CITY OF ORANGE COVE

REPORT TO CITY COUNCIL
To: Orange Cove City Council
From: Chris Howard, City Engineer
Subject: Accept property dedication from KC W Reality, LLC to support; 1) Proposed 13 Lot Residential Development and 2) Facilitate Water System Improvements associated with the Construction of a City Well / 1.0 Mgal. Storage Tank Site Attachments: 1) Certification of Acceptance
2) Easement Dedication Documentation for a portion of APN 398-021-55 3) Exhibit B - Ariel Depiction of Easement Dedication
RECOMMENDATION:

Staff recommends the City Council accept the subject property easement dedication associated with a portion of APN 398-021-55 totaling + 4,440 SF. The offer of dedication is being made by KC W Reality, LLC for the purposes of right-of-way procurement for public streets and utilities. It is further recommended that the Council authorize the City Manager to execute a Certificate of Acceptance (COA) document accepting the dedication.

Upon acceptance of the dedication, the easement dedication documents will be recorded with Fresno County Accessors office.

BACKGROUND:

City staff has negotiated the subject dedication from KC W Reality, LLC so that the proposed extension of Tangerine Drive may be constructed. The dedication will allow for the proposed extension to be constructed to its full width and length. The construction of Tangerine Drive will improve accessibility and allow for construction of off-site improvements to serve the proposed water well and 1.0 M gallon tank site located directly to the south-east of the property owned by KC W Reality, LLC.

The property owned by KC W Reality, LLC (APN: 398-021-55) consists of ~ 3.0 Acres of unimproved property located NE of the proposed City Well & Tank Site improvements. A Tentative Track Map was submitted by the developer in 2022 and is being revised to reflect the construction of Tangerine Drive.

The sub-division review can actively move forward as the property is within the City limit boundary and the proposed City improvements provide a location for storm water drainage.

The dedication has benefits for both the City and KC W Reality, LLC. The dedication provides the City with the needed rights-of-way (ROW) for the City to complete needed construction associated with ongoing water system improvements. The dedication also establishes a roadway for which the proposed subdivision can utilize for ingress and egress, and provides a solution to a past storm water handling issue.

FISCAL IMPACT:

None - The dedication is being made at no cost to the City.

CITY OF ORANGE COVE

REPORT TO CITY COUNCIL
To: Orange Cove City Council
From: Chris Howard, City Engineer
Subject: Authorize City Manager to execute a Community Development Block Grant (CDBG) Agreement for the "Sheridan Park Improvement Project" Attachment: Copy of Agreement Document
RECOMMENDATION:

Authorize the City Manager to sign the subject agreement in behalf of the City. The agreement will allow the City to receive CDBG grant funding in the amount of $303,614 for the construction of a thirty- two (32) stall parking lot; as well as street, drainage, and ADA improvements along the 2nd Street park frontage.

BACKGROUND:

On November 4, 2024 the Council passed Resolution 2024-38 approving the grant application for the Sheridan Park Improvement project. The grant utilizes FY24/25 CDBG funding from the US Department of Housing and Urban Development (HUD), administered through Fresno County. The execution of the CDBG will allow the City to access design and construction funding totaling $303,614. There is no City grant matching component and funds would be available for use starting December 2025.

The CDBG grant application was specifically targeted to complete the Sheridan Park Renovation project, which is currently in the last phase of construction. The Sheridan Park Renovation project did not have provisions for visitor parking which will be accommodated using the subject CDBG funds. In addition to the new 32 stall parking lot, the project will address; 1) 2nd Street pavement rejuvenation (slurry seal), 2) curb and gutter repairs, 3) ADA accessibility improvements, 4) drainage improvements, and 5) signage and striping improvements.

FISCAL IMPACT:

There is no fiscal impact to the construction component of the project; however, the City will take on the maintenance of the parking lot and associate project construction after acceptance.

ENVIRONMENTAL REVIEW:

The State /CEQA component of the project environmental review was completed and cleared as part of the Sheridan Park Renovation project. As the HUD CDBG program is federally funded, Fresno County has taken the lead to clear the Federal / NEPA environmental review requirements. No construction will take place until the required State and Federal environmental clearances required by law are procured.

The City agrees to provide 21 any necessary information to the County to carry out such inspections. Likewise, before the City awards a contract using at least 25 $100,000 of such CDBG funds, the City shall require the consultant and/or contractor and all their 26 sub-consultants and/or subcontractors to complete and submit these two (2) forms described 27 herein to both the City and the County.

Records Retention: The City shall retain all financial records, supporting 9 1 documents, statistical records, and all other records pertinent to this Agreement for a period of four 2 (4) years from the date of the submission of the County's consolidated annual performance and 3 evaluation report to HUD in which the activities assisted under this Agreement are reported on for 4 the final time. If there is litigation, claims, audits, negotiations, or other actions that involve any of 5 the records cited, and that have started before the expiration of the four-year record retention 6 period, such records must be retained until completion of the actions and resolution of all issues, 7 or the expiration of the four-year period, whichever occurs later (24 CFR 570.502, 570.503(b)(2), 8 570.506).

The request shall also be 14 accompanied by a written certification from the City that the request for payment is consistent with 15 the amount of work that has been completed, and that the work is in accordance with the contract 16 documents and this Agreement. The request for payment shall also be accompanied by 17 documentation acceptable to the County, such as invoices, or vouchers for services or materials 18 purchased, contractor's costs, or other costs chargeable to the Project. After appropriate review 19 and inspection, the County shall make payment from CDBG funds provided in this Agreement for 20 all eligible costs specified herein up to the maximum amount payable under Section I. 21 B. CDBG regulations at 24 CFR 570.200(h) permit the City, as a 22 subrecipient, to incur pre-award costs for the project beginning with the start of the 2025-2026 23 program year on July 1, 2025, and submit such costs for payment under the agreement. 24 C. Any savings realized in the final cost of the Project, due to Project cost 25 and/or scope of work reductions, liquidated damages, or any other reason, shall be used to reduce 26 the amount of this Project paid for with CDBG funds, and shall be credited to the City's CDBG 27 allocation. If the City is required to provide any funds toward the Project, any cost savings shall be 28 first used to reimburse the City for its contribution in excess of the total amount provided by this 10 1 Agreement.
2 D. Payment for advertising and award shall be based on the actual costs of 3 printing and noticing.

An extension to the sixty (60) 11 calendar day period may be granted by the Director prior to the deadline if the City can demonstrate 12 just cause for the delay.
13 G. The County may withhold reimbursement of the final payment request made 14 by the City until a final POM, recorded NOC, and written summary of all Project work completed 15 with CDBG and other funds, and evidence of compliance with the Section 3 clause, as specified 16 in Sections III-P and IV-D, have been submitted to the County. 17 H. For the Meeting of October 22, 2025

CITY OF ORANGE COVE

REPORT TO CITY COUNCIL
To: Orange Cove City Council
From: Chris Howard, City Engineer
Subject: Approve Close Out of Community Development Block Grant (CDBG) 21-CDBG- PL-30005 "City of Orange Cove Planning & Technical Assistance (TA) for Water Well and Storage Tank" Infrastructure
Attachment: Copy of Public Hearing
RECOMMENDATION:

Approve the close-out of the 21-CDBG-PL-30005 City of Orange Cove Planning & TA for Water Well and Storage Tank.

BACKGROUND:

The City was awarded $250,000 in CDBG funding from the US Department of Housing and Urban Development (HUD) on September 2, 2022. The objective of the grant allocated was to produce a reliable and high-quality potable water supply for the residents of Orange Cove. The scope of work consisted of four tasks: (1) preparation of a preliminary engineering report, (2) preparation of a Hydrological Study, (3) preparation of CEQA/NEPA environmental assessment documents, and (4) administrative services.

The project, for which the grant was predicated, envisioned a single remote water well and tank site constructed outside the sphere of influence of Orange Cove (Manning & Dinuba). A water source of sufficient quality capacity was identified; however, it could not be developed and utilized due to objections expressed by the City of Reedley, Alta Irrigation and the Fresno County GSA (Groundwater Sustainability Administrator).

The City was able to partially meet the national objective (deliverables) specified in the grant of Low/Mod Area benefit to the citizens of Orange Cove. The four (4) tasks were attempted and /or partially completed, but ultimately terminated for the reasons previously discussed. The City has changed its approach with respect securing a supplemental water supply source. The new focus involves the development of multiple wells in lieu of a single high capacity well. Although the CDBG grant funds have been utilized to the fullest extent, in consideration of the new water supply procurement scenario.

Water system improvement work continues utilizing State Department of Water Resources (DWR) grant funding.

At this time the City has met the deadline for the grant which will close on October 27, 2025. Upon Council's approval, the City will submit closeout documents to CDBG when appropriate, thus completing all obligations under the grant.

FISCAL IMPACT:

None - The dedication is being made at no cost to the City.

REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Shun Patlan, Director of Planning
Subject: Final Parcel Map No. 2023-01, Singh/Kaur, dividing eight acres into eight parcels ranging from.9 and 1.10 acres in size located on the West side of Anchor Avenue, 750 North of Park Blvd.

Attachments: Resolution 2025-31/Parcel Map No. 2023-01
Conditions of Approval
Statement of Covenants, Conditions and Restrictions Document RECOMMENDATION:

Staff recommends the City Council adopt Resolution No. 2025-31 approving the Singh Final Parcel Map 2023-01, subject findings and the "Conditions of Approval" hereby attached and Statement of Covenants, Conditions and Restrictions Affecting the Land Document BACKGROUND:

The applicants) are seeking approval of Final Parcel Map No. 2023-01. The applicants) applied and receive a recommendation for approval of the Tentative Parcel Map 2023-01 to the Orange Cove City Council from the Orange Cove Planning Commission on August 28, 2024. The final map will divide eight acres of commercially zoned land into eight parcels ranging in size from .09 to 1.1 acres. The subject property is located on the west side of Anchor Avenue 750 feet north of Park Boulevard. The APN for the subject property is 375-040-361.

The objective of the proposed parcel is to create eight commercial lots each of which could allow for a wide range of commercial uses, including retail store, office, restaurants and grocery stores and others.

Potentially, the applicant could create a shopping center over the entire property with a store and/or parking lot on each proposed parcel.

Staff is recommending that proposed construction on any of the subject parcels would potentially trigger a wide range of off-site improvements as well as dedication of rights-of-way along Anchor Avenue and a future unnamed road to the north. These improvements would include but not limited to curb & gutter, sidewalks, street pave out, tree-lined parkway and the extension of water, sewer and storm drain lines. 1 of 2
The subject site is currently vacant and zoned Community Shopping Center. Approval of the Final Parcel Map will permit the applicant to sell off all or portion of the parcels once the final map is approved by the city council. Any proposed construction of one or more parcels will require a site plan review process and will result in the installation of the off-site improvements.

Findings:

1. The parcel map will not have an adverse impact on the health and safety on the nearby neighborhood or the community at large

2. The parcel map will not pose land use conflicts for surrounding properties given that commercial uses exist to the south, industrial uses to the east and vacant land to the west and north. site for community commercial uses.

4. The parcel map is consistent with the development standards of the community commercial district.

5. The parcel map will provide additional commercial lots on Orange Cove that could potentially enhance the city's tax base.

6. The parcel map is categorically exempt under CEQA indicating that it will not have an adverse impact on the environment.

The office of the city engineer has found the Singh Final Map 2023-01 substantially in compliance with the approved Tentative Parcel Map and recommends approval.

ENVIRONMENTAL REVIEW:

The proposed project will not have a significant impact on the environment and is categorically exempt under California Environmental Quality Act, Section 15332, Class 32.

CONFLICTS OF INTEREST:

None
FISCAL IMPACT:

There are no financial impacts at this time, however upon future commercial development the city will receive development impact fees, land application processing fees and building permit fees.

CITY OF ORANGE COVE

REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Joe Estrada, Public Works Director
Subject: Contracted Professional Janitorial Services
Attachments: None
RECOMMENDATION:

Staff recommends that the City Council approve and award the Professional Janitorial Services contract to Dinuba Carpet Pros, identified as the lowest responsive bidder. Their proposal satisfies all required specifications and terms outlined in the solicitation. With a monthly bid of $1,800, Dinuba Carpet Pros offers the most cost-effective solution for the City's janitorial service needs.

Received proposals:

Tri County Janitorial Services, Kingsburg, CA-$3,400.00 Desert Commercial Cleaning Services, Selma, CA-$2,560.00 Dinuba Carpet Pros. Dinuba CA-$1,800.00
BACKGROUND:

Public Works staff provides basic janitorial services for the Orange Cove Community Center, Senior Center, City Hall, and Police Department, servicing these locations twice a week However, staffing challenges have led to inconsistent performance. Staff members often need to rush through janitorial tasks to assist coworkers with other projects, meet deadlines, or make up for limited time in their daily maintenance schedules. As a result, coverage shortfalls occur, contributing to reduced service quality. These issues originate from departmental staffing shortages, which continue to affect daily operations across all facilities.

FISCAL IMPACT:

The service reflects an annual cost of $14,400. Staff are currently exploring cost-saving measures, and a budget amendment will be considered as part of the mid-year budget review.

CONFLICT OF INTEREST:

None.
