County Highway Declaration for Construction Project on City Streets
RESOLUTION OF THE BOARD OF SUPERVISORS OF
ORANGE COUNTY, CALIFORNIA
April 28, 2026
WHEREAS, those portions of West Metropolitan Drive and The City Drive South, at the intersection of West Metropolitan Drive and The City Drive South, lying within the limits of the City of Orange (“City”), and as depicted in Exhibit A, are deemed to be highways of County - wide importance; and
WHEREAS, the County of Orange proposes to perform intersection improvements at those portions of West Metropolitan Drive and The City Drive South (hereinafter referred to as the “City’s Street(s)”); and
WHEREAS, the County and the City have entered into a Cooperative Agreement to facilitate the performance of the work on the City Street (s) by the County (“ Cooperative Agreement”); and
WHEREAS, Streets & Highways Code Section 1700 -1704 set forth procedures by which the County may perform improvements on City Street(s).
NOW, THEREFORE, BE IT RESOLVED that this Board does hereby:
1. Declare that the City’s Street(s) are a County highway for the purposes of construction by the County of Orange.
2. Direct that this Resolution be forwarded to the City, and that City’s Street(s) shall become a County highway upon the consent of the City consistent with Streets & Highways Code Section 1701 and the Cooperative Agreement.
3. Declare that the improvements to the City Street(s) shall be deemed fully completed upon the filing of a Notice of Completion , and that upon such completion the Board of Supervisors hereby declares City’s Street(s) to no longer be a County highway . The Board directs the County of Orange to file copies of this Resolution and the Notice of Completion with the City Clerk and ten (10) days after said filing, City’s Street(s) shall cease to be a County highway. This action is intended to be, and shall be interpreted as, consistent with Streets and Highways Code Section 1704 and the Cooperative Agreement.
