On behalf of the Filipino American Council of Ventura County (FACVC), I would like to extend our heartfelt gratitude for the city's support of the Filipino American community in Oxnard during October's Filipino American History Month with their proclamation at the October 7, 2025, City Council Meeting.
In particular, we appreciated the words of Mayor McArthur at the Filipino American Fiesta at the Museum of Ventura County on October 19, 2025. We are grateful for the time that he took out of his busy schedule to celebrate with us and to continue building bridges of understanding and cooperation among all cultural communities.
The mayor's message along with the other elected officials who spoke during the event of Ventura City Councilman Ryyn Schumacher, Ventura Mayor Dr. Jeannette Sanchez-Palacios, and Port Hueneme Mayor Pro Tem Jess Lopez encouraged and inspired all of us about the unity and strength that comes from embracing our collective heritage.
I look forward, along with the rest of the FACVC Board, to furthering civic engagement and awareness of the Filipino American community with the City of Oxnard and throughout all of Ventura County. Maraming salamat.

A public entity shall make reasonable modifications in policies, practices, or procedures when the modifications are necessary to avoid discrimination on the basis of disability, unless the public entity can demonstrate that making the modifications would fundamentally alter the nature of the service, program, or activity.” 28 C.F.R. § 35.130(b)(7)(i) law.cornell.edu+1 Because this option is provided by City policy, any requirement that an individual also attend in person or by phone when submitting a video imposes an additional barrier and, under the Americans with Disabilities Act Title II, the City must ensure that the policy is implemented in a manner that affords equal participation to all persons.
I therefore request that the video I submitted be accepted and played at the upcoming meeting without the condition of my personal attendance.
Therefore:
I submitted the video in accordance with the City’s posted deadline and coordination requirement.
The refusal on 10/21/2025 to play my video solely on the basis that I was not physically present (nor on call) is inconsistent with the City’s ordinance/policy and the underlying purpose of open public comment.
I request that the video be accepted and shown at the upcoming meeting, and that confirmation be provided in writing that it will be included in the official record of public comment.
Unless the Council has adopted a lawful rule (which has been properly noticed and posted) restricting video comment to only those physically present or on the phone, the refusal to play the video denies my right to participate and may violate the Brown Act’s purpose of open participation and ADA compliance for the disabled.
I therefore request that the video be accepted and played at the upcoming meeting, and that the City Clerk confirm in writing that it will be included in the public comment portion regardless of my presence in person or by phone.

Good evening. Most people don’t know this, so here it is in plain English: PEG fees are a small, separate charge—about 1% of local cable TV revenue—that’s earmarked to buy the equipment and build the facility that puts our city’s TV channels on the air. Think cameras, switchers, encoders, cabling, and the connection to the cable system—not general spending. California lets cities collect that 1% only for this purpose, and Oxnard has adopted it in our code.
There’s a bright-line rule: PEG money buys capital broadcast gear that actually creates or carries the channel. It’s not for running meetings, software, maintenance, or convenience gadgets at the dais. That’s how federal policy draws it, and the state says PEG has to be used consistent with those federal rules.
In a recent public record request I did, it showed that the City charged PEG funds for a bundle that mixed a legitimate video encoder (that belongs in PEG) with a council “speak-and-vote” system that cost about $12,040. That voting system is a stand-alone light-up wall board that is not part of the video feed—viewers never see it. That makes it a meeting tool, not broadcast equipment, so it shouldn’t have been bought with PEG dollars. Meanwhile, I’ve also been told the voting system doesn’t even work, and our government channel isn’t operating. PEG exists so people can watch their government—not so we can buy hardware the public never sees. (For context: federal law treats PEG as capital for access facilities, not operations.)
Council, this needs to be fixed. Investigate the purchase, put the PEG money back where it was wrongly used, and make sure PEG dollars aren’t spent on non-broadcast items going forward. And because that 1% PEG fee keeps coming in every quarter, the public deserves a straight answer: if the government channel has been down, where is that PEG money going? PEG funds are for pictures and sound the public can actually see—period.
By the way, that public record request only produced one document so far and the city has illegally delayed getting me the rest of the information I requested…likely because it’s going to show more irregularities like this. RECOMMENDATION
That City Council approve an appropriation in the amount of $16,568 from the Public, Educational, and Governmental (“PEG”) Fees
Capital Improvement Fund 311 to Council Chambers A/V Upgrade (Project 151401) for:
1. Previous expenditures of $2,483 for microphones and monitors in the Council Chambers;
2. Purchase of video encoding equipment and accessories for broadcasting meetings in the amount of $2,045; and
3. Purchase of an electronic voting and speaker management system in the amount of $12,040.
BACKGROUND
PEG Funds Generally
The Digital Infrastructure and Video Competition Act of 2006 (Pub. Util. Code §§ 5800 et seq., DIVCA) provides for the continued funding of public, educational and governmental access (PEG) channel facilities by holders of state video franchises, and requires franchisees to provide PEG channel capacity as needed. Pursuant to that authority, the City’s video franchise ordinance establishes a PEG fee of one percent (1%) of a state franchisee’s gross revenues derived from the provision of video service within the City. The federal Cable Act and DIVCA require PEG funds to be used for PEG facility capital costs and related equipment.
Previous expenditures
From 2014 to 2017, various audio/visual equipment was purchased for use in the Council Chambers to replace old pieces of equipment that had
reached the end of their useful service life and were beginning to fail. The microphones at the dais, podium, and staff tables were replaced, and three new monitors were purchased - two for inside the Council Chambers and one in the hallway/lobby. However, an additional purchase of $2,483 was needed for accessory components for the microphones, but wasn't covered in prior appropriations to the PEG Fund. Council is requested to appropriate this amount from the PEG Fees account to balance this fund.
Video encoding equipment
This year, the City Clerk’s office implemented a new agenda software system that includes its own livestreaming platform for viewing meetings online. To transition from the current livestream system to the new, Information Technologies staff will need to purchase a new video encoder that is more compatible with the new platform, as well as the necessary accompanying components, in the amount of $2,045 as an appropriation from the PEG Fees. Much of the footage transmitted using the video encoder will also be featured on the City’s cable channel.
Electronic voting and speaker management
Since the City Council’s transition from a five-member to a seven-member body late last year, the need to keep meetings 5 / 32
running efficiently is more important than ever. Staff conducted informal bidding to seek an electronic voting and speaker management system for use by the Council to automate the current voice-vote and Council speaking requests. With the new system, ElectroVote, Councilmembers can cast their vote by pushing a button, rather than waiting for their name to be called in a random order. The speaker management portion allows the Council to queue up their requests to speak at the push of a button, rather than waiting to be called on by the presiding officer. The ElectroVote system is unique in that it is a stand-alone hardware system: nearly all other systems available of this type are software-based, and therefore susceptible to network/wi-fi failures. Staff requests $12,040 for the purchase of this equipment.

This agenda item is a routine operational item or does not relate to the four strategic plans adopted by City Council on May 17, 2016.
FINANCIAL IMPACT
The requested action results in a $16,568 budget appropriation from the PEG Fees Capital Improvement Fund 311 to the existing Council Chambers A/V Upgrade Project No. 151401, leaving an estimated unreserved fund balance of $4.15 million for June 30, 2019.

Mayor and Councilmembers,
The Sea View Neighborhood Council Executive Board asks that you vote in the affirmative on agenda item L-7.
City staff have done an incredible job figuring out how to unlock the city’s substantial Quimby fund balance and now need your approval to deploy these funds and start making long overdue material improvements to our parks.
We hope that this marks a lasting change in city policy regarding these funds. With the continued development of the city there will undoubtedly be more neighborhoods that receive Quimby funds. We hope this process can now be streamlined and these new funds can be utilized in a more reasonable amount of time for future projects.
We would also like to commend city staff for their commitment to resident engagement.
They have been to no fewer than 6 of our neighborhood meetings over the past few years to speak on this topic. We are excited to work with them to shape this project.

You have allowed this to happen with your apathy and inaction.
It is now November, 11 months since escalated violent ice raids began in Oxnard, and still nothing has been done to protect Oxnard’s vulnerable community. You can string people along with promises of 600 thousand dollars being allocated to help families affected by ice “coming really soon”, but as it stands right now, today, in this moment: 11 months and you have done nothing. You have left the community unprotected. You have minimized OPD’s inaction. You have tried to shift the blame and responsibility away from you by telling people to protest and call out the local agricultural industry. But we didn't vote for them. This community voted you in as delegates to represent and take action to protect the most vulnerable. Your inability to take direct action has left this community even more vulnerable. It has led to ice agents freely pepper spraying community and zip tying and detaining youth. Why would ice respect this community when you haven't shown that you are prepared to fully take a stand against their violent tactics? You are showing them that you do not care, that you will not protect the people. And they are paying attention. It is not enough for you to show up when ice is violently raiding neighborhoods. You must act. All of the people that have been taken. All of the families ripped apart. All of the children left alone. All of the youth harassed and zip tied. The military vehicles being used. The pepper spray being sprayed. This is all on you. This is all violence you have allowed to be inflicted on Oxnard.
