CITY COUNCIL AGENDA REPORT

INFORMATION/CONSENT AGENDA
AGENDA ITEM NO. L.2

DATE: September 21, 2021

TO: City Council

FROM: Brian Yanez, Acting Public Works Director, (805) 200-5412, [email protected]

SUBJECT: CalRecycle Rubberized Pavement Grant Program Application.

RECOMMENDATION

That City Council adopt a resolution authorizing:

1. The City Manager or Public Works Director, or his/her designee to execute in the name of the City of Oxnard all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project for an amount not to exceed $250,000 in California Department of Recycling and Recovery (CalRecycle) Rubberized Pavement Grant Program funds, to be used for the resurfacing of several streets identified in the FY 2021-26 Capital Improvement Plan (CIP); (This item did not originate in Committee.)

BACKGROUND

The Rubberized Pavement Grant Program provides funds to agencies that use recycled tires when resurfacing roads.

There are many advantages to using rubberized asphalt versus conventional asphalt. Rubberized Asphalt Concrete (RAC) incorporates ground tire (crumb) rubber into the hot mix. Crumb rubber is ground or granulated rubber particles, which are derived from auto, light truck or other sources that use a high content of natural rubber. The wet process is typically used in rubberized asphalt within the State of California.

California produces more than 40 million waste tires annually; therefore, there is a significant environmental benefit to using asphalt rubber since a two-inch Rubberized Hot Mix Asphalt (RHMA) overlay consumes about 2,000 scrap tires per lane mile. Over the years, engineers and researchers have found that RHMA is a durable, safe, and quiet paving material, compared with conventional Hot Mix Asphalt. Additionally, it is worth noting that 1 inch of RHMA is equal to 2 inches of conventional hot mix asphalt, which means that this is the preferred material when vertical constraints such as curb and gutter restrict the thickness of the overlay, which we find in many cases throughout the City.

Additional advantages of Rubberized Asphalt Concrete are as follows:
Rubberized asphalt concrete is highly skid-resistant, quieter and resists shoving and rutting if a gap-graded mix is used.
Rubberized asphalt concrete provides excellent long-lasting color contrast for striping and marking. Rubberized asphalt concrete provides a long-lasting, durable pavement that resists reflective cracking and provides for a smoother ride.

DISCUSSION
The City is eligible to receive a reimbursement of $7 per ton in grant funds for the projects proposed under this funding cycle. With numerous streets that need resurfacing, these grant funds will be used to supplement the costs of resurfacing several streets that are identified in the FY 2021-26 CIP. These streets include sections of the following projects:
-Oxnard Boulevard
-Del Norte Boulevard
-North Ventura Road
There is no requirement for matching funds and the maximum grant award is $250,000. The grant term ends on April 1, 2024, and all eligible program costs must be incurred by this date. If awarded, the grant award is anticipated in December 2021.

For large resurfacing projects, the cost of RAC is about equal to that of traditional asphalt, and there would be cost savings with this reimbursement. However, for smaller projects, the cost is roughly $10 more per ton of rubberized material, but again, this would be offset with this reimbursement.

STRATEGIC PRIORITIES

This agenda item supports the Infrastructure and Natural Resources strategy. The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.

FINANCIAL IMPACT

The construction cost for the respective streets CIP projects is estimated at approximately $8,872,500 for the total cost of the selected sections of the resurfacing projects. These streets have already been identified for resurfacing under the street maintenance program and are in the CIP, and a mix of General Fund Measure E and RMRA Gas Tax funds have been planned to be appropriated. If the City were to receive a grant award, the grant funds would reduce the amount of General Fund Measure E and RMRA Gas Tax funds that are needed to complete these projects. The grant program only funds a reimbursement of $7 per ton; therefore, the City will be responsible for the remaining cost of $8,622,500 after the $250,000 grant award. Upon grant award, staff will recognize and appropriate the grant award to the eligible resurfacing project(s).

COMMITTEE OUTCOME

DISCUSSION
• The lowest bidder was Onyx Paving Company, Inc. (Onyx Paving)
• This contractor is compliant with City business
requirements.
• Staff recommends that the City Council award a contract for this project to Onyx Paving Company, Inc.
13 194

DISCUSSION

16 197

FINANCIAL IMPACT
• Staff is recommending a decrease in appropriations from the RMRA Fund (185) in this Project to offset the grant award from CalRecycle by $158,998 for use in this Project.

CITY COUNCIL AGENDA REPORT

REPORTS
AGENDA ITEM NO. M.3

DATE: April 1, 2025

TO: City Council

FROM: Stephen Fischer, City Attorney, (805) 385-7483, [email protected]

SUBJECT: Committee Bylaws Revision. (10 minutes)

RECOMMENDATION

That the City Council adopt a resolution amending the bylaws for City Council committees.

(The Finance and Governance Committee approved 3-0 on March 11, 2025)

Please click the following link to view the required Measure M pre-recorded presentation video: https://youtu.be/EqQq- T7yMhs

BACKGROUND

Oxnard City Code Section 2-1.1 establishes the following City Council committees (“the Committees”) consisting of three City Council members per committee, appointed by the Mayor and approved by at least four City Council members:

Finance and Governance Committee, Public Works and Transportation Committee, and Community Services, Public Safety and Housing and Economic Development Committee. Section 2-1.1 provides that the City Council shall adopt bylaws setting forth the powers and duties of the Committees.

On December 3, 2019, the City Council adopted Resolution 15,286, establishing Committee bylaws. If adopted, the proposed resolution would make the following changes to the bylaws:

1. Identify three committees instead of the original five: Finance and Governance, Public Works and Transportation, and Community Services, Public Safety, and Economic Development. Measure M, adopted by voters in 2020, established that meetings of the City’s legislative bodies could not begin until after 5 p.m. This change made it difficult to hold five meaningful committee meetings (with good discussion and public input) on a Tuesday night. As a result, the number of committees was reduced from five to three, combining the Community Services, Public Safety, and Housing and Economic Development committees into one;

2. Adding the following exceptions (items that can be considered by the City Council without input from the Committees): Capital Improvement Projects ("CIP") identified in the Council-approved CIP book (including all CIP- related items and procurement for the projects), items related to routine and recurring maintenance necessary to keep public facilities operable that have a financial impact under $500,000, and items that are only to be received and filed by the City Council;

3. Specifying that a committee member may be reappointed to a committee once their term ends;

4. Modifying the meeting times for the Committees: Finance and Governance from 5:00 to 6:30 p.m., Public Works and Transportation from 6:45 to 8:15 p.m., and Community Services, Public Safety, Housing, and Economic Development from 8:30 to 10:00 p.m.

5. Updating the rules of order from Rosenberg's to Robert's; and

6. Making clerical corrections.

On March 11, 2025, the Finance and Governance Committee recommended 3-0 that the City Council adopt the proposed resolution with the following exception added to Article II Section D 3. "i. Items that are only to be received and filed by the City Council."

If approved by the City Council, the updated bylaws would take effect immediately.
