Recommendation: Informational only no action is recommended for the Council
On July 27, 2022, the Fresno Bee published an article regarding the State Water Resources Control Board's (SWRCB) significant delay in processing grants and loans requested by communities throughout the State to address water systems issues, including systems that are contaminated by excess amounts of nitrate, arsenic, and other dangerous chemicals. According to the article, the SWRCB's application process currently takes an average of 33 months to complete, which is almost double the amount of time it previously took four years ago. A change in the law has contributed to this problem, which requires the SWRCB to shift its focus to helping smaller water systems. This means that the SWRCB is spending more of its time handling grant request from managers of smaller, potentially less sophisticated systems who need technical assistance with the application process form SWRCB staff.

One officer had surgery on September 6 and is expected to be off for several weeks. Another officer is scheduled to have surgery in November.

Several different officers have been off on COVID during the last month. We will be adjusting employees to fill shifts.

Applicant Manuel Casarez pre-employment exams are complete, and he will start the FTO Program soon. We have one female applicant attending the Tulare County Police Academy.

Animal Shelter.... See report.

All city workers completed training so they could work at the shelter. City manager is talking to SEIU so that they can start helping on weekends. Hope to get an answer soon.

Vehicles. ..We ordered three vehicles this week. They should arrive in about 5-6 months. The price will be approximately $10,000 more per vehicle than the last purchase. We will have costs by the end of September.

K-9 Marko Last month Tom Greenwood requested that we attempt to sell Marko to a guard dog company instead of letting the dog handler buy it for one dollar. I made several calls to companies that might be interested in purchasing Marko. Everyone contacted said they were not interested due to his age and the fact that he has been trained to protect his handler. We are still making the recommendation to sell it to Cpl. Parra for one dollar as we discussed last month. The council was given the resolution on the sale of Marko last month.

Flashing Speed Signs...We have ordered three flashing speed signs to be placed on Anchor, South and Adams Avenue. They should arrive in approximately two months.

Coffee with a Cop We plan to have the first event sometime this month. Hope to do it twice a month to start and then decide how often to do it depending on public participation. It will be announced prior to the event.

RECOMMENDED ACTION BY PLANNING COMMISSION

1. Waive second reading and adopt Zoning Ordinance Amendment 2022-392, amending Government Code Section 65583.2 subdivision (h) and (i). Sections 17.20.070 and 17.20.200 of the Orange Cove Municipal Code for compliance with

EXECUTIVE SUMMARY
The California Department of Housing and Community Development has advised the City of Orange Cove that the Orange Cove Municipal Code is in noncompliance with Government Code Section 65583.2 subdivision (h) and (i). City staff has drafted a Zoning Ordinance Amendment to achieve compliance with State standards by amending the R-3 (High Density Multiple Family Residential) district. This planning application does not constitute a "project" under the California Environmental Quality Act (CEQA), because it is categorically exempt under CEQA, Section 15061 (b)(3), the "Common Sense" exemption.

Text additions are shown in underline format. Text deletions are shown in strikeout format (i.e., strikeout). Changes in text are shown in bold. The amendment reads as follows:
"17.20.070 - Population density
There-shall-be-a minimum of one thousand five hundred square feet of lot area for cach dwelling unit

4. There shall be a required minimum density of twenty (20) units per acre. There shall be a required maximum density of twenty-five (25) units per acre." *17.20.200 - Site plan review
A. Before any building or structure, with the exception of a one-family dwelling, is erected on any lot in the R-3 district, a site plan pursuant to Chapter 17.56 of this code shall have been submitted to and approved by the City Manager, or his designee.

B. Multifamily development for which 20% or more of the units are affordable to lower income households shall be subject only to design review, and shall not be subject to Conditional Use Permit, Planning Unit Development, or other discretionary local government review or approval that would constitute a "project" for the purposes of Division 13 of the Public Resources Code" The proposed amendment will impact all property zoned R-3 within the jurisdiction of the City of Orange Cove. The amendment is consistent with the General Plan Land Use Element, and purposes of the R-3 district.

The Environmental Impact Report (EIR) prepared for the Orange Cove General Plan discussed the impacts associated with utbanization and residential development and adopted a "Statement of Overriding Consideration". For this particular project, staff has determined that the proiect is categorically exempt. There are no significant impacts beyond the environmental impacts discussed in the EIR prepared for the Orange Cove General Plan.

PRIOR ACTION / REVIEW
Approval of the Orange Cove General Plan, Land Use Element which details policy and design guidelines for the subject property as well as surrounding properties.

Approval of Planning Commission Resolution No. 2022-04, approved on July 19, 2022, recommending that the City Council of the City of Orange Cove approve Zoning Ordinance Amendment No. 2022-392

BACKGROUND
Location: The amendment will impact all property currently zoned R-3.

Request: The proposed amendment implements two major changes to the R-3 district. The first is a change to section 17.20.070, which governs population density. The second is an addition to section 17.20.200, which governs the Site Plan Review process. These changes in tandem will bring Orange Cove in compliance with Government Code Section 65583.2 subdivision (h) and (1). These text amendments to the Zoning Ordinance are not tied to a specific project and are not designed to impact any particular development. Likewise, the amendments will have no direct impact on utilities, infrastructure, or finances.

Section 17.20.070 will have all of the existing text removed, which set a maximum population lensity based on area per unit, but not a minimum. The state requires a minimum density of 2 muts per acre, and aiso requires that agencies allow for a range of densities, so as not to be a constraint to development. Therefor the proposed new standard will set the minimum population density to comply with the State's minimum requirement, and by permitting a range of twenty to twenty-live units per acre, will also meet the requirement for a range of densities.

Section 17.20,200 does not have any noncompliant text, and therefore will not have any text removed. However, the State requires that multifamily development must be allowed "by-right" when 20% or more of the units are affordable to lower-income households. This means that the City cannot require conditional use permits, planned unit development, or other local discretionary review or approval that would constitute a "project" for the purposes of Division

3. However, this does not exempt these projects from administrative design review. The intel f the amended ordinance as written is to provide a pathway for the aforementioned qualifyir developments to be submitted without the possibility of discretionary review or approval, while maintaining the right of the City of Orange Cove to enforce basic development standards that apply to all multifamily development.

The impacts of the amendment would allow the City of Orange Cove to secure a significant portion of the units required by the Regional Housing Needs Allocation (RFINA) 197- unit shortfall that Orange Cove must accommodate for California Department of Housing and Community Development compliance, because the R-3 zone will meet requirements for shortfall rezoning.

Development standards for R-3 district are currently as follows:
-
Lot Area: Minimum of 6,000 feet.

Lot Width: Interior lots have a minimum width of 60 feet, corner lots have a minimum width of 65 feet, and curved lots have a minimum width of 40 feet.

Lot Depth: Lots facing local streets have a minimum depth of 100 feet.

Front Yard Setback: Minimum of 30 feet, except for special conditions.

Side Yard Setback: Interior lots have a minimum side yard of 10 feet, except for special conditions.

Rear Yard Setback: Minimum of 20 feet.

Lot Coverage: Maximum lot area covered by buildings or structures is 30%.

Population Density: Minimum 1,500 square feet of lot area per dwelling unit.

Building Height: Maximum three stories, or 40 feet in height.

PROGRAM OBJECTIVE
To provide Low-Moderate Income (LMI) clients/households who have been financially impacted, as a direct result of the coronavirus pandemic, with emergency mortgage and/or utility assistance for the purpose of preventing eviction and/or cutoff of utility services.

Il. INTAKE
Applications will be processed on a first come basis, until all funds are exhausted. Incomplete applications are not considered received until complete. Applications may be submitted in person or electronically.

Applicants in need of assistance on how to complete the application will be provided assistance upon request.

III. NONDISCRIMINATION AND INCLUSION
Title VI of the Civil Rights Act of 1964 requires that, "No person shall, on the grounds of race, color or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance." We strongly encourage under-represented and non-English speaking families in your community have a fair chance of receiving assistance. Steps could include:
• Working with services providers that serve primarily race and ethnic minority groups to announce the availability of assistance to hard-to-reach residents • Allowing non-English speaking residents a fair amount of time to apply and gather the necessary documentation, and providing translation or other language support • Accessing COVID-19 racial equity and social justice resources.

IV. OUTREACH AND MARKETING
All outreach efforts will be done in accordance with state and federal fair lending regulations to assure nondiscriminatory treatment, outreach and access to the Program. No person shall, on the grounds of age, ancestry, color, creed, physical or mental disability or handicap, marital or familial status, medical condition, national origin, race, religion, gender or sexual orientation be excluded, denied benefits or subjected to discrimination under the Program. The Sponsor will ensure that all persons, including those qualified individuals with handicaps, have access to the Program.

A. The Fair Housing Lender and Accessibility logos will be placed on all outreach materials. Fair housing marketing actions will be based upon a characteristic analysis comparison (census data may be used) of the Program's eligible area compared to the ethnicity of the population served by the Program (includes, separately, all applications given out and those receiving assistance) and an explanation of any underserved segments of the population. This information is used to show that protected classes (age, gender, ethnicity, race, and disability) are not being excluded from the Program. Flyers or other outreach materials, in English and any other language that is the primary language of a significant portion of the area residents, will be widely distributed in the Program- eligible area and will be provided to any local social service agencies. The Program may sponsor homebuyer classes to help educate homebuyers about the home buying process and future responsibilities. Persons who have participated in local homebuyer seminars will be notified about the Program.
