CITY OF ORANGE COVE
REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Cynthia Cisneros, City Clerk
Subject: Approval of the Updated City of Orange Cove Facility Use Application.
Attachments: Facility Use Application
RECOMMENDATION:
Staff recommends that the City Council approve the updated City of Orange Cove Facility Use Application, including the current Clean Up Fees provisions and the new 2:00 a.m. limit on events extending past midnight, with the outdated clean-up language removed from the Addendum to Use of Facility.
BACKGROUND:
The Facility Use Application is the document residents, organizations, and other applicants complete to reserve City facilities, including the Victor P. Lopez Community Center, J.O. Eaton Memorial Park, and Sheridan Park. The application sets out the City’s requirements for use of these facilities, including the processing fee, rental rates and deposits, insurance, security, alcohol, and food permits, clean up responsibilities, and the rules for use of the Victor P. Lopez Center. Applicants sign the application acknowledging these requirements, and all applications are presented to the City Manager and/or City Council for final approval.
Staff has reviewed the application to make sure the terms are current and consistent throughout the document. The key terms in the application presented for approval are as follows:
Processing fee: A non-refundable $45 processing fee is due at the time of application and is applied toward the rental fees if the application is approved.
Community Center rates: Residents $1,500 and non-residents $2,500, each with a $1,000 deposit ($900 refundable and $100 non-refundable). Kitchen use is $50 per hour, and decorating or rehearsal the day before the event is $50 per hour.
Non-profit and funeral use: Orange Cove non-profit organizations pay $50 per hour (excluding dances), with non-resident non-profit rates doubled. Use of the Community Center for funeral services is free to Orange Cove residents and $300 for non-residents.
Insurance and security: A Certificate of General Liability Insurance of at least $1,000,000, naming the City as additional insured is required, along with one uniformed security guard for every 50 people at dances, dinners, and events with alcohol.
Clean up: The facility must be cleaned at the conclusion of the event. The applicant must schedule a walk-through with City staff one business day before the event, and a final walkthrough is conducted before the facility is vacated at 12:00 a.m. If extra cleaning is needed, a fee of $90.00 per hour will be charged. The refundable deposit is processed within three weeks of the event, and an itemized report is provided if any portion is withheld.
Hours of use: Events at the Victor P. Lopez Center must end by 12:00 midnight. Any time past midnight is charged at $200 per hour and deducted from the deposit, and no event may continue past 2:00 a.m.
The Addendum to Use of Facility on page 5 of the application previously contained a separate Clean Up Fees paragraph. That paragraph repeated the clean-up requirements in older language and listed an extra cleaning fee of $50.00 per hour, which conflicts with the $90.00 per hour fee and the walk-through procedures in the Clean Up Fees section of the facility rates. To avoid confusion for applicants and staff, the outdated paragraph shown in redline on page 5 has been omitted, and the Clean Up Fees section of the facility rates will be the sole statement of the City’s clean-up requirements.
Staff has also added language to Item 15 of the Rules for the Use of the Victor P. Lopez Center, shown in redline on page 10 of the application. Item 15 already provides that any time past 12:00 midnight is charged at $200 per hour and deducted from the deposit, but it did not set a limit on how late an event could continue. The new language provides that events may not extend past 2:00 a.m., giving applicants and staff a clear final end time.
FISCAL IMPACT:
None.
CONFLICT OF INTEREST:
None.

CITY OF ORANGE COVE
REPORT TO CITY COUNCIL
TO: Orange Cove City Council
FROM: Samuel Escobar, City Manager
SUBJECT: Removal of Art Council Member Nancy Villegas, Appointment of Cassandra Sosa to the Art Council, Approval of Art Council Officers, and Authorization of Otter.ai Account Access
RECOMMENDATION:
Staff recommends that City Council take the following actions regarding the City of Orange Cove Art Council: Approve the removal of Nancy Villegas as a member of the Art Council; Approve the appointment of Cassandra Sosa as a member of the Art Council; Approve the Art Council’s selected officers: Destiny Fierro as Chairwoman, Estella Juarez as Vice Chair, and Kaycie Hernandez as Secretary; and Authorize one (1) shared Otter.ai account for use by the Chairwoman, Vice Chair, and Secretary for the purpose of recording and preparing Art Council meeting minutes.
BACKGROUND:
The City of Orange Cove Art Council supports and promotes arts and cultural programming within the City. To keep the Art Council fully staffed and operating effectively, periodic changes to its membership and leadership are brought before the City Council for approval.
Staff recommends the removal of Nancy Villegas from the Art Council because of her resignation. Her removal creates a vacancy on the Art Council. To fill this vacancy, staff recommends the appointment of Cassandra Sosa, a resident who has expressed interest in serving and is committed to supporting the arts in the Orange Cove community.
In addition, the Art Council has selected its officers to lead the body. The Art Council selected Destiny Fierro to serve as Chairwoman, Estella Juarez to serve as Vice Chair, and Kaycie Hernandez to serve as Secretary. Staff recommends that City Council approve these selections so that the officers may begin serving in their respective roles.
To support accurate and timely record keeping, staff further recommends that the Chairwoman, Vice Chair, and Secretary be granted access to one (1) shared Otter.ai account. Otter.ai is a transcription software that records meetings and generates written transcripts, which will assist the officers in preparing Art Council meeting minutes. Access will be limited to these three officers and used only for official Art Council business.
CONFLICT OF INTEREST:
None.
FISCAL IMPACT:
The cost of one (1) Otter.ai account subscription is approximately $80.00 per year, to be funded from the administration subscription account.

1. Open the public hearing on the formation of Community Facilities District No. 2026-1 (Public Facilities Maintenance District No. 1) of the City of Orange Cove (the "CFD"), receive the City Engineer’s Community Facilities District Report (Attachment 1) and the report of the City Clerk on any written protests, take public testimony, and close the hearing;

3. Adopt the Resolution Calling a Special Landowner Election on the levy of the special tax and the establishment of an appropriations limit, and accept the landowner’s waiver and consent to holding the election this evening (Attachments 3 and 4); CFD No. 2026-1 Formation Hearing — Page 1
4. Following the canvass of the ballot by the City Clerk, adopt the Resolution Declaring the Results of the Special Election and directing the recording of the Notice of Special Tax Lien (Attachment 5); and
5. Introduce by title only, waive further reading, and conduct the first reading of the Ordinance Levying a Special Tax within the CFD (Attachment 6), with second reading and adoption scheduled for the regular meeting of October 28, 2026.
BACKGROUND
On August 26, 2026, the City Council adopted Resolution No. 2026-33 (the "Resolution of Intention") declaring its intention to establish the CFD under the Mello-Roos Community Facilities Act of 1982 (Government Code Section 53311 et seq.) over the territory of Tract Map No. 6289 (Macias Subdivision), Fresno County Assessor’s Parcel Number 375-040-26, approximately
19.54 gross acres consisting of forty-one (41) lots owned by Efrain Yanez Construction, Inc. The subdivision comprises thirty-nine (39) single-family lots, one multi-family lot (Lot 40, 4.85 acres), and one non-residential lot (3.52 acres). The Resolution of Intention identified the maintenance services to be funded (Exhibit A), fixed the maximum special tax rates in the Rate and Method of Apportionment (Exhibit B), designated a future annexation area, and directed the City Engineer to prepare the report required by Government Code Section 53321.5.
Because the Act requires that the public hearing be held not less than thirty days after adoption of the Resolution of Intention, the Council adopted Resolution No. 2026-36 on September 9, 2026, resetting the public hearing to October 14, 2026. The boundary map was submitted to the Fresno County Recorder for recordation on September 8, 2026, and notice of the hearing was published in the Mid-Valley Times on September 10, 2026 as required by Government Code Section 53322.
The Community Facilities District Report, dated September 10, 2026, has been filed with the City Clerk and is made a part of the record of this hearing.
This is the City’s first community facilities district. Once formed, the CFD will serve as the City’s standard mechanism for funding the maintenance of public improvements constructed by new development: each future subdivision can be added by unanimous landowner consent under Government Code Section 53339.7 without repeating the formation proceedings.
DISCUSSION
Services to be funded. The special tax will fund the maintenance, servicing, operation, repair, and replacement of the public improvements serving the subdivision: landscaping and irrigation; street lighting; streets and sidewalks; storm drainage and water-quality facilities; local park and open space; graffiti abatement; and other public facilities constructed as conditions of approval and accepted by the City, together with district administration and a repair and replacement reserve. The services are in addition to those the City provides in the territory today and will not supplant any existing service.
Estimated annual cost. The City Engineer’s report estimates the fair and reasonable annual cost of the services at buildout, based on quantities from the approved improvement plans and current City maintenance contract and utility rates, as follows:
Line Item Estimated Annual
Cost
Parkway landscaping maintenance (approx. 28,500 SF of parkway strips and Park Boulevard frontage landscaping, including street trees) $2,850 Landscape water and electrical utilities $1,500
Street lighting — maintenance and energy (approx. 18 streetlights) $900 Street pavement maintenance reserve (approx. 94,400 SF of local street pavement) $9,440
Sidewalk, curb, gutter, signage, and striping maintenance allowance $1,750 Storm drainage and retention basin maintenance (district share of the expanded City basin and in-tract facilities) $2,000
CFD No. 2026-1 Formation Hearing — Page 2
Line Item Estimated Annual
Cost
Local park and open space maintenance (no park site within Tract No. 6289) $0 Graffiti abatement and miscellaneous repairs allowance $750 Subtotal — Services $19,190
CFD administration (annual levy submittal, County per-parcel fees, state reporting, City staff time) $1,500
Repair and replacement reserve contribution (2% of Services subtotal) $383.80 Total Estimated Annual Cost (Special Tax Requirement at Buildout) $21,073.80 Three scoping determinations are reflected in the estimate. The pavement line covers only the local streets constructed by the subdivision (Orona Avenue, Celaya Avenue, Peace Street, "D" Street, and connector legs); the travelway of Park Boulevard, an arterial serving the community at large, remains a City responsibility funded through the City’s SB 1/RMRA and Measure C street maintenance programs. The five-foot parkway strips fronting the residential lots are included so that the CFD maintains a uniform streetscape. No park site exists within Tract No. 6289, so the park and open space category is budgeted at zero for the initial territory and retained for territory annexed in the future.
Sufficiency of the maximum special tax. The maximum special tax rates adopted in Exhibit B to Resolution No. 2026-33 are:
Land Use Category Taxable Unit Maximum Special Tax (FY
2027-28)
Developed Property – Single-Family Residential Dwelling Unit $222 per Unit Developed Property – Multi-Family Residential Dwelling Unit $166 per Unit Developed Property – Non-Residential Acre $887 per Acre Approved Property Lot $222 per Lot
Undeveloped Property Acre $1,240 per Acre
At buildout (39 single-family units, approximately 75 multi-family units on Lot 40, and 3.52 nonresidential acres), the revenue available at the maximum rates is $24,230 per year, approximately fifteen percent (15%) above the $21,073.80 estimated annual Special Tax Requirement. The maximum rates escalate each July 1, commencing July 1, 2028, by the greater of the change in CPI-U (West Region) or four percent (4%). Prior to development, Lot 40 and any unbuilt lots are taxed at the Approved and Undeveloped Property rates, which fully secure the Special Tax Requirement in all interim conditions. The Council sets the actual levy each fiscal year at or below the maximum rates.
Protests. Under Government Code Section 53324, the proceedings must be abandoned if written protests against the establishment of the CFD are filed by fifty percent or more of the registered voters residing within the proposed district, or by the owners of one-half or more of the area of land within it, and not withdrawn. The sole owner of the entire territory petitioned for formation of the CFD. The City Clerk will report at the hearing any written protests received.
Landowner election. No one resides within the territory and fewer than twelve registered voters have resided there during the ninety days preceding the hearing. Under Government Code Section 53326(b), the qualified electors are therefore the landowners, with one vote for each acre or portion of an acre owned — twenty (20) votes for the 19.54-acre territory. The owner has executed a waiver of the statutory election time limits and consent to holding the election this evening (Government Code Section 53326(a)), with the City Clerk acting as election official. The ballot presents two propositions: Proposition A, the levy of the special tax in accordance with the Rate and Method of Apportionment, and Proposition B, the establishment of an appropriations limit for the CFD. Each requires approval by two-thirds of the votes cast. Upon the City Clerk’s CFD No. 2026-1 Formation Hearing — Page 3
canvass, the Council may adopt the Resolution Declaring the Results and proceed to first reading of the special tax ordinance.
What happens next. The Notice of Special Tax Lien will be recorded with the Fresno County Recorder within fifteen days of the election (Government Code Section 53328.3), giving constructive notice of the special tax to every future purchaser; State law also requires the seller of each lot to deliver the Notice of Special Tax to the buyer. Second reading and adoption of the ordinance is scheduled for October 28, 2026, with the ordinance effective thirty days thereafter.
The first annual levy will be adopted by the Council in Fiscal Year 2027-28 and submitted to the Fresno County Auditor-Controller for collection on the secured property tax roll. Formation of the CFD also satisfies the intent of Condition of Approval No. 9 of Resolution No. CC 2020-43, which contemplated a landscaping and lighting district for the subdivision.
FISCAL IMPACT
None to the General Fund. All formation costs are advanced by the property owner under the Deposit and Reimbursement Agreement. Once formed, the CFD’s special tax funds the maintenance services, administration, and reserves for the public improvements serving the subdivision — an estimated $21,073.80 per year at buildout that the General Fund would otherwise absorb — and City and contract staff time spent administering the district is reimbursable from the annual levy. The special tax is not a debt of the City and no bonds will be issued.
ENVIRONMENTAL REVIEW
Formation of the CFD and the levy of the special tax are not a "project" subject to the California Environmental Quality Act (State CEQA Guidelines Sections 15378(b)(4) and 15061(b)(3)) because they establish a government funding mechanism that does not commit the City to any specific project and has no potential for a physical change in the environment. The underlying subdivision was separately reviewed, and a Negative Declaration adopted, in connection with Resolution No. CC 2020-43.
CONFLICT OF INTEREST
None.

I. INTRODUCTION
By Resolution No. 2026-33, adopted August 26, 2026 (the "Resolution of Intention"), the City Council of the City of Orange Cove declared its intention to establish Community Facilities District No. 2026-1 (Public Facilities Maintenance District No. 1) of the City of Orange Cove (the "CFD") over the territory of Tract Map No. 6289 (Macias Subdivision), Fresno County Assessor’s Parcel Number 375-040-26, approximately 19.54 gross acres consisting of forty-one (41) lots owned by Efrain Yanez Construction, Inc., and directed the City Engineer, as the officer responsible for the services to be funded by the CFD, to prepare and file this report pursuant to Government Code Section 53321.5. By Resolution No. 2026-___, adopted September 9, 2026, the City Council reset the public hearing on the establishment of the CFD to October 14, 2026. This report contains (a) a brief description of the services required to adequately meet the needs of the CFD and (b) an estimate of the fair and reasonable cost of providing the services, including the cost of administering the CFD, and is filed with the City Clerk and made a part of the record of the public hearing.
II. DESCRIPTION OF SERVICES
The services to be funded by the CFD (the "Services") are the maintenance, servicing, operation, repair, and replacement of the public improvements serving the territory of the CFD, as more particularly described in Exhibit "A" to the Resolution of Intention, incorporated herein by reference:
(1) landscaping and irrigation; (2) street lighting; (3) streets and sidewalks; (4) storm drainage and water-quality facilities; (5) local park and open space; (6) graffiti abatement; and (7) other public facilities constructed as a condition of approval of development within the territory of the CFD and accepted by the City, together with the incidental and administrative expenses authorized by Government Code Section 53345.3. The Services are in addition to those provided in the territory of the CFD as of the date of its creation and will not supplant services already available within that territory.
III. ESTIMATE OF COST
The fair and reasonable estimated annual cost of the Services at buildout of the Subdivision, including administration and a repair and replacement reserve contribution, is set forth below.
Quantities are derived from the approved improvement plans for Tract No. 6289 (A.W. Engineering) and the recorded final map; unit costs reflect current City maintenance contract and utility rates.
Line Item Estimated Annual Cost
Parkway landscaping maintenance — approx. 28,500 SF of five-foot parkway strips and Park Boulevard frontage landscaping, including street trees ($0.10/SF/yr)
$2,850
Landscape water and electrical utilities (irrigation supply and controller power) $1,500 Street lighting — maintenance and energy, approx. 18 streetlights per City Standards E-1/E-2 ($50/light/yr)
$900
Street pavement maintenance reserve — approx. 94,400 SF of local street pavement (Orona Avenue, Celaya Avenue, Peace Street, "D" Street, and connector legs) at $0.10/SF/yr, funding the recurring slurry seal cycle, crack sealing, striping, and signage, with major pavement rehabilitation of local streets addressed through the City’s pavement management program as such needs arise $9,440
Sidewalk, curb, gutter, signage, and striping maintenance allowance $1,750 Storm drainage and retention basin maintenance — district share of the expanded City ponding basin (10.82 ac-ft) and in-tract drainage facilities $2,000
Local park and open space maintenance (no park site within Tract No. 6289; category retained for territory annexed in the future)
$0
Graffiti abatement and miscellaneous repairs allowance $750 Subtotal — Services $19,190
CFD administration (annual levy submittal, County per-parcel fees, state reporting, and City staff time)
$1,500
Repair and replacement reserve contribution (2% of Services subtotal) $383.80
TOTAL ESTIMATED ANNUAL COST (SPECIAL TAX REQUIREMENT
AT BUILDOUT)
$21,073.80
Three scoping determinations are reflected in the estimate. First, the pavement maintenance line includes the local streets constructed by the Subdivision only; the travelway pavement of Park Boulevard, an arterial street serving the community at large, is excluded from the CFD budget and remains a City responsibility funded through the City’s street maintenance programs (SB 1/RMRA and Measure C), so that the special tax funds only services attributable to the development and does not supplant an existing citywide service. The Park Boulevard frontage improvements constructed by the Subdivision — sidewalk, curb and gutter, streetlights, and frontage landscaping — are new improvements serving the development and are included. Second, the landscaping line includes the five-foot parkway strips fronting the residential lots, which will be maintained by the CFD to ensure a uniform streetscape. Third, no park site exists within Tract No. 6289; the park and open space category is budgeted at zero for the initial territory and retained in the authorized Services for territory annexed to the CFD in the future.
The multi-family estimate assumes approximately seventy-five (75) dwelling units on Lot 40 (4.85 acres); under the Rate and Method of Apportionment, multi-family property is taxed per dwelling unit actually permitted, and prior to development Lot 40 is subject to the Approved and Undeveloped Property rates, which fully secure the Special Tax Requirement in all interim conditions.
IV. SUFFICIENCY OF THE MAXIMUM SPECIAL TAX
The maximum special tax rates set forth in Table 1 of the Rate and Method of Apportionment (Exhibit "B" to Resolution No. 2026-33) are as follows:
Land Use Category Taxable Unit Maximum Special Tax (FY
2027-28)
Developed Property – Single-Family Residential Dwelling Unit $222 per Unit Developed Property – Multi-Family Residential Dwelling Unit $166 per Unit Developed Property – Non-Residential Acre $887 per Acre Approved Property Lot $222 per Lot
Undeveloped Property Acre $1,240 per Acre
At buildout (39 single-family units, approximately 75 multi-family units, and 3.52 non-residential acres), the revenue available at the maximum rates is $24,230 per year, which exceeds the $21,073.80 estimated annual Special Tax Requirement by approximately fifteen percent (15%). The maximum rates escalate each July 1, commencing July 1, 2028, by the greater of the change in CPI-U (West Region) or four percent (4%). The maximum special tax rates are therefore sufficient to fund the estimated costs of the Services, administration, and reserves at buildout and thereafter. The annual levy shall be set by the City Council each Fiscal Year at or below the maximum rates in accordance with the Rate and Method.
V. CERTIFICATION

Ordinance Levying a Special Tax
Community Facilities District No. 2026-1
Introduction / First Reading — October 14, 2026
Second Reading and Adoption — October 28, 2026
ORDINANCE NO. ___
AN ORDINANCE OF THE CITY OF ORANGE COVE, STATE OF CALIFORNIA,
LEVYING A SPECIAL TAX WITHIN COMMUNITY FACILITIES DISTRICT NO. 2026-1 (PUBLIC FACILITIES MAINTENANCE DISTRICT NO. 1) OF THE
CITY OF ORANGE COVE
WHEREAS, the City Council of the City of Orange Cove has established Community Facilities District No. 2026-1 (Public Facilities Maintenance District No. 1) of the City of Orange Cove (the "CFD") pursuant to the Mello-Roos Community Facilities Act of 1982, Government Code Section 53311 et seq. (the "Act"); and
WHEREAS, at a special landowner election held on October 14, 2026, more than two-thirds of the votes cast were in favor of the levy of the special tax within the CFD in accordance with the Rate and Method of Apportionment approved by the Resolution of Formation (the "Rate and Method").
THEREFORE, THE CITY OF ORANGE COVE CITY COUNCIL DOES ORDAIN as follows:
SECTION 1. Levy of Special Tax. A special tax is hereby levied within the CFD pursuant to Sections 53328 and 53340 of the Act, at the rates and in accordance with the Rate and Method, which is incorporated herein by reference. The special tax shall be levied each Fiscal Year, commencing Fiscal Year 2027-28, in perpetuity unless terminated by the City Council.
SECTION 2. Annual Levy. The City Council shall, by resolution adopted each Fiscal Year, determine the specific special tax rate to be levied for that Fiscal Year, which shall not exceed the maximum special tax set forth in the Rate and Method, and the Finance Director or designee is authorized to submit the levy to the Fresno County Auditor-Controller for collection on the secured tax roll.
SECTION 3. Collection. The special tax shall be collected in the same manner as ordinary ad valorem property taxes and shall be subject to the same penalties and the same procedure, sale, and lien priority in case of delinquency, provided that the City Council may provide for other appropriate methods of collection, including direct billing.
SECTION 4. Exemptions. Properties identified as exempt in the Rate and Method shall be exempt from the special tax.

REPORT TO THE CITY COUNCIL
To: Orange Cove City Council
From: Samuel A. Escobar, City Manager
Subject: Request for Council Direction on Proposed Ordinance No. 408, Adding Chapter 5.42 (Sidewalk Vending and Food Vendor Trailers) to Title 5 of the Orange Cove Municipal Code, Amending Section
5.12.080 (Confectionery Wagons), and Establishing the Orange Cove Food Vendor Trailer Business Incubation Program.
Attachments: Ordinance No. 408
RECOMMENDATION:
This item is presented for information only. Staff recommends that the City Council receive this report and direct staff regarding proposed Ordinance No. 408.
BACKGROUND:
In 2018, the California Legislature enacted Senate Bill 946, the Safe Sidewalk Vending Act (Government Code sections 51036 through 51039), which decriminalized sidewalk vending statewide and limits a city's ability to regulate sidewalk vendors to measures directly related to objective health, safety, or welfare concerns. State law has since been expanded by Senate Bill 972 (2022), which created the compact mobile food operation category under the California Retail Food Code, and Senate Bill 635 (2025), which prohibits cities from requiring or collecting criminal history, immigration status, place of birth, fingerprints, LifeScan, or background checks in connection with a vending permit.
Orange Cove's Municipal Code does not currently contain a chapter dedicated to sidewalk vending. The closest existing provision is Section 5.12.080 (Confectionery Wagons), last amended by Ordinance No. 384 on August 22, 2018, which restricts hours of operation and confines vendors to specified street frontages. Those restrictions were adopted before the Safe Sidewalk Vending Act took effect and are inconsistent with state law as applied to vendors in the public right-of-way. The proposed ordinance brings the Municipal Code into conformity with state law and establishes a separate program for food vendor trailers operating on private property.
Sidewalk Vending (Article II). The ordinance establishes an annual, nontransferable sidewalk vending permit for vendors operating in the public right-of-way and in City parks. Consistent with state law, the City may not cap the overall number of sidewalk vendors, require the consent of any private party, or collect prohibited personal information. Vendors must maintain a clear 48- inch pedestrian path, comply with the Americans with Disabilities Act, keep their location free of litter, display their City and County Health permits, and follow the hours permitted for other businesses on the same street. Stationary vendors may not operate in areas zoned exclusively residential, and roaming vendors in residential areas are limited to 8:00 a.m. to 8:00 p.m.
Violations are subject to administrative fines only, with an ability-to-pay process as required by Government Code section 51039.
Food Vendor Trailer Business Incubation Program (Article III). The ordinance establishes a time-limited business incubator that allows food vendor trailers to operate on private commercial property in the C-1, C-2, C-3, and M-1 zone districts, with the goal of helping new food businesses build the experience and capital needed to move into permanent commercial space in Orange Cove. Key provisions include: a required Fresno County Department of Public Health permit for every trailer; written, notarized consent from the host property owner; a limit of two trailers per parcel; a limit of three active permits citywide in each of fourteen food categories; a ranking preference for Orange Cove residents when applications exceed available permits; a 24-month, non-renewable permit term with one possible six-month extension for permittees moving into permanent space in the City; required business training; and graduation incentives, including a two-year waiver of the City business license fee.
Hours of Operation. Food vendor trailers may generally operate from 7:00 a.m. to 10:00 p.m. daily. Where the trailer's food category is also offered as a principal part of the menu of an established restaurant in the City, operation is limited to Wednesday through Sunday, 7:00 p.m. to 1:00 a.m. Trailers operating after 10:00 p.m. must be located at least 150 feet from residentially zoned property and must meet additional lighting, noise, and litter standards.
Other Provisions. The ordinance amends Section 5.12.080 so that confectionery wagons and similar vendors are governed by the new Chapter 5.42, establishes an appeal process to the City Manager and then to the City Council, and requires an annual program report to the City Council each July. The City Attorney has identified the Orange Cove resident preference and the restricted hours provision as the sections most likely to draw a legal challenge; the ordinance includes severability language so that the remainder of the chapter would remain in effect if either provision were found invalid.
Staff is presenting the draft ordinance for the Council's review and is requesting direction on the following policy questions before the ordinance is scheduled for a public hearing and first reading: whether food vendor trailers should be permitted in the M-1 (light manufacturing) district or in commercial districts only; whether the Council wishes to set a citywide total cap on food vendor trailer permits, and at what number; whether to retain the Orange Cove resident preference as drafted or limit it to a tiebreaker; whether to retain the restricted hours for food categories served by established restaurants, including the 150-foot separation from residential zoning; and the structure of application, permit, and appeal fees, including any reduced fee tier.
FISCAL IMPACT:
Application, permit, and appeal fees will be established by separate resolution of the City Council and may not exceed the reasonable cost of administering the program. The two-year business license fee waiver for program graduates who move into permanent commercial space in the City would result in a minor reduction in business license revenue.
CONFLICT OF INTEREST:
None.

ORDINANCE NO. 408
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE COVE, CALIFORNIA, ADDING CHAPTER 5.42 (SIDEWALK VENDING AND FOOD VENDOR TRAILERS) TO TITLE 5 OF THE ORANGE COVE MUNICIPAL CODE, AMENDING SECTION 5.12.080 (CONFECTIONERY WAGONS), AND
ESTABLISHING THE ORANGE COVE FOOD VENDOR TRAILER BUSINESS
INCUBATION PROGRAM
THE CITY COUNCIL OF THE CITY OF ORANGE COVE DOES ORDAIN AS FOLLOWS:
RECITALS
WHEREAS, in 2018 the California Legislature enacted Senate Bill 946, the Safe Sidewalk Vending Act (Government Code sections 51036 through 51039), which decriminalized sidewalk vending statewide and sharply limited the authority of cities to prohibit or restrict sidewalk vendors operating in the public right-of-way; and
WHEREAS, Government Code section 51038 provides that a local authority may regulate sidewalk vending only in a manner directly related to objective health, safety, or welfare concerns, and section 51038(e) expressly provides that “perceived community animus or economic competition does not constitute an objective health, safety, or welfare concern”; and WHEREAS, in 2022 the Legislature enacted Senate Bill 972, which amended the California Retail Food Code (Health and Safety Code section 113700 et seq.) to create the “compact mobile food operation” category and to broaden access to county health permits for small food vendors; and WHEREAS, in 2025 the Legislature enacted Senate Bill 635, effective October 7, 2025, which further limited local enforcement against food vendors, prohibited local authorities from requiring or collecting criminal history, immigration status, place of birth, fingerprints, LiveScan, or background checks in connection with a vending permit, restricted disclosure of vendor information, and required destruction of certain previously collected records; and WHEREAS, Section 5.12.080 of the Orange Cove Municipal Code, as last amended by Ordinance No. 384 on August 22, 2018, regulates “confectionery wagons, push carts or other vehicles” by restricting hours of operation and confining such businesses to specified street frontages and to private property with the written consent of the property owner, and those restrictions were adopted before the Safe Sidewalk Vending Act took effect and are inconsistent with it as applied to sidewalk vendors in the public right-of-way; and
Ordinance No. ____ — Page 2 of 23
WHEREAS, the City Council desires to bring the Orange Cove Municipal Code into conformity with state law governing sidewalk vending; and
WHEREAS, mobile food facilities that operate from a stationary position on private commercial property are not “sidewalk vendors” within the meaning of Government Code section 51036, and the City retains its ordinary zoning and police power authority to regulate the time, place, and manner of such uses; and
WHEREAS, the Fresno County Department of Public Health, Environmental Health Division, is the local enforcement agency responsible under the California Retail Food Code for plan review, permitting, and inspection of mobile food facilities, mobile food preparation units, and compact mobile food operations within the City of Orange Cove, and no food vendor should be permitted to operate in the City without that agency’s approval; and WHEREAS, the City Council finds that a significant number of Orange Cove residents seek to enter the food service industry but lack the capital, credit history, and operating experience necessary to lease or purchase a permanent commercial kitchen, and that a structured, time-limited food vendor trailer program can serve as a business incubator that moves those entrepreneurs toward permanent commercial tenancy within the City; and WHEREAS, the City Council further finds that Orange Cove has a limited inventory of commercially zoned land, a constrained street and parking network, and a downtown core in which commercial parcels adjoin residential neighborhoods, and that objective standards governing the number, siting, hours, lighting, noise, waste disposal, sanitation, circulation, emergency access, and accessibility of food vendor trailers are necessary to protect the public health, safety, and welfare and to ensure orderly land use; and
WHEREAS, the City Council finds that concentrating multiple food vendor trailers offering substantially identical products at scattered private sites places cumulative demands on parking, refuse collection, code enforcement, and public safety resources that the City cannot absorb, and that a reasonable numerical limit by food category is necessary to manage those cumulative impacts; and
WHEREAS, a duly noticed public hearing was held before the Planning Commission on ______________, 20___, and before the City Council on ______________, 20___, at which times all interested persons were given an opportunity to be heard; and WHEREAS, the City Council finds that the adoption of this Ordinance is exempt from the California Environmental Quality Act (“CEQA”) under CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of regulatory standards for vending activity may have a significant effect on the environment, and further under CEQA Guidelines sections 15301 and 15305 as applicable.

E. A written consent from the host property owner in the form required by Section 5.42.260; F. A site plan, drawn to scale, showing the parcel boundaries, existing buildings, the proposed location and dimensions of the trailer, all drive aisles, parking spaces, accessible parking and paths of travel, fire lanes, fire hydrants, trash enclosures, the location of the required toilet and handwashing facilities, the location of any proposed seating, lighting, and signage, and the distance to the nearest residentially zoned property; G. Proof of insurance meeting the requirements of Section 5.42.290; Ordinance No. ____ — Page 10 of 23
H. A business plan on a form provided by the City, including projected hours, staffing, startup costs, and a written statement of the applicant’s plan and timeline for transitioning into permanent commercial space in the City of Orange Cove;
I. Documentation supporting any preference claimed under Section 5.42.270; and J. The application fee established by resolution of the City Council.
The City shall not require, request, collect, or consider an applicant’s criminal history, immigration status, citizenship, or place of birth, and shall not require fingerprinting, LiveScan, or any background check in connection with an application under this article.
5.42.240 — Total number of permits; waiting list.
A. The City Council may, by resolution, establish a maximum total number of food vendor trailer permits that may be active in the City at any one time, based on the City’s administrative, code enforcement, and public safety capacity.
B. When the limit established by Section 5.42.250 or by resolution under subsection A of this section has been reached, the Director shall maintain a waiting list of complete applications, ordered as provided in Section 5.42.270. As a permit expires or is revoked, the Director shall offer the resulting opening to the highest-ranked eligible applicant on the waiting list for the affected food category.
5.42.250 — Limitation on the number of permits by food category.
A. Not more than three (3) food vendor trailer permits shall be active at any one time within any single food category. This limit applies citywide.
B. The food categories are:
1. Tacos, burritos, tortas, quesadillas, and other Mexican-style prepared foods;
2. Birria, barbacoa, menudo, pozole, and other braised, stewed, or slow-cooked meat specialties;
3. Hamburgers, hot sandwiches, fries, and other American-style grill items;
4. Hot dogs, bacon-wrapped hot dogs, and sausages;
5. Pizza and other Italian-style prepared foods;
6. Chinese, Japanese, Thai, Vietnamese, Filipino, Korean, and other Asian-style prepared foods;
7. Seafood and mariscos;
Ordinance No. ____ — Page 11 of 23
8. Barbecue and smoked meats;
9. Fried chicken, wings, and other poultry specialties;
10. Ice cream, paletas, raspados, shaved ice, and frozen desserts;
11. Bakery goods, churros, pastries, and other desserts;
12. Coffee, aguas frescas, juices, smoothies, and other beverages;
13. Elotes, esquites, fresh fruit, chips, and other snacks; and
14. Any prepared food not described in subdivisions 1 through 13.
C. The Director shall assign each application to a single food category based on the items that constitute the predominant share of the proposed menu. Where a menu spans more than one category, the Director shall assign the category that best describes the applicant’s principal offering, and the permit shall count against that category only.
D. A permittee shall not materially change the assigned category of the permitted menu without the prior written approval of the Director. Approval shall be denied if the category to which the permittee seeks to move is at its limit.
E. A determination of food category under this section may be appealed as provided in Section
5.42.420.
F. The City Council may, by resolution, adjust the list of food categories in subsection B of this section to reflect changes in the local market, without amendment of this chapter.
5.42.260 — Host property owner consent; site control.
A. Every application shall include the written, notarized consent of the host property owner, on a City form, which shall: identify the parcel and the specific location on the parcel; state the term of the authorization, which shall be at least twelve (12) months; acknowledge the owner’s obligation to maintain the site, the required parking, the accessible path of travel, and the required toilet and handwashing facilities; and acknowledge that the owner may be subject to code enforcement for violations occurring on the parcel.
B. The consent shall be filed with the City and shall remain on file for the duration of the permit. Withdrawal of consent by the host property owner shall suspend the permit as to that location. A permittee whose consent is withdrawn may apply to the Director to relocate to another eligible site, and the permit term shall continue to run during any period of relocation.
C. Nothing in this section requires the consent of any nongovernmental party as a condition of a sidewalk vending permit under Article II.
Ordinance No. ____ — Page 12 of 23
5.42.270 — Ranking of applications; Orange Cove resident preference.
A. Where the number of complete, eligible applications within a food category exceeds the number of available permits in that category, the Director shall rank the applications in the following order of preference:
1. First preference: an applicant whose principal residence has been located within the City of Orange Cove for at least the twelve (12) consecutive months immediately preceding the date of the complete application, and who will personally operate the food vendor trailer;
2. Second preference: an applicant whose principal residence is located within the City of Orange Cove on the date of the complete application, or whose principal place of business is located within the City of Orange Cove;
3. Third preference: all other applicants.
B. Within each preference tier, applications shall be ranked by the date and time the complete application was received. Applications received on the same date shall be ranked by public lottery conducted by the City Clerk.
C. The preference established by this section is a ranking preference only. It does not disqualify any person from applying for, or holding, a permit under this article, and it does not apply where the number of complete, eligible applications in a food category does not exceed the number of available permits.
D. If subsection A of this section is held invalid or unenforceable by a court of competent jurisdiction, applications shall be ranked solely as provided in subsection B, and the remainder of this chapter shall continue in full force and effect.
5.42.280 — Hours of operation.
A. Standard hours. Except as provided in subsection B of this section, a food vendor trailer may operate between 7:00 a.m. and 10:00 p.m. daily.
B. Restricted hours where the food category is served by an established restaurant. Where the Director determines that the food category assigned to a permit under Section 5.42.250 is also offered as a principal part of the menu of one or more established restaurants located in the City, the permit shall authorize operation only on Wednesday, Thursday, Friday, Saturday, and Sunday, between the hours of 7:00 p.m. and 1:00 a.m.
C. Determination and review. The Director shall make the determination required by subsection B at the time of permit issuance, shall state the basis for the determination in writing, and shall identify each established restaurant relied upon. The determination shall be reviewed annually on the anniversary of permit issuance, and upon the written request Ordinance No. ____ — Page 13 of 23
of a permittee following the closure of an established restaurant relied upon in the determination. If no established restaurant in the City offers the applicable food category as a principal part of its menu, the permit shall be modified to authorize the standard hours in subsection A. A determination under this subsection may be appealed as provided in Section 5.42.420.
D. Late-night siting and operating standards. A food vendor trailer authorized to operate after 10:00 p.m. shall:
1. Be located on a parcel no portion of the operating area of which is within one hundred fifty (150) feet of any residentially zoned property;
2. Provide site lighting of not less than one (1) foot-candle, maintained at the customer queuing and service area, directed downward and shielded so as not to spill onto adjoining property;
3. Not use amplified sound at any time, and not operate a generator that exceeds the nighttime noise standards of Chapter 12.08 measured at the nearest property line;
4. Provide and maintain a covered trash receptacle within twenty (20) feet of the service window, and police the host property and the abutting public right-of-way for litter at the close of each operating period; and
5. Cease all sales, close the service window, and extinguish all cooking equipment no later than 1:00 a.m., and complete all cleanup and vacate the customer service area no later than 1:30 a.m.
E. In no event shall a food vendor trailer operate during hours prohibited by the County Health Department permit, by the terms of the host property owner’s written consent, or by a conditional use permit applicable to the host property.
5.42.290 — Operating and site standards.
Every food vendor trailer permitted under this article shall comply with the following:
A. Location on site. The trailer, its service window queuing area, and any ancillary equipment shall not obstruct any drive aisle, fire lane, fire hydrant, fire department connection, required exit, accessible parking space, or accessible path of travel, and shall be separated from buildings and other units as required by the California Fire Code as adopted by the City.
B. Parking. The operation shall not reduce the number of off-street parking spaces available to the host property below the minimum required by Title 17 for the uses on that parcel. The Director may allow the use of not more than two (2) spaces, or ten percent (10%) of the on-site spaces, whichever is greater, where the host property has a documented surplus.
Ordinance No. ____ — Page 14 of 23
C. Restrooms. Toilet and handwashing facilities meeting the requirements of Health and Safety Code section 114315 shall be available to employees within two hundred (200) feet travel distance of the trailer at all times during operation, and the permittee shall provide written authorization from the party controlling those facilities.
D. Waste. All liquid waste, grease, and wastewater shall be retained on the unit and disposed of at an approved commissary. No liquid waste, grease, ice, or wash water shall be discharged onto the ground, into a gutter, or into a storm drain. Solid waste and recyclables shall be collected in covered receptacles and removed daily; the permittee shall not use the host property’s trash enclosure without the written consent of the host property owner.
E. Utilities. Electrical service shall be provided by an on-board generator or by a permanent, code-compliant connection installed under a City electrical permit. Extension cords and hoses shall not cross a pedestrian path of travel or drive aisle unless protected by an approved cord cover ramp.
F. Seating and structures. No permanent structure, foundation, deck, canopy, fence, or enclosure shall be constructed in connection with a food vendor trailer. Portable tables, chairs, and umbrellas may be provided only where shown on the approved site plan and only where they do not reduce required parking or obstruct circulation.
G. Alcohol. No alcoholic beverage shall be sold, served, or consumed in connection with a food vendor trailer.
H. Mobility. The trailer shall remain fully operable and capable of being moved under its own power or by tow at all times. Wheels shall not be removed and the unit shall not be permanently affixed to the ground. The unit shall be removed from the host property, or relocated to an approved storage or commissary location, in accordance with County Health Department requirements and, where the host property is within one hundred fifty (150) feet of residentially zoned property, at the close of each operating period.
I. Display of permits. The City permit, the County Health Department permit, and the City business license shall be displayed so as to be visible to the public at all times during operation.
J. Conduct. The permittee shall not obstruct the sidewalk or street, shall not use amplified sound, flashing lights, or attention-getting devices, and shall be responsible for the orderly conduct of patrons within the customer service area.
5.42.300 — Signage.
A. Signage shall be limited to signage affixed to the body of the trailer, plus one (1) freestanding portable sign not exceeding six (6) square feet in area and four (4) feet in height, placed on the host property and removed at the close of each operating period.
Ordinance No. ____ — Page 15 of 23
B. No banner, feather flag, inflatable device, off-site sign, or sign placed in the public right-ofway is permitted.
C. Menu boards and prices shall be posted in a manner legible from the customer queuing area.
5.42.310 — Term; non-renewability; graduation.
A. Term. A food vendor trailer permit shall be valid for a term of twenty-four (24) consecutive months from the date of issuance. The term runs continuously and is not tolled by periods of nonoperation, seasonal closure, relocation, or suspension.
B. Non-renewable. A food vendor trailer permit shall not be renewed or extended, except as provided in subsection C of this section.
C. Transition extension. Upon written application filed not later than sixty (60) days before expiration, the City Manager may grant one (1) extension of not more than six (6) months where the permittee demonstrates, by an executed lease, purchase agreement, or accepted building permit application, that the permittee will occupy permanent commercial space within the City of Orange Cove. No more than one extension shall be granted.
D. One permit per operator. No person, and no entity in which a person holds a controlling interest, shall hold more than one food vendor trailer permit at a time, or shall be issued a new permit within twenty-four (24) months after the expiration or revocation of a prior permit. The City Council may waive this subsection for good cause shown.
E. Incubation requirements. As a condition of the permit, the permittee shall:
1. Complete not less than eight (8) hours per permit year of business technical assistance, financial literacy, or food-business training through a provider approved by the Director, and file proof of completion with the City;
2. Meet with City staff at approximately the twelfth (12th) and twentieth (20th) months of the permit term to review the permittee’s transition plan; and
3. Maintain and produce, on request, records sufficient to demonstrate compliance with this chapter.
F. Graduation incentives. A permittee that occupies permanent commercial space within the City of Orange Cove during, or within twelve (12) months after, the permit term shall be entitled to:
1. Waiver of the City business license fee for the first two (2) years of operation in that space;
Ordinance No. ____ — Page 16 of 23
2. Expedited plan review and inspection scheduling by the City to the extent consistent with law; and
3. Priority consideration for any City small-business assistance, façade improvement, or economic development program for which the business is otherwise eligible.
5.42.320 — Insurance and indemnification.
A. The permittee shall maintain commercial general liability insurance of not less than one million dollars ($1,000,000) per occurrence and two million dollars ($2,000,000) aggregate, and automobile liability insurance of not less than one million dollars ($1,000,000) combined single limit, together with workers’ compensation insurance where required by law. The City, its officers, officials, employees, and agents shall be named as additional insureds on the general liability and automobile policies.
B. The permittee shall provide the City with certificates of insurance and additional insured endorsements before the permit is issued, and shall provide the City with not less than thirty (30) days’ written notice of cancellation or material change.
C. The permittee shall defend, indemnify, and hold harmless the City, its officers, officials, employees, and agents from and against any and all claims, damages, liabilities, and costs, including reasonable attorneys’ fees, arising out of or in connection with the permitted operation, except to the extent caused by the sole negligence or willful misconduct of the City.
5.42.330 — Permit not transferable.
A food vendor trailer permit is personal to the permittee and to the unit identified in the permit. It shall not be sold, assigned, leased, subleased, or otherwise transferred, and any attempted transfer is void and shall be grounds for revocation. A change in the unit, in the ownership of the permittee entity, or in the host property location requires the prior written approval of the Director; approval of a change in location or unit does not extend the permit term.
5.42.340 — Annual report to the City Council.
Not later than the second regular meeting in July of each year, the Director shall report to the City Council on the operation of the Program, including the number of permits issued by food category, the number of applications on the waiting list, the number of permittees that transitioned into permanent commercial space in the City, code enforcement activity, and any recommended amendments to this chapter.
Article IV. Enforcement
5.42.400 — Enforcement — sidewalk vending.
Ordinance No. ____ — Page 17 of 23
A. A violation of Article II of this chapter is punishable only by an administrative fine and shall not be punishable as an infraction or misdemeanor. No person alleged to have violated Article II shall be subject to arrest except as permitted by law.
B. Administrative fines for vending in violation of Article II by a person who holds a sidewalk vending permit shall not exceed: one hundred dollars ($100) for a first violation; two hundred dollars ($200) for a second violation within one year of the first; and five hundred dollars ($500) for each additional violation within one year of the first.
C. Administrative fines for vending without a required sidewalk vending permit shall not exceed: two hundred fifty dollars ($250) for a first violation; five hundred dollars ($500) for a second violation within one year of the first; and one thousand dollars ($1,000) for each additional violation within one year of the first. Upon proof that the vendor has obtained the required permit, these amounts shall be reduced to the amounts in subsection B.
D. The City shall provide the person with notice of the right to request an ability-to-pay determination, and shall accept and consider that request at any stage of the proceedings, including after referral to collections. Where the person is receiving public benefits or has an income at or below two hundred fifty percent (250%) of the federal poverty level, the City shall reduce the total amount due, allow payment over time, allow completion of community service in lieu of payment, or waive the fine, as provided by Government Code section 51039.
E. The City shall not require a sidewalk vendor to surrender a permit, and shall not deny, suspend, or revoke a permit, based on the failure to pay an administrative fine, except as permitted by state law. Failure to pay a fine shall not be punishable as an infraction or misdemeanor.
F. This section shall be interpreted and applied consistently with Government Code section 51039 as it may be amended.
5.42.410 — Enforcement — food vendor trailers.
A. A violation of Article III of this chapter is subject to the administrative citation and penalty provisions of Title 1 of this code, to permit suspension or revocation, and to any other remedy available at law or in equity, including abatement as a public nuisance.
B. Each day a violation continues constitutes a separate violation.
C. Operation of a food vendor trailer without a valid County Health Department permit, or after suspension of the City permit, is declared a public nuisance and may be summarily abated where necessary to protect the public health.
Ordinance No. ____ — Page 18 of 23
D. The host property owner and the permittee are jointly responsible for compliance with the site standards of Section 5.42.290 as to conditions on the host property.
5.42.420 — Denial, suspension, revocation, and appeals.
A. The Director may deny an application, or suspend or revoke a permit issued under this chapter, upon a finding that: the application contains a material misstatement; the permittee has failed to maintain a required County Health Department permit, business license, or insurance; the permittee has violated this chapter, a condition of the permit, or applicable state law; or, as to Article III only, the operation constitutes a public nuisance or a demonstrated threat to public health or safety.
B. Written notice of a denial, suspension, or revocation shall be served on the applicant or permittee, shall state the reasons and the effective date, and shall state the right to appeal.
C. An applicant or permittee may appeal a determination of the Director, including a food category determination under Section 5.42.250 and an hours determination under Section
5.42.280, by filing a written appeal with the City Clerk, together with any appeal fee set by resolution, within ten (10) calendar days of service of the notice. The City Manager shall hear the appeal within thirty (30) days and shall issue a written decision.
D. The decision of the City Manager may be appealed to the City Council by written appeal filed with the City Clerk within ten (10) calendar days of service of the City Manager’s decision. The decision of the City Council is final.
E. The time within which judicial review of a final decision under this chapter must be sought is governed by Code of Civil Procedure section 1094.6.
5.42.430 — Fees.
All fees under this chapter shall be established by resolution of the City Council and shall not exceed the reasonable cost of administering this chapter. The City Council may establish reduced or waived fees for applicants whose income is at or below two hundred fifty percent (250%) of the federal poverty level.
SECTION 3. SECTION 5.12.080 AMENDED.
Section 5.12.080 of the Orange Cove Municipal Code is hereby amended to read in full as follows:
5.12.080 — Confectionery wagons.
Confectionery wagons, push carts, or other vehicles used for the sale or offering of ice cream, soft drinks, candies, prepared foodstuffs, or other foods for immediate consumption shall pay a license tax as specified in Section 5.16.330. The operation Ordinance No. ____ — Page 19 of 23
of any such business shall be governed exclusively by Chapter 5.42 of this code, and to the extent of any conflict between this section and Chapter 5.42, Chapter
5.42 controls.
SECTION 4. CEQA.
The City Council finds that this Ordinance is exempt from the California Environmental Quality Act pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of this Ordinance may have a significant effect on the environment. The City Clerk is directed to file a Notice of Exemption with the Fresno County Clerk within five (5) days of adoption.
SECTION 5. SEVERABILITY.
If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unenforceable by a court of competent jurisdiction, that portion shall be deemed a separate, distinct, and independent provision, and the holding shall not affect the validity of the remaining portions. The City Council declares that it would have adopted this Ordinance, and each section, subsection, sentence, clause, phrase, and portion thereof, irrespective of the fact that any one or more portions be declared invalid or unenforceable. This declaration applies with particular force to Sections 5.42.250, 5.42.270, and 5.42.280, each of which the City Council intends to be severable from the other and from the remainder of this Ordinance.
SECTION 6. EFFECTIVE DATE AND PUBLICATION.
This Ordinance shall take effect thirty (30) days after its adoption. The City Clerk shall certify to the adoption of this Ordinance and shall cause it to be published or posted as required by Government Code section 36933.

DRAFTING NOTES — NOT PART OF THE ORDINANCE
These notes are provided for staff and the City Attorney. Delete this page before the Ordinance is placed on an agenda.
1. Source of the existing law.
The Orange Cove Municipal Code on Municode is codified only through Ordinance No. 390 (May 11, 2022), Supplement 16. The City has no chapter dedicated to sidewalk vending. The closest existing provision is Section 5.12.080 (Confectionery wagons), last amended by Ordinance No. 384 on August 22, 2018 — four months before the Safe Sidewalk Vending Act took effect. Staff should confirm that no later, uncodified ordinance on street or mobile vending has been adopted since May 2022; if one exists, it should be reconciled with or repealed by this Ordinance.
2. Why sidewalk vendors and food vendor trailers are in separate articles.
State law treats the two very differently. Government Code section 51038 forbids a city from capping the number of sidewalk vendors, from requiring private-party consent, from confining vendors to particular streets, and from imposing hours in nonresidential areas that are more restrictive than those imposed on other businesses on the same street. None of those limits apply to a mobile food facility operating from a stationary position on private property, which the City may regulate under its ordinary zoning and police power. Keeping the two regimes in separate articles, with the sidewalk vending article expressly subordinated to state law, is what allows the Council’s policy choices in Article III to stand. Applying the Article III standards to sidewalk vendors in the right-of-way would be preempted.
3. The three-per-food-category cap (Section 5.42.250).
The cap is drafted to apply only to food vendor trailers on private property, where a numerical limit is a conventional land use tool. Two points for the City Attorney: first, the ordinance ties the cap to cumulative impacts on parking, refuse, code enforcement, and public safety capacity rather than to market saturation, because a record built on competition is a weaker record; second, “similar types of food” needed a definition that a hearing officer can apply, so the draft supplies a fourteen-category list with a Director determination and an appeal. Expect the category assignment to be the most litigated administrative decision in the program. The list is adjustable by resolution so the Council can respond without a code amendment.
4. Orange Cove resident preference (Section 5.42.270) — legal risk.
A durational residency preference in the issuance of a business permit is the provision most likely to draw a challenge. Preferences of this kind have been attacked under the Privileges and Immunities Clause of Article IV, the dormant Commerce Clause, and equal protection, and a twelve-month durational element strengthens a challenger’s argument. The draft mitigates the exposure three ways: the preference is a ranking preference that never bars a nonresident from holding a permit; it operates only when applications exceed available permits; and subsection D Ordinance No. ____ — Page 22 of 23
provides that if the preference falls, applications are ranked by filing date and lottery and the rest of the chapter survives. If the Council wants a more conservative posture, the safest version drops subsection A(1) and uses current residency as a tiebreaker only. The City Attorney should make the final call.
5. Restricted hours where a brick-and-mortar serves the same food (Section 5.42.280) — legal risk.
This is the second exposure, and it is the one that most needs careful handling of the record.
Government Code section 51038(e) states that “perceived community animus or economic competition does not constitute an objective health, safety, or welfare concern.” That sentence governs sidewalk vendors, not private-property mobile food facilities, so it does not directly control Article III — but a court asked to review Article III will read the City’s own findings, and a record showing the purpose was to shield existing restaurants from competition invites a challenge on due process and equal protection grounds. For that reason the recitals and this section are written in land use terms — hours, siting, noise, lighting, litter, and compatibility with adjoining residential property — and the words “competition” and “protect existing restaurants” appear nowhere in the operative text. Staff and Council members should be advised to keep hearing testimony framed the same way.
Two practical points. First, a 7:00 p.m. to 1:00 a.m. Wednesday-through-Sunday window is a latenight operation, which brings its own noise, lighting, security, and litter concerns; Section
5.42.280(D) addresses them, including a 150-foot separation from residential zoning that will materially narrow the eligible sites in Orange Cove. Staff should map the C-1, C-2, C-3, and M-1 parcels that actually satisfy that separation before the hearing — if the number is very small, the Council may want to reduce the separation or shift the closing time earlier. Second, the restriction is a real hardship for a breakfast or lunch concept, and most taco, birria, and elote businesses in the Valley earn a large share of their revenue at midday. The Council may want to consider allowing a restricted-hours permittee to also operate a weekend daytime window, or to seek a waiver where the established restaurant relied upon is closed during the requested hours.
6. Two-year non-renewable term (Section 5.42.310).
A fixed, non-renewable term is defensible so long as the ordinance says clearly that no vested right or expectation of renewal attaches, which Section 5.42.200(C) does. The draft adds a single sixmonth transition extension tied to an executed lease or purchase agreement, and a set of graduation incentives, because an incubator that only takes something away at the end of twenty-four months will not produce brick-and-mortar tenancies. Staff should confirm the City can absorb the business license fee waiver in Section 5.42.310(F)(1).
7. Items to confirm before the hearing.
A. Whether the City wants food vendor trailers permitted in the M-1 district, which the draft allows, or in commercial districts only.
Ordinance No. ____ — Page 23 of 23
B. Whether the Council wants a citywide total cap under Section 5.42.240(A), and at what number.
C. The fee resolution: application fee, annual fee, appeal fee, and any reduced-fee tier.
D. Whether Chapter 12.08 (Noise) sets a numeric nighttime standard the ordinance can cite; if it does not, insert an express decibel limit in Section 5.42.280(D)(3).
E. Whether Section 5.12.200 (Sidewalk sales), which requires five million dollars in liability insurance, should be conformed to the one-million-dollar standard used here.
F. Whether the City wishes to add a school-proximity standard; any such standard must rest on an objective safety rationale.
G. Coordination with the Fresno County Department of Public Health, Environmental Health Division, on referral and information-sharing so the City learns promptly of a suspended county permit.

Approval to purchase water treatment filter media
ERS Industrial Services Inc. Quote
RECOMMENDATION:
Staff recommends that the City Council approve a sole source purchase in the amount of $33,790.00 from ERS Industrial Services, Inc. for the purchase and installation of replacement filter media for the City's water treatment facility filters.
BACKGROUND:
The City's Water Treatment Facility relies on treatment filters to properly filter and treat the City's drinking water before it is delivered to customers.
During inspection of the treatment filters, staff determined that six (6) filters have lost approximately five (5) inches of filter media. The loss of media has reduced the depth of material available for proper filtration and could affect the performance and effectiveness of the treatment process.
Maintaining the proper level and depth of filter media is critical to the operation of the City's water treatment facility. Operating the filters without the proper amount of media could result in reduced treatment effectiveness, increased operational problems, and potential impacts to the City's ability to consistently produce properly treated water.
ERS Industrial Services, Inc. has provided the City with a proposal in the amount of $33,790.00 to furnish and install the required filter media.

Ordinance Amendment-Public Nuisance Code
Regulations for Storage of Portable Toilets
Ordinance No 409
RECOMMENDATION:
1) Staff recommends that the City Council introduces and waives the first reading of Ordinance No. 409 amending Title 7, Chapter 7.27.403 - Nuisances.
BACKGROUND:
City staff have received several complaints regarding the storage of portable toilets and farm or commercial equipment and large empty trailers in residential neighborhoods. The property owners have concerns of leaking toilets, odor and view obstruction(s), similarly the parking and storage of farm equipment and large trailers. The city's current public nuisance ordinance does regulate the storage of portable toilets in residential districts. The goal of the proposed ordinance amendment is to establish enforceable regulations by declaring the storage of portable toilets on public streets in residential districts a public nuisance.
With an adopted amendment regulating storge of portable toilets, city code enforcement staff can have the authority under the public nuisance ordinance to fine and abate the nuisance. The ordinance amendment will add the following to Section 7.27.403:
1) Section 7.27.403(0) - It shall be unlawful for any person to park or store any vehicle with or without a trailer that transports portable outdoor toilets on any residential property or street. 2) Section 7.27.403(M) - It shall be unlawful for any person to park, place, keep or maintain farm equipment or large commercial vehicles any residential street. 3) Section 7.27.404(N)- Notwithstanding Section 7.27.403(M) it is lawful for any person to park or detach a utility trailer no longer than twenty-four hours with a maximum of fortyeight hours for any lawful purpose adjacent to the right-of-w
1 of ay where the ut2 ility trailer is parked with an approved city issued parking permit and a fee establish by city resolution. For the purposes of this section, the term "adjacent to" shall mean, on the street, in front of the real property that the trailer is parked and permitted trailers with open or boxed trailers when associated with a commercial landscape, concrete and construction uses or business.
ENVIRONMENTAL REVIEW:
Adoption of Ordinance No. 409 consists of changes to admirative procedures and does not authorize any development or physical changes. Accordingly, it has no potential to significantly affect the environment and is therefore not subject to CEQA as indicated in CEQA Guidelines Section 15061(b)(3).
