Good Afternoon Randy,
With this email, effective today, I am memorializing City of Orinda staff’s ministerial approval of the attached Tentative Parcel Map for 6 Patrick Lane. This Tentative Parcel Map is being approved ministerially in compliance with Senate Bill (SB) 9 as well as the Subdivision Map Act, the City of Orinda Municipal Code, and all applicable objective standards. Because all applicable standards were met, City staff determined they have no discretion under State Law to deny this SB9 lot split. The record before City staff does not establish that the scenic easement offered on the subdivision map was accepted by the City as to 6 Patrick. Therefore, that scenic easement offered on the subdivision map is not a reason to deny the 6 Patrick SB9 lot split. The City is not taking any position regarding whether the scenic easement would qualify as a conservation easement under SB9, if that easement had been accepted.

Likewise, in approving this SB9 lot split, the City is taking no position on the existence or absence of any private rights or responsibilities, as the City does not adjudicate private legal rights. Finally, as you know and the public record makes clear, portions of 6 Patrick consist of steep slopes and areas of potential geologic instability. While City staff have determined we must approve the SB9 lot split ministerially, we wish to flag for the applicant and other interested parties that future development may be challenging.

Any potential purchasers should carefully review the full public record.

Approval of this Tentative Parcel Map is subject to the following conditions:
•                     The Final Parcel Map presented for approval must include this updated language: “A 2- LOT SUBDIVISION (SB-9 URBAN LOT SPLIT) OF THE LANDS DESCRIBED IN THAT CERTAIN GRANT DEED TO 63 HOLDINGS TRUST, DATED JUNE 18, 2020, RECORDED ON JUNE 17, 2021, AS DOC No. 2021-0175963, RECORDS OF CONTRA COSTA COUNTY; SAID LANDS BEING MORE PARTICULARLY DESCRIBED AS LOT 3 OF “SUBDIVISION 5592”, FILED FOR RECORD JANUARY 28, 1986, IN BOOK 298 OF MAPS AT PAGES 32, RECORDS OF CONTRA COSTA COUNTY”
•                     When presenting the Final Parcel Map for approval, the applicant shall include closure calculations, supporting documents and a current title report, as listed in the SB 9 Lot Split application.
•                     When presenting the Final Parcel Map approval, the applicant shall provide a tax letter stating all liens have been paid.
•                     This approval is limited to the SB9 lot split and does not include approval of any proposed structures. The applicant shall obtain the required permits for any proposed structures.

In addition, please note the MOFD requirements as stated in the Moraga-Orinda Fire Final Fire Review Letter, signed by Fire Marshal, Jeff Isaacs on 06/29/2023 that you provided (attached). You are also subject to MOFD requirements.

As you know, the next step in the lot split process is for the City to review, and for you to obtain an F.9.c
Packet Pg. 172 Attachment: Attachment C: September 26, 2023 Tentative Parcel Map approval email (3345 : Approving 6 Patrick Lane Urban Lot Split Parcel approval of, the Final Parcel Map. The Final Parcel Map is reviewed and processed by the Public Works Department, and typically appears on the City Council consent calendar. Per the State of California Subdivision Map Act, the Council’s role is limited (e.g., confirming consistency with the approved Tentative Parcel Map and compliance with any associated conditions). The Final Parcel Map needs to be approved prior to the expiration of the Tentative Parcel Map. The expiration of the Tentative Parcel Map is governed by the State of California Subdivision Map Act.

AGENDA TITLE: Public Hearing to Confirm the Diagram and Assessment for the Orinda Street Lighting and Landscape Assessment District No. 1986-1 Zones L-42, M-9 and M-11 for Fiscal Year Ending June 30, 2025
RECOMMENDATION:

Open the Public Hearing, receive public testimony, close the Public Hearing and consider adoption of Resolution 18-24, Confirming the Diagram and Assessment for the Orinda Street Lighting and Landscape Assessment District No. 1986-1, Zones L-42, M9 and M-11 for Fiscal Year Ending June 30, 2025.

BACKGROUND:

The Orinda Street Lighting and Landscape Assessment District No. 1986-1 “District” consists of three distinct zones of benefit. These zones are former County Service Areas. The current District was created upon incorporation to continue similar services. • The L-42 Zone finances the cost of residential street lighting within four neighborhoods in South Orinda. These neighborhoods are:
o Tahos Road from just north of Bates Blvd to the south cul-de-sac including Bates Court, Silverwood Court, and Oakridge Court: Meadow View Road from Meadow Lane to the north cul-de-sac
o Valley Drive from Heather Lane to south of Valley court o Courtney Lane
o Martha Road and Catherine court (cul-de-sac sections of both streets) • The M-9 Zone finances the cost of residential street lighting in the Orinda Downs area along the following streets:

Dalewood Drive Amber Valley Sundown Terrace
Redcoach Lane Singingwood Lane Silver Oak Terrace
Coachwood Terrace Fallen Leaf Terrace Happy Valley Road • The M-11 Zone is comprised of commercial properties in the Village and Theatre (Crossroads) Districts and finances the cost of part or all of the following services:
o street lighting
o street sweeping
o litter pickup
o landscape maintenance (median islands, right-of-way, and mini-parks) o water and electric utilities for landscaping (water, electrical irrigation) G.1
Packet Pg. 174
The service levels for these zones are reviewed on an annual basis.

An election was held in July 1999 in the District to increase assessments and provide for future adjustments to the assessments based on the annual change in the consumer price index (CPI). The increases were approved within the L-42 zone and M-9 zone, but not within the M-11 zone.

The method used by the City to adjust the assessments for Zones L-42 and Zone M-9 is to calculate the adjustment based on the annual change in the Consumer Price Index (CPI) as reported for San Francisco-Oakland-Hayward area for all urban consumers.

The report is published bi-monthly and the February report is used for the calculation.

The Federal Bureau of Labor Statistics reported that between February 2023 and February 2024 the index increased by 2.36%.

DISCUSSION:

The City Council is required to establish the budget and levy assessments within each of the three zones of benefit annually in order to continue financing the services within the assessment district. The first step in the assessment levy process is the adoption of a resolution ordering engineering assistance in the preparation and filing of the report, which was done at the City Council Meeting of April 16, 2024. The second step was to approve the Engineer's Report (Attachment A), to declare the City's intention to levy and collect assessments and to set the date for the public hearing regarding the assessments; this was done at the City Council meeting on May 7, 2024, by adoption of Resolutions No. 16-24 and No. 17-24 and set the public hearing date for June 18, 2024.

The Engineer's Report, prepared by NBS, an assessment consultant, recommends increases for the assessments in Zone L-42 and Zone M-9 to cover increased annual District costs. Assessments in Zone M-11 are not eligible to be adjusted, as explained in the background section of this report. The proposed Fiscal Year Ending June 30, 2025 assessments are as follows:

ZONE
Current
FY 2022/23
Levied
Proposed
FY 2023/24
Levy
Annual $
Change Per
Unit
L-42 $ 75.63 $ 77.42 $ 1.79
M-9 $ 79.61 $ 81.49 $ 1.88
M-11* $635.94 $635.94 -0- *
*Zone M-11 does not have an inflator due to majority opposition in the 1999 assessment ballot proceeding.

The Engineer's Report (Attachment A) establishes the proposed budgets for the next fiscal year for each zone, the estimate of actual costs for the current fiscal year and a statement regarding the basis for the assessment levy on properties. The Engineer's Report also refers to several exhibits that provide background data; the original exhibits G.1
Packet Pg. 175
are on file in the City Clerk's office. There are no proposed changes to the District boundaries for the upcoming fiscal year.

Section 5 of the Engineer's Report provides both projected revenues and expenses for prior, current and upcoming fiscal years and a proposed budget for Fiscal Year Ending June 30, 2025 for the Orinda Street Lighting and Landscaping Assessment District No. 1986-1. The following table provides a high-level summary for all three zones:

Proposed Fiscal Year 2024/2025 Revenue & Expenses by Zone (Assessments / General Fund Contribution; and General / Special Expense) Zone L-42 Zone M-9 Zone M-11 Totals
Beginning Balance $ 18,128 $ 289 $ 0
Assessment Revenue $ 9,891 $ 13,036 $ 37,711 $ 60,688
Interest 200 10 0
General Fund Contribution 240 1,029 54,754 $ 56,023
Total Funding $ 10,311 $ 14,075 $ 92,465
Expenditures – Special Benefit $ 7,008 $ 13,335 $ 76,665 Expenditures – General Benefit 240 1,029 15,800
Total Expenses $ 7,248 $ 14,364 $ 92,465 $ 114,077
Total Contribution to Reserve $ 3,063 ($ 289) $ 0
Ending Balance $ 21,191 $ 0 $ 0
Zone L-42 has per unit rates that fully offset the costs undertaken in the District. The General Fund is scheduled to contribute $240 which offsets any “general benefits.” This complies with the requirements for an assessment to only levy the costs of the special benefits.

Zone M-9 requires General Fund contributions of $1,029 as shown in the above table.

This amount more than offsets the estimated “general benefits” of $40. This complies with the requirements for an assessment to only levy the costs of the special benefits.

Zone M-11 requires General Fund contributions of $54,754 as shown in the above table. This Zone does not have an approved escalator and therefore the current per unit assessment is the maximum that can be levied.

NEXT STEPS:

The assessment consultant (NBS) will prepare and submit the levy of assessments to Contra Costa County for placement on the Fiscal Year 2024-25 secured property tax roll.

G.1
Packet Pg. 176
FISCAL IMPACT:

The proposed Fiscal Year 2024-25 assessments to be collected from parcels in Assessment District 86-1 (all zones) will provide $60,688 to partially offset $114,077 of costs. The General Fund will contribute $56,023 towards the costs, which includes funding general benefits that cannot be funded from special assessments.

AGENDA TITLE: Wagner Ranch Nature Center State Funding Steward Role RECOMMENDATION:

Approve Resolution No. 26-24 Whereby the City of Orinda Agrees to be Designated as the Steward for $1.5 Million in State Funds for the Wagner Ranch Nature Center BACKGROUND: The Wagner Ranch Nature Center is on the campus of the Wagner Ranch School and is an Orinda Union School District facility which sustained damage as result of recent winter storms. This damage resulted in the closure of the Nature Center due to access and safety concerns, with a very small portion reopened and available for use. Assemblymember Bauer-Kahan was able to secure $1.5 million in State funding to assist in repairing damage and reopening additional elements and portions of the Wagner Ranch Nature Center.

While discussions between the OUSD and the State have been on-going about the use of the funds and the conditions associated therewith, given current State budget considerations, there are concerns that the funding could be clawed back unless committed in a manner to ensure that does not happen. Assemblymember BauerKahan has asked, and the OUSD has agreed, that it would be prudent pending the final negotiation of terms between the State and OUSD, that the City serve as a steward for the funds. Attachment 2 is an e-mail for Assemblymember Bauer-Kahan’s Chief of Staff which confirms the transfer of the funds to the City until negotiations between the State and OUSD are complete.

Given the significant community benefits which arise out of the Wagner Ranch Nature Center and related programming, staff are recommending that the City agree to serve in this role. The attached resolution confirms the City’s willingness to do so.

NEXT STEPS: The City will serve as the Steward until such time as the funds can be transferred back to the OUSD.

FISCAL IMPACT: None because of this item. It is not anticipated that the City of Orinda will receive the State provided funds other than on a short-term, temporary basis, before they are passed onto the Orinda Union School District, if at all.

Hello DavidThis email serves as notification that funding in the sum of $1.5 million is to be transferred from the State to the City of Orinda so the city may act as the steward of the funding while negotiations about how best to preserve access to Wagner Ranch proceed. Originally this funding was earmarked in the 2023-24 State budget to go to Orinda Unified School District (OUSD) for this same purpose, but in the interest of ensuring stakeholder meetings can continue, our office has alerted the CA Assembly Budget committee and asked to have the funding instead routed to the City. Our expectation is that the City shall act as a responsible steward of the funding until such a time that stakeholders agree on a plan to conserve Wagner Ranch and ensure its access by the public for years to come.

Thank you and please let me know if you have any questions about this notification.

Receive Infrastructure Committee Report on Initial Work Program, Discuss, and Provide Direction, if any.

BACKGROUND: Upon establishing the Council’s Infrastructure Committee, the full Council requested that an initial work program be presented to the Council early in the Infrastructure Committee’s work. The Infrastructure Committee has met twice, with the attached Initial Work Program being a result of the second meeting. It is being provided to the full Council in advance of the next scheduled Infrastructure Committee meeting which is June 25, 2024.

NEXT STEPS: As the Infrastructure Committee proceeds with its efforts and the tasks in the Initial Work Program, this will inform a series of possible requested actions and recommendations which would require City Council review and action. Those will come back to the City Council as needed.

FISCAL IMPACT: None because of this item. As noted above, there may be costs with certain tasks yet to be defined. The current fiscal impact relates to time to staff and assist the Infrastructure Committee in its work.

Council Infrastructure Committee
Initial Work Program Outline
June 4, 2024
Introduction:

On February 6, 2024, in response to a Matters Initiated by Mayor Gee, the City Council approved the formation of an ad hoc City Council committee to address infrastructure matters related to roads and storm drains. The Council Members appointed were Mayor Gee and Vice Mayor Malkani. The approval included a request for the Infrastructure Committee to return to the City Council with a work program.

The Infrastructure Committee held an initial meeting on April 17, 2024, and a copy of the agenda for that meeting is attached. That meeting was well attended by many Orinda residents, and primarily served as a listening session to inform the Committee of the residents’ issues and concerns. The second meeting was held on June 4, 2024, and the main topic of discussion was an Initial Work Program. Presented here is an outline of the Initial Work Program as proposed by the Infrastructure Committee.

It should be noted that as the work of Committee progresses and various tasks are completed and additional input and information received, the work program will evolve and the timing of items for consideration may be modified.

AGENDA TITLE: Adoption of Resolution #27-24 Approving the Fiscal Year 2024-25 Mid-Cycle Update to the Biennial Budget, Adoption of Resolution #28-24 Approving the Capital Improvement Plan (CIP) Update for Fiscal Years 2023/24-2027/28 and Approval of Annual and On-Call Contracts for Trepepi Smith, California Consulting Inc, and Wildland Corp.

RECOMMENDATION:

Adopt a resolution approving the Fiscal Year 2024-25 Mid-Cycle Budget Update and a resolution approving the CIP Update, and approve certain annual and on-call service contracts.

BACKGROUND: On June 20, 2023, the City Council adopted a two-year Budget covering Fiscal Year 2023-24 (July 1, 2023 – June 30, 2024) and Fiscal Year 2024-25 (July 1, 2024 – June 30, 2025). Since budgets rely on estimates and projections, it is appropriate to periodically review the financial plan and make adjustments as necessary. At the City Council meeting on May 21, 2024, Staff presented the Proposed Mid-Cycle 2024-2025 Budget Update which contained only minor changes in the operational budget and staffing for the coming year. In addition, as part of a separate item on the agenda that evening, Council directed staff to incorporate changes associated with the City’s reorganization of Public Works and Facilities Maintenance, including the addition of two positions as discussed later in this report. No additional changes to the proposed Mid-Cycle Budget Update were identified as a result of Council discussion that evening.

Also at the May 21, 2024, meeting, City Council was presented with the Capital Improvement Plan (CIP) Update for Fiscal Years 2023-24 through 2027-28 (Attachment C). These updates included 1) Reallocation of existing funding to close-out Measure L Sales Tax Fund #105; 2) adjusted budgets for four projects resulting in additional appropriations of $715,000 from various funding sources; 3) where projects are not complete and have expected expenditures in FY 2024- 25, the unspent 2023-24 budget allocations are rolled over into 2024-25; 4) Where projects are complete or nearing completion, funding determined to be surplus is closed out of the project and returned to the respective fund balance.

The Mid-Cycle Adjustments as presented May 21, 2024, include both the revenue and expenditures necessary to provide for a sound financial plan. It is anticipated that the General Fund emergency reserve balance will exceed the adopted goal of 50% for Fiscal Year 2024-25.

H.3
Packet Pg. 187
DISCUSSION:

The proposed Mid-Cycle Budget Update document (Attachment A) is formatted with the following key components:

City Managers Transmittal
Summary Fund Balance
Revenue Overview and Details by Fund
Staffing Level Comparisons
Operating Expenditures Summary and Individual Department Descriptions Internal Service Fund Budgets
Capital Improvement Projects
Draft Appropriations Limit (to be adopted at the July 2, 2024, Council Meeting) The format of the individual Department Budget pages present:
• A narrative description of the department including staffing, and any General Fund fee revenue generated
• Prior Fiscal Year 2022-23 (ended June 30, 2023) actual results; • The current adopted Fiscal Year 2023-24 Budget;
• The original adopted Fiscal Year 2024-25 Budget; and
• Any proposed Fiscal Year 2024-25 adjustment; and
• The net adjusted Fiscal Year 2024-25 Mid-Cycle Budget Revenue estimates are included for all funds on pages 22-23 of the Mid-Cycle Budget Update document and there is a discussion and detailed tables showing historical, estimated, and adjusted budgets for revenue.

Operating Budget Adjustments:

The proposed budget adjustments take into consideration current information about the local, regional, and national economic environment. As described in the City Manager’s transmittal letter, the budget encompasses a revenue increase, and three operating expenditure adjustments. The details of the proposed budget adjustments were discussed as part of the public meeting on May 21, 2024. City-wide, the Proposed Budget Update would increase operating expenditures by $620,000 and revenue projections by $305,000 in Fiscal Year 2024-25 compared to the budget originally adopted in June of 2023 as detailed below:

A proposed increase in projected property tax revenue in the General Fund of $305,000 for Fiscal Year 2024-25 is based upon a review and analysis of current year property tax receipts.

H.3
Packet Pg. 188
Contract costs associated with police services increased more than originally anticipated since the current budget was developed in June of 2023 as a result of the new labor agreement between Contra Costa County and the Deputy Sheriff’s Association. In addition, the City was notified that costs for Animal Control Services provided by Contra Costa County are increasing and will require an increase in budgeted expenditure of $15,000. This results in a total proposed General Fund expenditure increase of $280,000.

In addition, the City Council recently updated the parameters of the Fire Fuels Reduction Incentive Program, and as of the end of this fiscal year, staff estimates that $340,000 of the initial pilot allocation of $400,000 remains unawarded. Since no allocation for this pilot program currently exists in Fiscal Year 2024-25, staff is recommending establishing a budget of $340,000 for this item in Fiscal Year 2024-25.

Staffing Changes:

A staffing change being proposed as part of the Fiscal Year 2024-25 Mid-Cycle process involves the reclassification of a position in the City Clerk’s Office. The current Office Assistant classification was examined, and it was determined that the current duties being performed are more appropriately classified as Administrative Assistant I/II as this position also supports administrative tasks for the City Manager, Human Resources, Finance, and serves as the main City Hall receptionist. If approved, the incumbent will be reclassified from Office Assistant to Administrative Assistant. The cost associated with this change is roughly $2,500 annually and no additional budget appropriation is necessary to implement this change.

There are also a number of changes incorporated in the draft budget document being presented tonight which reflect the direction to move forward with the Public Works & Facilities Maintenance Reorganization. Organizationally, the Facilities Maintenance function is no longer reflected in the Parks & Recreation Department Budget Summary pages and has moved to the Public Works Department Budget Summary pages. This transition is expected to take place over the course of the 2024-25 fiscal year. The other change associated with the Reorganization is the addition of 2 full time equivalent (FTE) regular employees, one Maintenance Worker I/II/III and the newly created Maintenance and Facilities Superintendent classification (a separate item also on tonight’s agenda). The total ongoing annual costs associated for both positions is roughly $323,000 annually. City Council had previously approved $250,000 annually for the Restructuring of Maintenance Operations as part of Decision Package #2 during the June 2023 Budget approval process, so this change increases operating budget by an additional $73,000. It should be noted that due to recruitment timelines, it is estimated that less than $225,000 will actually be spent in Fiscal Year 2024-25 on these positions.

Capital Improvement Plan:

Crossroads Mini-Park, CIP project #4103:

At their May 21, 2024 meeting, City Council requested updated information and estimates for the Crossroads Mini-Park, CIP project #4103. The project has been under review by the Parks & Recreation Commission and the Arts in Public Places Committee, and plans are 65% complete and include significant landscaping upgrades, including pathway modifications. Various Orinda monument signs have been considered for H.3
Packet Pg. 189
integration into the plan, however PG&E restrictions which prohibit metal have limited the choices. The current proposed signage is a mosaic tile sign, approximately 30 ft. long by up to 4’-8” tall (Attachment D shows a concept view).

To complete the project, additional funding of $450,000 would be needed as shown below. Fund 700 is one option; City Council may direct staff to utilize other funds, subject to fund restrictions. Subject to staff availability, the expenditures are shown for FY 2024-25.

Attachment E is a draft CIP detail page, showing these revised costs. The overall project cost, including design work to date and certain interim landscaping upgrades, is $645,000.

Road Safety Plan, CIP project #4185:

Staff has modified the description of this project to expand it to allow for future grant opportunities related to Local Road Safety Plan recommended projects. Attachment F is a draft CIP detail page, showing the revised description and budget.

Other Outreach:

The Proposed Mid-Cycle Budget Update and CIP Update have been available for review by the general public on the City’s website since May 16, 2024 when City Council Agenda for the May 21st meeting was posted. Consistent with the roles and duties of certain Advisory Committees and Commissions established by the City Council, and in an effort to receive an abundance of input from the community, Staff also made budget presentations to the Planning Commission, Supplemental Sales Tax Oversight Commission, Library Parcel Tax Independent Review Committee, and the Finance Advisory Committee. Input and feedback received is summarized below:

The Planning Commission – the Planning Commission determined that the Proposed Capital Improvement Plan Update is consistent with the General Plan at its meeting on June 11, 2024, and thereby adopted Planning Commission Resolution #24-02 (Attachment G).

Supplemental Sales Tax Oversight Commission – The Commission met on June 5, 2024, and reviewed the Measure R components of the Budget. This also included the review of proposed Capital Project funding in years beyond the two-year operating Budget. The funding from Measure R in each Fiscal Year through June 30, 2028, is projected to have an adequate remaining, unappropriated fund balance. The Commission expressed support for the components of the Budget funded by Measure R as presented, particularly that the funds were programmed in such a way that sufficient resources remain available to provide flexibility in addressing future needs.

H.3
Packet Pg. 190
Library Parcel Tax Independent Review Committee – This Committee met on May 29, 2024, and Staff presented information on both the operating budget as well as planned capital projects funded by the Parcel Tax. As part of the discussion, the Committee noted that the parcel tax was intended to support library operations in a sustainable manner and not sufficient to program major capital replacement. Following the presentation and discussion the consensus of the Committee was to support the components of the Budget funded by the Library Parcel Tax as presented.

Finance Advisory Committee – This Committee met on May 29, 2024, and Staff presented an overview of the Mid-Cycle Budget Update and provided an opportunity for discussion and questions. Following the presentation and discussion the consensus of the Committee was to support the Mid-Cycle Budget Update as presented Annual Contracts & On-Call Contract Approvals:

In Fiscal Year 2022-23, staff introduced the concept of asking the City Council to approve certain annual or on-going contracts, like for on-call services, as part of the budget process for efficiency purposes. This change was intended to streamline the contracting process by having certain regular annual or on-call contracts approved as part of the budget review process. This is a more efficient and cost-effective basis to handle certain approvals, especially given our limited staffing resources. As proposed, the contracts or agreements for services would be approved by the City Council as part of the budget adoption process and the City Manager would be authorized to execute the following agreements. In future years, it is anticipated that additional contracts could be added to this annual approval process. The table below summarizes the four approval requests:

projects, and other city-related communications. The current monthly cost is $5,220 and the not to exceed amount of $80k for the annual contract ending June 20, 2024. For 2024-25 the contract scope of services has been refined and the proposed contract amount is $5,270 monthly and not to exceed $80k for the annual contract ending June 30, 2025. This Contract will now include crisis-related communication work.

California Consulting, Inc -City requires certain grant related services for the purpose of identifying grant opportunities, grant research for projects specifically identified by the City, identification of other potential funding opportunities, and grant writing services at the direction of the City, perform post-grant award administration including filing of required documents by the prescribed deadlines set by the awarding entity. California Consulting, Inc. currently provides these services to the City and this approval will allow for a contract extension for the term of one year starting July 1, 2024, for $5K per month not to exceed $60k annually.

Wildland Corp (Chipper Services) - The City requires certain general services necessary to operate the City owned Chipper and provide service for the City’s Chipper Program. In May 2024, the City Council approved a contract amendment extending the existing agreement with Wildland Corp until June 20, 2024. The vendor has agreed to extend the terms of the current agreement for another year without an increase. The City intends to solicit bids for this service in the coming year and enter into a new agreement with the winning bidder for Fiscal Year 2025-26.

Wildland Corp (City Properties) - The City requires certain general services necessary to mitigate fire fuel hazards on City maintained properties and also provide for the removal of dead or diseased trees on City maintained properties which are not related to fire fuel mitigation. In researching information necessary for the Chipper Services Agreement renewal discussed above, it became evident that this vendor had been utilized outside of the scope of the Chipper Services Agreement administered by the City Manager’s Office to provide fire fuel mitigation services and tree removal services on City maintained properties by the Parks & Recreation Facilities Maintenance staff in a cumulative amount of $240,080 (as of 5/6/24) over the past three years not in compliance with the City’s purchasing ordinance. Staff has taken steps to ensure that the City’s purchasing ordinance is adhered to in the future which include additional oversight of the Facilities Maintenance function with the addition of the Maintenance and Facilities Superintendent position, required contracts training for all new staff, and implementing annual contracts training refresher for all staff who have contracting responsibilities. In light of all of this, and given that it is the middle of the fire fuels mitigation season, Staff determined that Wildland Corp was the successful bidder in a procurement process performed by the Moraga Orinda Fire Department for Fire Fuel Mitigation and Tree Removal services which was awarded on September 6, 2023. The proposed contract would utilize the same scope and cost of services to perform fire fuel mitigation and tree removal services on City maintained properties, in an amount not to exceed $150,000 and be valid through June 30, 2025. It is Staff’s intention that a Request for Proposal be issued for these services during the coming fiscal year to be utilized for future City needs.

NEXT STEPS:

Staff have prepared proposed resolutions which will adopt the revised appropriations for Fiscal Year 2024-25 (Attachment B) and approve the changes to the Capital Improvement Plan (Attachment C).

The Proposed Mid-Cycle Update Resolution (Attachment B) includes as an attachment a summary by fund of the Revenue, Expenditures, and Inter-fund Transfers that are authorized by adoption of the Fiscal Year 2024-25 Mid-Cycle Update. The Resolution also includes other procedural authorizations as part of the adoption of the Budget.

The Proposed Capital Improvement Plan changes (Attachment C) includes as an attachment Project Detail Sheets for projects #5023 through #5027, a Projects by Funding Source Summary, a Projects by Category listing, and a Sources and Uses of Funds Summary.

Typically, the City Council would also, as a separate consent calendar item, approve the Fiscal Year 2024-25 Annual Appropriations Limit on the same night as the budget. But due to noticing requirements this will occur at the July 2, 2024, meeting instead. A copy of the soon to be approved Annual Appropriation Limit is included in the budget document on pages 93-95.

FISCAL IMPACT:

The following provides a very high-level summary of the proposed Mid-Cycle Budget Update for Fiscal Year 2024-25:

The total expenditures (excluding Internal Services Funds and G.O. Debt) are $29.7 million which includes both Operating Expenses as well as a very significant Capital Improvement Program investment. Any expenditures in excess of revenues are funded by accumulated reserves, including grants and capital funds that will be spent on capital projects. The General Fund (General Purpose) portion of the Budget consists of $16.9 million in Revenue and $17.0 million in Operating Expenditures (includes $200,000 of one-time Operating Expenditures related to a limited duration position in Engineering).

The General Fund provides inter-fund transfers in support of the Landscaping and Lighting Districts.

Description
In the spring of 2019 PG&E removed the redwood trees (approximately 8 trees) which provided a visual buffer between the Mini-Park and its adjacent properties. The Mini Park area is on land owned by PG&E and leased by the City, and PG&E will not allow congregation (no benches etc.). Landscape design includes new monument signage. Partial funding for the project is from park dedication fees, the Orinda Community Foundation, and potential donations from the Orinda Garden Club.

Project # 4103
Justification
Removal of the trees was required due to new regulations regarding vegetation under electric transmission lines. This project will reduce the visual impact of the tree removal, replace the planted material and upgrade irrigation and add monument signage. The pathway thorough the Park will be upgraded and constructed to accessibility standards.

Description
The Orinda Local Roadway Safety Plan was adopted October 2023, which includes comprehensive evaluation of Orinda’s public roadway system using a defined set of criteria to identify and prioritize safety projects. This will also allow the City to submit for future HSIP (Highway Safety Improvement Program) grant funding. The LRSP includes an analysis of recent collision data and proposed countermeasures, with a summary of recommended projects. This is a living document and will be updated every 5 years.

The following projects recommended in the LRSP will be implemented as and when funding becomes available.

Project 1. Install Flashing Beacons at STOP controlled intersections - $160,000 Project 2. Install chevron signs on horizontal curves - $175,000 Project 3: Install Rectangular Rapid Flashing Beacon at Orinda Way - $365,000 Project 4. Install New Pedestrian crossings $150,000
Project # 4185
Justification
The LSRP is now a requirement in order to receive future HSIP grants. The plan also identified a priority list for safety related improvement projects for future CIP planning and funding allocations. Implementing the recommended projects will improve safety.
