CITY OF ORANGE COVE

REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Cynthia Cisneros, City Clerk
Subject: Consideration of a revision to the Revised Facility Use Application Attachments: Revised Facility Use Application
RECOMMENDATION:

Staff recommends that the City Council review and approve the revision on page 5 of 10 regarding the deposit return. That is to be changed from returning the deposit the following business day to returning the deposit three (3) weeks after the event and mailing it to the applicant.

BACKGROUND:

The revised Facility Application previously stated that the deposit would be processed the next business day following the event. Staff is recommending an amendment to extend the processing period to three (3) weeks after the event.

This change allows the Public Works Department to conduct a thorough inspection of the facility and verify that it has been returned in satisfactory condition and in compliance with all rental requirements. Additionally, the extended period provides the Finance Department with sufficient time to complete the necessary administrative review and processing of the deposit refund.

The proposed revision ensures a more practical, manageable timeline for staff while maintaining clear expectations for applicants regarding the return of their deposits.

FISCAL IMPACT:

None.

CONFLICT OF INTEREST:

None.

Dear Supporter,
The OCHS Softball team has an exciting year planned ahead. We are asking for donations to purchase the necessary materials and equipment for our program. We depend on businesses as well as individuals in the community to support our team in order for us to not only compete but also represent the City of Orange Cove.

We are hoping that you will consider sponsoring us with a donation that will assist us with vital team expenses. Expenses for the 2025-2026 season include tournament fees, travel expenses, team uniforms, team warm-ups, and new training equipment for the team's development.

Our goal is to acquire the necessary funds from sponsors that will greatly contribute to strengthening the foundation of our team and ensuring the future success of the athletes in our program. Your donation serves as an excellent way to give back to your community. We are selling advertisements in the form of banners we will display on our home run fence. We are asking $300 per banner or $200 to re-up (a tax identification number will be provided upon request).

Please help support our Lady Titans and our outstanding student-athletes. All funds will be used for developing quality athletes and citizens.

CITY OF ORANGE COVE

REPORT TO CITY COUNCIL
To: Orange Cove City Council
From: Chris Howard, PE / City Engineer
Subject: Authorize the Mayor to sign an agreement Amendment and Restatement of a previous agreement between the City of Orange Cove and County of Fresno LAgemenation in conner on vite the her venue Park Boulevard Sewed Trunk and Water Main Improvements with the County of Fresno Right-Of-Way in connection with the EDA "Park Blvd. Infrastructure Improvement" project.

Attachment: 2026 Amended and Restated Agreement for the Cooperation and Indemnification in Connection with the Park Blvd. / Sumner Ave. - Sewer Trunk and Water Main Improvement project.

RECOMMENDATION:

Staff recommends the council authorize the Mayor to sign the attached amended and restated agreement. The agreement update (amendment and restatement) is a modification to an earlier agreement, 1st executed in December 5, 2017. The new agreement was generated by Fresno County, who had requested the amended / restated agreement follow the same format as the original 2017 agreement. In that agreement, the City signatory was the Mayor.

The amended and restated agreement was requested by the Economic Development Administration (EDA). The earlier agreement contained a misstatement and did not adequately address the responsibilities of the City and County with respect to the water main and trunk sewer line maintenance and roadway repairs in the County ROW along Sumner Ave, between Monson and Orona Ave.

The new agreement has been approved to form by the City Attorney. Upon consent of council and procurement of the Mayor's signature, the signed agreement would be forwarded to the County of Fresno for approval by the Board of Supervisors.

BACKGROUND:

The EDA "Park Blvd. Infrastructure Improvement" project agreement was formally executed in March of 2022 by the City. The Cooperation and Indemnification was executed in December of 2017 by the Orange Cove Planning Commission at the time as a precursor to the EDA Park Blvd. Infrastructure project. In that time, several things had changed which created some discrepancies which prompted the amendment and restatement of the agreement.

FISCAL IMPACT:

EDA has requested the new (subject) agreement be executed between the City of Orange Cove and the County of Fresno as a condition of receipt of EDA grant funding totaling ~ $1,942,800.

ENVIRONMENTAL REVIEW:

Not Applicable - the project was cleared via Negative Declaration per the CEQA process in 2016 (trunk sewer) and then again in 2025 (water main).

Authorize the Mayor to Sign Amended and Restated Agreement for Cooperation and Indemnification in Connection with the Sumner Avenue Sewer Trunk and Water Main Improvement Project
