The presentation, titled "Community Wildfire Risk Reduction," is attached to these minutes and is also available on our website at www.mofd.org/agendas.

Questions from Elected Officials
During the question-and-answer session, Councilmembers and MOFD Board of Directors asked various questions to Fire Chief Winnacker and Ms. Watkins ranging from implementation timelines, when Orinda and possibly Moraga might be classified as firedistressed areas, and the impact of this designation on insurance coverage, insurance requirements, potential insurance discounts, Zone Zero Implementation, education and outreach, collaborative action and community engagement, evacuation and community hardening, legislation and code requirements, fire district staffing and capacity resources.

MOFD President Roemer Opened Public Comment
In-person public comments were received from Jorge Escobar (Orinda resident), Nick Waranoff (Orinda resident), Bruce Jett (Orinda resident), Charlie Couric (Moraga resident), and Katie Hayner (Orinda resident).

Written public comments were received from Pete Williams, Spencer Schilling, Scott Whipp, Richard Stanley, and Juana Rudati, provided to the Councils and Board of Directors, posted online as part of the meeting record.

Elected Official Discussion
Town of Moraga Councilmember Kerry Hillis shared personal experiences and concerns related to fire safety in Moraga. He described his own investments made in home hardening and emphasized the inevitability of implementing zone zero measures.

He highlighted the importance of taking proactive measures to safeguard the community, future enforcement and educational outreach to help residents comply with Zone Zero safety requirements.

Town of Moraga Councilmember Renata Sos expressed support and urged the MOFD Fire Board to adopt Zone Zero requirements. Councilmember Sos suggested implementing with a phased timeline, allowing for public education, financial planning, and potential funding support, proposing a delay in enforcement of up to 18 months to facilitate voluntary compliance.

Town of Moraga Mayor Teresa Onoda expressed support and emphasized the importance of implementing Zone Zero fire safety measures. She urged the MOFD Fire F.1.b
Packet Pg. 8
Attachment: City Council Tri Agency Minutes of October 21, 2024 (3465 : City Council Minutes) Tri Agency Special Meeting Minutes Page 3 of 5 10.21.24 Board to support the Zone Zero initiative, recognizing the need for proactive community safety actions and encouraged residents to adopt measures. Mayor Onoda acknowledged community concerns but reiterated the Fire Board’s responsibility to prioritize safety.

Town of Moraga Vice Mayor Steve Woehleke expressed his support. He emphasized the need for stakeholder engagement and suggested that both MOFD and the Town play a role in communicating the costs and benefits of the modifications. Vice Mayor Woehleke noted that having the updated hazard maps could be instrumental in conveying the urgency of these changes and proposed requiring Zone Zero compliance for homes undergoing a sale or major remodel as a first step, with a phased implementation timeline for others.

City of Orinda Councilmember Brandyn Iverson Despite initial hesitation, Councilmember Iversson found Chief Winnacker’s presentation persuasive, particularly regarding the limitations of evacuation and the benefits of community-wide fire safety.

She expressed support for the balanced enforcement approach, which included a compliance period and reasonable fines. Councilmember Iversson ultimately voiced support for the Zone Zero measures as a necessary step to protect the community.

City of Orinda Councilmember Inga Miller expressed her concerns about the Zone Zero measures, noting her personal experience. She emphasized the need for caution in using fear as a motivator and suggested thoughtful consideration of what the community may look like under full enforcement of the current fire safety regulations. Councilmember Miller raised concerns about potential consequences on hillside stability from vegetation removal, referencing recent landslides and the absence of fire-safe mulch options. She encouraged exploring gradual implementation, particularly by identifying communities, like Orinda Woods, that may be suitable for initial compliance efforts. Councilmember Miller urged a careful, community-informed approach to balance fire safety with environmental stability.

City of Orinda Mayor Darlene Gee noted that while she may ultimately support the Zone Zero measures for the community's overall benefit, she remained concerned about the practical challenges of implementation and community acceptance.

City of Orinda Vice Mayor Latika Malkani expressed support for the proposed Zone Zero measures, recognizing the requirements may eventually become State requirements. She emphasized the importance of public education and feedback in the implementation process, suggesting that the Zone Zero requirements initially apply to properties being sold or remodeled. Councilmember Malkani highlighted concerns about financial impacts on residents and advocated for a balanced approach that prioritizes community safety without inciting fear-driven decisions.

City of Orinda Councilmember Janet Riley acknowledged the validity of prior comments and expressed her mixed feelings on implementing Zone Zero measures. She noted that while residents understand the importance of these changes, many are reluctant due to aesthetic and financial considerations, particularly regarding landscape modifications. Councilmember Riley also highlighted concerns about the challenges faced by seniors and residents on fixed incomes in meeting these requirements, F.1.b
Packet Pg. 9
Attachment: City Council Tri Agency Minutes of October 21, 2024 (3465 : City Council Minutes) Tri Agency Special Meeting Minutes Page 4 of 5 10.21.24 emphasizing the need for strategies that support effective action for all community members.

MOFD Director Craig Jorgens emphasized the importance of community safety. He acknowledged the challenge of implementing Zone Zero measures, particularly for older residents or those with limited financial resources and suggested incentives or financial assistance might be beneficial. Director Jorgens noted that proactive Zone Zero measures could reduce the risk of evacuations and improve safety for vulnerable populations. He expressed his support for the proposed requirements, advocating for a phased or thoughtful implementation that might begin with new construction and home sales.

MOFD Director Steve Danziger expressed appreciation for prior comments and acknowledged community concerns about financial and evacuation challenges. He supported further discussion by the Fire Board for the proposed Zone Zero measures, emphasizing the importance of community input and resident feedback. Director Danziger shared some resident opposition from his neighborhood and recognized the likelihood of further pushbacks. He suggested that any timeline for implementation should allow for ample time for compliance, as with previous vegetation removal initiatives, and reaffirmed his support for continued board discussions on the issue.

MOFD Director Greg Hasler noted the importance of considering diverse perspectives from the community, acknowledging that tonight’s comments may not represent the entire community’s views. Director Hasler highlighted the need for effective outreach and careful planning, sharing his personal experience with the notification process. He supported the board’s further review of the proposal and emphasized the need for an organized, wellcommunicated implementation that considers community understanding and feedback.

MOFD Director John Jex acknowledged the challenges associated with change, recalling previous efforts to upgrade the fire code and the positive impact it had on community safety. He expressed his support for the proposed Zone Zero measures, viewing them as a necessary next step in enhancing public safety.

MOFD Board President Mike Roemer acknowledged the difficulty of implementing Zone Zero measures, recognizing that achieving full compliance may not be possible. He expressed confidence in MOFD’s enforcement team, noting their fair and compassionate approach. President Roemer stated his willingness to prioritize community safety, even at personal political risk, and encouraged the MOFD Fire Board to take proactive steps in fire safety.

Fire Chief Winnacker thanked the MOFD Board of Directors, Orinda and Moraga Councilmembers for their input, noting both the support and concerns regarding Zone Zero implementation. He acknowledged the scale of the task and emphasized that the implementation of Zone Zero would need to be phased in over time due to resource limitations. Fire Chief Winnacker committed to developing a proposal for the MOFD Fire Board and emphasized the importance of public engagement to ensure all community voices are heard.
