December 30, 2024 Mayor Luis McArthur Mayor Pro Tem Gabe Tera Council Member Bert Perello Council Member Aaron Starr Council Member Gabriela Rodriguez Council Member Gabriela Basua Council Member Michaela Perez Re: B. City Council Business Item #1 - Closed Session ParJcipaJon by Council Member Starr, Who is also President and CEO of Moving Oxnard Forward, Inc., the LiJgaJon Case’s PlainJff-Appellant Given that Council Member Starr has been the driving force behind the liJgaJon case to be discussed in Closed Session Item D. #1, it is incomprehensible that he did not recuse himself immediately from the closed session. That Council Member Starr did not do so causes speculaJon as to his moJvaJon and possible future conduct as an Oxnard City Council Member. Page 15 of the City Council Procedures Manual clearly says: “A conflict of interest shall be declared whenever appropriate and in compliance with State law. The affected Councilmember will step down from the dais and leave the Chambers as required by State law.” Disclosure to the public should also be made as to the nature and history of Councilmember Starr’s interest and involvement in this liJgaJon. I urge Councilmember Starr to recuse himself from the Closed Session regarding this liJgaJon. If the Councilmember does not do so, I urge the Mayor and other Councilmembers to declare Councilmember Starr’s parJcipaJon a conflict of interest as it is inappropriate for a liJgant, no ma[er who they are, to be in a City Council Closed Session that involves a case that they are a primary liJgant in. It is inappropriate for a litigant OR a participant in litigation against the City, no matter who they are, to be in a City Council Closed Session that involves a case that they are a participant in.
I am extremely disappointed that this is even an issue.

Steven Nash <[email protected]> Mon, Dec 30, 2024 at 9:44 AM To: "[email protected]" <[email protected]>, Steven Nash <[email protected]> To put it in the simplest terms possible, Councilmember Starr cannot serve two masters.
As the president and chief execu ve officer of Moving Oxnard Forward, Inc., the named plain ff-appellant, he has an obvious conflict of interest by also purpor ng to represent his District and the en rety of the City of Oxnard. The 4835 votes he received does not grant him either a reprieve from the rules of the Fair Poli cal Prac ces Commission or give him a mandate to impose his Libertarian agenda on the remaining 200,000+ residents of Oxnard.
Councilmember Starr has two op ons. He must either recuse himself from all closed session items involving his group, Moving Oxnard Forward, Inc., or he can remove himself from the group.
Please distribute to the City Council.
Thank you for your me and considera on.

I would like to ask the City Council to bury the hatchet with ALL legal cases against Moving Oxnard Forward Inc. We have four new council members and they bring new enthusiasm to the council.
I want to remind all council members and the mayor that the City Manager Alexander Nguyen works for You. You do not work for him! His du es are.
Plan, organize, and manage the ac vi es of the City under the policy guidance and direc on of the elected officials of the City Oxnard.
He does not make policy! He is not an elected representa ve of the City of Oxnard. He needs to be reminded of that. Many of the cases brought against Moving Oxnard Forward, have been at his direc on.
Not in his job descrip on.
BURY THE HATCHET AND MAKE OXNARD THE CITY THAT CARES AGAIN. Stop all this foolish li ga on now! Thank you for reading this,
Ted Maloney
