Last week VC Defensa and 805Undocufund volunteers' homes and businesses were raided. Guns were pointed at mothers. Doors were kicked down with children present. In the days that have followed, ICE presence has been more pronounced in Oxnard. Several community members have been ripped away from their families and forcibly deported Some days have been worse than others with multiple people being stalked and taken in the early hours of the morning.

You have all expressed your "support" in the past. But words mean nothing. Action does. And one action that you can directly take today is to get in contact with the groups to provide them with support. 805 Undocufund, in particular, is looking for a place to host a training for more community members in Oxnard to become volunteers. Something that is communities with resources then at the very least use your connections to help facilitate those who do.

Re: Avalon Homes, agenda item M1
Mayor Luis A. McArthur and Councilmembers,
Ventura County is in need of quality, affordable housing. The House Farm Workers! Oxnard City Committee is looking to policymakers to enforce existing policies to allow the creation of affordable housing.

The proposed Avalon Homes may house people from other jurisdictions based on their location and potential pricing. The fact that Oxnard has a limited amount of land means that the city needs to make sure to house the low-income people in our community.

In order to give everyone the opportunity to have a home, new developments have to offer affordable housing. Unfortunately, in-lieu fees often allow developers to incur more benefits than the residents of the city in which they are building.

If there is not an affordable subset that will benefit Oxnard families, then the loss of land that can be used to create housing stock should be reconsidered. Some of this land has to be dedicated to affordable housing, and in lieu fees do not do that.

For the reasons above, we strongly urge you to require the developer of Avalon Homes, to build affordable units and not accept their offer to pay an in-lieu fee.

Sincerely,
Gabrielle Vignone Frank Barajas

PUBLIC COMMENT: Oxnard City Council: May 19th: Agenda Item M1 2 messages
Heather Schmidt < Sun, May 17, 2026 at 11:22 PM
To: City Clerk <[email protected]>
Good evening Mayor, Council -
I am writing today to express my sentiments regarding Agenda Item M1 - Public Hearing on the Avalon Homes development proposal in the Oxnard Dunes region of the City. I am writing regarding a couple of issues, specifically:
1 - The developer has requested to scrap the mandatory 10% inclusionary affordable housing in favor of paying an in lieu of fee. Obviously such a suggestion is preposterous. As you know, public projects take longer and cost more, meaning that in lieu of fee would likely yield fewer affordable units than if the developer just built them themselves, and in a prolonged timeline at that. Furthermore, with a significant, ongoing homeless population in the region, the need for affordable housing in that specific area is evident.
2 - Oxnard is also facing a crisis not only of affordable, low income housing, but in "affordability" for the middle and working class earners. Approval of higher cost units has - in fact - not lowered the cost of housing for the middle class as intended; in fact, since developments such as the luxury apartments in Riverpark went in, market rates have only continued to increase, even as those units sit empty. Rejecting the developer's request for in lieu of fees ensures affordable housing is built where needed, in a timely manner, and in a way that provides a broader spectrum of price points for Oxnard residents.
3 - The Measure M presentation mentions that the open space will be managed by a private HOA or a non profit. Has a non profit been identified? If it becomes a private HOA, what is to stop the HOA from privatizing the path and parking lot, making it inaccessible to the nearby public? We have seen this occur here in East Village, where a private HOA decided they were tired of the public parking on the streets they privately managed, so they marked slots on the street, assigned them to homes, and now the streets sit nearly empty. Residents of Oxnard, especially in the adjacent areas of Oxnard Dunes and Oxnard Shores, should have unfettered access to that open space. 4 - The Measure M video also mentions that the council could also disregard the Planning Commission's recommendation to require the 10% inclusionary housing. If you are going to disregard a 6-0 Planning Commission recommendation, even given their expertise on this issue, I would have to ask: for what purpose do you even have such a commission, if you're going to disregard their advice? I respectfully request you take staff's recommendation to listen to your Planning Commissioners on this issue.
5- With an increase in vehicular traffic to the area - both from residents, and visitors to the open space - I would like to request your council strongly encourage the Public Works/Traffic division to strengthen protections at the traffic signal at 5th and Harbor. Presently, Northbound Harbor Boulevard has no protected left turn, whereas all other directions do. It is a little strange, and disorienting, for people driving in the area. While the collision warrant has not been met at the location to make changes to the signal itself, accidents nevertheless DO occur, so as traffic increases with more residents, couldn't Traffic put up more signage to direct drivers to yield on green? The signals on 5th also have yellow reflective backplates, whereas Harbor does not. I respectfully request your body to advocate for more traffic safety improvements in the region.

Mayor McArthur & Honorable Councilmembers
City of Oxnard
300 West 3 Street
Oxnard, CA 93030
SUBJECT: AVALON HOMES: REQUEST FOR PAYMENT OF IN-LIEU AFFORDABLE HOUSING FEES IN ACCORDANCE WITH ORDINANCE NO. 2980
Planning & Zoning Permit No. 16-400-02, 16-300-02 | APNs: 196-001-022; -023; -027 Dear Mayor McArthur & Honorable City Councilmembers,
Our firm represents the Oxnard Dunes, LLC, the project applicant for proposed Avalon Homes residential subdivision (Planning & Zoning Permit No. 16-400-02, 16-300-02). The proposed project site is located just to the north of the existing Oxnard Dunes neighborhood, at the current northern terminus of Canal Street. The proposed project consists of 56 detached condominium units, associated amenities, and infrastructure. Residential development will occur on approximately 8.7 acres of the site, with the remaining 29.6 acres will be permanently conserved as a publicly accessible nature preserve.

Pursuant to City of Oxnard Ordinance No. 2980, known as the Inclusionary Housing Ordinance, the applicant is required to either 1) provide ten (10) percent of the proposed units to be affordable to households classified as lower income', or 2) pay an affordable housing in-lieu fee which would remove the obligation to provide affordable units onsite. In-lieu fees are deposited in the City's Affordable Housing In-Lieu Fund and used for the creation of affordable housing opportunities across the City. Both options are acceptable approaches to satisfy the requirements of Ordinance No. 2980. Specifically, the ordinance states:
"WHEREAS, the City Council desires that a program exist to allow new residential development to provide an in-lieu affordable housing payment in place of providing affordable housing units on site, which in-lieu payment would allow other affordable housing goals and objectives to be met throughout the City."
In accordance with the requirements of the Ordinance, the applicant presented their initial proposal to proceed with payment of an in-lieu fee to City Council on July 20, 2021 as a Pre- Application item. At the time, Council did not object to the concept of the in-lieu fee.

At the March 5, 2026 Planning Commission hearing, the Commission conditioned the project to provide ten (10) percent of the 56 units proposed as onsite affordable housing, resulting in six (6) affordable inclusionary units. After careful consideration, the applicant is requesting that the Council instead permit the payment of the in-lieu fees, as originally requested. The reasons for seeking payment of in-lieu fee include:
' Ordinance No. 2980 defines a low-income person or family as one earning between 30% and 80% of the Area Median Income for the Ventura County Metropolitan Statistical Area.

AVALON HOMES: INCLUSIONARY HOUSING IN-LIEU FEE REQUEST
PAGE 2 OF 2
1) Payment of $2,456,298.96 of Inclusionary Housing Fees (as of July 1, 2025), orthe fee amount in place at time of building permit issuance, to the City's Affordable Housing In-Lieu Fund can be leveraged to produce a greater number of affordable units than the required six (6) units onsite. Specifically, the fee can be utilized by the City as a gap-financing loans to affordable housing developers utilizing tax credit allocations, grant funding, or other State/Federal funding sources for construction of new 100% affordable housing within the City for very-low-and low-income households. Often, these funding sources do not cover the full project costs, resulting in the need for gap financing.

Recent examples of gap financing loans from the City of Oxnard utilized to fill gaps in 100% affordable housing financing include a $1.2 million dollar loan to Many Mansions (Aspire Apartments), a $1.6 million dollar loan to People's Self-Help Housing (Cypress Place), and a $1.8 million dollar loan to Cabrillo Economic Development Corporation (Dolores Huerta Gardens). Cumulatively these recent loans, totaling $4.6 million, have contributed to 235 units of 100% affordable units to be constructed. 2) Potential residents of affordable units will have better access to specialized onsite supportive services and amenities at an offsite location when compared to the six (6) hypothetical onsite units. When developed at scale, affordable housing units can be accompanied by meaningful onsite supportive services such as childcare/after school daycare services, health and wellness counseling, medical clinics, and career development opportunities. Such supportive services are typically housed within an onsite common area at dedicated 100% affordable housing developments, and may include community centers, computer labs, and daycare facilities. The proposed project's required six (6) onsite inclusionary affordable units cannot support these specialized services, nor does Oxnard Dunes LLC have the expertise and experience to provide such services.
3) To date, no other development in the City's Coastal Zone has been required to provide onsite affordable housing. This includes the 'Shoreline 50' project at the Intersection of Harbor/Wooley.

Thank you for your consideration of this request. While we believe that payment of the in-lieu fee is the superior option for the reasons outlined above, Oxnard Dunes LLC understands that the decision to grant payment of In-Lieu fees is ultimately at the discretion of City Council.

Accordingly, we will comply with the direction received by Council on this topic.

We look forward to developing a high quality and special new community for Oxnard.

Respectfully Submitted.

Dear Mayor McArthur, Mayor Pro Tem Teran, and Council Members Perello, Basua, Perez, Starr and Rodriguez,
Attached is my letter of support for the Planning Commission's determination that six low income homes should be built on site, within the Avalon Homes development, consistent with the City's Inclusionary Housing Ordinance. Land is a finite resource. We must ensure that at least some of that land is used for the benefit of low income Oxnard residents.

RE: May 19, 2026 Council Meeting, AGENDA ITEM NO. M-1

AVALON HOMES - INCLUSIONARY HOUSING REQUIREMENTS
Dear Mayor McArthur, and Council Members:

I am writing to state my unconditional and unequivocal support for the Planning Commission's determination that six low income homes should be built on site, within the Avalon Homes development, consistent with the City's Inclusionary Housing Ordinance. Just as the Planning Commission rejected the Developer's request to pay affordable housing in-lieu fees, I urge the City Council to likewise reject that request.

My reasons for requesting this action follow.

The City's Inclusionary Housing Program is key to compliance with the City's obligation to Affirmatively Further Fair Housing opportunities for all Oxnard residents. It is a fact that one of the few tools the City has to actually affirmatively further fair housing is through inclusionary housing.

Facts matter. Over the last three decades more than 85% of the housing that was constructed in our community was affordable to only 15% of our population. We already have a huge housing imbalance to overcome in order to affirmatively further fair housing in our community.

Oxnard's median income is significantly below the area median income, and this Letter to Hon. Luis McArthur, Mayor and City Council Members May 18, 2026
RE: May 19, 2026 Council Meeting, AGENDA ITEM NO. M-1

Page 2 ends

imbalance puts our residents in a hole from day one. More of our residents fall into the moderate, low, very low and extremely low income categories every year as Ventura County's median income continues to rise. For example, the area median income for Ventura County for a family of four was $131,300 as of April 23, 2025, I do not have the figure for 2026, but no doubt it will be a little higher. In any event, according to HCD, the annual income of a low income household of four persons is $119,750.

So the developer's request is the equivalent of saying that it prefers to bar households earning an annual income $119,750 from living in its new community. That is discriminatory and morally and ethically wrong, especially since this development is on the coast, and no doubt the developer will draw customers from outside of Oxnard. We cannot continue to allow developers to skirt their obligation to address the housing needs of our Oxnard residents.

This situation reminds me of a sad state of affairs that unfolded in my own neighborhood involving the 27 small lot single family development known as Encanto Homes, that was constructed on the site of the old Oxnard Adult School. The homes, at $963,000, were way overpriced to begin with. The developer was allowed to offer seven homes at a price affordable to Moderate income households, and those seven homes were quickly purchased. The remaining twenty homes stood vacant for months, and to date, the neighborhood is still not fully occupied, even after offering some of the homes as rental units. In the interim, I have been approached by many low income Oxnard residents who are desperately searching to find a home that they can afford to buy. The City's Inclusionary Housing Ordinance is their only ray of hope. Please do not extinguish that hope.

It is important to understand that the RHNA for Oxnard requires only 48% of the housing stock be constructed for above moderate income households. That means that 52% of the housing stock should be constructed for the remaining income categories (21% for combined very low & extremely low-income households, 12.5% for low income households and 18.0% for moderate income households). We must require every developer who wants to build housing in Oxnard to do its part by assisting the City in meeting these goals.

We must not forget that for every project that goes forward, there remains less land to address the housing needs of our residents. Land is a finite resource. There must be a Letter to Hon. Luis McArthur, Mayor and City Council Members May 18, 2026
RE: May 19, 2026 Council Meeting, AGENDA ITEM NO. M-1

Page 3 ends

modicum of balance if there is ever to be any equity in our land use policy.

Please insist that the developer comply with Oxnard's Inclusionary Ordinance by conditioning approval of this project upon the developer's acceptance of its obligation under the Inclusionary Housing Ordinance to build six low income units on site. If the developer does not want to do that or pleads poverty, then I would suggest that it walk away from this project and leave the land vacant until someone steps forward who will respect our local laws and address the housing needs of our residents.

Please do the right thing for our community. Insist that the developer provide six low income units!
Thank you for the opportunity to comment on this very critical housing issue.

Sincerely
Barbara Macri-Ortiz
