IN PERSON SPEAKER CARDS: If you would like to speak during the public forum or on an item listed on the agenda, you are invited to submit a speaker card to the City Clerk. You will be permitted to speak even if you elect not to submit a speaker card or decline to provide information requested on the card. After the City Council has heard from everyone who submitted speaker cards, anyone electing not to submit a speaker card may form a line at the lectern. Public comment is generally limited to 3 minutes per speaker per agenda item.

Receive report on a recent grant application that was submitted to the Metropolitan Transportation Commission (MTC) for the Multi-Jurisdiction Lamorinda Regional Trails-to-Transit plan.
D.3. Metropolitan Transportation Commission Priority Development Area Planning Grant Status Update
Recommendation:
Receive the update regarding the status of Orinda's $200,000 MTC Priority Development Area Planning Grant.
E. PUBLIC FORUM
The public forum provides an opportunity for members of the public to speak on any item within the jurisdiction of the City Council that is not on the agenda.
Additionally, a speaker has the option of addressing the Council on an item listed on the agenda, if the speaker will not be present when that agenda item is taken up. When an item is not listed on the agenda, State law prohibits Council discussion or action. Councilmembers may only “briefly respond” to statements made and questions posed. For example, State law allows Councilmembers to ask questions for clarification and provide a reference to staff or other resources for factual information. Additionally, consistent with the “Matters Initiated” rule contained in its Policies and Procedures Manual, the Council may also direct staff to report back and/or place a matter on a future agenda for discussion.

Approve Contract Change Order #1 with Cowan & Thompson, Inc. to increase the contract value by $40,889 to a new total contract amount of $120,000 and authorize $20,000 (17%) in contingency and approve Budget Change Form #004-25 appropriating $20,000 from the Transportation Impact Fee Fund.
F.7. Approve a Grant Application for Glorietta Boulevard and Martha Road Intersection Improvements to the Metropolitan Transportation Commission for the Allocation of Fiscal Year 2025-2026
Transportation Development Act (TDA) Article 3 Pedestrian/Bicycle Funding
Recommendation:
Approve a Transportation Development Act grant application for the Glorietta Boulevard and Martha Road Intersection Improvements, find the project categorically exempt with respect to CEQA and direct a Notice of Exemption be filed with the County Clerk, by adopting Resolution No. 49- 24, in a format specified by the grant requirements.

G.1. Appeal of the Planning Commission’s Decision to Deny a Design Review and Exception Permit Application (DRA-2024-001, EXC-2024- 004)

Recommendation:
Adopt Resolution No. 48-24 to approve the Design Review and Exception Permit applications, DRA-2024-001 and EXC-2024-004, to construct 499 adjusted square feet in additions (448 square feet of additions to the living space on the first level, along with a 67 square-foot front porch and 134 square-foot back porch) to an existing, 2,978 adjusted square-foot, twostory, single-family residence; with a portion of the additions within the side yard with street frontage setback, subject to the conditions of approval included in the resolution.
H. POLICY MATTERS
H.1. Final Design Concept for Crossroads Park (CIP project #4103) and Related Actions
Recommendation:
Take the following actions: 1) Receive the presentation; 2) Approve revised design concept; 3) Approve Amendment #2 to the Contract with Gates & Associates; and 4) Approve Budget Change Form #005-25.
H.2. Proposed Solid Waste Rate Adjustments for Orinda Residential and Commercial Customers for March 1, 2025 to February 28, 2026 Recommendation:
Review, discuss, and receive public input on the proposed solid waste rate adjustments. The input will be provided to Orinda Board Members on the RecycleSmart JPA (Council Member Miller and Council Member Riley), for the JPA consideration of rate adjustments to be effective March 1, 2025.

Recommendation:
