The City of Orange, CA (City), is a federal entitlement community that receives annual allocations of Community Development Block Grant (CDBG) and HOME Investment Partnerships (HOME) funds from the U.S. Department of Housing and Urban Development (HUD). The City is required to prepare an Annual Action Plan detailing the uses of entitlement funds to meet its affordable housing and community development goals as outlined in its Consolidated Plan.
According to 24 CFR 91.505 and the City’s Citizen Participation Plan, the City of Orange has determined that the following actions will require a substantial amendment:
In response to the Coronavirus 2019 (COVID-19) pandemic, the U.S. Department of Housing and Urban Development (HUD) notified the City of Orange that it would receive an allocation of HOME-ARP Funds in the amount of $1,655,186 to be used for eligible activities for qualifying populations. This allocation was authorized by the American Rescue Plan Act of 2021, Public Law 117-2, which was signed into law on March 11, 2021, to respond to the growing effects of this unprecedented public health crisis.
On June 3, 2025, HUD notified the City of an administrative correction to the original allocation. As a result, the City’s entitlement was adjusted to a total award of $1,657,048, an increase of $1,862.
As the City of Orange will receive additional HOME - ARP funds, an Amendment to the Program Year 2021 Annual Action Plan is necessary. The City’s Citizen Participation Plan (CPP) serves as a framework to ensure participation from the community and interested stakeholders in the development of the Annual Action Plan (AAP). In accordance with the adopted CPP, an increase exceeding 20% of the original allocation to an approved project or activity constitutes a substantial amendment, triggering a 30-day public review period and a public hearing before the City Council.
The proposed $1,862 increase to the HOME-ARP allocation does not meet the threshold for a substantial amendment, as it represents less than 20% (or $316,385.40) of the original HOME-ARP funds designated for supportive services to prevent homelessness. Therefore, this amendment requires only City Council approval prior to submission to HUD for final authorization.
The HOME – ARP funds allocated under the American Rescue Plan (ARP) may be used for a range of eligible activities, as allowed under24 CFR Part 92.2 to assist individuals or households who are homeless, at risk of homelessness, and other vulnerable populations, by providing housing, rental assistance, supportive services, and non-congregate shelter, to reduce homelessness and increase housing stability.
Eligible activities include (1) Production or Preservation of Affordable Housing, (2) Tenant-Based Rental Assistance, (3) Supportive Services, Homeless Prevention Services, and Housing Counseling, and (4) Purchase and Development of Non-Congregate Shelter. As such, the City proposes the following:
SOURCE Amount
FY2021 HOME ARP $1,657,048
USES
Provide supportive
services to the qualifying
populations.
$1,583,079
Administration and
Planning
$83,259.00
TOTAL $1,657,048
The City is proposing the following changes to be incorporated into the HOME-ARP Allocation Plan, approved on May 8, 2025 to reflect the increase to the allocation for supportive services to qualifying populations.
