CITY COUNCIL AGENDA REPORT

PUBLIC HEARINGS
AGENDA ITEM NO. M.1

DATE: June 7, 2022

TO: City Council

FROM: Michael Wolfe, Public Works Director, (805) 385-8055, [email protected]

SUBJECT: Adoption of Resolution Approving the Amended Engineer's Report and Ordering the Levy and Collection of Assessments for Fiscal Year 2022-23 within the City's Landscape Maintenance Districts. (0/5/5)

RECOMMENDATION

That the City Council, acting as the legislative body for the City of Oxnard’s (City) Landscape Maintenance Districts (LMDs):

1. Hold a public hearing to receive public testimony regarding the proposed Fiscal Year 2022-23 assessments in the City’s LMDs; and

2. Adopt a resolution approving the Fiscal Year 2022-23 Amended Consolidated Engineer’s Report and ordering the levy and collection of assessments for Fiscal Year 2022-23 within the City’s LMDs pursuant to the Landscaping and Lighting Act of 1972.

(Finance & Governance Committee approved 3-0.)

Please click the following link to view the required Measure M pre-recorded presentation video: https://youtu.be/7rgsyPK-fQw

BACKGROUND

On May 17, 2022, City Council adopted Resolution No. 15,573 which initiated proceedings and Resolution No. 15,574 declared an intention to levy assessments for Fiscal Year 2022-23. City Council also preliminarily approved the Consolidated Engineer’s Report for the 36 LMDs, and set a public hearing for June 7, 2022.

The preliminary Engineer’s Report reviewed and approved by the City Council on May 17, 2022 has been amended slightly. The attached amended Engineer’s Report is for Council’s consideration and includes additional budget information as a result of the overall City budgeting process. The amended Engineer’s Report now includes funding for:
 Additional personnel to support Division operations;
 Adjustment of City Indirect Costs as budgeted for FY 22/23; and  Increase of budget line item “Fund Balance Collection” for LMD No. 49 Cameron Ranch.

DISCUSSION

With the assistance of NBS, the City's special districts consultant, staff has calculated assessment rates and expenditures for maintenance of public landscaping and other improvements as noted in the Engineer’s Report within the City's thirty- 454
six (36) LMDs.

Following the City Council’s action at the public hearing on June 7, 2022, the assessment data will be delivered to the Ventura County Auditor-Controller’s Office and processed for the collection of assessments in Fiscal Year 2022-23. This action must take place prior to July 6, 2022.

General Benefit

As presented to Council on May 17, 2022, the general benefit is an overall benefit to the public at large resulting from the maintenance activities that are provided by the special taxes levied in the LMDs. The improvements to be maintained by each LMD are located within their respective boundaries.

The landscaping in each LMD provides aesthetic, safety and economic benefits to the properties within the LMD.

However, it is recognized that the ongoing LMD maintenance activities also provide a level of benefit to some properties outside of, but within proximity to, the LMD. This includes traffic and individuals passing through the LMD areas.

As a result of the maintenance and operation of the authorized improvements, there is a level of general benefit to people that do not live in or conduct business within the LMDs. In order for the properties within the LMDs to be assessed only for their portion of special benefits they received from their LMDs, the general benefits provided to non-LMD residents need to be quantified. The costs of the general benefits that are provided by the LMDs maintenance activities cannot be funded by the property owners’ assessments.

Utility Caps and General Fund Contributions

A number of LMDs were created with utility caps which limits the percentage by which a district’s utilities can be increased each year. Regardless of utility rate or usage increases, the districts may only increase their utility budget (reimbursable by assessment revenue) based on the formula set forth in their formation documents. For example, if the utility rates increase 10% in one year, but the district is limited to a 5% increase, then the district would require a 5% contribution from the general fund to meet their utility needs.

STRATEGIC PRIORITIES

This agenda item is a routine operational item or does not relate to the five strategic priorities adopted by City Council on March 16, 2021.

FINANCIAL IMPACT

The total Fiscal Year 2022-23 General Fund contribution to the LMDs is estimated to be $180,598, of which $70,745 for general benefit contribution of the districts and $109,853 of the General Fund share of utility overage. The total Fiscal Year 2022-23 General Fund contribution is estimated to be approximately $180,598 for the City’s LMDs and has been included in the Proposed Budget for FY 2022-23 as a transfer out contribution to LMDs (account 101-1002-808-87-14) from the General Fund.

COMMITTEE OUTCOME

The Finance & Governance Committee approved 3-0 on May 10, 2022 to approve the staff recommendation and to forward the item for Council approval.

That the City Council, acting as the legislative body for the City of Oxnard’s (City) Landscape Maintenance Districts (LMDs), approve and authorize:

1. Holding of a public hearing to receive public testimony regarding the proposed Fiscal Year 2022-23 assessments in the City’s LMDs; and

2. Adopting a resolution approving the Fiscal Year 2022-23 amended Consolidated Engineer’s Report and ordering the levy and collection of assessments for Fiscal Year 2022-23 within the City’s LMDs pursuant to the Landscaping and
Lighting Act of 1972.

RECOMMENDATION
2 470
• May 17, 2022: City Council adopted Resolution No. 15,573 which initiated proceedings and Resolution No. 15,574
declared an intention to levy assessments for Fiscal Year 2022-23, preliminarily approved the Consolidated
Engineer’s Report for the 36 LMDs, and set a public
hearing for June 7, 2022
• Staff has calculated assessment rates and expenditures for maintenance in the 36 LMDs
3 BACKGROUND
471
4 MAP OF ASSESSMENT DISTRICTS IN CITY
Additional information can be found at: oxnard.org/city-department/publicworks 472
• Assessment data will be delivered to the Ventura County Auditor-Controller’s Office and processed for the collection of assessments
• This action must take place prior to July 6, 2022

DISCUSSION
5 473
• General benefit is an overall benefit to the public at large resulting from the maintenance activities provided by the special taxes in the LMDs
• Ongoing LMD maintenance activities also provides a benefit to some property within proximity to the LMD, as well as visitors and individuals passing through the LMD
• There is a level of general benefit to people who do not live in or intend to conduct business within the LMDs
• Amount of general benefit that is provided from the LMDs maintenance activities cannot be funded via property owners’ assessments and must therefore be funded by the General Fund

DISCUSSION
6 474
• A number of LMDs were created with utility caps, limiting the percentage by which a district’s utilities can be increased each year
• Regardless of utility rate or usage increases, the LMDs may only increase their utilities based on the formula set forth in their formation documents
• For example, if the utility rates increase 10% in one year, but the district is limited to a 5% increase, then the district would require a 5% contribution from the General Fund to meet their utility needs

DISCUSSION
7 475
Maintenance Service Levels
Each LMD has a specific level of service based on available funding and assessments.

Service level “A” includes daily inspection/repair of irrigation, weed and graffiti removal; weekly mowing edging, debris
removal/cleanup; monthly fertilization of shrubs, ground cover, and vines; and tree maintenance.

Service level “F includes quarterly mowing edging, debris removal/cleanup, and graffiti removal (when reported). No other services are provided at the “F” level of service.

DISCUSSION
8 476
• The general benefit contribution based on the budgeted expenses for the districts totals $70,475 and an additional $109,853 is being proposed to offset the estimated utility overage for a total of $180,598
• Total Fiscal Year 2022-23 General Fund contribution is estimated to be approximately $180,598 for the City’s
LMDs and has been included in the Proposed Budget for
FY 2022-23

BACKGROUND

The Waterways Maintenance Assessment District (“District”) was established by the City of Oxnard (“City”) for the maintenance of the waterways and landscaping along the public rights-of-way within Mandalay Bay. The District was created on June 16, 1970 by Resolution No. 5144. In contrast to the City’s landscape maintenance districts formed under the 1972 Landscaping and Lighting Act, the District was formed pursuant to the Improvement Act of 1911 in order to recover the City’s maintenance costs of the District’s waterways and landscaping along public rights-of-way.

Assessments are levied annually according to the procedures set forth in section 5820 et seq. of the Streets and Highways Code (the Improvement Act of 1911). The assessments are exempt from Article XIIID of the California Constitution by reason of Section 5 thereof.

DISCUSSION

The total recommended assessments equal $492,207 for Fiscal Year 2022-23 which remains unchanged from Fiscal Year 2021-22. The total assessment for Zone 1 Mandalay Bay is $444,258, and the total assessment for Zone 2 Harbour Island is $47,949. These calculations are based on the number of dwelling units or Assessor’s Parcel Number (APNs) in each zone.

After the City Council adopts the Resolution, the assessment data will be delivered to the County Auditor-Controller’s Office for processing and collection during the Fiscal Year 2022-23 property tax assessments.

The District’s maintenance costs for Fiscal Year 2022-23 are projected as follows:

DIRECT MAINTENANCE = $356,668
This includes the landscaping, utility costs, and waterways debris removal services in the amount of $322,883 for Zone 1 479
Mandalay Bay and $33,785 for Zone 2 Harbour Island.

OVERHEAD, CITY STAFF AND CONSULTING SERVICES = $134,159 This includes staff costs and consulting services in the amount of $120,137 for Zone 1 Mandalay Bay and $14,022 for Zone 2 Harbour Island.

COUNTY FEE = $1,380
This fee is based on the number of APNs in each zone in the amount of $1,238 for Zone 1 Mandalay Bay and $142 for Zone 2 Harbour Island.

STRATEGIC PRIORITIES

This agenda item is a routine operational item or does not relate to the five strategic priorities adopted by City Council on March 16, 2021.

BACKGROUND

On November 22, 1983, the Mandalay Beach Maintenance District (“District” or “MAD 4”) was formed, pursuant to the Improvement Act of 1911, in order to recover the cost of the City’s maintenance of the 36-acre beach area, plus landscaping on public rights-of-way within Tract No. 2923. The formation of the District was required as a condition to development imposed by the Coastal Commission and as a provision of a development agreement with the City. The assessments are exempt from Article XIII D of the California Constitution by reason of Section 5 thereof. The City’s responsibility to maintain the above-mentioned areas became effective on July 1, 1986. On July 5, 1988, City Council adopted Resolution No. 9500, which shifted the bulk of the District’s beach maintenance costs from the residents of The Colony to the Mandalay Beach Resort Hotel (Embassy Suites).

DISCUSSION

The total assessment levy for Fiscal Year 2022-23 is unchanged from Fiscal Year 2021-22 at $39,446, and is computed as follows:

LANDSCAPE MAINTENANCE - $21,346

The City’s Special Districts Division maintains the landscape areas along Falkirk Avenue, Harbor Boulevard, Mandalay Beach Road, Costa del Oro, and the bikeway/greenbelt along the southerly property line. The City’s budget for landscaping maintenance costs for FY 2022-23 is $21,346, of which $16,095 is paid by The Colony residential development and $5,251 paid by the Embassy Suites hotel. This shared cost is outlined in Resolution 9500 (75% to the Colony; 25% to the Embassy Suites hotel). MAD 4 has a service level of “F” which includes quarterly mowing edging, debris removal/cleanup, and graffiti removal (when reported). No other services are provided at the “F” level of service.

519
BEACH MAINTENANCE - $18,100 (MAD 4 share split between the Colony and Hotel)

The agreements between the City and the developers of MAD 4 assign the responsibility of beach maintenance based on the relative length of beach area that fronts both the hotel and the public beach property (park). The total expense of beach maintenance is $30,092, with the County Collection Fee the total cost is $30,137. Resolution No. 9500 divides the 60 percent ($18,100) obligation of the District into two parts. 75.4 percent ($13,647) is paid by the Embassy Suites hotel and 24.6 percent ($4,453) is paid by The Colony residents. The remaining 40 percent ($12,037) of the beach maintenance is borne by the City as part of the total operating cost of the Oxnard Beach Park. The annual beach maintenance cost is as follows:

Table 1.

Annual Costs = $30,092 District City
Percent Share of $30,092 x 60% x 40%
FY 2022-23 Shared Costs $18,055 $12,037
County Collection Fee $45 $0
Total Beach Maintenance Cost $18,100 $12,037

Embassy Suites’ Share (75.4%) $13,647 $0
Colony's Share (24.6%) $4,453 $0

CONCLUSION

The total cost to the District for both the landscaping ($21,346) and the beach maintenance ($18,100) is $39,446. The Embassy Suites pay $18,898 ($5,251 for landscaping + $13,647 for beach maintenance) and The Colony residents pay $20,548 ($16,095 + $4,453).

STRATEGIC PRIORITIES

This agenda item is a routine operational item or does not relate to the five strategic priorities adopted by City Council on March 16, 2021.

FINANCIAL IMPACT

The City will assess the property owners within the District $39,446 in FY 2022-23 to pay landscape maintenance costs and 60 percent of beach maintenance costs. The City’s portion of the beach maintenance is 40 percent ($12,037) and will be included in the Proposed Budget for FY 2022-23 as a transfer out contribution to MAD 4 (account 101-1002-808- 8714) from the General Fund.

WHEREAS, the City Council is required by Streets and Highways Code section 5830 to estimate the cost of maintaining and operating the improvements within the District, to decide whether the cost of such maintenance and operation shall be borne wholly or partially by the District, and to levy a special assessment tax within the District sufficient to raise the money to pay for such cost; and
WHEREAS, the City Council wishes to levy such assessments for FY 2022-23 in an amount sufficient to cover all of the expense of maintaining the landscaping and to cover 60% of the expense of maintaining the beach area, with the City paying the remaining 40% of the latter expense; and
WHEREAS, assessments were levied in the District in Fiscal Year 2021-22, and such assessments are not proposed to increase in Fiscal Year 2022-23; and WHEREAS, the assessments are imposed exclusively to finance the capital costs and maintenance and operation expenses for sidewalks, streets, water, flood control, drainage systems and vector control, inasmuch as the beach is public right of way that serves much as a street, manages water and is part of the flood control and drainage systems in the District, and the landscaping is located in or adjacent to sidewalks, streets and other public rights of way and maintenance of the landscaping involves irrigation and vector control; and WHEREAS, for the foregoing reasons, the assessments are exempt from Article XIII D of the California Constitution, by reason of section 5 thereof; and WHEREAS, a description of the improvements and the proposed special assessment taxes on real property in the district is contained in the agenda report dated June 7, 2022 on file with the City Clerk ("the agenda report").

City Council
June 7, 2022
Eric L. Storrie
Special Districts Manager
543
That the City Council, acting as the legislative body for the Mandalay Beach Maintenance District (MAD 4):

1. Hold a public hearing to receive public testimony
regarding the proposed Fiscal Year 2022-23 assessments
for the Mandalay Beach Maintenance District; and

2. Adopt a resolution fixing the special assessments in the Mandalay Beach Maintenance District for Fiscal Year 2022-23.

RECOMMENDATION
2 544
• On November 22, 1983, the Mandalay Beach Maintenance
District (District) was formed pursuant to the Improvement Act of 1911, in order to recover the cost of the City’s maintenance of a 36-acre beach area, plus landscaping on public rights-of-way within Tract No. 2923
• July 1, 1986: City’s responsibility to maintain the above- mentioned areas became effective
• July 5, 1988: City Council adopted Resolution No. 9,500, which shifted the bulk of the District’s beach maintenance costs from residents of The Colony to the Mandalay Beach Resort Hotel

BACKGROUND

4 MAP OF ASSESSMENT DISTRICTS IN CITY
Additional information can be found at: oxnard.org/city-department/publicworks 546
Total assessment levy for Fiscal Year 2022-23 is $39,446 MAD 4 has a service level of “F” which includes quarterly mowing edging, debris removal/cleanup, and graffiti removal (when reported). No other services are provided at the “F” level of service.

DISCUSSION
5 547
Landscaping:

The District maintains the landscape areas along Falkirk Avenue, Harbor Boulevard, Mandalay Beach Road, Costa
del Oro, and the bikeway/greenbelt along the southerly
property line. Based on an agreement between the
residential developers and the Mandalay Beach Resort
Hotel executed in February 1984 - $21,346 allocated cost:
• 75.4% to The Colony residential development of $16,095 • 24.6% to the Embassy Suite hotel of $5,251

DISCUSSION
6 548
Beach Maintenance:

District bears 60% of the beach maintenance cost. Of that,

75.4% is paid by the Embassy Suites hotel and 24.6% is paid by the Colony.

DISCUSSION
7 Annual Costs = $30,092 District City
Percent Share of $30,092 x 60% x 40%
FY 2022-23 Shared Costs $18,055 $12,037
County Collection Fee $45 $0
Total Beach Maintenance Cost $18,101 $12,037
Embassy Suite’s Share (75.4%) $13,647 $0
Colony's Share (24.6%) $4,453 $0
549
• City will assess property owners in Fiscal Year 2022-23 to pay landscape maintenance costs and 60% of beach
maintenance costs for the Mandalay Beach Maintenance
District.
• City’s portion of the beach maintenance, 40% equaling $12,037, will be included as a transfer out contribution to MAD 4 from the General Fund in Fiscal Year 2022-23

AGENDA ITEM NO. M.4

DATE: June 7, 2022

TO: City Council and Housing Authority

FROM: Betsy George, Chief Financial Officer, (805) 200-5400, [email protected]

SUBJECT: FY 2022-23 Operating Budget Public Hearing. (0/15/15)

RECOMMENDATION

That the City Council and Housing Authority Board conduct a public hearing on the Fiscal Year (FY) 2022-23 proposed budgets for the City of Oxnard and Oxnard Housing Authority and provide staff direction regarding any adjustments to the proposed budget, in preparation for final budget adoption on June 21, 2022.

(Finance and Governance Committee approved 3-0)

Please click the following link to view the required Measure M pre-recorded presentation video: https://youtu.be/kGFkV6byFHM

BACKGROUND

On April 27, 2022, a video budget preview presentation was published for public viewing. On May 4, 2022, the City Manager and Chief Financial Officer discussed the proposed budget preview with the Inter-Neighborhood Council Organization (INCO). On May 10, 2022, the proposed budget preview was discussed at the Finance and Governance Committee.

This agenda report covers the final projected revenues and available fund balances for the City's five major funds -- General Fund, Measure O (Half- Cent Sales Tax) Fund, Water Fund, Wastewater Fund, and Environmental Resources (solid waste) Fund -- and the proposed expenditures for FY 2022-23. The City Manager's Budget Message and the full draft budget document (Budget Book) were published on May 25, 2022, 14 days ahead of the June 7, 2022, public hearing.

A public hearing on the proposed budget is required by law. For FY 2022-23, the Citywide proposed budget is approximately $639,922,824, which includes the General Fund group, landscape maintenance and community facilities district funds, special revenue funds, assessment district funds, enterprise funds, internal service funds and Housing Authority funds, and excludes operating transfers.

Numerical values included in the narrative below may not add due to rounding.

DISCUSSION

General Fund (101)

Revenues: General Fund revenues are projected at $208.2 million, $8.6 million (4.3%) greater than the prior year budget. The projected change is primarily due to a $7.2 million increase in sales tax revenues, which includes the 1% Bradley Burns sales tax and the 1.5% Measure E sales and use tax as the region and City continue to recover from the 552
pandemic-induced recession and purchases of goods and services increase due to global inflationary pressures.

Property values continue to rise; the median home price in Oxnard increased 13.3% to $850,000 in March 2022 compared to March 2021. Since March 2020, the median home price in Oxnard is up 30.7% or $200,000. The City’s revenue projection for its portion of levied property tax for FY 2022-23 is projected to grow by $3.2 million (5.1%) to $66.7 million.

Transient occupancy (hotel) tax revenue is projected to return to pre-pandemic levels at $5.6 million in FY 2022-23.

Finally, service fees and charges are projected to decrease substantially ($4.3 million in total). The reduction is primarily a result of $4.0 million in service fees and charges for ambulance services billing budgeted in FY 2021-22, but never implemented. The City's new pre-hospital emergency medical services (EMS) program was challenged by the County, which currently runs EMS service throughout all of Ventura County, and the court ruled in the County’s favor. The deferred implementation will also reduce budgeted General Fund expenditures.

Expenditures: General Fund expenditures are projected at $215.9 million; $15.1 million (7.5%) higher than FY 2021-22 original budget. The increase, overall, is related to the City’s restore and improve efforts. With the passing of Measure E, the City Manager and staff developed a three-year plan to restore and improve services. FY 2022-23 is year two of those actions and initiatives. The increase in estimated expenditures primarily results from $3.4 million additional spending on capital improvement projects (CIP), $12.2 million in departmental needs, $4.2 million higher salaries for competitive job environment and pay parity, $2.8 million debt payment on an anticipated streets and alleyways bond and Technology and Fire Apparatus debt, and $5.0 million higher IUF reimbursement (higher than the FY 2021-22 original budget). These increases are offset by $6.2 million of anticipated net personnel savings due to unfilled positions and $5.7 million due to not implementing EMS. The vacancy savings are an expenditure variance compared to the prior year budget, because the $9.2 million in vacancy savings budgeted in FY 2021-22 was accounted for in the ending fund balance calculation, rather than an offset to expenditures.

Over the last six years, the City’s overall vacancy rate has always been at least 10%. In FY 2021-22, although the Human Resources Department hired approximately 260 regular hire employees, over 40% of those were promotions, which do not reduce the net amount of vacant positions. Experience shows that the City always has a percentage of vacant positions at any given time due to retirements, promotions, jobs taken elsewhere, new hires not making it through probation, terminations, and so forth. The Finance Department recommends incorporating a modest assumption for vacancies in the City’s annual General Fund budget. For FY 2022-23 the $6.2 million proposed represents a 6% vacancy rate compared to FY 2021-22 assumption of 9%.

Additional details on the $12.2 million department needs can be found in the attached presentation. Details on the $3.4 million CIP increase in General Fund expenditures can be found in the proposed 2022-2027 City of Oxnard Five-Year Capital Improvement Program item presented at the Public Work Committee on April 26, 2022 (https://oxnardca.civicclerk.com/Web/Player.aspx?id=4416&key=-1&mod=-1&mk=-1&nov=0).

FY 2022-23 Ending Available Fund Balance: Total General Fund revenue for FY 2022-23 ($208.2 million) minus the total proposed General Fund expenditures plus transfers out ($215.9 million) yields a net annual operating deficit of $7.7 million. Annual operation deficits are expected in both FY 2022-23 and FY 2023-24 as reimbursement payments of $10.0 and $9.5 million, respectively, are made to the City’s Utility Enterprise Funds for prior years’ Infrastructure Use Fees (IUF). The estimated starting fund balance at July 1, 2022, of $40.9 million less the $7.7 million projected deficit spending, plus $1.9 million in anticipated mutli-year CIP that is projected to be carried into FY 2023-24 would yield an ending fund balance at June 30, 2023, of $35.1 million, or 16.2% of expenditures and transfers out. This is the projected General Fund reserve.

The City Council’s policy is for a General Fund reserve (available ending fund balance) of 12% and staff’s target is 15%.

For additional detail, refer to the General Fund tables in attached PowerPoint slides 3 and 4.

Measure O Fund (104)

Revenues: FY 2022-23 revenue from the Measure O half-cent sales (transactions and use) tax is projected at $18.2 553
million, a $0.9 million (5.1%) increase over the FY 2021-22 budget. Adding $41,500 of interest income and the annual $1.9 million repayment by the General Fund for the 2015 loan made by the Measure O Fund produces total projected revenue of $20.1 million for the budget year.

Expenditures: FY 2022-23 expenditures from the Measure O Fund are proposed at $18.6 million, representing a continuation of programs previously funded by Measure O and year one of the proposed seven-year weaning schedule. Measure O will terminate in 2029. The City must prepare to reabsorb the programs currently funded by Measure O into the General Fund or other funds. A seven-year weaning schedule was proposed at the April 28, 2022, Measure O Citizen Oversight Committee; the Committee supported staff’s recommendation. This is coming to Council at the same meeting as this budget as a separate item.

In year one of the weaning schedule, Fire Station 8 operational expenditures totaling $4.8 million are proposed to be moved into the General Fund and one-time General Fund expenditures will be moved to the Measure O fund. The one- time expenditures proposed to be moved from General Fund to Measure O in FY 2022-23 are $2.3 million citywide alleyway resurfacing, $0.5 million technology infrastructure refresh at the library, $0.3 million technology equipment replacement/upgrades, and to achieve interest expense savings a $1.8 million prepayment on the Station 8 bonds (on top of the required annual payment of $1.4 million).

Available Fund Balance: Projected revenues in FY 2022-23 less the proposed expenditures suggest positive net operating activity of $1.5 million. The projected positive net operating margin added to the projected beginning available fund balance of $9.7 million yields a projected ending available fund balance at June 30, 2023, of $11.2 million.

For additional detail, refer to the Measure O table in attached PowerPoint slide 6.

Water Funds

Revenues: FY 2022-23 Water Fund revenues, of which 88% result from utility fees paid by users, are projected to total $69.5 million, $1.1 million (1.5%) lower than the prior year's budget. The projected change is primarily due to lower water usages due to drought-related conservation efforts. The increase in Transfer-In is primarily a result of expected $1.3 million initial draw on the recently finalized Water Infrastructure Finance and Innovation Act (WIFIA) loan. Infrastructure Use Fee Repayment is lower by $0.9 million compared to FY 2021-22 due to the overall decrease in total reimbursement to all Utility Funds from $12.0 million to $10.0 million. In FY 2021-22, the Street Fund reimbursed $7.0 million and the General Fund reimbursed $5.0 million. In FY 2022-23, per the Court’s reimbursement schedule, the General Fund will reimburse a total of $10.0 million allocated between the three Utility Funds. No further reimbursements are due from the Street Fund.

Expenditures: FY 2022-23 Water Fund expenditures are proposed at $85.1 million, including a reduction of $11.4 million of CIP projects, most of which is reflected in the "Other O&M Expense" budget line, because the majority of Water- related CIP will be spent on contract services. The one-time ratepayer credit of $4.8 million in FY 2021-22 is the other factor attributing to the proposed $11.7 million (12.1%) reduction in expenditures for the FY 2022-23 budget year. The reductions are offset, in part, by projected $2.8 million rate related increases from the City’s two major water providers.

Available Fund Balance: The total projected fund balance at June 30, 2022, excluding previously committed CIP of $37.0 million is projected to be $23.4 million. Projected revenues for FY 2022-23, less the proposed expenditures, suggest net operating deficit of $15.6 million. The projected net operating deficit subtracted from the projected beginning available fund balance yields a projected ending available fund balance at June 30, 2023, of $7.8 million, which represents 9.2% of annual expenditures. The City Council policy target for available fund balance is 25%.

For additional detail, refer to the Water Funds table in attached PowerPoint slide 7.

Wastewater Funds

Revenues: FY 2022-23 Wastewater Fund revenues are projected to total $67.2 million, excluding the $27.1 million intrafund transfer between Wastewater Treatment and Wastewater Collection, which is required for City Council budget appropriation purposes, but has no effect on the overall Wastewater Fund. Over 70% of Wastewater Fund revenue is from utility fees paid by users. Another nearly 25% comes from the State Water Resources Control Board in the form of 554
grants or loans for specific CIP projects.

The $7.2 million (9.6%) projected decreases in Wastewater revenues is primarily due to reduction in the estimated bond that may be issued to fund CIP and the Infrastructure Use Fees payment being lower by $0.6 million compared to FY 2021-22 due to the overall decrease in total reimbursement to all Utility Funds from $12.0 million to $10.0 million.

Expenditures: FY 2022-23 Wastewater Fund expenditures are proposed at $74.4 million, including an increase of $8.1 million of CIP projects, most of which is reflected in the "Other O&M Expense" budget line, because the majority of Wastewater related CIP will be spent on contract services, just like in the Water Fund. Personnel increases include the addition of two maintenance workers, an engineer, and two inspectors to enhance the City’s wastewater compliance enforcement. The one-time ratepayer credit of $3.0 million in FY 2021-22 is off-setting the increases in personnel and CIP, resulting in a total proposed increase of $7.0 million (10.4%) reduction in expenditures for the FY 2022-23 budget year.

Available Fund Balance: Projected revenues for FY 2022-23, less the proposed expenditures suggest net operating deficit of $7.2 million. The projected net operating deficit subtracted from the projected beginning available fund balance at June 30, 2023 of $63.0 million yields a projected ending available fund balance at June 30, 2023, of $55.9 million. This represents just over 75% of annual expenditures excluding the intrafund transfers. The City Council policy target for available fund balance is 25%, which has been exceeded due to the City's recent success in securing grants and low- interest loans from the State to pay for wastewater capital improvement projects. Furthermore, that fund balance will be used to pay for the longer-range capital improvement program required by the wastewater enterprise.

For additional detail, refer to the Wastewater Funds table in attached PowerPoint slide 8.

Environmental Resources Funds:

Revenues: FY 2022-23 Environmental Resources Fund revenues are projected to total $49.7 million. Nearly all of the revenue is paid by users via utility fees. The primary reason for the $32.6 million (6.8%) decrease in fees and charges is that the recycled material scrap market has experienced a downward trend in market prices. This impacts revenues the City is able to generate by selling recyclable waste. Additionally, due to restrictive COVID-19 protocols and reduced hours, area recycling centers have redirected their volume from the City’s Del Norte Facility to other processing facilities. Efforts to remediate staffing shortages and increase Materials Recovery Facility (MRF) operating hours are underway and could increase revenue generated from selling recyclables as well as the cost to buy back recyclables. As with the Water Fund and the Wastewater Fund, there is a decline in reimbursement revenue from the General Fund as a result of the repayment of Infrastructure Use Fees; see "Wastewater" and “Water” sections discussion above.

Expenditures: FY 2022-23 Environmental Resources Fund expenditures are proposed at $57.1 million, a $9.0 million decrease (13.6%) compared to FY 2021-22 budget. The proposed expenditure includes $2.1 million of CIP projects -- most of which is reflected in the "Other O&M Expense" budget line because most of the CIP will be spent on contract services, just like in the Water Fund and the Wastewater Fund. This is a decrease of $5.8 million to the annual budget in alignment with the FY 2022-23 CIP presented to the City Council on May 3, 2022. The one-time ratepayer credit of $2.8 million in FY 2021-22 and the proposed $2.7 million reduction to Buy Back Recycles in Other O&M Expense are also major contributors to the proposed decrease in expenditures for the FY 2022-23 budget year.

Available Fund Balance: The projected net operating deficit of $7.4 million subtracted from the projected beginning available fund balance at June 30, 2022, of $17.2 million yields a projected ending available fund balance at June 30, 2023, of $9.9 million, which represents 17.3% of annual expenditures. The City Council policy target for available fund balance is 25%.

For additional detail, refer to the Environmental Resource Funds table in attached PowerPoint slide 9.
