I'm a concerned homeowner of the Oxnard Shores community. I am against the opening of a Cannabis Retail Permit # 21-516-24 in my residential neighborhood.

We already have a liquor store, a brewery, a bakery (mainly doughnuts) and pizza place in the approx 7 storefront shopping center. As is, I am hesitant to walk my dog there in the evening, due to the boisterous people hanging out outside, the storefronts and smoking. I have had to walk around people laying on the sidewalk, early in the morning, and have to walk around angrily shouting people (some seem homeless, and not in their right mind). I see people walking around drunkenly, and have also noticed parked cars at the beach areas where the smell of cannabis smoke wafts through the open window. Or sitting at a beach/ oxnard park bench. These people are using illegally, and will be driving home under the influence. Harbor Boulevard has become so busy, also the harbor blvd/wooley intersection is dangerous, due to the parallel service road. Nobody seems to know what the rules of the road are, for pedestrians, nor cars coming from the service road. I can just imagine with more traffic coming, the dangers.

I voted for Cannibis, however the storefronts need to be in large shopping centers, where people go to shop, get in the car, and take their purchases home. This area is just a small community, with plenty of cannibis retail stores just within 3- 5 miles in Port Hueneme. I understand we are considered Oxnard, however I think it needs to be taken in consideration how many of these shops there need to be within a certain radius.

I am also disappointed that you would allow this TD Enterprise, a corporation who is not even a local resident. It would be nice if we could get local business owners. When I saw the sign for a Tacos selling sign up at that address, I thought a little mexican food place would be good, since they've been parking mexican food trucks near there. Was I surprised with that deceiving advertisement to realize it was going to be a Cannabis retail!! Please do not allow this type of Retail here in this small neighborhood shopping center, there are already enough mind altering stores there.

Sincerely,
Yolanda Bagnay

PROPOSED CANNABIS STORE IN OXNARD SHORE
WAYNE PIHLGREN <[email protected]> Wed, Feb 9, 2022 at 8:21 PM To: "[email protected]" <[email protected]>
TO: Members of the Oxnard City Council
We built our home in Oxnard Shores 14 years ago to enjoy our golden years in a peaceful, relaxed senior friendly neighborhood environment. We like sing on our front balcony overlooking Whitecap Street enjoying quiet and stress-free day-to-day living. We like taking our preschool grandchildren on “adventure walks” up and down our street and adjacent streets not having to worry about who or what we might encounter.

Allowing a pot store to operate within a two-minute walk of our home will destroy all these things and the quality of life we now have and treasure. We do not want Whitecap Street (the first street immediately north of the proposed pot store loca on) to become a major thru street with substan ally increased traffic and street noise. We do not want to encounter armed security guard while walking with our grandchildren in the neighborhood. We do not want a pot store to operate in our residen al neighborhood adversely impacng our daily lives and devaluing our property that we have worked a lifeme to achieve.

We respecully request the City Council to reject the proposed pot store in Oxnard Shores for all these reasons and so many more
Thank you;
Wayne and Eva Pihlgren

Proposed Cannabis store in Oxnard Shores.

The underlying reason against the ill-conceived proposal for a cannabis store in Oxnard Shores is the fact that the city is not filtering the types of businesses moving into our small neighborhood. These shops are a part of the neighborhood community and are not even located on the main thoroughfare.

My wife and I have lived in our home at the Shores for over 44 years. Our home is 150 feet from the neighborhood shops. We have seen businesses come and go. These businesses have always been a mixture of family oriented shops and some adult venues. But more recently our neighborhood shops have become less and less family oriented with liquor, beer, wine and now… cannabis. Scarcely family oriented.

Not many years ago, my granddaughter and I would walk over to the shops for a sandwich. She loved to walk closely by each business door and smell the aromas from within as we made our way to get a sandwich. She said each shop had its own disnct smell; the cleaners, the bakery, the pizza parlor, the sandwich shop. That won’t happen in our future neighborhood mall. It will include the bad smells of pot and armed guards to stop any kids from approaching the business doors.

It is doubul when friends and families on vacaon come to visit the Shores to access the beach, that they would appreciate being subjected to pot sales and armed guards at the neighborhood mall.

Please stop this trend towards adult venue businesses and keep our neighborhood shops neighborly and family friendly.

Dear Oxnard City Council Members,
We are residents of Oxnard Shores and against the proposed cannabis store trying to locate at Oxnard Shores because it’s too close to a residential neighborhood.

We already have three alcohol-related businesses in our little commercial area, and do not need a cannabis store there as well.

There are numerous cannabis stores in Oxnard and Port Hueneme only a couple of minutes’ drive from Oxnard Shores, so the city should space them out better than loading the west side of the city with cannabis.

The City of Oxnard has already approved many locations for other cannabis stores that are not impactful to residential neighborhoods, so please tell the one trying to locate at Oxnard Shores “NO.”

Thank you,
Ted & Cory Kuepper

Troy Johnson <[email protected]> Sat, Feb 12, 2022 at 6:44 AM To: "[email protected]" <[email protected]>, "[email protected]" <[email protected]> Dear Mayor and City Council:

I am writing in support of Oxnard Holistics' proposed cannabis retail establishment at the Oxnard Shores Shopping Center. As a San Diego business owner, I am very familiar with the company and people behind it since they operate Torrey Holistics here in our city. They are leaders here in safe, legal cannabis who care about the community and give back to it. They employ a PhD scientist. They are exactly the kind of operators any city should want as it allows safe, legal cannabis to be part of its business community.

Years ago, when cannabis was legalized, people in our own community had reservations. But Holistics, through their education and community efforts, quickly put those concerns to rest.

I’ll let your own constituents tell you how to vote. But as a business owner who is very familiar with this operator—and cares deeply about my own city—I can tell you they are an asset to the community.

Sincerely,
Troy Johnson

Gentlemen,
My wife and I are long-time (40+ years) residents and voters living in Oxnard Shores. We strongly disapprove of establishing the proposed Cannabis store in Oxnard Shores. There are already too many businesses currently operating in this location (the liquor store, the Shores Restaurant, and the Red Tandem Brewery, to name a few). There are already several other established cannabis dispensaries within just a few miles of Oxnard Shores. Establishing a new business with the projected auto traffic will stress the limited parking spaces now available and may possibly overflow into the close-by local residential area.

The City's Planning Board has already voted not to approve this new Cannabis Store. Please follow suit do not permit this proposal to pass.

Thank you for your consideration.

Sincerely,
Thomas F. Delaney, III

Please vote NO for Oxnard Holistics at the proposed site in Oxnard Shores. The proposed site is bordered by Wooley Rd, the narrow Harbor Service Rd (NOT Harbor Blvd), and Outrigger Way (which is an alley). The intersection at Harbor Service Road and Wooley is extremely dangerous. Outrigger Way is an alley, and Wooley Rd is a 2 lane Road that is flanked by parked cars on each side & condo's & apartments. Directly across the street (south) on Wooley Rd. is an undeveloped commercial lot that, once developed, will generate even more traffic.

I have looked at satellite pics of all the top 16 proposed Cannabis sites the City of Oxnard is considering. None of them are close to or have direct access to residential property. None are flanked by an alley or small service road.

Instead, they have direct access to major roads that will support this level of traffic that will be generated.

The problem with the proposed Oxnard Shores site is that customers will not be aware they should not exit on to the Harbor Service Rd. If they try to make a left on Wooley from that service road, it could be deadly. You can't close off the Alleyway at Outrigger as that would prevent homeowners an escape route in case of a disaster (tsunami, etc) You can't close off the driveway onto that Service Road from the strip mall as that would block fire fighter truck access or an escape route in case of a disaster.

Oxnard Holistics states that the weekends will generate 260 vehicles per day. I really don't understand how this proposed site could ever be considered with that volume of increased vehicle traffic and being not being directly linked to a major road like all the other proposed locations.

The attached pic was taken on Feb 5th, 2022 at 5:30 p.m. at the proposed site parking lot just feet from the alley at Outrigger Way. The parking lot was mostly full. Please remember, this was taken in February, NOT during the summer when more beach traffic occurs.

This is NOT a safe location based on access roads, ingress-egress, & how much additional traffic will be generated.

Decisions need to be made on facts & accurate on-site studies & evaluation. Please vote NO for this location.

Thank you,
Steve Guerrero

I think putting a marijuana dispensary in our residential neighborhood is a horrible idea. Our neighborhood children walk to that center every day to get doughnuts at “Heavenly Cakes”, they go to the “Bottle Shop” for an ice cream or a soda in the summer time. We take our kids and grand kids for a slice at the “Pizza Company”. Our children accompany their parents to the laundry mat in that center. Now all of a sudden we are going to have an armed guard out front. Are we supposed to tell our kids that the dispensary is perfectly safe to be around. If it's such a safe place why the heck do they need an armed guard? How do we discourage our children from using a substance that harms them physically and mentally when they see one on every corner like a “Star Bucks”. Our city should be ashamed for putting revenue above our young.

Marijuana increases teen use and leads to more medical emergencies including traffic deaths from driving while high.

This isn't a strip mall in an adult area, this is a residential neighborhood. This center is pretty much in the center of Oxnard Shores where the residents and guests pass by multiple times per day. A marijuana dispensary has no place here. The fact that you are proud that you are packing our City of Oxnard with 16 dispensaries is disgusting. The fact that one of the other dispensaries is called “Cookies” is just wrong. What is the matter with you? If this goes through I am sure you will not get the support for economic plans or votes for re-

Please vote to reject the Oxnard Shores location I understand the city needs the revenue, but this tiny shopping center in the middle of a neighborhood is not a good location! There are many larger strip malls with lots more parking that would make excellent location for such a business. Thank you Nancy Hill

Mr.Perello and Mr.Coyotl : I understand our City will soon take up the issue of allowing the subject business to operate in the Oxnard Shores shopping plaza. This space has been empty since the sandwich shop closed many months ago.

As a long time resident of the area I welcome this business subject to the restrictions applicable to all such stores. Such business is totally in keeping with the other stores already there and will begin to offer our City and people in the neighborhood the advantages enjoyed by surrounding areas hosting dispensaries.

I hope you will support this application.

Respectfully, Marvin Tepper. Resident at since 2011.

I live in Oxnard Shores for many years. No pot shop shoud be approved in Shores shopping center because:

Parking in the center is already totally full because of the Shores Restaurant and the neighborhood bar.

Trafic is already DANGEROUS because of the Little Harbor and Wooley Road intersection. 50 new condos directly across the street is causing additional heavy and dangerous traffic.

Outrigger Way is just that, a way. It is not built to accommodate commercial traffic. Parking in the entire neighborhood is already very difficult and streesing traffic more is unacceptable.

The armed guards needed is unaccceptable for our residential neighborhood/ Additional pot shops already exist in close proimity on Channel Islands Blvd. Yes they are in Port Huenem but totally accessible to folks living here and they are in a commercial shopping center.

Thank you for denying this appeal.

Mr. Jose Coyotl
City of Oxnard Planning Commission
305 West Third Street
Oxnard, CA 93030
RE: Proposed Cannabis Retail Facility at 1015 Harbor Blvd., Oxnard, CA 93035 TO THE COMMISSION:

This letter is written to request, in the interests of public safety, that the City of Oxnard Planning Commission deny the proposal for TD Enterprises’ cannabis retail facility. I am a homeowner in Oxnard Shores and I have concerns about the impact a cannabis retail store will have on the area. This shopping center has three intoxicant providers; a liquor store, a sports bar and a brewery. Adding another intoxicant provider creates a potentially dangerous environment where customers can purchase and/or consume alcohol can also purchase and/or consume cannabis products in the same location. This will result in more impaired drivers in the area and on heavily-trafficked Harbor Boulevard.

Another compelling reason to deny the proposal is that cannabis retail operations are targets for crime due to the presence of cash and cannabis products. In Los Angeles, the past nine years have seen an increase in reported crimes at dispensaries. (Kate Ly Johnston, “Pot May Be Legal, But Crime at Dispensaries is Rising.” Crosstown, December 10, 2019. 1 Cannabis retail stores have lines of waiting patrons that other shopping center visitors must maneuver through which puts them in a vulnerable position of ending up in harm’s way. The required presence of armed security guards for this store will impair the friendly beach- side ambiance of this small shopping that attracts tourists and visitors.

Additionally, this shopping center already has difficulties related to parking, deliveries and traffic especially on weekends and when the weather attracts beach goers. The cannabis retail store will result in more traffic, decreased parking for other customers and added congestion in the area. My suggestion to the property owner is that a more family-friendly business should open in the available space. The neighborhood would welcome a new dining operation such as a snack bar, taqueria, ice-cream vendor, etc.

I respectfully request that the Commission consider the above issues and deny the request to permit a cannabis retail operation at the above location at the next meeting to be held on January 13, 2022.

Sincerely,
Linnea von Wissmann

Dear City of Oxnard:

My husband and I are residents and voters who have lived in Oxnard Shores for the past 18 years. We urge you to vote against establishing a cannabis store in our neighborhood. We are a residental neighborhood that already has a liquor store, brewery, bar/restaurant, out of control theft, unregulated vacation rentals and many homeless individuals who frequent the area. We already feel that our city has failed us on many levels. Please stand with us in keeping cannabis out of ANY residental neighborhood in our city. Our children need to live in a safe environment and Oxnard Shores is not the safe neighborhood it once was. Allowing cannabis to be sold here will only speed the decline of what once was a safe and beautiful area that all the citizens of Oxnard could enjoy.

Thank you for hearing our concerns.

Mayor and Members of the City Council
Although I support the goal of getting beach and harbor residents' and visitor cannabis dollars into Oxnard, if the Holistics shop is sited in the Shores strip mall, this resident, and most of the folks I have talked to, will continue to patronize the shops on the Green Mile in Port Hueneme. Therefore, I urge the Council not to overturn the Planning Commission decision.

This strip of shops is just too difficult to access. The Green Mile, in Port Hueneme, is so much easier to access, park and leave.

I do patronize the cleaners, bakery and restaurant, but, truthfully, as seldom as possible. Each time, driving west on Harbor and turning into Little Harbor, I have a slight sick feeling in my chest. It is a bad turn. It is bad going in, as it is so narrow and conflicts with traffic on Wooley. It is way, way worse getting out.

This strip and the service road called Little Harbor would need to be reconfigured and additional signaling added to make me and many more comfortable with what I consider to be a poorly designed business area and one that is pretty much local only.

To get out of the place, I always go around the back, make a left on Wooley and usually stop at the light. Little Harbor is then to my left and if there is a car, truck or cycle that wants out at the same time, I know it could go badly, since there is no signal or signage to direct those drivers. To get behind me is nearly impossible. Waiting for the green and for me to make my move first loses seconds for them. The light could change before they can move, especially if either direction Wooley traffic also starts to move. If they try to move before me and cut me off, CONFLICT! Bam!
Getting out the west exit, turning onto Little Harbor east or west puts you in No Man's Land. If you are going west, you'll have to go half a dozen streets before you can make your move. And again, no signal, so you have to cross two way traffic by yourself. If you are headed east, then you have the problem I described above. The only sane route is to exit the west end of the strip, turn west on the service road and take the first street that allows access to Harbor eastbound, go to the intersection with Wooley, wait for the signal and make a U-turn. Does the sound like it is really worth the inconvenience?
The need for the service road along the various Shores streets is obvious, but we all know about the accidents that have occurred, the number multiplying during these plague years, with all the souped up cars and tricksters on the roads now.

2/14/22, 3:04 PM City of Oxnard Mail - Proposed cannabis store in Oxnard Shores-Item M1 Feb 15 2022 https://mail.google.com/mail/u/0/?ik=bee10df961&view=pt&search=all&permmsgid=msg-f%3A1724409084939184809&simpl=msg-f%3A17244090849… 2/3 Truthfully, how was the site chosen without a traffic pattern study? Put this on hold and drive out there. See if you do not think it is one funky place to access.

City staff think the Air B&Bs and the three bars are going to make the Shores a pot hot spot. Unlikely. I have begged for promotion of Oxnard as a beach city for 30 years, but all hearts have always been with the redesign of the downtown. The waves are no good for surfing; the rip tides are dangerous for swimming and the city's refusal to sponsor a lifeguard are all well known issues.

Why did the applicant not do market research instead of accepting the site suggested by the city? And city staff, what is wrong with Seabridge? Always a hot spot, populated day and night by locals and visitors alike, there are two ways to ingress and egress, good parking, good traffic control and several vacant pads. Others have suggested 5th street, also easy access but fewer people around the general area.

I hope you have all taken the time to drive out there and get in and out of the Shores strip. If you want this cannabis money for Oxnard, choose a more accessible site. I would not risk that corner and that alley like road for a reefer and a lot of others feel the same way.

Lauraine Effress
LIttle Harbor, a way too narrow, two way service road is a totally different kettle of fish.

Controlled only by the aforementioned signal, it is impossible to know whether to go directly onto Harbor, if you can make it, or turn onto Wooley (which takes a bit of maneuvering) and stop at the main signal. Most just go for it and try to make it directly onto eastbound Harbor bypassing the signal (since no signage tells you this may not be "legal."
Whichever, you feel as if you are taking your life in your hands, especially with the big pick ups and the recently numerous number of souped up cars that like nothing better than to shoot out from wherever and cut you off. I am not up for a game of chicken just to buy a reeefer.

Add the additional traffic the pot shop hopes to generate and, bam! Accidents! Despite the traffic study indicating that the accident rate at this intersection is not excessive, with the recently built condos, and the addition of traffic to the cannabis location, the accident rate will accelerate, in my opinion. Do we really need to wait and see? Accidents from streets in the Shores trying to access Harbor in either direction are well

I jsut do not get it! Why has a supposedly savvy city staff and business people homed in on this ridiculously "hidden" location, known mostly to locales and well known as a very difficult place to get to.

Why in the world does the applicant not put this shop into Seabridge. There are now 2- 3 vacant pads, plenty of parking, lots and lots of people day and night to patronize the door, two entrances and exits (one onto Victoria in either direction and another onto Wooley in either direction. This seems like a much more logical business location than a remote strip mall mostly locals know about.

I have not followed this closely and just recently learned that this was a proposed location. I was pretty surprised.

Of course, you would like the cannabis money to move from Hueneme to Oxnard, but easy and safe as it is to get to Hueneme, I predict that those presently going to Hueneme will continue to do so becaue it is just easier and safer.

I am a resident and voter who lives in Oxnard Shores and I disapprove of the proposed Cannabis store in Oxnard Shores.

Currently, that location has 2 bars and a liquor store. We are already coping with patrons leaving these locations often under the influence and then getting in their cars and driving away. The intersection at Harbor Blvd., the South Harbor Service Road, and Wooley Rd. is a dangerous intersection to navigate for sober drivers due in part to the service road and the many who speed along Harbor Blvd, and it becomes more difficult to navigate when the driver is under the influence of any substance. While not all customers will consume or partake of the products immediately on or near the premises, some will. This will continue to contribute to the dangerous driving situation that we must deal with every day.

Thank you,
Kari Tudman

I am writing to add two thoughts to my letter of 21 January as you prepare for the hearing on 15 February. 1) After several months of asking, I have finally met with the proponent of this project, Tony Hall (yesterday afternoon), and the Security Consultant, Randy Latimer (this morning). Both have acknowledged the unique situation of the 6 residences abuting the retail center to the north, and both have apologized that little was done to reach out and engage the residents of those six properties directly affected by this proposal.

In short, I specifically raised my concern about armed guards patrolling Outrigger Way, the small alley/street that is the only separation of the homes from the property. Both acknowledged the concern, and did their best within the limitations placed on them by staff at the City of Oxnard to address the security plan for the project.

Unfortunately, the facts remain the same.
a. The state mandates armed security.
b. That security will at some point patrol the north side of the property in front of the rear access to our homes. c. The City will not allow us to read or participate in the security plan, which means we will have armed security we have no control over in this area.
2) While I am satisfied that Mr. Latimer will be responsive to our concerns as both the security provider and our neighbor, there is no guarantee he will have this contract in perpetuity, and we have no control over how future security arrangements may affect our homes.

In the end, I would put this question back to each of you. Would you like to have armed security patrolling the property line of your home and have no official say in who they are or what they do? Individuals who are not police officers, and whom you have no assurance have anything beyond the modicum of training required for this role? This is a tremendously unfair burden to place on us, and I ask that you uphold the Planning Commission's decision and deny the appeal. This location should never have been approved for this use due to the impact on the six homes on the north side of the retail property, and the Council has the perfect way of addressing this mistake on Tuesday Night.

Again, I am happy to answer any questions you might have, and to engage in a similar conversation to the one I had with Tony and Randy at the location to see this impact first hand. - Ken

Dear Mayor and City Council:

As an Oxnard Shores resident, I am writing in SUPPORT of Oxnard Holistics' proposed cannabis retail establishment at the Oxnard Shores Shopping Center.

Access to safe, legal Cannabis in the City of Oxnard is important to me. I am a Registered Nurse and I believe strongly that There are CBN and THC solutions to problems normally treated with addictive and potentially harmful drugs. No oe has ever fatally overdosed on Cannabis.

Oxnard Holistics has pledged to be an asset to neighboring businesses and in the community.

The parking lot at Oxnard Shores is in need of monitoring and security. I hear the concerns of those who are concerned about armed security in the neighborhood but I believe they are for more likely to be injured by a drink driver. I am consistently seeing open liquor and consumption on the property in conjunction with teenagers biking and skateboarding there. OH will prohibit consumption on the property of their product and will certainly discourage alcohol and loitering.

Possible there could be a compromise on loaded guns. Rubber bullets? Guard dogs? Mace? Tasers? Lassos? In the current climate, it is worth discussing.

Please listen to the voices in support of this project that actually live at Oxnard Shores.

Vote to APPROVE Oxnard Holistics’ permit.

Thanks.

VOTE NO- OXNARD HOLISTICS
2-3-2022
Dear City Council Members and Mayor,
We ask that you vote NO and not approve the Oxnard Holistic permit based on the following points:

1. Safety & Enjoyment:

Honestly, it has gotten to the point that we do not walk by the strip mall close to dusk due to some people just hanging out (maybe doing their laundry, OR?). A pot store will only increase this issue. We want to continue to be able to take guests-children over there to sit outside at the tables enjoying a pizza or donut. But, since the proposed Pot Shop will be in the middle of the strip mall with an armed guard surveilling the area just feet away from the tables, it will not be the atmosphere we desire. Please do not affect our lovely businesses that we (& all the visitors and vacationers) all enjoy so much.

2. Lack of Adequate Buffer Zone:

I have Google mapped all 16 proposed sites and we are the only one surrounded by residential homes with the nearest being just about 100 feet away. CA State law is absent on a buffer zone from dispensaries and residential homes (vs. schools). But, the County of Ventura enforces a buffer zone of 1200 feet for schools and residences.

3. Dangerous and Inadequate Egress:

Have you personally tried to make a left on to Wooley when exiting that strip malls eastern exist? You have to make a right on a narrow frontage road then make a VERY DANGEROUS left on to Wooley. Your own City of Oxnard Ordinance for Cannabis retail states: "Be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate".

If you have never attempted this left turn, I ask that you try between the hours of 5 & 7 p.m. Monday through Friday. But, be very careful & watch for pedestrians. Watch out for drivers traveling west on Wooley across Harbor Blvd. that have the sun in their eyes. Keep in mind this is not yet summer when foot & bike traffic increase. Most all locals never attempt this turn! This little beach community was developed back in the early 1960's & the little strip mall was zoned to provide the community with basics: Laundry mat, restaurants, a liquor store, etc. It wasn't until at least 1979 that Wooley went through from the beach to Victoria. That intersection was not designed to handle much traffic. We already have a Brewery, a restaurant that serves alcohol, & a liquor store. I don't know the facts of what happened, but just a couple of weeks ago, there was an accident at that intersection that resulted in a young lady getting broad-sided, bones broken, and removal of part of her intestines.

This is the proposed pot store site. It was a sandwich place for years. Then it was going to be a Mexican food place which most all of us were looking forward to but then came Covid. We love getting donuts or pizza or other food and sitting at these benches. We certainly will not be doing that if a pot store opens and customers are going in & out & an armed guard will be standing vigil.

This is the proposed pot store on the left. About 100 feet down at the end is a street lined with homes.

I am standing on Little Harbor facing south towards Channel Islands Harbor. To the left of the bushes is Harbor Blvd. To my right is the parking lot & proposed pot store. Parking is not allowed on this narrow street on the side where the mailbox is. But, it is allowed on the other side of the street. There are a couple of exits out of the parking lot on to this narrow street. The street at that stop sign is Wooley. If you make a right it takes you to the beach. If you make a left, you head east to Victoria. You can see a car turning off Wooley and heading north towards me on this small street. So, in order to make a left on this small street on to Wooley, you have to figure out when you have a green light, if anyone is crossing this small street (where that car is), you have to make sure no cars on coming from the right to turn like this car or go straight, etc. Frankly, in all the years we have owned a home here, we have never attempted to make that left or proceed south on Harbor Blvd. BUT, non-residents don't know this! Remember Wooley did not go through prior to 1980 when they developed this community. DUI (alcohol and/or pot) is a recipe for disaster. It was certainly ironic: as I stopped to take this pic, someone in the parking lot was smoking pot in their car.

Here is another perspective. I am standing on Wooley facing east towards Victoria. My line represents anyone coming off that little street (Little Harbor frontage road) and making a left to proceed up Wooley towards Victoria. Once you make that left, unless you have a green light, you have no where to idle till the signal changes.

Your own City of Oxnard Ordinance for retail Cannabis states: "Be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate".

Oxnard Holistics application states: "The proposed business will have 5 POS terminals in Year 1, 6 in Year 2, and 7 in Year 3". If there are 7 Point of Sale terminals with customers cycling in/out every 15 minutes, in one hour they could have 35 customers. Sure, that great sounds like good income for the city, but what do you think the risk of car accidents or pedestrians getting hit will be?
I am not against Cannabis! In fact after my neck injury I found an edible that I used for the extreme nerve pain. I really had to weigh the issues of having this cannabis store at this location. But after much deliberation, I have come to the conclusion that this is NOT the right location. I hope you will too! Oxnard is a big city & you have many options for other locations in which to generate revenue.

Please weigh the cost-benefit ratio carefully when you vote for this location.

Please vote NO

Thank you & most sincerely,
Kathy & Steve Guerrero

Councilman Perello:

Count me as one member of the 47% of the California Public that voted against the legalization of Marijuana. Count me also as member of the Oxnard Shores Community that is against the location a dispensary in this community. All the reasons are too numerous to list but here are a few:
1) Property Values ..Nice to know we have dispensary within walking distance is not going to reward the long time residents real estate values.
2) Criminal fringe element...Smash an grab always target Dispensaries regardless of security. 3) It is compromised industry that still has a vast majority of participants involved in the in the illicit market. Legalizing cannabis in order to drum up tax revenue only has raised the cost of running a cannabis business and therefore the cost of a gram of weed, pushing sellers and consumers back to the illicit market. 4) Businesses frequently pay an effective tax rate of 70% because they are breaking federal law and are therefore are not able to take tax deductions. Certainly the city sees the industry as a source of tax revenue and may set higher rates but it is a compromise to the quality of life for the residents in the Shores. Surely the proprietor of this business has provided financial projections to the city, but estimates are that only 10% of the legal cannabis shops make money. 5) Marijuana is the most common reason for arrest in America. The establishment of this business will facilitate ... the purchase of weed, drive down Wooley, make a left on Capri, park illegally, walk across my property, smoke a joint or two get in the car and exit through the Streets of the Shores as a DUI. This happens routinely now.

Do we really need to compromise this neighborhood and entertain a shady industry with a foundation of 80-90%

Esteemed Mayor and Councilpersons,
We are writing to urge you to uphold the decision made by the Oxnard Planning Commission regarding the location of the proposed Oxnard Holistics cannabis dispensary at the Shores shopping center, corner of Wooley and the Harbor Blvd access road.

If you are not familiar with the location, please take a drive out to see for yourselves that this location is not appropriate.

The entrance to the parking lot is not off Harbor Boulevard, but off the adjacent (separated by a median) service road.

This road is not wide enough for two cars to pass when there are cars parked on the one side where parking is allowed.

The other access points are from Wooley Road, which is a congested and accident-prone intersection, and Outrigger Way, which functions as a 15-mile-per-hour alleyway. The applicants say they expect 250 car trips per day. This small neighborhood center will not support that kind of traffic.

We are concerned that the shopping area is already 1/4 occupied by adult businesses which provide alcohol, and will be 1/3 if the cannabis operation opens. There are many more suitable locations on the west end of town. Oxnard Shores is a quiet neighborhood, with more families and children moving in. Please think about the proximity of homes to this shopping area, about the neighborhood kids seeing armed guards.

Please know that we are not opposed to the use or sale of cannabis. We are offended by the company in question touting their charitable willingness to provide “medicine” for folks in the neighborhood. It takes just a few minutes to review the menu for their store in Mammoth to see that there are almost no medical, CBD or CBG (non-intoxicating) products listed. It is all about getting people high and making money. If you want to approve their use, please consider a better location, such as an industrial park (as Ojai and Thousand Oaks have done) or a large retail/ service location that is separated from residential backyards.

Respectfully,
Karen Brooks

I heard they got turned down by planning and they are appealing to city council Please do not approve!! another concern is when my grandkids come over and I take them to the dount shop or store there in the strip mall. There will be at least one or 2 armed guards outside this proposed shop., leading to a SAFETY issue if trouble starts with guards who are authorized to use lethal force if needed.. Again these are not trained Police officers, just private guards with police vests on and loaded up with guns. With a cash only business you are asking only for trouble.. There are other options to put this store in.Thank you Ken and Kim Boyd

Subject: Monday Nov 15 item td enterprise permit 21-516-24 Holistics This proposed cannabis store is in a small strip mall surounded by 1700 homes. Why not put in channel island marina with all the boats. Or Seabridge shopping center witch has open vacant stores including the chase bank area who are closing that branch next month.. All the cannabis stores along the green mile on channel islands blvd . have not one by two heavily armed swat style guards out in front of each one. Good for business. Why do you need guards? cash business. I live right around the corner and my main complaint is this business is out of step with the surrounding area, coupled with the fact as we all aware of the large number homeless people who live right across the street in the Dunes between 5th st and Wooly. They come down the streets at all times of day and night looking for things to steal to use and resell. This shop will give them more reason to do so. In fact 3 years ago we had a homeless lady break into my yard steal items from my garage and then took screens off to try to enter my house. I confronted her and she ran off. Called Oxnard police who did an excellent job of finding her after 2 other neighbors called as she tried to break in their houses on camera. We installed a security system and motion lights.I went to ID her in police car and the officer said they knew her from past arrests .Point being their are alternative locations in Oxnard for this business, and

1 My name is Jesus Torres, CEO of LEAD Public Strategies, on behalf of my client , TD Enterprise DBA Oxnard Holistics, I am submitting a memo outlining the community outreach efforts implemented to introduce, inform, and engage the Oxnard beach community residents. As you may know, my client, Oxnard Holistics, is proposing a cannabis retail establishment at 1015 Harbor Blvd.

In November of 2020, Oxnard Holistics, with the assistance of LEAD Public Strategies, conducted outreach to local community organizations, including Gabriel’s House, Oxnard Firefighter Foundation, Oxnard PAL via California Police Activities League, and LULAC, Council 3147. In addition, in September 2021, Oxnard Holistics engaged with the Audubon Society, Surfrider Foundation, and Friends of Ormond Beach.

In December 2020, during the cannabis retail application phase, Tony Hall, CEO, Oxnard Holistics, conducted business to business outreach at the Oxnard Shores Shopping Center to introduce himself and let neighboring business owners know that Oxnard Holistics was proposing a retail establishment in S uite 1015. Mr. Hall has stated that he received no opposition at that time. In fact, he received some enthusiasm that a new business was moving into the anchor suite of the shopping center, thereby increasing business traffic. LEAD Public Strategies was not involved in this effort. See Petition as Exhibit A.

On February 16, 2021, Oxnard Holistics was an invited guest presenter at an Oxnard Shores Neighborhood Council meeting where Mr. Hall formally introduced Oxnard Holistics to local residents and provided a description of the ownership team, business model, and showcased renderings of the building interior and exterior. He proceeded to answer questions from residents.

In September 2021, Oxnard Holistics requested that LEAD Public Strategies create an aggressive outreach plan to ensure local residents are aware of their proposed cannabis retail establishment at 1015 Harbor Blvd and address concerns that may come up. I presented Mr. Hall with a plan that involved canvassing, direct mail, e-mail blast, a new project specific website, and an Open House event at the Mandalay Beach Resort located at 2101 Mandalay Beach Rd in Oxnard.

Canvassing the Oxnard Shores neighborhood commenced on Saturday October 2, 2022 and continued on Saturday October 9, Sunday, October 10, Saturday, October 16, Sunday October 17, and finally on Saturday, October 23. The geographic area of focus were households approximately 1,000’ from the 2150 Pickwick Drive, #1732

RE: Community Outreach Memo on behalf of TD Enterprise DBA Oxnard Holistics 2 shopping center of the proposed retail location. Specifically, our canvassers started on Whitecap Street and made their way down to Dolphin Way and portions of Mandalay Beach Rd. Approximate 600 households were canvassed and canvassers spoke directly to 60 residents. Most homes were gated or inaccessible, vacant, or some residents didn’t’ answer their doorbells. Mr. Hall personally canvassed the neighborhood on October 16th and 17th.

Of the 60 residents we engaged, 17 were in full support and happy to hear that they would have access to cannabis without having to drive to Port Hueneme. One resident on Outrigger Way stated that she drives her elderly neighbor to Port Hueneme to purchase cannabis products for their spouse who suffers from a debilitating disease. Another resident on Outrigger Way, a retired film stunt person, was elated that a nearby dispensary would be coming soon due to his use of cannabis for its medicinal benefits. There were approximately 10 residents that were opposed to the proposed retail store including a retired police officer on Outrigger Way and two residents on Terramar Way who expressed their concerns that the proposed store would attract “bad elements.” One of our canvassers spoke to the Chair of the Oxnard Shores Neighborhood Council at their home on Whitecap Street on October 2, 2021, for approximately 20 minutes. He expressed his concern with traffic issues.

The remaining residents, a majority, were indifferent to the prospect of a cannabis retail establishment at the Oxnard Shores Shopping Center.

A postcard inviting local residents to an Open House event at the Mandalay Beach Resort was mailed on October 18, 2021, to a voter registration universe of 845 households. In addition, a follow-up email was sent to a list of 706 registered voters on October 29, 2021. See Exhibit B and C.

On Thursday, November 4, 2021, Oxnard Holistics hosted an Open House event at the Mandalay Beach Resort from 5:00 p.m. to 7:30 p.m. Twenty-five (25) residents attended and the entire Oxnard Holistics leadership team attended, including the project’s architect, security consultant, and myself from LEAD Public Strategies. The Oxnard Holistics team answered questions and had “info boards” set-up around the room including boards on project layouts, renderings, timelines, and community partnerships. See photo of Open House in Exhibit D.

Oxnard Holistics sent 3,243 Community Workshop notifications to residents of Oxnard Shores and Oxnard Dunes neighborhoods on November 4, 2021.

Finally, on Saturday, November 6, 2021, the Oxnard Holistics team took part in an Ormond Beach Clean- up event with the Friends of Ormond Beach organization. Other community groups took part as well.

LEAD Public Strategies has worked on community outreach efforts on behalf of other retail cannabis applicants and Oxnard Holistics’ efforts were the most robust and aggressive so far. It is my hope that this memo provides you a detailed description of all the outreach that was conducted to inform and engage local residents on this proposed project.

I am available to answer any follow-up questions.

Sincerely,

Jesus Torres

Dear Mayor and Council members,,
For months our Neighborhood anticipated the opening of a Mexican Taco eatery, as advertised by the owner of the Oxnard Shores Shopping Strip.

Since this small shopping strip is the entrance to our Oxnard Beach, a place for families and beach goers to stop, wash up and get a bite to eat would have been more than welcome and appropriate.

Instead, we are looking a potential Cannabis retail business, which is just that "a business". Patrons will come to get healed or get high. Not to visit one of Oxnard's strongest assets.

Please consider this when reviewing Oxnard Holistics Appeal.

Respectfully,
Julie Pena
Oxnard Shores Resident

E-MAIL REBUTTAL—COMMERCIAL CANNABIS RETAIL PERMIT, NO. 21-516-024

February 5, 2022

TO:

Mayor John C. Zaragoza
Mayor Pro Tempore Bryan A. MacDonald
Councilmember Bert E. Perello
Councilmember Gabe Teran
Councilmember Oscar Madrigal
Councilwoman Gabriela Basua
Councilwoman Viany Lopez

Honorable Mayor and Esteemed Councilmembers:

As I am unable to attend this hearing in person, please accept this written document as the statement I would have given had I been able to make a personal appearance and read this into the record of these proceedings as such.

My name is John Ficken. I am a resident of the area we are all calling the “Shores” for this Hearing.

I retired in 2019 after a 29 -year career with the Los Angeles Police Department. Twenty -five of my 29 years were as a Motor Officer and Motor Sergeant. As it is germane to th ings I will say later and expect that they be taken with a n increased degree of g ravitas, I offer the following by way of establishing my bona fides here:

In addition to having been a sworn law enforcement officer, I have additional specialized training and experience in gang enforcement , Internal Affairs investigations, traffic enforcement, DUI enforcement (to include DUI/drugs), collision investigation, traffic engineering, and as an Area Commanding Officer’s Adjutant. I was a Certified Drug Recognition Expert and recognized as a Court-qualified expert on the evaluation of drug and/or alcohol impaired persons , with specialization in the synergistic effects of the various classes of drugs and their presentation to the trained observer . As a DRE, I have hundreds of hours of classroom training and supervised practical application in the field, and I personally have conducted hundreds of (logged) evaluations involving criminal activity and subsequent prosecution.

John Ficken
E-MAIL REBUTTAL—COMMERCIAL CANNABIS RETAIL PERMIT, NO. 21-516-024

Additionally, I was registered with the Califor nia BSIS and in possession of ever y security classification they offer, in that for eight years I worked in an off -duty capacity at the Ronald Reagan Presidential Library, which is a designated Federal facility.

Having read the 42-page Letter of Appeal submitted by Mr. Alfred Fraijo, Jr., for the law firm of Sheppard, Mullin, Richter & Hampton on behalf of the Applicant, TD Enterprise s (“Oxnard Holistics”), I will now offer several points of rebuttal for your consideration. In the interest of brevity, I will make my rebuttal in bullet point format, referencing the document page and paragraph of Mr. Fraijo’s letter. Note that in referring to the Applicant’s legal representatives, I will use terms such as “the Firm” or “the attorneys” to save time. No disrespect is implied or intended by my using this shorthand terminology.

Page 3 ends

Attorneys for the Applicant state that despite the recommendations of their own Staff (i.e., “employees”), the City Planning Commission (i.e., “the employee’s bosses”) “puzzlingly” denied the Oxnard Holistic permit. At the risk of sounding pedantic here, it must be recognized that the Commission is not required to confirm and follow “decisions” made by their staff. The way it works is your staff investigates an issue and submits a report to one or more Department heads or Supervisors and they decide where to go from there , using all, some or none of the recommendations made by said Staff. Making such decisions is what the Department heads and Supervisors ar e paid to do. This placement of the proverbial cart before the horse is the first of several attempts by the attorneys to obfuscate the facts in order to achieve the result the Firm is being paid—and paid well—to obtain.

Page 3 ends

The Firm spends a great deal of time here trying to pull case law into what was, in fact, a case of the Shores Community being heard, and their wishes acted upon by representatives of their elected Municipal government. This is called “Democracy.” Not being paid to believe in Democracy at this time, the Firm asserts that the actions of the Commission were “arbitrary and capricious.” The Oxford Dictionary defines the word “arbitrary” as “acting on a whim” and the word “capricious” as being “suddenly and unaccountably changeable.” The attorneys are attempting—with their included citing of old and obscure case law —to show malicious bias against the Applicant by the Commission , when in fact what the Commission did was chose the needs of the many over the wants of the one. Finally, we see here the second of several times throughout this document in which the Firm calls statements made by Shores residents speaking against the Applicant ’s plan “erroneous,” and “inaccurate.” The Firm is t rying to cover all the bases, apparently, by calling the residents of the Shores “mistaken liars.” The Firm ’s assertions in this section are argumentative in nature and provide no evidence that the Commission’s decision was incorrect other than by saying, “they’re wrong because we said so.” John Ficken

Page 4 ends

Historically, Field Officers have a love/hate relationship with their Commanders and Administrators. Note that the Firm’s use of “arbitrary and capricious” should be inserted here. Neverthe less, they are still sworn members of the Department, and if “Staff One” requests assistance over the radio frequency, all coppers in the area will go hell-bent-for- leather to the scene; that Command Staffer might be an idiot, but he or she is our idiot.

It is because of this love/hate relationship we Field operators have with our Administrative Commanders that I find myself horrified, appalled, and dismayed that Chief Salinas would leap so deeply into the pool of pot sales, emerging as a re-born prophet of reefer madness, traveling the wastelands, and preaching the Word of legal dope for City cash coffers.

The Chief appeared before the Commissioners and somewhere along the line, dropped the phrase, “myths, misconceptions or untrue anecdotal stories.” The Chief is also said to live in Oxnard, having worked for OPD for 20 -plus years before accepting the Port Hueneme COP position. I will address some of these anecdotes shortly, but I can guarantee you this—Chief Salinas does NOT live in the Shores. If he did, the Applicant would have already been moved to a more appropriate location. But we all already knew that didn’t we?
Continuing within this Section, let’s talk about safety— The Firm makes much of a vaunted Security agency, to be contracted by the Applicant.

Mr. Mayor; Honorable Councilmembers—you are being gaslighted.

One only need take a brief trip to Port Hueneme's Wheelhouse Mall complex pot shops and spend 30 minutes there to understand what I mean. I have been there, numerous times, for dental appointments, and have se en--firsthand--how disastrous a scenario that area has become.

Quite frankly, it's to the point to where I schedule my wife's appointments concurrently with mine, and I go armed. There is a very seedy undertone there now, and based upon my training and experience, I can point out any number of obvious felons who are hanging out at the location. This shall not stand in the place in which I live. It's one thing to go to a public large-mall complex knowing what to expect, and what you're letting yourself in for.

It's quite another to feel unsafe in my own home because that criminal element has been allowed by the City that's supposed to protect me and mine to be transported here, because "there's already alcohol, so why not a pot shop?" More on that statement in a moment.

As a former holder of a BSIS license who spent years moonlighting at the Regan Presidential Library, I can tell you what you’re not being told.

Plain and simple, security officers --even those who are armed --have NO police powers under Section 836(a) of the California Penal Code , which describes wh o can lawfully take police action in this State.

John Ficken
E-MAIL REBUTTAL—COMMERCIAL CANNABIS RETAIL PERMIT, NO. 21-516-024

So, I can tell you right now that any security assigned to the pot shop will do NOTHING outside the front door to the place; they are there to discourage the above -mentioned criminals from engaging in felonious activity inside the location only. To be told by the Firm that these security personnel will be a vailable to save the day if something bad happens at the mall, or that their very presence will have a chilling effect on crime and the presence of the unhoused is to be told something that is patently not true.

Now—let’s just assume that they are outside, patrolling the parking lot in a manner that I saw outside Safeport Cannabis earlier this week . Over -armed, over-armored and poorly trained, these security personnel are a tragedy in the making, and a source of City liability.

As an honorably retired Police Sergeant, I have been granted the privilege of carry ing concealed weapons. So--what happens when the wind takes up my shirt a nd one of these guards sees the gun in my waistband?
I personally do not want armed guards visible anywhere in my neighborhood. This devalues my home—my greatest investment. I live across the street from a Realtor, who has informed me that if the Applicant is allowed to open, the presence of his store will have to be disclosed to any potential buyers.

Page 5 ends

Now, this whole section just angers me. Here are a whole group of people, who don’t live here telling me t hat this is going to happen, whether I want it or not , and the whol e neighborhood just has to eat it and smile. Unbelievable. According to the Firm, our concerns are to be rejected as “improper or baseless,” and shouldn’t even be considered.

Since legalization, pot shops have sprung up like weeds, and it's like the Wild West out here. I would have no problem if California were still operating dispensaries, and the drug remained only available to the folks who truly need it, but that battle was lost, and I can tell you as a seasoned, trained observer of people and their habits, many individuals who are frequenting pot shops are the ones who would have no problem with committing acts of thievery, robbery and burglary in a residential neighborhood such as ours, because it is in the nature of criminals (especially when chemically altered, say, perhaps, by marijuana) to do so. It is my understanding that there are commercial properties available that are not near residential neighborhoods. Why isn't the City stepping up, doing the right thing, and directing the applicant to find a home in one of those locations? Why is it even being considered by the Co uncil to allow this pot shop to ruin my peace, quiet, and most especially, the value of my residential property investment?

John Ficken
E-MAIL REBUTTAL—COMMERCIAL CANNABIS RETAIL PERMIT, NO. 21-516-024

Page 7 ends

The Firm claims that there is existing infrastructure in place to handle traffic at the location.

This is patently untrue . The location i tself sits on the Harbor service road, or “Little Harbor,” as we all seem to call it. To the south is Wooley Road . The intersection of Wooley, Harbor and Little Harbor is more poorly engineered than the “Five Points ” intersection of central Oxnard.

The Firm took the time to define what a “highway” is, and yes, they are correct—it’s that thing we drive on, wherever we may be. What the Firm did not consider w as Outrigger Way, which their letter sa ys will be on e of the primary ingress/egress arterials to the Applicant’s proposed location.

However—Outrigger Way is an ALLEY, per Section 110 (Definitions) in the California Vehicle Code:

An ALLEY is any highway having a roadway not exc eeding 25 ’ in width which is primarily used for access to the rear or side entrances of abutting property.

All the residential properties on the north side of Outrigger Way abut their garages with the highway. The roadway i tself—measured property line to property line —is approximately 20 ’ wide. I know this, bec ause my home is one of those north -side properties, and I have gone outside and measured. Ironically, the proposed location of the Applicant’s store also abuts Outrigger Way for rear access to the mall itself.

California Vehicle Code Section 2235 2 gives the prima facie speed in any alley as maximum 15 mph.

Simply stated, this nullifies the Applicant’s proposed traffic plan. An alley cannot be used as a main thoroughfare. Period. As residents we have problems enough with speeding on Outrigger Way, because Wooley Road has speed humps installed upon it th at go all the way to the beach. I notice neither the Firm nor the Applicant chose to mention that in their report, either, although they do arrogantly suggest that the City shall widen roads to their specifications and for their own needs in order to handle the exc essive traffic they expect to draw.

Page 7 ends

Ah, yes. Do what we say, or we’ll sue. My response is simple: In a City where elections are so narrowly decided in closely contested races, would it not be better to avoid angering a bun ch of retired Boomers who have nothing better to do, possess a certain level of influence within the City, and who WILL vote? In other words, WE say what is done in our neighborhoods, not some rich Corporate entity.

John Ficken
E-MAIL REBUTTAL—COMMERCIAL CANNABIS RETAIL PERMIT, NO. 21-516-024

In conclusion, I will t ouch upon my own anecdotal experience with cannabis, even though both the Firm and the Applicant have made it clear that in their opinion, our thoughts and feelings are antiquated, wrong, fearful, or out and out lies—and therefore should be utterly rejected by the City.

Incredibly, arrogantly, patronizing and insulting.

In my time as a Drug Recognition Expert, the one constant I found was that drivers who were under the influence of m ultiple classes of drugs or narcoti cs consistently al so had cannabis on board. Cannabis is used as the great drug cocktail additive. Being in the class of Central Nervous System (CNS) depressants, it takes the edge off some illegal drugs and adds a “pleasing” effect on to others.

The most com mon combination of drugs I found in use was cannabis and alc ohol being used together. Alcohol , being another CNS depressant , when consumed with cannabis causes an “additive effect.” This means that the subject becomes “more drunk” faster and harder, often with disastrous and tragic results, especially behind the wheel of a car.

I have heard the screams of trapped victims burning to death in their car , after being struck by someone who, of course, walked away nearly unharmed . When I completed my evaluation, cannabis and alcohol were the primary cause of this murderer’s impairment.

I mention this not to be gruesome, but to make on e last plea to you, Esteemed Councilmembers, to disallow this Applicant’s appeal to be allowed to place a cannabis retail store between two bars and a liquor store, knowing what I have just told you, and knowing as well that there are at least three homes on Outrigger Way with infant to preschool aged children living in them.

Don’t put us in danger. Don’t destroy our neighborhood. Put the store in an industrial park, away from our kids, dog-walkers, and elderly residents.

Respectfully,
John E. Ficken, Sergeant, LAPD, Ret.

A vice business in a residential neighborhood where children will regularly be exposed to armed guards is not appropriate.

Oxnard Holistics is a high-quality business and they will be an asset to neighboring businesses and in the community. Having worked closely in the evolution of legal cannabis, I can personally and professionally attest to the nearly unparalleled level of operations that this team brings - there are extraordinarily few in the state that compare. You would be hard-pressed to find another operator who genuinely cares for, and participates in their community, more than this team.

Good morning,
I just wanted to provide support for the new cannabis store on Wooley in Oxnard. I am fully in favor of this store.

The residents of Oxnard would be able to buy this product withould going into Port Hueneme. It will provide additional revenue for the city of Oxnard. I have been in most of the cannabis shops in Port Hueneme and they are all clean and safe. There are no "unsavory" people outside. I would think residents would welcome a guard outside in light of the increased crime in our city.

Pease register my vote as a firm Yes!

But, I am not aware of any community outreach at the Shores until 11-15-2021.

He said when the city council adopted the regulations (that was Dec 15, 2020), they requested that we wrap up this first wave by this upcoming March. (2022)

Thank you~

Dear Mayor & City Council Members,
I realize it is enticing to think about the $$$ the city may receive from a Cannabis store at the Shores but you have choices. Please consider the impact this will have on families. People old enough to purchase it will drive 1/4 mile to the beach and light up. We already see it at Neptune Sq. and in the dunes by Embassy Suites. A Cannabis store at the beach will only enable this. During the summer families from Santa Clarita, Simi Valley, family vacationers staying at STR's, and our own local City of Oxnard families enjoy our beautiful beaches. What do you think will be the short & long-term impact on children smelling this? Let's not normalize cannabis. Having worked as the District RN, MA at Rio School District (now retired), I can assure you, families that can enjoy our local beaches do not need this uphill battle to keep their children on the right path to success. And, I have no doubt, out of town families will go elsewhere & take their tourist dollars with them.

Please Vote No for the Oxnard Shores location.

OXNARD HOLISTICS
MY REBUTTAL TO THEIR APPEAL:

Their rebuttal appears to possibly be in violation of the City of Oxnard Cannabis Ordinance # 11-473 Location & Design of Cannabis Businesses

This overlay map is on page 18 of Oxnard Holistics application to the City of Oxnard. https://www.oxnard.org/wp-content/uploads/2021/04/CCB-21-26_-TD-Enterprises_-complete-redacted.pdf

In their overlay map, it looks wide open between Harbor Blvd. and Harbor Service Road, which is in front of the proposed Oxnard Holistics site seen in orange.

But, in fact, you can clearly see the divider between Harbor Blvd. and Harbor Service Road in this is a pic I took from Google Maps of that same area.

Here is the satellite Google Map I took of that same area. You can clearly see there is a divider between Harbor Blvd. and Harbor Service Road.

Yet, The City of Oxnard Cannabis Ordinance states:

Pg 17 at bottom #5: "Be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate".
https://www.oxnard.org/wp-content/uploads/2020/12/Final-Version-of-Cannabis-Ordinance-2994.pdf

BUT~
As stated in their Letter of Appeal on page 10: (I added the bold & underline) file:///C:/Users/kozmo123/Downloads/Applicant%20Letter%20of%20Appeal%20(SUP%20No.%2021-516-024).pdf

"4. The site that is subject to the Special Use Permit shall be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate. As described in the Staff Report, the project is currently served by existing infrastructure and will continue to be accessed directly from West Wooley Road, Harbor Boulevard, and Outrigger Way public alleyway, which indirectly connects Highway 101."

They also state on page 10 #3
"The project site has a frontage and vehicular access on West Wooley Road, Harbor Blvd, and Outrigger Way"

BUT, in fact, that strip mall is accessed DIRECTLY & has a FRONTAGE from West Wooley Road, S Harbor Service Blvd (NOT Harbor Blvd) and Outrigger Way. This is a critical point as the intersection at S Harbor Service Blvd & Wooley is NARROW & VERY DANGEROUS!

ALSO~
Depending on where you park in that strip mall for the proposed Oxnard Holistics, Google map directions to Vons at Wooley & Victoria has you driving down S. Harbor Service Blvd & making a left on to Wooley. This is extremely dangerous.

Consider~

In the City of Oxnad's Commercial Cannabis Application Phase 2 Evaluation Report, Oxnard Holistics state:

"The proposed business will have 5 POS terminals in Year 1, 6 in Year 2, and 7 in Year 3 and use the TREEZ POS system. " "Annual revenue projections start at approximately $5.8M in Year 1 and grow to $7.8M by Year 3."

https://www.oxnard.org/wp-content/uploads/2021/03/CCB-2021-26-TD-Enterprise-LLC-dba-Oxnard-Holistics_Phase-2-Evaluation-Report.pdf

So, by year 3, if they are generating $7.8 million in annual revenue, and if they are open 365 days a year, their daily revenue will be $21,370. If, as an example, each person purchases $100 of product, there will be 213 customers per day.

In conclusion, please ask yourself :
1) Why did they omit the divider between Harbor Blvd & Harbor Service Rd. in their overlay map on their application to the City of Oxnard? 2) Why did they write in their appeal that the proposed site is accessed directly & has a frontage from West Wooley Road, Harbor Boulevard, and Outrigger Way" when it is not? FACT: It has direct access from Harbor Service Rd. not Harbor Blvd. 3) They wrote in their appeal that the site is 'subject to the Special Use Permit & shall be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate' when in fact, Harbor Service Rd is narrow, allows cars to be parked on the east side which further narrows it, and the intersection of Harbor Service Rd & Wooley is very dangerous!
4) Do you think that Harbor Service Road is safe to handle that volume of traffic? 5) Finally, does the above meet the City of Oxnard's Cannibas Ordinance that states on pag 17 at bottom #5:
"Be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate". https://www.oxnard.org/wp-content/uploads/2020/12/Final-Version-of-Cannabis-Ordinance-2994.pdf

PLEASE, IF YOU HAVE NEVER DONE AN ON-SITE VISIT, PLEASE GO OVER AND SEE FOR YOURSELF. IF YOU EXIT THAT STRIP MALL ON

TO HARBOR SERVICE ROAD & DRIVE TOWARDS WOOLEY TO MAKE A LEFT ON WOOLEY, YOU ARE PUTTING YOUR LIFE AND OTHERS AT RISK AS THIS IS VERY DANGEROUS.

Here is Harbor Service Rd to the left of the mailbox. It is seperated from Harbor Blvd by a median (to the left of the Service Rd where the bushes are). The strip mall is on the right. Parking is allowed on the Service Road on the opposite side of the street where the mail box is. Here you can see a car making a left from Wooley on to the Service Rd. There is a new striped crosswalk across Harbor Blvd. to the new 50 condo's you can see on the left. No doubt, there will be more foot & bicycle traffic from the condo development crossing Harbor Blvd and Harbor Service Rd to get to the beach and the strip mall. Now, imagine driving down the Harbor Service Rd. past that mailbox and trying to make a left onto Wooley to get back to Victoria (red line). The best all you can do is to come and check out for yourself how dangerous it is.

Is this why they omitted the median seperation of Harbor Blvd. and Harbor Service Road in their overlay map? Please, come see for yourself.

Do not approve the Oxnard Shores cannabis dispensary

During my POST, Police Officers Standard Training, it was repeatedly emphasized how SELDOM shots fired by trained police officers hit their intended target. Shots fired by security guards and criminals almost never hit their target.

One of the reasons I moved from Van Nuys to Oxnard was I was at the Costco armed car robbery Aug. 14,2000 that ended with one bystander killed and three wounded.

As reported in the Los Angeles Times, “Panic-stricken customers, many with children, dived for cover in the pandemonium. Bullets shattered car windows 100 yards away.

At least five other people were injured as they tried to escape the barrage of bullets sprayed into the huge warehouse discount store in the 6100 block of North Sepulveda Boulevard and across the parking lot. “They were indiscriminately firing into a crowd of people,” Los Angeles Police Lt. Jim Grayson said of the suspects.”
Cannabis shops aract this kind of acvity as recently reported in the Daily News of 15 shops robbed and 175 shots fired.

The only places for these gun shots by guards and criminals to go will be into bystanders and homes if the pot shop is approved in this residenal locaon.

These are not “myths, misconcepons and untrue anecdotal stories” but veritable facts.

I will not go to the shops in the strip anymore and I will not let my children or grandchildren go there if the pot shop is approved.

George White

We live nearby, we are excited for the community to have a business that in committed to beautify the area and keep it safe. Knowing there will be a security guard out front of the business is an added bonus to me as I have children and I walk by there quite frequently and can only go during certain hours due to the rowdy crowd and homeless issue from. I do not use recreational marijuana but I am not opposed to it it anyway because I think it actually helps our community as a whole. So....

Re: TD Enterprise/Oxnard Holistics & Oxnard Shores
Dear Oxnard Mayor, City Council members, City Manager Nguyen and Associate Planner Coyotl My wife and I have resided in Oxnard Shores for over 30 years.

As you know, Oxnard Shores is a small, quiet beach residential community. All commercial enterprises are located in one small strip-mall and TD Enterprise/Oxnard Holistics (“Holistics”) seeks to establish a marijuana dispensary (“pot shop”) in that small strip-mall. The Oxnard

2/14/22, 3:27 PM City of Oxnard Mail - Fwd: Oxnard Holistics and Oxnard Shores https://mail.google.com/mail/u/0/?ik=bee10df961&view=pt&search=all&permmsgid=msg-f%3A1724490271343473791&simpl=msg-f%3A17244902713… 2/3 Planning Commission denied Holistics’ permit application and Holistics has appealed. I write today to urge the City Council to uphold the denial of Holistics’ permit application.

1. There is no need for a pot shop in Oxnard Shores. (A number of pot shops are located a very short distance away. Oxnard Shores residents who smoke pot see no need for another nearby pot shop.)

2. Granting Holistics’ permit will contribute to a general degredation of Oxnard Shores. (The small strip-mall can accommodate a limited number of businesses, perhaps six or seven. Three of the current occupants include a liquor store, a bar (The Shores) and a brewery (Red Tandem).

Allowing a majority of businesses to be engaged in the selling of booze or pot will not improve or vitalize the community; it will bring it down.)

3. The Oxnard Shores community would be better served by a different kind of business; one that confers an actual benefit to our residential community. (The first “Future Home of …” signs that went up on the commercial space sought by Holistics announced a coming taco shop. That would have been great!)
Finally, inasmuch as Holistic's permit application was denied by the Planning Commission and Holistics is, now, appealing that decision, I would hope that the burden of proving an error by the Planning Commission rests with Holistics and that Holistics must meet or exceed some higher level of proof or persuasion in order to reverse the Planning Commission's decision. In professional football, the ruling on the field stands unless there is clear and convincing proof that the ruling on the field was incorrect. I hope that a similar structure is in place regarding issues such as the one we have here in Oxnard Shores.

Yours truly,
Gregory Fast,

To Whom It May Concern: I have received notice of your upcoming Public hearing on Tuesday, February 15, 2022 at 6:00 PM and am unable to attend this hearing.

As the owner of a single family home within several hundred feet of the shopping center involving this Special Use Permit, I would like to express my strong protest against granting this Special Use Permit. This small shopping center on Harbor Blvd is the only commercial property within about one mile of other commercial properties. It is surrounded by a large residential community with new residences just having been built across the street.

I frequent the bakery in this shopping center as do many other local residents and children. From witnessing other Cannabis businesses, including those on Channel Island Blvd in Pt Hueneme, I do not believe that this is the proper location for this type of business. While it is legal to conduct a Cannabis business in California, I believe that this type of business should be located in a commercial setting away from and not immediately next to a residential community.

I therefore respectively ask that my opinion be shared with the appropriate committee charged with making the decision to decide on this Special Use Permit.

Thank you very much.

Sincerely,
Frank Glaser

Hello
I am a resident of Oxnard Shores and I oppose the establishment of a marijuana outlet here.

This is mostly a retirement community and therefore inappropriate for such an outlet. We are a population vulnerable to street crime and studies have shown a rise in such crime around marijuana outlets.

This strip mall is where we go for a cinnamon roll or other domestic services. It is already the site for three alcohol outlets; I urge you not to allow further inappropriate activity.

Thank you

City of Oxnard Representaves,
Aer all their posturing to show that they wanted to be “part of the community”, TD Enterprises (TDE), LLC showed their true character and ambions with lawyer-ese to denigrate the concerns of Oxnard Shores residence and sway the city to overturn the appeal.

UPDATE: In addion, TDE LLC was at the site of their proposed locaon this past weekend 2/5/22, trying to bribe and sway residents with free SWAG. This is unethical behavior especially since they have an appeal in process with the city and residents of Oxnard Shores. This also looks like they are not taking the appeal seriously and think this is a mere formality. It also can be perceived that they know something we (Oxnards Shores residents) don't. Again, not something that the city wants to explain to their constuents.

Let’s talk about a couple of items:
· Locaon:
o As you know or have visited, Oxnard/Mandalay Shores is a small beach community. And yes, we are proud of our ght knit, robust rerement and family environment. The shopping mall in queson is our “main street”. We have no other community area!
o Adding a Holisc (Pot) Shop to this locaon will have an adverse effect in the near and foreseeable future. Look at Port Hueneme. There are pot shops lined up and down CI Blvd. A friend went to dinner at the Chinese restaurant located near the pot shops and saw armed guards at both ends of the parking lot. Although I could not confirm this, she said they had long rifles. This is why the police chief loves them. They are an armed camp patrolling the area. o During the summer months and holiday weekends, we see a surge of visitors to our beach community. That means a visit to the pot shop will be a must-see aracon. I do not want this small friendly shopping area turned into another armed camp.
o State law is silent on the buffer zone from cannabis use to residenal properes; seng that buffer is enrely up to the local government. In October 2018, Council determined that the city should adhere to the state-mandated 600-foot buffer and not impose a more stringent distance separaon requirement.
§ Based on this mandate, there are properes within this 600-foot buffer area. Remember, this is the length of two football fields for a distance prospecve. · Traffic:
o We can talk about this unl we are all blue in the face but traffic is and will be an issue whether you accept it or not. Two weeks aer I/we warned the city of the dangers of the Wooley/Harbor intersecon (that serves the shopping mall) there was another major accident sending cizens to the hospital.
o In addion, the ingress to the shopping area from Wooley is confusing to the out-of-town drivers as you need to make a sharp right turn just into the parking lot, then a le into busy Bole Shop traffic. The only other access to the mall is via a service road and access via Outrigger Way. These are not main thoroughfares. These residenal streets are where we live. We walk our pets, ride bicycles and meet with our neighbors. There is no direct access to the mall from Harbor Blvd! See Figure 1 o The Wooley ingress and egress was meant for truck deliveries not regular customer traffic/parking.

I see the confusion on a regular basis when accessing the mall in my daily travels there. See Figure 1 o It is in our opinion that they do not meet the following requirement. § Be served by highways adequate in width and improved as necessary to carry the kind and quantity of traffic such use will generate.
· Plea to the city:
o It is no secret that the city and TDE LLC will stand to make a great sum of money with the installaon of the Holisc Shop in Oxnard. It is also the right of the city and TDE LLC to do what is best for their interests. Having said that, the city has a responsibility to ensure that installaons do not degrade the fabric of a community and the well-being of a community. There are many other

2/14/22, 3:08 PM City of Oxnard Mail - RE: TD Enterprises (TDE), LLC’s appeal for doing business as Oxnard Holistics. https://mail.google.com/mail/u/0/?ik=bee10df961&view=pt&search=all&permmsgid=msg-f%3A1724417944268249433&simpl=msg-f%3A17244179442… 2/2 locaons where this shop can be installed that will sasfy the cies’ need for income and the wishes of this small beach community. TD Enterprises just wants to add another trophy locaon to their list of conquests and their relocaon will not be a detriment to their business model. I implore you not to allow this to happen to our beloved Shores and so I respecully request you vote no to overturn the appeal.

Figure 1

Here in the satellite view, you can see the red dot where Oxnard Holisc wants to be. Directly in front of it is a driveway to access S Harbor Service Blvd (not Harbor Blvd). Parking is allowed on the east side of this small service road which makes this road even more narrow). Since Oxnard Holiscs plans on repaving and installing more parking it will cause more traffic flow issues and a great potenal for accidents. If a driver enters from the Wooley entrance, they will make a right into the parking lot and then a le to park. In their proposal, they state they will have 7 Point of Service registers. That will create a lot of frequent traffic. If someone wants to leave their parking stall, they are most likely not going against traffic (in the direcon they entered). Instead, they will exit on the nearest driveway which is in front of the proposed store front or on to Outrigger Way. If they then make a right on to the service road to get back to Wooley, and aempt to make a le on Wooley, the risk of accidents is HUGE as this intersecon is very dangerous!!! I am guessing that is why they omied this fact in their appeal. PLEASE DRIVE OVER AND SEE FOR YOURSELF!

Dan Nicholas

Good afternoon!
Please hold tight to your decision to NOT allow the approval process to continue with the proposition to have a cannibus shop go into our neighborhood.

We walk to the bakery, surf shop and dry cleaners with our grandchildren all the time and the parking lot and traffic around the entrances are already scary.

I don’t want impaired drivers trying to maneuver little Harbor blvd.

It’s bad enough we have so many accidents on Harbor between 5th and Wooley.

I don’t mind them having a shop but put it in an Oxnard industrial area where children don’t have to see the people waiting to get in because the parking situation. I know you will be putting more in but the spaces are small in front of the entrance.

Please don’t allow them to continue!
Thank you

Dear Mayor and City Council:

As an Oxnard resident, I am writing in SUPPORT of Oxnard Holistics' proposed cannabis retail establishment at the Oxnard Shores Shopping Center.

Access to safe, legal Cannabis in the City of Oxnard is important to me. This is the ONLY proposed store west of Ventura Rd.

Oxnard Holistics is a high-quality business and they will be an asset to neighboring businesses and in the community.

There are so many proven effective uses and having a safe and trusted place to make this purchase will be a great service. The owners are family people and outstanding community members.

Please:

Vote to APPROVE Oxnard Holistics’ permit.

Sincerely,
Dana Gabriel

The attached is an excerpt from Citizens for a Better Oxnard. Clearly indicating that a cannabis dispensary is not a good thing in a neighborhood BUT The Shores should not get "a pass". (?) Making this into a us vs. them issue? A white vs. non white issue? A wealth divide issue? Wow, just wow. When does this stop? --

The City Council will vote to approve a Cannabis dispensary in the Oxnard Shores that is getting opposition from the residents of Oxnard Shores. Their arguments to oppose are mainly that the Oxnard Shores Shopping Center is a “neighborhood shopping center” and that there are many families that live in the neighborhood. I’ve heard residents there say that this should be “moved to other areas of Oxnard.” Again, we are talking about a nice cannabis dispensary, not a "Gentlemen's Club".

What is really upsetting about this whole issue is that similar cannabis dispensaries have been approved with unanimous or near-unanimous votes in other areas – El Rio, Rio Lindo, South Oxnard. Do the families in these neighborhoods not matter as much as those in Oxnard Shores? I’m not against those stores that were approved – in fact, I spoke in favor of many of them due to their commitment to the community and ability to enhance the safety and security of the surrounding area. But to say that Oxnard Shores gets a “pass” is flat wrong.

If you agree, I urge everybody to write to City Council and let them know that they should not make a bad policy statement by saying that cannabis dispensaries only belong in certain areas of Oxnard (where people of color live). This isn’t about how you personally feel about Cannabis – this issue is about fairness and treating neighborhoods the same, regardless how they look or how much money they make. I am writing in advance of the city council meeting Feb 15 that includes discussion of the planned cannabis retail business in the Oxnard Shores shops.

I feel this is a totally appropriate business for this location and would welcome them into our collection of shops. I also understand the other tenants are mostly in favor of this addition also.

You are going to hear a lot from a small but vocal group of neighbors who are against this, especially of course from those that live closer to the shops.

I believe that a majority of all the residents of Oxnard Shores and Dunes are in favor of this business locating here, or they don’t really care.

Thank you

Proposed Cannabis Retail Store in Oxnard Shores - Opposed Clifford Maurer <[email protected]> Mon, Feb 7, 2022 at 9:49 PM To: [email protected]
Mayor & City Councilmembers,
I am a resident and property owner in Oxnard Shores. I am an Oxnard voter and property tax payer. I request each of your support in denying TD Enterprise’s appeal of the Planning Commission’s denial of the Special Use Permit for a cannabis retail store to operate in our residential neighborhood.

It is understood TD Enterprise’s application meets the minimum requirements established by the State and the City in response to the voter approved Prop. 64; but a vote of City officials is required because this decision is much more than an application of minimums. I’ve owned my home in Oxnard Shores for more than 25 years. I purchased here, and remain here, because it is a quiet, friendly, residential beach community. While the City may benefit in the short term from additional ‘sin tax’ revenue from the cannabis sales, the ‘Pot’ shop’s presence will do irreparable harm to the neighborhood. Unlike other cannabis retailers throughout a 10 mile radius, many (if not most) patrons who travel to this shop, will not purchase and leave the area to consume their high-inducing products. They will stay at the beach, in our neighborhood. The one place with ocean view parking, an excellent location to get high, is Neptune Square. The very same location as the City’s children’s playground. Please take the long view. Both legal and Illegal (which there are many) short-term rental owners will use the cannabis shop to market to out of the area, and out of the State, clients to ‘come to the California beach, where you can purchase your pot to get high, just a short walk away.’ This is not just another cannabis shop in a small commercial mall. If approved, it will be a City-sponsored invitation to come to the Oxnard Shores neighborhood to get high at the beach. TD Enterprises’ security responsibilities and authorities don’t extend beyond the property line of the commercial business mall. Oxnard Police will bear the responsibility to respond to the wrongful acts and residents’ reports as this retail shop will surely concentrate ‘drug’ use at the beach.

Oxnard has been on a long journey to build itself into a more vibrant and appealing coastal City. We’ve turned the corner and made gains over the past decade. I request your fortitude and commitment to that ideal by protecting Oxnard Shores. Please don’t sell it out; the long-term net losses will be another disappointing footnote in Oxnard’s past history of shortsighted and poor planning decisions.

Very respectfully,
Clifford M. Maurer

My name is Cindy Maurer, I am 63 years old, born and raised here in Oxnard. My husband and I bought our home in Oxnard Shores in 1997. After 30+ years of Naval Service and 12 moves we were finally able to return to Oxnard and live here permanently in 2014. We are active community members.

I strongly oppose the City considering or worse yet permitting TD Enterprises Oxnard Holistics at the Oxnard Shores Shopping Center on Harbor Blvd.

Many of the families living here in the Oxnard Shores neighborhood walk or ride their bikes to the shopping center to stop at Heavenly cakes to get a donut, go into the Bottle shop to get ice cream, go to the Pizza Company to get a Pizza or dinner and enjoy dinner at the Shores Restaurant. This is a family and neighborhood shopping center in a residential area not a Commercial destination shopping center.

I live on Whitecap St, which is the street adjacent to the shopping center, on our street and Wavecrest Way (which is the shared drive street) we have 11 children living here literally less than one block from the Shores Shopping Center. I frequently walk over to get donuts or ice cream with my nieces who stay over at my home one to two times a month for a sleep over. The idea of an armed guard within feet of where we will be walking through is just a very bad idea! How will I be explaining the gun, the bullet proof vest, the mace, the handcuffs as we walk to enjoy a donut? How will I be explaining the nature of the tremendous volume of people going in and out of the "pot" shop where the guard is? How do I begin to explain Marijuana use to a 5 year old, or a 9 year old? If you have any doubt as to how many children visit the donut shop just go inside get a donut or better yet order a cake from Heavenly cakes, that is what we all did to support our local business's during the pandemic. The donuts are great, the cakes even better. When you do go inside you will literally see the wall and space next to the cash register covered with pictures of the children who frequent that donut shop. What message are we giving to our children? We no longer have a safe place to go get a donut or an ice cream in Oxnard because we need an armed guard on the sidewalk? Marijuana is ok for children?
Finally, I am disappointed that the City could not entertain other options other than this location. There currently are 4 Commercial Real Estate vacancies on the corner of 5th and Victoria, These locations certainly would have met the City's need to place a pot shop on the West end. There is no housing and certainly no children living in this location as it is Commercial.

The children nor the individuals living in this neighborhood should have to deal with the future ramifications of the poor planning involved in issuing this permit to TD Enterprises. It is really unfortunate the City did not include alternative properties for permitting that literally are within 1 mile of our neighborhood shopping center. The ramifications of this decision will have long and lasting effects on this neighborhood. The obvious rationale for having a pot shop in a neighborhood is the City would like the revenue from the taxes.

Please vote to deny and look for another location.

Very Respectfully,
Cindy Maurer

Oxnard Mayor and City Council:

I am writing to let you know that my family matters as much as any family in Oxnard.

There have been proposed cannabis dispensaries approved in El Rio, downtown, Five Points, and South Oxnard.

They’ve been approved with no issues.

The one being proposed at Oxnard Shores is controversial and could get denied at your next Council meeting because many of the Oxnard Shores residents are saying that the location is not ideal or because families live nearby.

There are families (mainly Latino families) that live near the ones that have been easily approved. Think about the message the City is sending if it denies the Oxnard Shores proposed dispensary: Cannabis dispensaries don’t belong in higher-income areas, only in working-class and low-income neighborhoods.

If the project meets all the requirements for a permit, it should be APPROVED - just like they were approved in our neighborhoods. This is not about whether I am for or against Cannabis. This is about treating everyone fairly.

Our families matter too.

Dear City Council members,

I live right down the street from the Oxnard Shores strip mall. I am opposed to having a Cannabis shop move into my neighborhood. It will immediately make the neighborhood look commercial and downgraded and distract from the beachy, neighborly image of the Shores. Pot shops are cash intensive businesses and attract crime and violence. I don’t want a crime magnet located here! This is a residential neighborhood and Pot Shops should be in a commercial area. Its bad enough that the liquor store is located here. Every time I go in there I am inundated with foul language and vagrants. Please don’t let these types of entities take over this area. Let them open in a commercial area. I am sure there are many other suitable locations for them to sell their marijuana products.

Dear Mayor Zaragoza and City Council Members;

It is alarming to me that Oxnard Shores, A RESIDENTIAL COMMUNITY, is even considered to house a CBD DISPENSARY when there are so many other options available in the commercial areas of Oxnard.

If you check where these stores are located in other cities, it is always in a COMMERCIAL AREA !

One example is Vons shopping center at Victoria and Wooley, where there are several available spaces. One in particular is the latest addition which has never been filled since being built. It is away from the main shopping area with plenty of parking available.

Another option is the commercial area on 5th Street just east of Victoria where there are several available spaces for this store.

Please consider how you, as individuals, would feel about having a CBD Dispensary as your next door neighbor where the owner finds it necessary to have armed guards because of it's content and what kind of activity it might attract.

Keep in mind, that there are children living in this community.

Thank you,

Angela Slaff

Dear City Councilmembers:

I am about to submit an offer to purchase a residence (along Wooley Rd.) adjacent to the proposed site. Unfortunately, I learned of the pending appeal and have significant concerns. If the permit is granted, I will not proceed with the transaction.

Please understand that the proposed location differs significantly from the Port Hueneme and other cannabis locations.

The 1015 Harbor location is directly adjacent to residences. Yet, the other cannabis stores are not directly next to homes. The sensitive nature of the business is clearly inconsistent with the neighborhood. Many neighbors have already voiced concerns about safety, crime and traffic. I strongly echo those concerns. It is unfathomable that people would be forced to live next to a cannabis store which requires enhanced security measures given the anticipated safety concerns.

The simple solution is to place the store elsewhere where homeowners would not have to face this threat on a daily basis with the store being open late in the evening until 9pm.

Some neighbors have also voiced concerns about the impact on property values. Certainly my reaction is clear evidence that the marketability of the nearby homes will be negatively impacted by the cannabis store. My view is that this rises to the level of a taking of property without due process or compensation. This result should not be allowed to occur. There will be homeowners who will face greater difficulties in selling their homes and/or property values will be diminished. In fact, the adjacent neighbors will experience this immediate impact once the cannabis store is in place.

They will likely have to disclose the cannabis store to any potential buyer especially since the store will not visibly indicate that it is selling cannabis.

I am respectfully requesting that the City Council consider the wishes of its residents who will be negatively impacted by the proposed cannabis location. Please consider their safety and economic interests over TD Enterprise which can easily find a more suitable location. Please deny the appeal and decline the requested special permit tomorrow without further proceedings.

Regards,
Alex Rhim, Esq.

RE: February 15th Council Meeting - (M.1) Public Hearing: TD Enterprise LLC dba Oxnard Holistics - Commercial Cannabis

Dear Mr. Mayor, Council Members, Mr. City Manager and Staff’:

The neighborhoods of Oxnard Shores, the Dunes and Channel Islands Neighborhood Council surround the proposed business named Oxnard Holistics – attempting to start their business at the corner marketplace of Wooley Rd. and Harbor Blvd. January 13th the Planning Commissioners VOTED NO - 3/3 after hearing and reading sufficient opinions from the residents to NOT recommend this Cannabis Store from receiving City permits to operate.

Since then, the City has received a 100+ page document from the legal team of Oxnard Holistics arguing that the Planning Commission and the residents are wrong. Will we see a powerful cannabis industry try to overturn the City of Oxnard’s own Planning Commission’s NO vote? If City Council, Mayor and Staff goes against our own Planning Commission and reverses the decision, what message does this send to every future developer?

I am opposed to ANY BUSINESS that wants to take over a neighborhood shopping spot that must have the requirement for multiple armed guards at their retail location. Normally, armed guards are not necessary for this little neighborhood strip mall. Armed guards are required for avoiding violence, robberies or worse. The cannabis business owners are protecting their business and their staff with guns, from people who want to rob the place and do harm to others. Personally, I think this is a bad business to be in ANY of our City’s small neighborhoods. Most folks don’t want to be exposed to that threat of violence and certainly don’t want their kids or grandkids around that kind of business. Support your Planning Commission and re-locate this arm- guarded business in an industrial location, not embedded it into a quiet neighborhood.

A NO VOTE means that NO ONE with guns needs to be guarding our little strip mall (except for our fine Police Officers of course).

Audrey Keller

Dear Mayor and City Council:

As an Oxnard resident, I am writing in SUPPORT of Oxnard Holistics' proposed cannabis retail establishment at the Oxnard Shores Shopping Center.

Access to safe, legal Cannabis in the City of Oxnard is important to me. This is the ONLY proposed store west of Ventura Rd.

Oxnard Holistics is a high-quality business and they will be an asset to neighboring businesses and in the community.

Vote to APPROVE Oxnard Holistics’ permit.

Cannabis is more than a plant. To many, it is a life-changing medicine. We must break down the barriers and stigma around such a natural entity. The approval of Oxnard Holistics shows not only the progression to an open-thinking progressive future for Oxnard Shores but it also paves a way to greater education around cannabis. I entrust and support the wonderful team behind Oxnard Holistics to do right by our community.

Dear Councilmembers and Others.

A group of us at Oxnard Shores has recently completed a hurry up signature gathering drive to oppose the Cannabis store location in the Shores shopping center. There are more than 435 signatures included here, with more being gathered daily. We will submit those others to you by the Appeal Hearing. We are sending these signatures now so there is time to enter them into the meeting packet.

This is a brief summary for your convenience.

All signatures have been gathered from the resident voters here. Mothers and Fathers of families, Grandparents, retired police officers, realtors, construction workers….a diverse group of residents who use the shopping center in question. Names, addresses and comments are included. None of the signers are paid consultants like the applicant and his lawyers have brought forward to the Planning Commission and named in their appeal letter to you.

Some comments people made in opposition to this location are:

Too close to homes
I have children
Not in this neighborhood
Opposed to this location
Bad location
Too close to my kids

SECOND PRODUCTION

City Council Meeting – February 15, 2022 FOR THE RECORD Subject: Cannabis Retail Store in Oxnard Shores
Mayor Zaragoza and Members of the Oxnard City Council
Summary:

The applicant and the City of Oxnard did not fulfill their legal requirement under the California Environmental Quality Act (CEQA). Furthermore, the required environmental review for the subject project was conducted without public input or participation and was prepared after the public workshop on November 15, 2021 and made public just before the Planning Commission meeting. An early review of this location would have revealed “Significant Effects” due to “unusual circumstances” requiring further review to meet the Categorical Exemption “Existing Facility” that is being claimed and would have resulted in the rejection of the proposed location. It was not fair to residents of Oxnard Shores that such a review was not conducted.

Background:

From the City’s first announcement of the retail cannabis shop location in the Shores shopping center, the question of the suitability of this location has been a major question. There are several “unusual circumstances” about this location including:
• This center has no access from Harbor Blvd, the main throughfare in the area. Customers must first enter the residential neighborhood before entering the center. • Access from Whitecap Street and Wooley Road cross the Harbor Blvd. service road with no traffic control resulting in a dangerous ingress and egress traffic pattern. • There is no physical barrier separating the residential from the shopping center unlike most strip malls with concrete block walls.

These types of questions usually come up as part of an environmental review, and it was determined by the city that such a review was required and was stated in the resolution as follows:

WHEREAS, the Planning and Environmental Services Division has completed a preliminary environmental assessment of the Project in accordance with the (CEQA) and determined that the Project is subject to a Section 15301 (Existing Facilities) Categorical Exemption.

To qualify for the Categorical Exemption, it must pass six required tests, and you are being asked to certify that the project passed these tests. The applicant and the city spend a great deal of time on the six exceptions that need to be met. These constitute an environmental review of each subject. One test states the following:

A categorical exemption shall not be used for an activity where there is a reasonable possibility that the activity will have a significant effect on the environment due to unusual circumstances.

The city concludes and declares that “the project will not have a significant effect on the environment due to unusual circumstances.” A declaration with no clear justification.

The three characteristics of this site listed above constitute “unusual circumstances” that could have Significant Environmental Effects that require investigation. The analysis given for this test does not address this project specifically. There are no studies cited, and no facts given that warrant these conclusions.

Legal Considerations:

The California Supreme Court ruled on a case in the City of San Diego that has relevance in this proceeding. The City of San Diego declared that cannabis retail stores were exempt from CEQA. The court rejected that analysis and ruled that a Cannabis business represents a “retail business of entirely new type” and “may cause a reasonably foreseeable indirect change to the environment” requiring the applicant and the city take into consideration any changes, even if they are small, to ensure that no harm will be done.

Conclusion:

The city determined that this was a project that required environmental review under CEQA. It concluded that the project may be eligible for a Categorical Exemption (Existing Facilities) if it passed a series of tests. The city then proceeded to deem the project exempt without any review at all, and they are now asking you to certify it.

The law required, and the residents of Oxnard Shores deserved, a specific review of the suitability of this location, and it was not done.

Sincerely,
Walter Hagedohm

I live at Oxnard, CA 93035. W
hile doing business next to cannabis shops in Port Hueneme, I've noticed an increase in people loitering (having purchased their Marijuana or waiting to go in to do so). Also accompanied by increased graffiti scratched into elevators, walls and windows. Furthermore let's not fool ourselves into thinking people are going to buy and drive home to partake, they're going to the beach. The nearest beach parking to this proposed dispensary location is Neptune Square which happens to be a children's playground and basketball court, this is no good.

I strongly urge that the City Council deny TD Enterprises appeal.

Thank you, Patrick Salamunovich

RE: February 15 City Council Meeting Agenda Item M.1 – Oxnard Holistics Appeal

Dear Councilmembers:

UFCW Local 770 is writing today in support of Oxnard Holistics’ application for a cannabis Special Use Permit and to ask that Council adopt staff’s recommendations and approve a resolution appealing and overturning the Planning Commission’s January 13th permit denial.

In coalition with community partners, Local 770 has supported and organized for the rights of cannabis consumers and retail workers and was a major sponsor for both medicinal and adult use in the State of California. We believe those who consume cannabis for health purposes and for recreational activity should have access to safe, regulated cannabis in their communities. Furthermore, we believe those who work in the industry deserve dignity, respect, and a living wage with benefits.

Oxnard Holistics employs best practices in its existing operations, and in compliance with the State of California’s Prop 64, they have signed a Labor Peace Agreement with our union that complies with all state and local requirements and establishes a fair process for employees to gain a voice at work. Oxnard Holistics is committed to meeting and exceeding local hiring requirements, employing best practices and compliance in its operations, and working with Local 770 to bring quality jobs and services to Oxnard.

We believe that Oxnard Holistics is a model operator who should be allowed to open their doors under the City’s cannabis ordinance - a policy established by this body intended to create a legal, regulated local market that will provide equitable and safe access to cannabis across the City of Oxnard as well as capture critical tax revenues for the benefit of all the residents of Oxnard, regardless of what neighborhoods they live in.

UFCW Local 770 strongly encourages the City Council to overturn the Planning Commission’s denial for this application and allow Oxnard Holistics to move forward in the permitting process. This will ensure alignment with Council’s vision for regulated cannabis businesses in the City of Oxnard, fairness in the application process for this high-road applicant, and more equitable access to safe, tested cannabis products for local residents.

Thank you for your time.

Sincerely,
UFCW Local 770

Dear Mayor and City Council:

As CEO and Co Founder of one of the largest licensed cannabis brands in California, Claybourne Co., I am writing in SUPPORT of Oxnard Holistics' proposed cannabis retail establishment at the Oxnard Shores Shopping Center.

We service several hundred licensed dispensaries throughout California with our "Claybourne" brand of products. We have been a supplier to all of TD Enterprises (The Holistic Group) dispensaries for many years. The Holistic Group is one of the most professionally run cannabis retail businesses in California, and they will be an asset to any community they operate in. Some of the key differentiators that make them better than most:

Dr. Beth PhD free Cancer & Cannabis Workshops, Knots for a Cause (community outreach), neighborhood clean- ups, etc!;
Education focused, catering to older, more mature demographics better than most other dispensaries in California. 1:1 cannabis consultants - private shopping experience to ensure customers understand how to use products and what best product to purchase for their ailments;
Vote to APPROVE Oxnard Holistics’ permit.

Subject: Rejected TD Enterprises in front of Subway storefront holding a tabletop event in Oxnard Shores, Saturday 12th, 2022
Walked by this location. Saturday, February 12, 2022;
TDEnterprises—-Oxnard Holistics
was holding an event ,in front of the location they do not legally have rights to as of yet. They were rejected in January 13th from the first planning commission meeting.

They were outside with a tabletop trade show, posters, flyers & a petition to sign. The lights were on inside the space as if they already had access to the location. ( please see photo in previous e-mail.

They were voted down for this location January 13th. 2022.

Is’nt it illegal to have signage or hold an event if you are not authorized to be the tenant of the space? It has also come to my attention that many kids on the way to the school bus in the morning walk through this parking lot. If you are a parent of school age kids, do you want them passing by a ‘POT SHOP’ on their way to school?? It’s a good way to set a bad example, before they even get to the school bus!

In closing, it is a very inappropriate location for this business… Please go elsewhere to tout your wares !

My husband and I own . We are against a cannabis retail facility being allowed at 1015 Harbor Blvd.

This small shopping center is located next to a peaceful neighborhood filled with families and retirees. We have always felt safe sending our kids to the bakery for doughnuts or to the corner store for a gallon of milk. Neighbors are the main customers at the brewery and the Shores and many walk there.

Allowing a cannabis store there will bring in significant traffic and will attract a wide array of drug users. With a brewery and bar and bottle shop in the same small strip mall, patrons are much more likely to mix alcohol and cannabis, which will increase safety concerns for our neighborhood. This type of facility will fundamentally change our neighborhood. It should be located in a more commercial area instead.

Thank you.

Your Honor,

I wanted to communicate to you and the City Council the opposition within the Oxnard Shores neighborhood to this proposed business, and point out the risks to the City of Oxnard in allowing this business to proceed over the objection of your Planning Commission and the residents.

Marijuana is still an illegal drug under Federal law, and as such the industry does not have access to traditional banking services. The State of California has decriminalized the drug under California law, but that does not change its current status under Federal law .

Retail Marijuana outlets are primarily cash businesses, and require armed guards to protect themselves from robbery. Simply put they are tar
gets. In the event there is an injury or death as a result of gun play or other issues such as wrongful death due to an accident from an impaired driver
, by ignoring Federal law and overriding your own Planning Commission you could be liable under civil law for any injuries or death caused. You are considering putting a problematic business into a quiet neighborhood that is predominantly senior citizens and has a growing number of young families. There are other areas in Oxnard that are a better fit for this type of business as the Planning Commission has pointed out. It only takes one incident to create a costly legal nightmare for the City.

Secondly there are a number of resident Veterans in Oxnard Shores who served from WWII to Afghanistan. W e also have active duty service people. Having armed guards in a neighborhood shopping center could be harmful to those dealing with PTSD. This is the only local retail we have in Oxnard Shores. Our residents don’t have a close alternative. There are a lar ge number of children who frequent the local bakery, and many young adults and families who patronize the surf shop. Y ou need to consider the affect armed guards will have on many people in our neighborhood. Until Federal law changes and marijuana sales have normal banking outlets, allowing these business in Oxnard neighborhoods has great risks to the residents and City. Since you have decided to accept this type of business within the City
, you need to carefully consider where those risks are minimized and the revenues to the City maximized.

Don’t ignore the community. W e vote and when wronged we can pursue litigation.

As we understand it, this is our last chance to inform the seven counsel members of our strong opposition to the above business being given
approval. We feel it is a true blight for our community. It is only about 450 feet from our front door and we do not desire to have an establishment that needs armed guards to protect itself from being robbed. We cannot understand why the city counsel is so determined that this particular business MUST be the one that leases the store.

Any business could rent it that would be safer than this one. We sympathize with the property owner that he wishes to have an income for that one store and the fact that the city desires taxes, but the taxes you will make from that one store hardly compares with the taxes that the residents of Oxnard Shores pay every year. The houses in this community are million dollar plus homes. It is a quaint retirement and family oriented beach community. Why cannot this shop locate in a commercial setting, where no homes are? If anybody in this neighborhood wants to buy cannabis, it is only 15 minutes away in any direction.

It appears to us that if you decide to approve this business moving in, you are not really honestly taking into account the genuine interests of our community. It is going to lower property values, attract a criminal element and make that shopping center lose considerable business because you will have people who will hang out and beg for money or possibly even rob shoppers.

Thank you for your consideration of the above.

Sincerely,
Lawrence and Magretan Howie

Hello,
I was informed that the City will no longer provide Neighborhood Cleanups in our area. We live on Costa de Oro in Oxnard, along Harbor Blvd.

It is important that we continue to have this service as many who live in our neighborhood are seniors and either don't have cars or ones that are too small to haul items away.

Our neighborhood has volunteers who pick up items and co-ordinate with the City, and residents when necessary.

Please do not end Neighborhood Cleanups.

Also, we do not need another Cannabis store in our area. There are plenty in Port Hueneme, only a couple of miles away, if that.

Putting them close to a residential neighborhood and family-run businesses is not a good choice. They should be in totally
commercially areas.

Thank you.

We live in Hueneme Bay and entering our complex we are faced with cars, motorcycles, bicycles and skateboards doing some crazy things on the street. We are actually in “The Green Mile” where there is one dispensary in every block! Please don’t bring the craziness to our beach areas. The beach areas are this community’s pride and joy, and the highest paying property taxes in all of Oxnard. Don’t bring a quiet neighborhood down! Use your heads!! There are plenty of other places to open up a dispensary…and bring down neighborhoods! Thank you!!

RE:

NO / AGAINST LOCATION Oxnard Holistic going in at The Shores Center at Harbor & Wooley Rd.

Project Name: TD Enterprise LLC dba Oxnard Holistics - Commercial Cannabis Business Retail Special Use Permit (SUP) - PLANNING AND ZONING PERMIT No. 21-516-24 (Retail): Located at 1015 Harbor Boulevard (APN: 191-0-075-015). A request to permit the operation of a commercial cannabis retail facility I DO NOT want this cannabis business in this location. This is a very small strip mall completely surrounded by residential. It is TOO CLOSE to residential area. This type of business will be a danger to the many children who live here. This will bring the neighborhood down. The strip mall is small and has limited parking. This intersection is VERY dangerous, there are frequent HORRIBLE collisions, in fact, 1 very bad multiple car accident just a couple of weeks ago. If this business goes in, traffic will get exponentially worse and increase 10 fold. The cannabis stores on Channel Islands Blvd & Wheelhouse have a clientele that are horrible drivers. My car has almost been hit every time I go to the bank, dentist, Domino's pizza place... I have to park far away to try to avoid them and even that isn't far enough.

I respectfully request that you DENY this permit.

Please make this part of the record and distribute directly to the city council members.

I am a 30 year long resident of Oxnard Shores. Additionally own FIVE properties in Oxnard Shores and Oxnard Dunes.

My husband and I are completely opposed to the exception being considered to permit the operation of a commercial cannabis retail facility by use of a Special Use Permit.

This is a residential neighborhood! The City of Oxnard took a long look at designating the area that would be zoned for this type of operation.

They only issued a handful of permits because they wanted only a handful of operations. They made it hard to get a license and many restrictions to those applying.

Why now make an exception for one not within the designated area? This would be totally inappropriate.

Why would the City entertain issuance of a special use permit that would negate the decision that they (our) spend time, money and effort designating zoning in another part of the city? I’m alarmed to hear that three of the council members had initially supported this SUP that is now being appealed. This must not be true.

This is the wrong place for this operation. A beach area, clearly in a Residential neighborhood, where families and children live and play.

I think that the City may now have second thoughts about missed revenue etc. and for the manner in which they handled the issue of Cannabis Business in the city overall.

If this is the case, revisit the issue and correct the zoning or add additional permits in the existing zone.

But don’t add to the situation be now issuing SUP for operations outside of the zoned designation.

Not in the entrance to downtown on Oxnard Blvd.

This would have made access easy for travelers as well as residents and drive volume just because of its local without disturbing residential neighborhoods.

I also own a commercial property within the existing designated area, and I don’t think it was a wise choice.

But don’t compound one bad decision with another one by issuing a SUP at all! Let alone issuing it in a location that is clearly a residential neighborhood!

RE: February 15 City Council Meeting Agenda Item M.1 - Oxnard Holistics Appeal

Dear Councilmembers:

On behalf of the Central Coast Labor Council, I am writing today in support of Oxnard Holistics’ application for a cannabis Special Use Permit and to ask that Council adopt staff’s recommendations and approve a resolution appealing and overturning the Planning Commission’s January 13th permit denial.

In coalition with community partners, UFCW Local 770 has supported and organized for the rights of cannabis consumers and retail workers and was a major sponsor for both medicinal and adult use in the State of California.

Oxnard Holistics is committed to meeting and exceeding local hiring requirements, employing best practices and compliance in its operations, and working with UFCW Local 770 to bring quality jobs and services to Oxnard.

The Central Coast Labor Council strongly encourages the City Council to overturn the Planning Commission’s denial for this application and allow Oxnard Holistics to move forward in the permitting process. This will ensure alignment with Council’s vision for regulated cannabis businesses in the City of Oxnard, fairness in the application process for this high- road applicant, and more equitable access to safe, tested cannabis products for local residents. Thank you for your time.

Sincerely,

Jeremy Goldberg, Executive Director
