep in mind that walking is good for you and inconvenience is a part of life. ;)
Bless you and have an amazing day.
The CedarHouse Team
