GENERAL RULES OF DECORUM
While any meeting of the City Council is in session, the following rules of decorum shall be observed:

City Council Meeting
June 12, 2024
REPORT TO: Orange Cove City Council
DATE: June 6, 2024
FROM: Cynthia Cisneros, City Clerk / Human Resources
A Resolution No. 2024-12 Calling and Giving Notice of a General Municipal SUBJECT: Election to be held in the City of Orange Cove on Tuesday, November 5, 2024 for the Election of Certain Officers; Requesting the Board of Supervisors of the County of Fresno to Consolidate and Canvass the Election; Authorizing the County Clerk/Registrar of Voters of the County of Fresno to Render Specific Services to the City of Orange Cove Relating to the Conduct of the General Municipal Election and Appropriating Funds to Pay for Said Services; and Establishing Regulations for Candidates Pertaining to Candidate Statements.
EXECUTIVE SUMMARY
Approval of this resolution will allow the City to conduct the November 5, 2024 General Municipal Election for the purpose of electing two (2) members of the City Council, each for a four (4) year term until November 2028. The resolution provides a notice and call for a General Municipal Election, authorizes a consolidation of the General Municipal Election with the Statewide General Election, requests Fresno County Board of Supervisors to authorize the Fresno County Registrar of Voters to render specific election services to the City of Orange Cove, authorizes the City of Orange Cove to reimburse the County of Fresno for elections services performed, and establishes conditions of filing candidate statements.
BACKGROUND
On November 5, 2024, an election will be held in the City of Orange Cove ("City") to fill two (2) City Council seats.
1. Calling and Giving Notice of the November 5, 2024 General Municipal Election; and Nomination Period
Pursuant to Elections Code section 12101, the 2024 General Municipal Election must be called prior to the opening of the nomination period. The Notice of Election that lists the time and date of the election and the offices to be filled must be published no sooner than July 1, 2024, and no later than July 15, 2024.
The nomination period for the election on November 5, 2024 opens on July 15, 2024 and closes on August 9, 2024. However, if an incumbent does not seek re-election, the nomination period is extended five (5) days to August 14, 2024, for non-incumbents only. The extension period does not apply to vacant seats.
2. Requesting Consolidation of the Orange Cove Municipal Election with the Statewide General Election to be Held on the Same Date
Effective January 1, 2016, Election Code section 14052 prohibits a city from holding an election on any date other than a statewide election date to prevent a voter turnout of below average.
City will be compliant by holding its election on November 5, 2024 in consolidation with the Statewide General Election, as permitted by Elections Code section 10403, subdivision (a).
3. Requesting that Fresno County Board of Supervisors Authorize the Fresno County Registrar of Voters to Render Specific Services to the City Relating to the Conduct of the General Municipal Election, and Permitting County Reimbursements for Rendered Specific Services
Fresno County Elections Division operates under the supervision of the Fresno County Registrar of Voters. Fresno County Elections Division is responsible for conducting Statewide General Elections, making it well-versed and capable of conducting the City's General Municipal Election in accordance with election process requirements pursuant to Elections Code section 10418. For the County's Elections Division's services on November 5, 2024, Elections Code section 10002 requires the City to reimburse the County of Fresno in full upon the County's presentation of a bill to City.
4. Establishing Conditions for Filing of Candidate Statements Elections Code section 13307 provides that City Council must establish the conditions for filing of candidate statements prior to the filing for the November 2024 Election. These conditions include setting a word-limit of two hundred (200) words per statement and requiring candidates to make a pre-payment to the County at the time the candidate files the nomination papers, which includes the cost of printing, handling, and translating the candidate's statement to required foreign languages. These conditions will help limit the size of the sample ballot pamphlet and reduce the cost that the City will have to repay the County for.

REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Dario Dominquez, Assistant City Manager / Public Works Director Subject: Accept Easement Dedication of private property to allow for the construction of a public street and utilities to serve future Sequoia View Park and various public needs.
Attachments: Proposed Grant Deed Documents & Exhibits for Council Approval Resolution 2024-10
RECOMMENDATION:
Adopt Resolution 2024-10, accepting the easement dedication necessary to access and construct a street paving, curb & gutter and utilities to serve future Sequioa View Park. In addition to the need to provide future park access to the general public, the easement is required in the near term to construct storm water infrastructure required to complete the Park Boulevard Infrastructure Improvements project.
The Park Boulevard Infrastructure Improvement project is funded through the U.S. Economic Development Administration (EDA) which requires the City to show Evidence of Good Title for the entirety of the infrastructure improvements. The subject easement dedication is the last remaining easement required for the City to demonstrate Evidence of Good Title, ensuring the City has the lawful Right of Way to construct the Park Boulevard Infrastructure project in its entirety.
Staff recommends the City Council take the above action.
BACKGROUND:
On March 25 of 2022, the City secured a grant from the State Department of Parks and Recreation - 2018 Parks Bond Act, Statewide Park Development and Community Revitalization program totaling $1,819,000.
At the time of the grant award, the City owned the property to the east and south of the proposed park site. A street was proposed "Sequoia View Boulevard" to allow access to the park site from Anchor Boulevard. In 2023 eight (8) acres of City owned property was sold to Palwinder Singh & Ravinder Kaur (Singh Development) for commercial development land locking the park site.
As a condition of development approval, the Singh Development ownership was required to provide the subject easement dedication to construct Sequoia View Boulevard and associated infrastructure. The Singh Development ownership has agreed and executed the subject easement dedication to the City, subject to City acceptance.
1 of 2
The easement dedication consists of approximately 38 feet wide by 350.3 feet long strip of property generally located in the north-east corner of accessors parcel 375-040-36. In terms of Township and Range, the easement occupies a portion of SE 1/4, NE 1/4, of Section 14, T15S, R24E. Refer to the attached grant easement documents for additional details.
ENVIRONMENTAL REVIEW:
No Environmental Review is required as a condition of the City accepting the Easement Dedication. Prior to construction of the future Sequoia View Blvd. and associated infrastructure, environmental clearances may be required.

None
FISCAL IMPACT:
There are no financial impacts associated with the acceptance of the subject easement dedication.

AGENDA ITEM: First Reading and Introduction of Ordinance No. 397 Which Amends Chapter 17.12, Section 17.12.120 of the Orange Cove Municipal code
ACTION REQUESTED: x ordinance - Resolution Motion Receive/File RECOMMENDED;
1. Staff recommends the city council consider taking the following Action:
A. Approve First Reading and Introduction of Ordinance No. 397 Amending Orange Cove Municipal Code Chapter 17.12, Section 17.12.120 Relating to Reduction of Rear Yard Setback Requitements in the R-1-6 Zoning
EXECUTIVE SUMMARY
Over the past several months, city statt have been approached by many property owners who wish to construct back yard patios and/or porches for the enjoyment of their property. However, some of the most recent housing developments only have the minimum twenty feet requirement and have no extra space for the construction of a patio/porch.
Chapter 7.12., Section 17.12.120 requires a twenty-foot setback from the rear yard property line to the proposed new structure. Staff has reviewed several applications for a patio/porch which do not comply with the required twenty-foot setback and thus cannot be issued a building permit.
The proposed amendment to Section 17.12.120 of the Orange Cove Municipal Code would reduce the required twenty-foot rear yard setback requirement to a ten-foot rear yard setback requirement.
Conclusion
Staff is recommending approval of the ordinance amendment and cites the following benefits as a result:
1. Homeowners will be able to enjoy a basic right that is enjoyed by older larger properties.
2. Will reduce potential code enforcement complaints for building without a permit.
3. Will increase general fund revenues.

RECOMMENDED ACTION BY CITY COUNCIL
It is recommended that the city council consider adopting the Mobile Vendor Pilot Program Policy will provide temporary opportunity for local mobile vendors to operate at a designated area approve in the City of Orange Cove.
EXECUTIVE SUMMARY
Over the past year, the city has received several inquiries from Mobile Food Vendors regarding regulations and business license(s) to operate their mobile trucks in the City of Orange Cove.
Currently, the city does not permit Mobile Food Vendors to operate in the city's right-of-way or on private property. Chapter 5.12., Section 5.12.080 regulates "Confectionary Wagons" which includes wagons, push carts or other vehicles used for the sale of ice cream, soft drinks, candies prepared foodstuffs or other food for immediate consumption and only allow them to conduct business in the summer months and permitted on Park Blvd, E Street or G Street between Anchor Avenue and Hills Valley Avenue from 8:00am to 9:00pm Mobile Food Vendors have become increasingly popular and part of the food and beverage industry over the past several years. Food trucks are popular with consumers due to the convenience of being located in different places and times. 1 While historically they have been seen as competing with local restaurants, food trucks are often seen now as complementary with such restaurants.
Incorporated on the Draft Food Mobile Food Vendor Pilot Policy are the following recommendations:
Mobile Vendors Permitted:
1. Mobile Food Vendors only
2. Mobile Food Vendor food sales within a self-contained vehicle only.
Location to Operate:
Mobile Food Vendors may attract customers ranging from a few customers every hour to several customers in a short time period. The most appropriate location with safety in mind would be on a designated area approved by the city. The area being considered is the parking lot east of the soccer field by the Victor P. Lopez Community Center.
Duration of Operations:
1 .Mobile Food Vendor Pilot Program, if approved by the city council will temporarily operate through October 31, 2024.
2.Mobile Food Vendor can operate every Thursday from 6:00pm to 11:00pm, Friday and Saturdays from 6:00pm to 12:00 am.
Permit Requirements:
1. All vendors shall obtain a city business license
2. All vendors shall pay a season fee of $75.00

4. All vendors shall submit copy of food handler's certificate

Staff will be evaluating the Taco Truck Pilot Program after the approval dates are concluded and determine its success for future recommendations to the City Council.

CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Dario Dominquez, Assistant City Manager / Public Works Director Subject: Contract Award - Sheridan Park Playground Equipment Procurement & Installation
Attachments: Exhibit 1 - Conceptual Layout proposed Playground Structure Exhibit 2 - 3D Rendering of proposed Playground Structure RECOMMENDATION:
Adopt Resolution 2024-13, awarding the contract for the Sheridan Park Playground Equipment Procurement & Installation to the KYA Group in the amount of $639,055.68, and provide a $64,000.00 (~10%) contingency to deal with any unforeseen issues that might arise during the course of construction for a total encumbrance of $702961.32. Staff further recommends that the City Manager and / or his designee be authorized to execute the Agreement.
BACKGROUND:
On July 20 of 2022, the City secured a grant from the Clean California Local Grant Program, administered through the State Department of Transportation (Caltrans) in the amount of $2,525,000.00 for the Renovation of Sheridan Park and Orange Cove Welcome Signs.
On June 5 of 2024, a public bid opening was held and two (2) bid proposals were received. The responsive bidders and the corresponding bid results are listed as follows; 1) The KYA Group - $639,055.68
2) HBC Enterprises - $828.497.67
The Engineer's Estimate for the project was $631,097.50 with contingency. Although the low bid exceeded the engineers estimate by $7,958.18 (~1.3%), it is the opinion of staff that the bid submitted by the KYA Group is reasonable and in line with the cost of comparable public works projects being constructed throughout the State.
Major items and improvements addressed in the bid proposal; include but are not limited to; 1) Site Preparation, 2) ~325' of Perimeter Concrete Curb Construction, 3) ~5,800 SF of Poured in Place (PIP) Safety Surfacing, and 4) Playground Equipment Furnished & Installed
The playground equipment procurement and installation component of the overall Sheridan Park Renovation project, was bid as a separate standalone project to better ensure the likelihood of 1 of 2
the playground equipment being constructed in 2024. Lead time for the playground equipment was originally projected to be 12 - 16 weeks based on input from the various playground equipment vendors.
In parallel with the subject Playground Equipment Installation project component, the City Engineer is finalizing the plans and specifications for the overall Sheridan Park Renovation & Welcome to Orange Cove Sign project. It is anticipated that these plans and specifications will be available in mid-July for bid, with an anticipated recommended award date by council in August 2024.
It is unlikely the entirety of the Sheridan Park Renovation & Welcome to Orange Cove Sign project will be 100% completed in 2024; however, it may be possible to open the playground equipment to the general public prior to the end of the year if no adverse circumstances are encountered during construction (ie. unusually wet fall weather and / or significant unforeseen issues encountered).
Adequate funding is available through the grant to fund both the Playground Equipment and the overall Park Revitalization & Orange Cove Welcome Sign components of the project. In broad terms $757,500 (30%) of the grant funding is being allocated to the Playground Equipment component of the project, with the remaining balance of the grant $1,767,500 (70%) to be allocated to the completion of the overall project.
The Playground Structure and associated equipment is the major feature of the Sheridan Park Revitalization and Orange Cove Welcome Signs project. Staff is confident that remaining balance of the grant, estimated at $1,767,500, will be sufficient to complete the key aspects of the project as identified in the grant award documentation and a park that the residents of Orange Cove can be proud of.
ENVIRONMENTAL REVIEW:
All Environmental Reviews have been completed for the project and a Notice of Categorical Exception (Receipt No. E202410000053) filed with Fresno County and the California Department of Fish and Wildlife in accordance with the California Environmental Quality Act (CEQA).
