BACKGROUND
The Oxnard Conduit can serve as much as 50% of the City’s water supply and is the only State Water Connection between the City and Calleguas Municipal Water District. This is a critical infrastructure, which is over 50 years old, in poor physical condition, and beyond its service life.
The project involves preparing a preliminary engineering study, design drawings, specifications, and bid documents for the design and construction phase engineering services of a new water main that parallels with the existing Oxnard Conduit from the Springville Reservoir in Camarillo to the City’s Blending Station #3 (Phase 1) and the design and construction phase engineering services for the rehabilitation of the existing Oxnard Conduit (Phase 2). The existing Oxnard Conduit was built in 1968 and consists of 3,755 linear feet of 30-inch steel pipe, 15,793 LF of 36-inch steel pipe, and 19,818 LF of 45-inch steel pipe.

DISCUSSION
856
The specific work for this project includes the preliminary engineering study, design plans, and bid and construction phases engineering services for the replacement and rehabilitation of the existing Oxnard Conduit. The consultant is tasked with the following:
Develop a comprehensive preliminary design report (PDR) outlining the pipeline alignment alternatives, pipe material selection, trenchless construction technology selection for the new pipeline, and existing pipeline rehabilitation engineering.
Provide a complete set of design drawings, specifications, and bid documents that incorporate the results of the PDR.
Provide a bid item list with a construction cost estimate to be used for budgetary purposes by the City. Provide bid and construction phase services and support. Develop record drawings representing the final installation.
The request for proposals (RFP) for the Project was published on May 9, 2022, and all proposals were due on June 17, 2022. The City received two (2) proposals and were reviewed by two (2) staff members consisting of the Water Operations Manager and Senior Civil Engineer.
Tetra Tech was selected as the most qualified firm to complete the design for the Oxnard Conduit Replacement and Rehabilitation Project. The selection was based upon the firm’s dedication to the field of large diameter pipelines, significant experience, and proposed approach to the project. Thus, staff recommends that the City Council award the contract for this project to Tetra Tech. Staff has confirmed that Tetra Tech meets all required City contractual provisions including possession of a City business tax certificate, insurance certificates and corporate filing with the California Secretary of State.
STRATEGIC PRIORITIES
This agenda item supports the Infrastructure and Natural Resources strategy. The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.
FINANCIAL IMPACT
The cost for this agreement with Tetra Tech, Inc. shall not exceed $2,497,312 for the design and construction phase engineering support of the Conduit Replacement and Rehabilitation Project. The Oxnard Conduit Replacement and Rehabilitation Project No. 226501 is being funded from the Water Operating Fund (601) and Water Bonds Fund (609) which has an available project balance of approximately $1,470,000 for Fiscal Year 2022-23. Due to the project being ahead of schedule an additional budget appropriation of $1,027,312 from the Water Operating Fund (601) is needed to provide sufficient funds to award the contract. These additional appropriations were originally anticipated in FY 2023-24 per the City Council approved CIP budget.

OPTIONAL SCOPE OF WORK
We are also proposing the following Optional Scope of Work Items to be considered by the City:
Prepare Traffic Control Sheets (assumed 40 sheets). Tetra Tech will prepare signed and sealed traffic control drawings. It may be advantageous for the City to have this optional item as it has been our experience that some permitting agencies, especially Caltrans, will require traffic control as part of the permit review requirements. We will work with the City to discuss the pros and cons regarding the development of traffic control as part of the design or to place the requirement on the Contractor.
There are a lot of advantages to the Contractor preparing the traffic control plans both in terms of cost and schedule and including the traffic control requirements described in the project specifications.
Prepare Geotechnical Baseline Report (GBR). Projects involving subsurface construction present many risks, which must be assumed by both the City and the Contractor. The greatest risks are associated with encountered ground conditions and ground behavior during excavation and installation of support systems. The GBR provides interpretation of ground conditions and anticipated ground behavior during construction and provides contractual baseline statements for the evaluation of differing site conditions. It establishes a contractual understanding (interpretation) of the subsurface site conditions presented factually in the Geotechnical Data Report. Thus, the GBR is a mechanism to allocate risk between the City and the successful bidder.
Brierley Associates strives to provide GBRs that accurately portray anticipated ground conditions, but also reasonably represent the Owner’s tolerance for risk and contingencies, while balancing various competing risk factors. When 100 percent of the work will be in the subsurface, but only widely spaced geotechnical investigations with a small sampling of actual subsurface conditions are possible, surprises can and likely will occur. Minimizing those surprises and creating realistic expectations, while realistically planning for contingencies for the “known unknowns” about the subsurface, will result in identifying ground appropriate means and methods to increase production, reduce delays and the potential for construction claims.
Development of the GBR requires open and honest communication between the design team and the City with respect to risk identification and allocation. The Tetra Tech / Brierley team will collaboratively review with the City the subsurface characteristics and how they are expected to behave during construction activities. We will emphasize how these elements can be mitigated through the GBR and design leveraging our risk matrix; and discuss potential third party impacts. We will develop the outline of the GBR during the 75% design phase. Development of a full GBR is best deferred to 95% design when the project is more fully developed and final project risks can be allocated appropriately.
Construction Observation (Tunneling). Brierley staff will perform part time on-site construction observation specifically for trenchless construction. This optional task is available to the City if this level of support is desired.

INSTRUCTION FOR SUBMITTING INSURANCE CERTIFICATES AND ENDORSEMENT FORMS
Certificates of Insurance
The sample accord form on the following page is provided to facilitate your preparation and submission of certificates of insurance.
You may use this or any industry form that shows coverage as broad as that shown on the attached sample. Please note the certificate holder address must be as shown on the attached samp le accord form with the contract number and insurance exhibit identification information completed. Improperly addressed certificates may delay the contract start-up date because the City’s practice is to return unidentifiable insurance certificat es to the insured for clarification as to the contract number.
Cancellation provisions must be endorsed to the policy. M odifying the certificate does not change coverage or obligate th e carrier to provide notice of cancellation.
Endorsement Forms
Original endorsements are required for commercial general liabilit y and business automobile liability insurance policies and m ust be attached to the applicable certificate of insurance. City preferen ce is that the Consultant/insurer use the endorsement forms which are attached. Substitute forms will be accepted, however, as long as they include provisions comparable to the sample accord form.
