PATRICK PIATT, COMMUNITY DEVELOPMENT DIRECTOR
RE: PRESENTATION FROM PIONEER COMMUNITY ENERGY ON
COMMUNITY CHOICE AGGREGATION OPERATIONS AND
CONSIDERIONG OF SUBMISSION OF A LETTER OF INTEREST AND
DIRECTION TO EXPLORE A FUTURE AGREEMENT WITH PIONEER
COMMUNITY ENERGY
DATE: JULY 16, 2024
SUMMARY
Council will hear a presentation from Pioneer Community Energy (PCE) on their Community Choice Aggregation (CCA) program and consider submitting a letter of interest to explore the financial feasibility of joining PCE.
DISCUSSION
California State law provides for the formation of Community Choice Aggregators (CCA), which allows local governments to purchase electricity on behalf of customers in place of investorowned utilities such as PG&E. By joining a CCA through a Joint Powers Agreement (JPA), the source and costs of energy provided locally is controlled by the local governing body.
By law, before a community can join a CCA, a study must first be performed to demonstrate that the inclusion in the CCA provides a benefit to the community and will not create a burden on the existing members of the JPA. Should the analysis be beneficial to both parties and there is a desire to move forward in joining the CCA, the California Public Utility Commission (CPUC) needs one full calendar year for planning purposes.
Oroville joined Butte Choice Energy (BCE) in October of 2022, a local CCA whose members comprised of Oroville, Chico, and Butte County. The formation of a CCA requires a significant amount of up front funding and incurring debt to begin purchasing energy that can then be sold to members of a community. Due to the COVID pandemic and the insecurity of the financial markets, the BCE Board determined to not take action to launch BCE, and instead continue to monitor the market to consider launching at a later, more financially favorable date. At this time, it still is not financially feasible to launch a new CCA.
City staff has recently begun discussions with Pioneer Community Energy (PCE), which includes El Dorado County, Placer County, Auburn, Colfax, Grass Valley, Lincoln, Loomis, Nevada City, Placerville and Rocklin. Through these conversations, research, and discussion 48 Item 6.
with industry professionals, staff has learned that PCE is accepting new members and has a track record of providing energy to its member communities at a rate that is 10% lower than that provided by PGE on the average.
Additionally, staff has conferred with staff from Chico, Town of Paradise and Butte County and each agency will also be considering providing a request to their Council and Board to continue the exploration of joining PCE by submitting a Letter of Interest to the PCE Board of Directors (Attachment 1).
FISCAL IMPACT
None
RECOMMENDATION
Direct staff to sign and submit to PCE the attached Letter of Interest and continue discussion with PCE until such a time as is appropriate to return to Council for further action.

RE: Letter of Interest for Pioneer Community Energy
Dear XXXX,
Through our recent discussion and the presentation that we were provided about Pioneer Community Energy (PCE), we would like to continue exploring the mutual benefits that may be realized if the City of Oroville (City) were to become a member agency to PCE.
The City has an interest in providing energy options for our residents and businesses, particularly if there is a pathway to that energy being provided at a lower rate than that provided by PGE. In addition – it appears based on our conversation there could be a synergy of energy interests between PCE and the City. It is our understanding that an expression of interest such as found in this letter will allow PCE to begin an exploration of potential inclusion of the Oroville Community as a member agency in the PCE organization. During this period of exploration both PCE and the City would be free of obligation until such time that it is deemed appropriate to enter into a formal agreement.
Thank you for connecting with us and for outlining the great work being conducted by Pioneer Community Energy.
I look forward to continuing our conversations and I am optimistic that there is potential for mutual benefits that will be favorable to both of our organizations.
Sincerely,

MythBusters
• Does Pioneer replace PG&E?
Pioneer is a choice on the generation portion
of your utility service – poles, wires, and bill
are still PG&E
• If I join Pioneer, will it impact my PG&E service?
Your requests will not be “put in the back of
the line” because you’re with a CCA
• Will my Transmission & Distribution (T&D) rates
increase by joining Pioneer because of savings?
There is no impact to your PG&E T&D rates because of
joining Pioneer
55 Item 6.
MythBusters (continued)
• Is Pioneer just a “middle-man” buying from PG&E
and marking up to the ratepayers?
No, Pioneer procures its own power from various
sources to provide savings, not PG&E
• I’m on Solar NEM 2.0. Will I be defaulted to the
new NEM rate?
Whatever NEM vintage you are on simply transfers over to Pioneer that pays a premium over PG&E on your net
generation
• Will I lose my PG&E Programs?
Any program or special rate you are on with PG&E will not be impacted by joining the CCA

CITY OF OROVILLE
STAFF REPORT
TO: MAYOR PITTMAN AND COUNCIL MEMBERS
FROM: BRIAN RING, CITY ADMINISTRATOR
RE: DISCONTINUANCE OF FLUORIDATION OF DOMESTIC WATER
PROVIDED BY CALIFORNIA WATER SERVICE COMPANY TO
CITY OF OROVILLE
DATE: JULY 16, 2024
SUMMARY
The Council will consider a resolution directing staff to work with the California Public Utility Commission (CPUC) and California Water Service (CalWater) to discontinue the requirement to add fluoride to domestic water that is provided to customers residing within the City of Oroville.
DISCUSSION
On February 1, 1954, the Oroville City Council passed a resolution requesting that California Board of Public Health issue a permit to CalWater, authorizing CalWater to add fluoride to domestic water supply provided to the City residents. In addition, the resolution requested that CalWater obtain said permit. In 1957, CalWater started to fluoridate the drinking water within the City limits.
State law currently requires systems with 10,000 or more service connections to fluoridate water if public funds are available to do so. In 2018, 59% of water systems in California treated their water with fluoride (down from 64%in 2014). Currently public funds are not available for this service.
There are differing opinions on the potential benefits of adding fluoride to water. In 1954, this matter was brought before the Oroville City Council at the request of many Oroville residents, as a way to help prevent tooth decay. Since this time, other methods have been introduced as a way to apply fluoride to your teeth. On May 21, 2024 the Oroville City Council considered the need to continue fluoridation in domestic water provided by CalWater and directed staff to take necessary steps to discontinue this requirement.

RE: PLACEMENT OF SOLID WASTE LIENS ON THE 2024-25 PROPERTY
TAX ROLL
DATE: JULY 16, 2024
SUMMARY
The Council may consider the placement of solid waste liens from Recology on the 2024-25 property tax roll.
DISCUSSION
The City’s Franchise Agreement with Recology and City Ordinance No. 1562 provide that the City must place delinquent garbage bills on the tax roll of property owners to ensure the proper funding for the refuse removal and disposal service.
Recology is required to send two notices prior to turning their delinquent garbage bills over to the City to be placed on the tax roll. The first notice is to both the service recipient (who may or may not be the property owner) as well as the property owner of record. The second notice states that if the payment is not received in fifteen days, a delinquency fee will be added to the bill when the City places the lien on the property.
These procedures are all in accordance with Ordinance No. 1562 and Resolution No. 4486 and 4929. In turning these delinquent tax bills over to the City to be placed on the tax roll of the property owner, Recology has certified that it has complied with all required procedures.
The City receives a small fee for each lien placed. $20.00 each to Recology and to the City for a total of $40.00 in fees for each parcel.
FISCAL IMPACT
The number of liens is unknown at this time. Prior year was 240 parcels for $4,800.00 ($20 of revenue per parcel placed on the tax roll).

CITY OF OROVILLE
STAFF REPORT
TO: VICE MAYOR & COUNCIL MEMBERS
FROM: MAYOR PITTMAN
RE: LETTER OF SUPPORT IN MARYSVILLE'S DISASTER DECLARATION DATE: JULY 16, 2024
SUMMARY
The City Council will receive a report from Mayor Pittman on the Letter of Support that was sent to various government officials pertaining to Marysville's Disaster Declaration.
DISCUSSION
The City of Oroville has a vested interest in the economic vitality of Marysville and our region, are writing to express our concern regarding the adverse impacts of the Marysville Hotel incident, previously managed by Urban Smart Growth, on local and regional businesses.
The Marysville Hotel incident has extensive disruptions to both the City of Marysville and the region. Specifically, the incident has forced road closures and traffic diversions on State Highway 70 between 3rd and 4th Streets, which is having significant impacts on business operations throughout Marysville and the region. Despite not being within the immediate fall zone, numerous businesses have reported significant declines in customer traffic and revenue, compelling some to implement workforce reductions as a means of financial sustainability.
Mayor Pittman sent a letter on his behalf in support of the declaration of a State of Emergency for Marysville, and requests consideration for a letter in Support from the entire Council.
