BACKGROUND

The California Public Records Act

The California Public Records Act (“CPRA”) (Government Code Section 7920.000 et seq.) requires public agencies to respond “promptly” to requests for public records and, within 10 calendar days of receipt, determine in writing whether the requested records are disclosable, unless an extension of up to 14 additional calendar days is justified under certain circumstances (such as voluminous records requests or the need to consult other agencies). Under the CPRA, agencies must determine whether a request seeks identifiable public records and whether responsive records exist. If responsive records are located and are not exempt from disclosure, they must be made promptly available for inspection or copying. Public agencies are also required to assist requesters in formulating focused requests for identifiable records when necessary (Section 7922.600).

In practice, not all CPRA requests constitute requests for identifiable public records. Some submissions consist primarily of questions, commentary, or arguments regarding prior responses rather than requests for specific records. While staff often attempt to assist requesters in clarifying or refining such submissions, the CPRA applies only to requests for existing records and does not require public agencies to answer questions, conduct research, or engage in ongoing debate regarding the City’s responses. Nor does the CPRA require public agencies to create records when responding to requests.

10 The City encourages requesters to submit CPRA requests through NextRequest, the system used by the City and over 200 other agencies in California to manage and track requests. When a CPRA request is received and entered into NextRequest, the system automatically generates an acknowledgment confirming receipt. The City then provides a written response within ten days, as required by law, informing the requester whether responsive records exist and how the request will be processed. After the initial response, staff coordinate with the appropriate departments to identify and gather responsive records. The records are reviewed to determine whether any exemptions apply, and responsive records are then provided to the requester, sometimes on a rolling basis as they become available.

When the City receives CPRA requests that are voluminous or that require extensive coordination amongst various departments, divisions, and/or other agencies, staff provides requesters with a rolling production release schedule (e.g., records released every week until a request is fulfilled). The rolling production process allows staff to locate, review, and redact records (if necessary). Rolling production is widely accepted as a reasonable and compliant way for agencies to meet their “prompt” disclosure obligation without violating the CPRA.

DISCUSSION

City of Oxnard CPRA Requests

Over the last four years, both the volume and complexity of these requests have increased substantially. In 2022, the City fulfilled 591 requests, 1,002 in 2023, and 960 requests in 2024. In 2025, that number had grown to 1,212 requests, with many of the 1,212 requests including multiple sub-requests. This trend appears to be continuing, as the City has already received 268 requests, again with many requests including multiple sub- requests, by March 16, 2026.

Historically, many requests came from individuals seeking specific, routine records, such as building permits, police reports, or fire incident reports. Between 2021 and 2026, the City received approximately 4,350 CPRA requests from about 1,625 unique requesters. While many individuals submitted only one request, a relatively small group of repeat requesters accounted for a notable share of the total request volume. The five most frequent requesters submitted roughly 11% of all requests.

A closer look at the most recent year illustrates a continuing trend in which a relatively small number of individuals account for a growing share of requests. Between March 2025 and March 2026, the City received approximately 1,260 requests from 661 unique requesters. The majority of unique requesters—about 76%— submitted only a single request during this period. However, a small number of repeat requesters submitted requests at a much higher frequency. For example, the most frequent requester submitted 124 requests during this one-year time period.

Consequently, a small number of high-volume requesters are disproportionately consuming City resources, requiring much more staff resources than currently available, which in turn increases the risk of delays or noncompliance with statutory timelines. In addition, requests have shifted from straightforward items, such as a list of building permits or a fire report for a specific address, to requests seeking numerous categories of records within a single request, including budget documents, funding sources, transaction-level financial data, contracts, invoices, procurement materials, and internal communications across multiple departments and years.

Increased complexity of CPRA Requests

In order to keep up with the increase in volume, pace, complexity, AI-driven nature, and convolution of requests, additional dedicated staffing is needed. A log of all requests received during the past year - nearly 450 pages - is attached for reference. As reflected in the log, several requests illustrate the increasing scope and complexity of submissions, including Requests 25-416, 25-570, 26-43, 26-51, 26-57, 26-138, 26-139, and 26- 191. These related requests, submitted by one requester, illustrate how a series of broad and iterative 11 submissions significantly increases the staff time and coordination required to process.

The advent and widespread adoption of artificial intelligence (AI) tools have further amplified these challenges, making CPRA requests more complex and resource-intensive than in the past. Requesters increasingly use AI to generate highly detailed requests with expansive search parameters that encompass large datasets across multiple departments. These requests often include structured headings, numerous record categories, detailed procedural language, and broad time ranges—characteristics commonly associated with AI-generated text.

Using indicators available within the City’s NextRequest system, along with these observable characteristics, staff have identified a growing number of requests that appear to be generated using AI tools.

When comparing the first month of each year, the City received 48 such requests in 2024, 63 in 2025, and 106 in 2026. While these represent a relatively small portion of the total number of requests received, AI-generated requests tend to be significantly broader in scope and often generate multiple follow-up inquiries after an initial response. These follow-up communications frequently expand the scope of the original request and require additional searches, review, and coordination across departments. Because these follow-up inquiries are typically submitted within the same request thread, they are not reflected in the total number of requests reported above, even though they substantially increase the staff time required to process a single request. In addition, many documents contain personal, privileged, or confidential information, necessitating careful redaction to ensure legal compliance.

The City recognizes that the CPRA is an important tool for promoting transparency and building public trust.

Responding to large or frequent requests of this nature requires substantial coordination across departments and staff to locate, review, and produce responsive records. As request volume has increased, the level of staff effort required to process these requests has increased as well. In some cases, a single request has required approximately 50 hours of staff time to fulfill:

“Dear Custodian of Records: Pursuant to the California Public Records Act (Government Code § 6250 et seq.), I hereby request copies of all public records in the possession, custody, or control of the City of Oxnard related to Landscape Maintenance District 12 (Standard Pacific). This request applies to all records maintained by all City departments, officials, and personnel, including but not limited to the City Clerk’s Office, City Manager’s Office, City Council, Public Works Department, Finance Department, Community Development Department, City Attorney’s Office, and any consultants, contractors, or third parties acting on behalf of the City in connection with Landscape Maintenance District 12. Records Requested This request specifically includes, but is not limited to, the following categories of records: 1.

Financial Records All income records from all sources related to Landscape Maintenance District 12, including but not limited to: Property tax revenues Assessments Fees Grants Any other funding sources All expense records, including but not limited to: Payments to vendors, contractors, and consultants Purchase orders Internal charges or transfers Administrative costs All invoices (received, paid, or unpaid) related to Landscape Maintenance District 12. All contracts, agreements, amendments, and change orders (both current and historical) with third-party vendors, contractors, consultants, or other entities providing any services or materials for Landscape Maintenance District 12. All financial reports, budgets, internal financial analyses, audit reports, and any other financial documentation related to Landscape Maintenance District 12. All assessment justification reports, including but not limited to any engineer’s reports or supporting analyses prepared pursuant to Proposition 218 or any other legal requirements. 2.

Correspondence and Communications All internal and external correspondence and communications related to Landscape Maintenance District 12, including but not limited to: Emails, letters, memoranda, text messages, and other communications between or among but not limited to the following: City staff Elected and appointed City officials Consultants Contractors All correspondence and communications from the public, including but not limited to residents, homeowners, property owners, and community groups, relating to Landscape Maintenance District 12. All public comments, complaints, service requests, and related responses regarding Landscape Maintenance District 12. 3. Maps, Plans, and Specifications All maps, site plans, and boundary descriptions for Landscape Maintenance District 12. All landscape design 12 plans, planting plans, and maintenance plans or schedules for the district. 4. Meeting Records All meeting minutes, agendas, staff reports, presentations, and supporting materials from any public meeting, council meeting, committee meeting, or advisory group meeting where Landscape Maintenance District 12 was discussed. This includes records from meetings of including but not limited to: City Council Public Works committees Finance committees Any other relevant committees or working groups. 5. Legal and Compliance Records All legal opinions, memoranda, and correspondence regarding but not limited to the following: The formation, governance, or modification of Landscape Maintenance District 12. Legal compliance issues, including compliance with Proposition 218. All notices of non-compliance or enforcement actions related to the district. 6. The following examples illustrate more typical requests received by the City:
• “Fire Report #25-0091090 for a fire at 3900 Pelican Way, Oxnard DOI 10/18/25” • “Permits of duplex or granny flat of 479 McKinley Oxnard Ca 93030. What are the permitted buildings at are allowed. Lot of land building and permits. All records to permit structures.”

In addition to the overall increase in request volume and complexity, the City has observed a growing proportion of requesters who submit repeated, broad, or iterative requests. These requests are often accompanied by follow-up communications raising concerns about compliance, threatening to sue the City, demeaning staff, or requesting additional clarification regarding the City’s responses. For example one requester has sent dozens of follow up messages asserting that the City is “in violation of the law” and including demeaning comments such as:

“...Are you incompetent, stupid or being told by your superiors to be as difficult as possible? Or all of the above?”

Addressing these follow-up inquiries and related communications requires additional staff coordination and review and may increase the potential for legal expenses. This trend is not unique to Oxnard. Many California cities and public agencies face similar burdens from serial or high-volume requesters, including overwhelming workloads, resource diversion from core services, and increased litigation threats.

Staffing for the CPRA Requests
The City’s approach to managing CPRA requests has evolved over time in response to significant increases in both the volume and complexity of requests. Initially, requests were tracked and processed by City Clerk staff using spreadsheets. As the number of requests grew, the City implemented the GovQA portal to better manage and organize submissions. During this period, City Clerk’s Office staff primarily handled the intake and processing of requests within the system, while Deputy City Attorneys were largely responsible for reviewing records, applying redactions, and responding to more complex requests, which placed a substantial additional workload on the City Attorney’s Office.

In March of 2022, the City created the Public Records Advocate position to centralize and streamline the CPRA process under a dedicated staff member responsible for coordinating requests, gathering records from departments, and preparing responses. As part of this process, the Public Records Advocate conducts an initial review of requests and responsive materials to identify potential issues and coordinate with the City Attorney’s Office when legal review is necessary. The City also implemented a new records request portal, NextRequest, designed to improve usability for both requesters and staff. These improvements were intended to make the CPRA process more accessible and transparent for the public, but the increased visibility and ease of 13 submitting requests may also contribute to higher request volumes.

Addition of a Full-Time Administrative Services Specialist As the number and complexity of requests continue to grow, additional staffing is necessary to effectively manage the workload. To address this need, a full-time Administrative Services Specialist position is proposed.

This role would provide dedicated administrative and technical support to the Public Records Advocate and other staff involved in CPRA processing.

Key duties would include:
• Tracking and logging incoming requests
• Assisting in compiling and formatting responsive records • Coordinating with departments to gather materials
• Supporting redaction processes
• Contributing to procedural improvements and workflow enhancements

This dedicated position would begin to alleviate the increased workload associated with the growing number of complex requests as previously described in this report.

Reclassification of an Administrative Services Analyst to an Administrative Services Analyst Senior The Public Records Advocate position is an Administrative Services Analyst, the 6th level of a 9 level series. Based on the increased scope of the CPRA Program, volume and complexity requests, and the addition of an Administrative Services Specialist position to support this Program, the Administrative Services Analyst needs to be increased to the 7th level of the series (Administrative Services Analyst Senior). As the Senior Analyst the position will not only implement the CPRA Program, but will supervise the Administrative Services Specialist.

STRATEGIC PRIORITIES

This agenda item supports the Organizational Effectiveness strategy. The purpose of the Organizational Effectiveness strategy is to reinforce, stabilize, improve, and strengthen the organizational foundation of the City in order to build a modern, high-functioning City government that effectively and efficiently supports the operating departments in providing high-quality services and programs for our residents and businesses.

FINANCIAL IMPACT

The total cost for the remainder of FY 2025–26 for the new Administrative Services Specialist position and the reclassification of the Administrative Services Analyst to Senior Administrative Services Analyst is $22,010. The estimated cost for a full year of the reclassification and the Administrative Services Specialist is $88,049.
