For the Special Meeting of May 26, 2026
CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Samuel A. Escobar, City Manager
Subject: Water and Wastewater Rate Study
Attachments: Resolution No. 2026-10
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. 2026-10, approving the proposed water and wastewater (sewer) rate increases in accordance with the Proposition 218–compliant rate notices (Notice of Public Hearing) mailed to all customers on April 7, 2026.
BACKGROUND:
Recommended increased rates by Tuckfield and Associates were implemented, then rescinded, from its 2021 rate study, because of issues with water meters not reporting data correctly for billing purposes. Rates from 2020 have been in place since then.
Problems with meters have continued, but are being corrected prior to the implementation of the new rates. The water and sewer systems also have significant deferred maintenance of equipment at the water and sewer treatment plants. Both the water and sewer enterprise funds have negative annual cash flow, and both have negative fund balances. Dan Bergmann of IGS began work on the rate study last October. The report, “Water and Wastewater Enterprise Financial Analysis and Rate Study,” dated March 2, 2026, was presented to City Council on March 24, 2026. Following the city council’s approval, Proposition-218-compliant rate increase notices were sent to all customers on April 7, 2026, allowing more than 45 days to pass before a rate hearing on May 26, 2026.
DISCUSSION:
Water and sewer rates must be increased substantially to 1) recover the negative fund balances, 2) cover the negative cash flows, and 3) provide for deferred capital repair of both systems. If all the needed increases were implemented in the first year, water revenue would increase 47 percent, and sewer would increase 60 percent, but the increases would be a burden on Orange Cove customers. Instead, the increases are staged over two years to soften the impact on customers. Staff will work to secure grant funding for capital repair work such that the second-year increase can be reduced. The result of staging the increases will be either that additional cash is borrowed from other funds or that capital repair projects are further delayed. Public Works is working diligently to ensure that all water meters are working properly prior to July 1, 2026, rate implementation date, should City Council approve the rate increase. Staff will also closely monitor rate implementation to ensure revenue is received as planned, to avoid the problems that happened following the previous rate study.
FISCAL IMPACT:
The first- and second-year revenue increases for water are $406,000 and $508,000, respectively. The first- and second-year revenue increases for sewer are $357,000 and $464,000, respectively.
ALTERNATIVES: If rates are not increased, the projected loss for the water enterprise in FY26/27 is $678,000, and the projected loss for the wastewater enterprise is $722,000.
These assume the planned capital repairs will proceed during that year.
CONFLICT OF INTEREST:
None.

CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
Orange Cove City Council
Joe Estrada, Public Works Director
Community Service Volunteer Policy
Proposed Community Service Volunteer Policy
RECOMMENDATION:
Staff recommends that the City Council provide direction to prepare a formal Community Service Program Policy for future consideration and adoption. The proposed policy would establish operational procedures, participant eligibility requirements, safety standards, supervision guidelines, and conduct expectations for individuals assigned to community service work within City departments.
BACKGROUND:
The City of Orange Cove periodically receives requests from courts, probation departments, and local agencies seeking placement opportunities for individuals required to complete court-ordered community service hours. Currently, the City does not maintain a formal written policy governing the acceptance, supervision, eligibility, or conduct of community service participants.
Typical assignments may include:
• Weed abatement;
• Litter and debrisremoval;
• Alleyway cleanup;
• Park maintenance assistance;
• Graffiti removal support;
• Public facility cleaning; and
• General non-skilled labor tasks under City supervision.
A formal policy would establish consistent procedures for participant screening, attendance, conduct, safety expectations, supervision, and program administration. The policy would also provide clear directions to staff regarding acceptable work assignments and operational limitations.
The proposed policy would prioritize public safety and limit participation to low-risk individuals approved through authorized referral programs. Participants would be prohibited from operating heavy equipment, driving City vehicles, handling hazardous materials, or performing specialized work unless specifically authorized and supervised.
In addition, the policy would include a Code of Ethics requiring participants to:
• Conduct themselves respectfully and professionally;
• Follow all City safetyprocedures;
• Obey staff instructions;
• Respect public property and equipment;
• Maintain appropriate workplace behavior; and
• Refrain from drugs, alcohol, weapons, or disruptive conduct while participating in City assignments.
Failure to comply with program rules would result in dismissal from the program and notification to the referring agency or court.
REASON FOR RECOMMENDATION:
Adoption of a formal Community Service Program Policy would establish a structured and consistent framework for accepting and supervising community service participants within City operations. The policy would improve accountability, support public safety, provide operational guidance to staff, and promote community beautification efforts.
FISCAL IMPACT:
Potential costs may include:
• Staff supervision time;
• Safety equipment and protective gear;
• Administrative recordkeeping;
• Orientation and training materials; and
• Liability and risk management review.
Potential operational benefits include:
• Assistance with routine cleanup and beautification efforts; • Reduction in minor maintenance labor costs;
• Improved response to public nuisance concerns;
• Enhanced maintenance of public spaces and alleyways;and • Increased community accountability and engagement.
The program may provide a cost-effective supplemental labor resource for limited non-skilled maintenance activities while supporting community improvement initiatives.
CONFLICT OF INTEREST:
None.

REPORT TO THE CITY COUNCIL
Orange Cove City Council
Joe Estrada, Public Works Director
Cooling Center Policy
Proposed Cooling Center Policy
RECOMMENDATION:
Staff recommends that the City Council provide direction to prepare and implement a formal Cooling Center Policy for future consideration and adoption. The proposed policy would authorize designated public facilities to operate as cooling centers during excessive heat warnings or emergency weather events in coordination with local public safety agencies, Fresno County emergency services, and community partners.
BACKGROUND:
The City of Orange Cove experiences prolonged periods of elevated summer temperatures that can create dangerous health conditions for residents, particularly vulnerable populations such as seniors, children, individuals with medical conditions, outdoor workers, and residents without reliable air conditioning.
Extreme heat events have become more frequent and severe throughout California, increasing the risk of:
• Heat exhaustion and heat stroke
• Dehydration
• Respiratory distress
• Power outages and utilitystrain
• Increased emergency medical responses
Nearby municipalities have already implemented operational cooling center programs, including:
• Sanger operates a cooling center Monday through Friday from 12:00 p.m. to 6:00 p.m. once temperatures reach 105 degrees.
• Kingsburg operates a cooling center Monday through Friday from 8:00 a.m. to 5:00 p.m. once temperatures reach 104 degrees.
• Fresno operates cooling centers Monday through Friday from 12:00 p.m. to 8:00 p.m. once temperatures reach 105 degrees.
The proposed Cooling Center Policy for the City of Orange Cove would establish:
• Criteria for activation during excessive heat warnings • Hours of operation
• Staffing responsibilities
• Safety and security procedures
• Coordination with emergency responders
• Public notification procedures
• Accessibility accommodations
• Availability of water and basic resources
• Operational standards for city facilities serving as cooling centers Potential facilities may include the City Community Center, Council Chambers, Recreation Facilities, or other suitable public buildings equipped with air conditioning and ADA accessibility.
REASON FOR RECOMMENDATION:
Adoption of a Cooling Center Policy would enhance the City's emergency preparedness capabilities and provide a valuable public service during extreme heat events. The policy would establish clear operational guidelines to protect public health and safety while utilizing existing city resources in a responsible and efficient manner.
FISCAL IMPACT:
The estimated operational costs are expected to be minimal and seasonal in nature, depending on the frequency and duration of extreme heat events.
CONFLICT OF INTEREST:
None.

CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Orfil Muniz, P.E., City Engineer
Subject: CDBG Funds Reprogramming – Capital Project Allocation Direction Attachments: None
RECOMMENDATION:
Staff recommends that the City Council provide direction to staff regarding the reprogramming of available Community Development Block Grant (CDBG) funds across the City’s three currently programmed capital projects. Two options are presented for Council consideration.
Staff’s recommended option is Option 2, which preserves a placeholder allocation for the Sheridan Park Improvements project pending additional funding, and reprograms the balance of available CDBG funds to fully fund construction of the Community Center Park Rehabilitation Project.
BACKGROUND:
The City of Orange Cove currently has CDBG funds programmed across three capital improvement projects: Sheridan Park Improvements, Park Boulevard Street Resurfacing, and the Community Center Park Rehabilitation. The current allocation of CDBG funds across these projects is summarized below:
Current CDBG Allocation
Project CDBG Funds City/Other Funds Total Project
Cost
Sheridan Park
Improvements
$230,030 $230,030
Park Blvd Street
Resurfacing
$157,300 $157,300
Community Center Park
Rehabilitation
$84,281 $84,281
Totals $471,611
Based on the engineer’s estimate, the construction cost for the Sheridan Park Improvements project is approximately $330,000, which exceeds the $230,030 currently allocated to the project. As programmed, the available CDBG funds are not sufficient to construct the Sheridan Park Improvements project. Staff is therefore seeking Council direction on how to reprogram available CDBG funds to make the best use of the City’s grant resources.
DISCUSSION:
Because the engineer’s estimate for Sheridan Park Improvements exceeds the currently programmed funds, the project cannot be constructed under the existing allocation. Staff has identified two options for Council consideration to reprogram the available CDBG funds. Both options use the full $471,611 of available CDBG funds; they differ in which project(s) are advanced to construction at this time.
Option 1 – Consolidate Park Funds into Sheridan Park Improvements Under this option, the $84,281 currently allocated to the Community Center Park Rehabilitation Project would be reprogrammed to the Sheridan Park Improvements project. The Park Boulevard Street Resurfacing allocation would remain unchanged. This would increase the Sheridan Park Improvements allocation to $314,311.
Project CDBG Funds City/Other Funds Total Project

$314,311 $314,311
Park Blvd Street
Resurfacing
$157,300 $157,300
Community Center Park
Rehabilitation
$0 $0
Totals $471,611
Even with the additional $84,281, this option still falls short of the engineer’s estimate of approximately $330,000 for Sheridan Park. Construction could proceed only if the City identifies additional funding from other sources, reduces the project scope, or receives favorable construction bids. The Community Center Park Rehabilitation Project would be deferred indefinitely under this option.
Option 2 – Fully Fund Community Center Park Rehabilitation (Recommended) Under this option, $50,000 would remain programmed to the Sheridan Park Improvements project to cover the engineering phase costs and to keep the project active pending identification of additional funding for Construction. The $157,300 currently allocated to Park Boulevard Street Resurfacing and the remaining $180,030 from Sheridan Park would be reprogrammed to the Community Center Park Rehabilitation Project, bringing its total allocation to $421,611 and fully funding its construction.

Park Blvd Street
Resurfacing
$0 $0
Community Center Park
Rehabilitation
$421,611 $421,611
Totals $471,611
Staff recommends Option 2 for the following reasons:
• Park improvement projects are generally more difficult to fund than street projects. Street and roadway projects are eligible for a broader range of dedicated funding sources — including SB 1, Gas Tax, Measure C, ATP, HSIP, STBG, & RSTP — that are not available for park improvements.
• Fully funding the Community Center Park Rehabilitation Project allows construction to move forward in the current fiscal year and avoids the risk of escalating construction costs.
• Maintaining a $50,000 placeholder for Sheridan Park Improvements keeps the project active and eligible for future grant supplementation for construction. • The Park Boulevard Street Resurfacing project remains a priority and can be reprogrammed in a future funding cycle using transportation-specific funding sources better suited to street resurfacing work.
Regardless of which option Council selects, the total available CDBG funds of $471,611 will be fully programmed and remain in compliance with applicable CDBG eligibility and timeliness requirements.
FISCAL IMPACT:
There is no impact to the City’s General Fund. This action reprograms previously allocated CDBG grant funds between eligible capital projects. Total CDBG funds programmed remain $471,611. Should Council direct staff to pursue Option 1, the Sheridan Park Improvements project will require an additional funding source estimated at approximately $15,000 to $20,000 to meet the engineer’s estimate of $330,000. Under Option 2, no additional funding is required to advance the Community Center Park Rehabilitation Project to construction.
CONFLICT OF INTEREST:
None.

Staff recommends that the City Council adopt Resolution 2026-13 awarding the contract for the Seven Intersections Striping Improvement project to Dave Christian Construction Company, Inc. in the amount of $279,523.00, and provide a $42,000.00 (~15%) contingency to deal with any unforeseen issues that might arise during the course of construction for a total encumbrance of $321,523.00.
Staff further recommends that the City Manager and/or his designee be authorized to execute the Agreement.
BACKGROUND:
On April 1, 2026, a public bid opening was held, and four (4) bid proposals were received. The four (4) responsive bidders and the corresponding bid results are listed as follows; 1) Dave Christian Construction Company, Inc. $279,523.00 (DCC) 2) Juarez Brothers General Engineering, Inc. $287,967.00 (JBGE) 3) American Paving Company $345,622.00 (APC)
4) Seal Rite Paving $385,004.95 (SRP)
The Engineer’s Estimate (EE) for the project construction, prepared in 2023 as a condition of the grant application, was $277,700.00 without contingency. The EE did not include engineering, inspection and administrative costs. The bid exceeded the EE by < 1%.
The project is funded through the Federal Highway Safety Improvement Program (HSIP) and administered through Caltrans. The total project grant funding authorization is limited to $249,930.00, with a requirement for the City to provide a minimum local match of $29,593.00 (~11%) based on the bid results. The City match will be provided using Measure C - SB 1 funds and / or the general fund as determined by the City Manager.
The low bid submittal was thoroughly vetted, and it is the opinion of staff that the bid submitted by DCC, should be accepted and a Notice of Award issued.
The specific intersections slated for improvement are; 1) 4th St. & “C” St., 2) Jacobs Ave. & “D” St., 3) Jacobs & “D” St, 4) Park Blvd. & 2nd St., 5) “J” St. & 9th St., 6) Adams Ave. & 4th St, and 7) Adams Ave. & 5th St. The project will install / upgrade cross walks with high visibility thermo-plastic striping, provide advanced yield lines, warning signs. In cases where paving is in poor condition and not suitable for striping improvements, minor resurfacing work will be performed.
Contract Award Recommendation, Seven Intersections - Safety Striping Improvements
HISTORICAL CONTEXT:
The project is funded as part of the 2023 Federal HSIP program (Cycle 11). The original grant application was prepared in September of 2022. The HSIP program is ongoing and applications are submitted annually. The City has been awarded a 2nd HSIP project for Cycle 12 in the amount of $349,920 to improve an additional twenty-three (23) additional intersection throughout the City, Construction is slated for 4Q26.
FISCAL IMPACT:
The project grant funding authorization requires a minimum local match of 10% but will be slightly higher based on bid results and possible contingency realization. The maximum HSIP funding available totals $249,930.00. The City match currently totals (~$29,593.00) and will be provided using Measure C - SB 1 funds and / or through the general fund as determined by the City Manager.
ENVIRONMENTAL REVIEW:
As the project constitutes a Maintenance Project taking place in the existing City Rights-of-Way, with no significant infrastructure improvements, there is no impact / change to the environment. Staff has determined formal Environmental Clearance is not required provided Best Construction Practices are followed and enforced.

Subject: ATP (Cycle 5) Bike Lane, Side Walk & Crossing Improvements – Public Works Contract Award
Attachments: Resolution 2026-14 “Award of ATP (Cycle 5) Bike Lane, Side Walk & Crossing Improvements Project”
RECOMMENDATION:
Staff recommends that City Council adopt Resolution 2026-14 awarding the contract for the ATP / SB1 (Cycle 5) Bike Lane, Side Walk & Crossing Improvements project to Juarez Brothers General Engineering, inc. in the amount of $563,079.25, and provide a $112,600.00 (~20%) contingency to deal with any unforeseen issues that might arise during the course of construction for a total encumbrance of $675,679.25.
Staff further recommends that the City Manager and/or his designee be authorized to execute the Agreement.
BACKGROUND:
On April 15, 2026, a public bid opening was held and eight (8) bid proposals were received. The top four (4) responsive bidders and the corresponding “base” bid results are listed as follows; 1) Juarez Brothers General Engineering, Inc. $563,079.25 (JBGE) 2) Terra West $602,607.00 (TW)
3) Advanced Engineering $676,053.00 (AE)
4) Dave Christian Construction Company, Inc. $746,911.50 (DCCC) The Engineer’s Estimate (EE) for the project construction was $1,052,300.00 without contingency. The EE included engineering, inspection and administrative costs. The bid included two additive alternatives which were not included in the award as the combined total exceeded the available project funding.
The total project (construction, engineering, inspection and administration) cost at close out for the execution of the base bid is estimated at $809,079.26, which can be funded 100% using ATP grant funding.
The project is funded through the State of California Active Transportation (ATP) program and administered through Caltrans. The total project grant funding authorization is limited to $839,000.00, with no City match requirement.
The low bid submittal was thoroughly vetted, and it is the opinion of staff that the bid submitted by JBGE, should be accepted and a Notice of Award issued.
The project improvements to be awarded are located along “C” Street between “B” St and the alley immediately north of Park Blvd. The project will install ~3,200 LF of Class II Bike Lane, 12,820 SF of Sidewalk and multiple ADA compliant Pedestrian Crossing Improvements. As a result of significant Contract Award Recommendation, ATP / SB1 (Cycle 5) Bike Lane, Side Walk & Crossing Improvements Project
grade differences, there are three (3) locations within the project construction limit that will require publicly funded improvements on private property. These improvements are required in order for the residents at these locations to access the newly constructed project amenities.
HISTORICAL CONTEXT:
The project is funded through the State of California Active Transportation (ATP) program - Cycle 5.
The original grant application was prepared in December of 2021. The ATP program is ongoing and applications are submitted annually. At present, the City has no new ATP projects pending. The application period for new 2026 ATP (Cycle 8) projects is open, with the submittal deadline ending June 22, 2026.
FISCAL IMPACT:
The project grant funding authorization totals $839,000.00 and is estimated to be sufficient to fund the base bid construction project award, as well as project engineering, inspection and administration.
There is no requirement for a local match.
ENVIRONMENTAL REVIEW:
A project was determined to be Categorically Exempt based on the Notice of Exemption (NOE) filed for the project on or about March 29, 2022. The project is being constructed in the existing City right-of way.

CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Megan Crouch, City Attorney
Subject: Approval of Resolution No. 2026-11 Declaring a Vacancy on the City Council and Determining the City Council’s Intent to Appoint a Qualified Candidate to Serve the Remainder of the Current Electoral Term
Attachments: Resolution No. 2026-11
RECOMMENDATION:
Staff recommends that City Council approve Resolution No. 2026-11 and appoint a current Councilmember to fill the vacancy of the mayor’s seat, as well as begin the appointment process to fill that Councilmember’s vacant seat.
BACKGROUND:
Current Mayor Diana Guerra-Silva’s seat is now vacant based upon absence due to unforeseen circumstances. Because of that, the Council must decide how it wishes to fill her seat. Since the mayor is elected in the city, staff are recommending that a current Councilmember be appointed to fill the vacancy of the mayor’s seat. Because the mayor’s term is up for reelection this November, the appointed Councilmember will only serve until the November 2026 election is certified.
If a current Councilmember fills the vacancy, this will leave that current Councilmember’s seat vacant. Staff recommends that the City Council declare its intention to appoint a qualified candidate to fill that vacancy. The term of that vacancy will be dependent upon which Councilmember takes the seat of the mayor.
FISCAL IMPACT:
None.
CONFLICT OF INTEREST:
None.

WHEREAS, after appointment of a current Councilmember to the Mayor seat, a Councilmember seat will become vacant; and
WHEREAS, Government Code section 36512 provides that the City Council shall either appoint a qualified candidate to fill the vacancy, or call a special election to fill the vacancy; and WHEREAS, the Mayor seat that has become vacant is for a term that will expire upon certification of the results of the November 2026 election, and the City Council wishes to avoid incurring the costs associated with calling a special election; and WHEREAS, the City Council finds it is in the best interests of the City to appoint a qualified candidate to serve for the remainder of the current electoral term, to ensure continuity of leadership and the orderly conduct of City business.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange Cove as follows:
1. The foregoing recitals are true and correct and are incorporated herein by this reference.
