ADMINISTRATIVE BUSINESS
Surplus Property – 824 Fourth Street Building (APN 040-212-009) Interim City Manager Justin Chaney presented a staff report regarding the City-owned property located at 824 Fourth Street (APN 040-212-009), consisting of approximately 0.36 acres. Mr. Chaney explained that on September 1, 2026, the City Council directed staff to explore selling the property. In order to proceed with the sale, the City must comply with the Surplus Land Act.
Mr. Chaney explained that the property qualifies as “exempt surplus land” because it is less than onehalf acre, is not contiguous to property owned by a state or local agency used for open space or lowand moderate-income housing purposes, and is not located within a designated Notice Zone. He further stated that the property is no longer necessary for City use and that disposition would reduce maintenance costs and return the property to the property tax rolls.
Vice Mayor Enriquez asked if the process was reversible if the City decided to not sell the property and Mr. Chaney stated yes.
ACTION: Councilmember Elliott moved, seconded by Councilmember Tolle to adopt Resolution 2026-17 declaring 824 Fourth Street (APN 040-212-009) is exempt surplus land pursuant to Government Code Section 54221, authorizing the City Manager, or designee, to take all actions and execute any documents necessary to ensure compliance with the Surplus Land Act and State regulations related thereto, and finding the declaration to be exempt from the California Environmental Quality Act pursuant to Sections 15060(c)(3), 15061(b)(3) and 15312. Motion carried by a voice vote 5-0.
Waste Management Presentation Regarding Delinquent Accounts, Bad Debt, and Proposed Memorandum of Understanding
Interim City Manager Justin Chaney presented a staff report regarding the City’s Collection Franchise Agreement with USA Waste of California, Inc., doing business as Waste Management (WM), and the significant number of delinquent customer accounts. Mr. Chaney stated that the account-aging report identified 206 accounts with balances more than 120 days past due.
Mr. Chaney explained that City staff and WM have been working on a coordinated process to reduce delinquent balances, verify property ownership and service information, identify properties required to maintain waste collection service, and establish a consistent process for communication and enforcement.
The proposed Memorandum of Understanding (MOU) would establish a two-phase process. The initial phase would include the City providing WM with updated occupied-property and exempt-property information, sending informational notices to property owners regarding mandatory collection service, and providing additional notices to owners of accounts that are 60 or more days delinquent. WM would match property-owner information with its service accounts, identify discrepancies, and provide the City with delinquent-account information.
The ongoing process would include regular updates between the City and WM, monthly reports of suspended and closed accounts, written communication with delinquent account holders, continued data matching, and quarterly meetings between City staff and WM to review the delinquent-account process. Mr. Chaney noted that the MOU would coordinate existing responsibilities under the franchise agreement and Orland Municipal Code and would not amend or replace those agreements or requirements.
Mayor Barr shared the process and provided background regarding when the ordinance was originally established.
Joantha Guthery of Waste Management (WM) was available to answer questions from the Council and community regarding the delinquent accounts and proposed process. The Council discussed the proposed MOU.
Mr. Chaney stated that, following several minor changes to the MOU, the document would need to be reviewed by WM. Once the review is completed and the MOU is finalized, it will return to the City Council at the next meeting for consideration and placement on the Consent Calendar. Mr. Chaney noted that the proposed MOU has been a collaborative effort between WM and City staff to develop a solution and address the issue of delinquent accounts.
City Manager Verbal Report
Mr. Chaney reported that Finance Director Joanne Moore has completed all outstanding state reporting. He stated that Ms. Moore’s next objectives are completing the Fiscal Year 2024/25 audit, followed by the Fiscal Year 2025/26 audit. Ms. Moore shared that the auditors are expected to be at City Hall during the last week of September.
Mr. Chaney reported that staff has reduced the hours for Ms. Janet Wackerman and Mr. Pete Carr as their assigned projects are nearing completion.
Mr. Chaney also shared that his time serving as Interim City Manager will be coming to an end soon and that the next few City Council agendas are not expected to be as full as they have been. He stated that upcoming agendas will remain focused on necessary items, such as warrant lists, contracts and authorizations. Mr. Chaney suggested that a future agenda item could provide an opportunity for the Council to discuss priorities and ideas they would like the incoming City Manager to address.
City Council Communications and Reports
Councilmember Elliott reported that he attended the ad hoc meeting between the City and County regarding the tax-sharing agreement, as well as a LAFCo meeting. He shared that it is great to see the City and County working well together.
Mayor Barr shared that the meeting agenda was light due to the heavy workload at City Hall and also shared that she is hopeful the City will have a new City Manager soon.
Councilmember McDermott shared that the Vietnam Veterans of America will be hosting a bowling tournament at Orland Bowl on Friday, September 18, 2026, from 11:00 a.m. to 2:00 p.m.
