CITY OF OROVILLE
RESOLUTION NO. 9477
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF OROVILLE, CALIFORNIA, ADOPTING AN UPDATED SCHEDULE OF USER AND REGULATORY FEES.
WHEREAS, user and regulatory fees are established by the City Council; and WHEREAS, in 2023 the City completed a study to identify the cost of providing various user and regulatory fee-related services; and
WHEREAS, the study examined fee-related services provided by the City, the costs reasonably borne by the City in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services; and WHEREAS, the City Council finds that providing these services is of special benefit to applicants both separate and apart from the general benefit to the public; and therefore, in the interests of fairness to the general public, the City desires to better recover the costs of providing these services from applicants who have sought or require the City's services by revising its schedule of fees; and
WHEREAS, the City Council hereby finds that the study provides adequate evidence to conclude that the revised fees do not exceed the reasonable costs to provide the services for which the fees are charged; and
WHEREAS, the City Council desires that annually the City Manager may increase various fees based on the annual percentage change in the all-urban Consumer Price Index for the San Francisco-Oakland-Hayward Area (CPI), not to exceed five percent (5%) per year. If the CPI does not change or goes down in a given year, no change shall be made to the fee schedule that year; and
WHEREAS, in adopting this Resolution, the City Council is taking action only on those fees for the services, programs or products set forth in Exhibit “A” which have been modified from prior resolutions of the City Council. The remaining fees that have not been modified from prior resolutions shall remain in full force and effect.
WHEREAS, prior to adopting adjustments to fees, the City Council shall have the opportunity to review and consider said adjustments.
NOW, THEREFORE, BE IT RESOLVED by the Oroville City Council as follows:
Section 1. Each WHEREAS paragraph, set forth above, is hereby adopted as a specific finding of this City Council.
Section 2. The City Council hereby adopts the schedule of fees as set forth in attached Exhibit "A" and incorporated by this reference. 313
Item 13.
Item _.
__
Section 3. Annually on July 1, commencing July 1, 2024, various fees in the fee schedule may be updated based on the prior year annual change in the CPI, not to exceed 5%. If the CPI does not change or goes down in a given year, no change shall be made to the fee schedule that year.
Section 4. Any fees adjusted based on the annual percentage change in the CPI shall go into effect upon adoption.
Section 5. Any fees that are new or being increased beyond the annual change in CPI that are development related, shall go into effect 60 days after adoption.
Section 6. The City Clerk shall attest to the adoption of this Resolution.

FIRST READING OF ORDINANCE NO. 1899 AMENDING OROVILLE
MUNICIPAL CODE 17.48 WITH A NEW ENTREPRENEUR-FRIENDLY
FEE INCENTIVE PROGRAM
JULY 21, 2026
SUMMARY
The City Council shall conduct a public hearing and consider an incentive fee policy recommended by the citizen Ad Hoc Business Advocacy Committee that encourages new businesses to re-use the city’s vacant commercial spaces.
DISCUSSION
On February 18, 2025, at the request of a group of citizens the City Council created the ad hoc Business Advocacy Committee to reduce potentially overly burdensome permit processes. The goals of the committee included improving the relationship between the city and the business community, ensuring an objective, clear and expeditious permit process, identifying permits and processes that could be made less onerous for applicants, and reducing the number of Use Permits.
The committee met several times and conducted several interviews with businesses and city staff to gather information. The committee’s recommendations for Zoning code changes and staff responses were presented to the City Council on April 7 th
and 24th 2026. At that time the recommendations did not include a new entrepreneurfriendly fee structure. The committee requested that the entrepreneur-friendly fee structure be presented now to align with the Master Fee Schedule Update.
The committee recommends establishing an entrepreneur-friendly fee incentive program to encourage new retail, service, restaurant, and lodging businesses to occupy vacant commercial spaces within the city. Under the proposed program, qualifying businesses establishing in a commercial space that has been vacant for at least six months would receive a reduced Administrative Permit fee of $50 (currently 390
Item 14.
$463) or a reduced Minor Use Permit fee of $500 (currently $3,729). The City's standard six percent (6%) Technology Cost Recovery Fee would continue to apply.
The proposed incentive would apply only to new businesses operating from a single location within the City and would remain in effect for two years, until June 30, 2028, unless extended by the City Council.
The committee believes reducing the initial cost of establishing a business will encourage the reuse of vacant commercial storefronts, support local entrepreneurship, and stimulate investment in existing commercial corridors.
This fee change ordinance is not a project under CEQA.
FISCAL IMPACT
Adoption of the ordinance will reduce revenue collected from qualifying Administrative Permit and Minor Use Permit applications. Because the program applies only to businesses occupying commercial spaces that have been vacant for at least six months, staff anticipates a limited number of qualifying applications and, therefore, a minimal impact on permit revenue. Increased business activity may also generate additional sales tax and, where applicable, transient occupancy tax revenue, which could partially offset the reduction in permit fee revenue.

ORDINANCE NO. 1899
AN ORDINANCE OF THE CITY COUNCIL ADDING SECTION 17.48.110 OF THE OROVILLE
MUNICIPAL CODE ESTABLISHING AN ENTREPRENEUR-FRIENDLY FEE INCENTIVE PROGRAM TO ENCOURAGE THE REUSE OF VACANT COMMERCIAL SPACES.
WHEREAS, the City Council finds that vacant commercial storefronts negatively impact economic vitality, neighborhood character, and sales tax generation within the City; and WHEREAS, encouraging new businesses to occupy existing vacant commercial spaces promotes economic development, revitalization of commercial districts, increased employment opportunities, and additional sales and transient occupancy tax revenues; and WHEREAS, the City Council finds that reducing the cost of certain permits for qualifying businesses will encourage investment in vacant commercial properties while maintaining appropriate regulatory review; and
WHEREAS, the City Council desires to establish a temporary incentive program to encourage entrepreneurs and small businesses to locate within the City of Oroville; and WHEREAS, this ordinance was introduced and read for the first time at a regular meeting of the Oroville City Council held on July 21, 2026; and this ordinance was read for the second time at a regular meeting held on ________.
WHEREAS, this ordinance has been determined to be exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3), the Common Sense Exemption, because it can be seen with certainty that adoption of this ordinance will not result in a direct or reasonably foreseeable physical change in the environment.
NOW, THEREFORE, THAT THE CITY COUNCIL OF THE CITY OF OROVILLE DOES ORDAIN AS FOLLOWS:
SECTION 1: Purpose.
The City Council hereby finds and determines that the foregoing recitals are true and correct and are incorporated by this reference as though fully set forth herein. The City Council further finds that this ordinance promotes the public health, safety, and welfare by encouraging the productive reuse of existing vacant commercial properties, reducing commercial vacancies, stimulating private investment, supporting local entrepreneurship, expanding employment opportunities, increasing economic activity, and strengthening the City's tax base, while maintaining appropriate regulatory oversight through the City's permitting process.. 392
Item 14.
SECTION 2: Purpose.

Chapter 17.48.110 of the Oroville Municipal Code is hereby added to read as follows:
