In addition, OMNIA Partners may engage a third party to conduct an independent audit of Supplier’s monthly reports. In the event of such an audit, Supplier shall provide all materials reasonably requested relating to such audit by OMNIA Partners at the location designated by OMNIA Partners. In the event an underreporting of Contract Sales and a resulting underpayment of Administrative Fees is revealed, OMNIA Partners will notify the Supplier in writing. Supplier will have thirty (30) days from the date of such notice to resolve the discrepancy to OMNIA Partners’ reasonable satisfaction, including payment of any Administrative Fees due and owing, together with interest thereon in accordance with Section 13, and reimbursement of OMNIA Partners’ costs and expenses related to such audit.

C. 271 POLITICAL CONTRIBUTION DISCLOSURE FORM
Public Agency Instructions
This page provides guidance to public agencies entering into contracts with business entities that are required to file Political Contribution Disclosure forms with the agency. It is not intended to be provided to contractors. What follows are instructions on the use of form local units can provide to contractors that are required to disclose political contributions pursuant to N.J.S.A. 19:44A-20.26 (P.L. 2005, c. 271, s.2). Additional information on the process is available in Local Finance Notice 2006-1 (http://www.nj.gov/dca/divisions/dlgs/resources/lfns_2006.html). Please refer back to these instructions for the appropriate links, as the Local Finance Notices include links that are no longer operational.
1. The disclosure is required for all contracts in excess of $17,500 that are not awarded pursuant to a “fair and open” process (N.J.S.A. 19:44A-20.7).
2. Due to the potential length of some contractor submissions, the public agency should consider allowing data to be submitted in electronic form (i.e., spreadsheet, pdf file, etc.). Submissions must be kept with the contract documents or in an appropriate computer file and be available for public access. The form is worded to accept this alternate submission. The text should be amended if electronic submission will not be allowed.
3. The submission must be received from the contractor and on file at least 10 days prior to award of the contract.
Resolutions of award should reflect that the disclosure has been received and is on file.
4. The contractor must disclose contributions made to candidate and party committees covering a wide range of public agencies, including all public agencies that have elected officials in the county of the public agency, state legislative positions, and various state entities. The Division of Local Government Services recommends that contractors be provided a list of the affected agencies. This will assist contractors in determining the campaign and political committees of the officials and candidates affected by the disclosure. a. The Division has prepared model disclosure forms for each county. They can be downloaded from the “County PCD Forms” link on the Pay-to-Play web site at http://www.nj.gov/dca/divisions/dlgs/programs/lpcl.html#12. They will be updated from time-to-time as necessary. b. A public agency using these forms should edit them to properly reflect the correct legislative district(s). As the forms are county-based, they list all legislative districts in each county. Districts that do not represent the public agency should be removed from the lists.
c. Some contractors may find it easier to provide a single list that covers all contributions, regardless of the county.
These submissions are appropriate and should be accepted. d. The form may be used “as-is”, subject to edits as described herein. e. The “Contractor Instructions” sheet is intended to be provided with the form. It is recommended that the Instructions and the form be printed on the same piece of paper. The form notes that the Instructions are printed on the back of the form; where that is not the case, the text should be edited accordingly. f. The form is a Word document and can be edited to meet local needs, and posted for download on web sites, used as an e-mail attachment, or provided as a printed document.
5. It is recommended that the contractor also complete a “Stockholder Disclosure Certification.” This will assist the local unit in its obligation to ensure that contractor did not make any prohibited contributions to the committees listed on the Business Entity Disclosure Certification in the 12 months prior to the contract (See Local Finance Notice 2006-7 for additional information on this obligation at http://www.nj.gov/dca/divisions/dlgs/resources/lfns_2006.html). A sample Certification form is part of this package and the instruction to complete it is included in the Contractor Instructions. NOTE: This section is not applicable to Boards of Education.

Contractor Instructions
Business entities (contractors) receiving contracts from a public agency that are NOT awarded pursuant to a “fair and open” process (defined at N.J.S.A. 19:44A-20.7) are subject to the provisions of P.L. 2005, c. 271, s.2 (N.J.S.A. 19:44A20.26). This law provides that 10 days prior to the award of such a contract, the contractor shall disclose contributions to:
any State, county, or municipal committee of a political party any legislative leadership committee*
any continuing political committee (a.k.a., political action committee) any candidate committee of a candidate for, or holder of, an elective office:
o of the public entity awarding the contract
o of that county in which that public entity is located o of another public entity within that county
o or of a legislative district in which that public entity is located or, when the public entity is a county, of any legislative district which includes all or part of the county The disclosure must list reportable contributions to any of the committees that exceed $300 per election cycle that were made during the 12 months prior to award of the contract. See N.J.S.A. 19:44A-8 and 19:44A-16 for more details on reportable contributions.
N.J.S.A. 19:44A-20.26 itemizes the parties from whom contributions must be disclosed when a business entity is not a natural person. This includes the following:
individuals with an “interest” ownership or control of more than 10% of the profits or assets of a business entity or 10% of the stock in the case of a business entity that is a corporation for profit all principals, partners, officers, or directors of the business entity or their spouses any subsidiaries directly or indirectly controlled by the business entity IRS Code Section 527 New Jersey based organizations, directly or indirectly controlled by the business entity and filing as continuing political committees, (PACs).
When the business entity is a natural person, “a contribution by that person’s spouse or child, residing therewith, shall be deemed to be a contribution by the business entity.” [N.J.S.A. 19:44A-20.26(b)] The contributor must be listed on the disclosure.
Any business entity that fails to comply with the disclosure provisions shall be subject to a fine imposed by ELEC in an amount to be determined by the Commission which may be based upon the amount that the business entity failed to report.
The enclosed list of agencies is provided to assist the contractor in identifying those public agencies whose elected official and/or candidate campaign committees are affected by the disclosure requirement. It is the contractor’s responsibility to identify the specific committees to which contributions may have been made and need to be disclosed. The disclosed information may exceed the minimum requirement.
The enclosed form, a content-consistent facsimile, or an electronic data file containing the required details (along with a signed cover sheet) may be used as the contractor’s submission and is disclosable to the public under the Open Public Records Act.
The contractor must also complete the attached Stockholder Disclosure Certification. This will assist the agency in meeting its obligations under the law. NOTE: This section does not apply to Board of Education contracts. * N.J.S.A. 19:44A-3(s): “The term "legislative leadership committee" means a committee established, authorized to be established, or designated by the President of the Senate, the Minority Leader of the Senate, the Speaker of the General Assembly or the Minority Leader of the General Assembly pursuant to section 16 of P.L.1993, c.65 (C.19:44A-10.1) for the purpose of receiving contributions and making expenditures.” Doc #4, continued

Agreement 32700179 with Clean Harbors for
On-Call Citywide Hazardous and Unknown Waste
Identification, Collection, and Disposal Services
Philip Schwieder, Streets Division Manager
Public Works Department
Public Works and Transportation Committee
September 22, 2026
220
RECOMMENDATION 2
That the Public Works and Transportation Committee
recommend that the City Council approve and authorize the Mayor to execute an Agreement with Clean Harbors
Environmental Services, Inc. for a five-year term, which includes options to extend, for a total not-to-exceed amount of $1,197,000 for citywide hazardous waste identification, collection, and disposal services.
221
BACKGROUND
The following Public Works Department Divisions routinely encounter various types of hazardous waste and unknown
hazardous materials as a result of their day-to day operations:
• Parks
• Streets
• Fleet
• Facilities
• Wastewater
• Environmental Resources
• Special Districts
• Water
3 222
BACKGROUND
• Hazardous materials are defined and regulated under
California Code of Regulations (CCR) Title 22 and Code of Federal Regulations (CFR) Title 49.
• A hazardous material is any substance that, if not properly controlled during handling, storage, manufacture,
processing, packaging, use, disposal, or transportation, may pose an unreasonable risk to the health and safety of employees, the public, or the environment.
• Hazardous materials may exist in the form of gases,
liquids, solids, or combinations of these physical states. 4 223
BACKGROUND
• A specialized hazardous waste disposal service is
necessary to safely manage unknown waste and
hazardous materials encountered by Public Works staff.
• City employees are not formally trained nor do they have the equipment to handle hazardous waste.
• Materials must be properly identified, characterized, packaged, labeled, transported, and disposed of in
accordance with applicable regulatory requirements and
established safety procedures.
5 224
BACKGROUND
• Unknown materials may require additional testing or
identification before an appropriate disposal method can be determined.
• This specialized process differs from the City’s routine disposal operations conducted through the Environmental Resources Division.
• A qualified hazardous waste service provider is
recommended to ensure unknown or potentially hazardous
materials are properly managed and disposed of while
minimizing risks to employees, the public, and the
environment.
6 225
DISCUSSION
• Public Works Department personnel frequently encounter unknown hazardous materials in the public right-of-way for which they lack the specialized training, equipment, and designated outlets required for safe disposal.
• To address these challenges, contracted vendor services are required both for emergency responses, such as vehicle accidents and fires, and for routine hazardous waste
management.
• Beyond handling waste generated at Public Works facilities, the vendor will manage burned or abandoned vehicles,
hazardous roadway spills, and illegally dumped materials in the public right-of-way.
7 226
DISCUSSION
• The selected vendor shall furnish all necessary labor, materials, supplies, and specialized equipment required to perform these essential services.
• This includes comprehensive cleaning and remediation
efforts following hazardous spills, vehicular accidents, or other unanticipated incidents.
• The provider must demonstrate the capacity for rapid
mobilization, responding to urgent emergency calls within a two hour window and addressing non-emergency requests
within 24 hours.
8 227
DISCUSSION 9
Photos below are examples of hazardous waste found in the public right-of-way:
228
DISCUSSION
• The City is securing a compliant hazardous waste services agreement through a pre-vetted Omnia Partners cooperative Cooperative Contract No. 2023.003935 as allowed by the City’s Purchasing Policy.
• Clean Harbors delivers lower labor and waste disposal rates for the City while maintaining full, comprehensive hazardous waste services.
10 229
DISCUSSION
• The following table summarizes Public Works’ historical spending with its previous service provider:
11 Fiscal Year Spending Time Period
2024 $42,903.60 8 months
2025 $125,406.98 12 months
2026 $181,708.96 12 months
2027 $5,780.30 4 months
230
FINANCIAL IMPACT 12
● The cost for this Agreement with Clean Harbors
Environmental Services, Inc. shall not exceed $1,197,000 ● over the full term, which can be up to five years, if extended.
● Sufficient appropriations are included in the Adopted FY 2026-27 Operating Budget. Funds for subsequent fiscal
years will be requested during the annual budget process for the City Council’s consideration.

AGENDA REPORT
REPORTS
AGENDA ITEM NO. D.3
DATE: September 22, 2026
TO: Public Works and Transportation Committee
FROM: Michael Wolfe, Public Works Director, (805) 385-8055, [email protected] SUBJECT: Report on Oxnard Storm Drainage Infrastructure and Preparation Measures for the Predicted Super El Niño Event.
RECOMMENDATION
That the Public Works and Transportation Committee (PWTC) receive and file this report.
Please click the following link to view the required Measure M pre-recorded presentation video: https://youtu.be/MllzawwW0Q8
BACKGROUND
At the June 23, 2026, 2026 PWTC meeting, one of the Committee members requested updates on storm drain capital improvement program (CIP) projects and information about the Public Works department’s preparations for a potentially higher than normal rainy season due to El Niño. This staff report provides those updates.
Geographically, Oxnard lies on a low alluvial plain, or delta for the Santa Clara River. Like many such deltas throughout the world, the Oxnard plain is characterized by nutrient-rich soils and very flat topography, making it ideal for the myriad agriculture that occurs here. The City is well-developed and, as such, has a large percentage of impermeable surfaces like roads, sidewalks, and parking lots. This is coupled with the fact that Oxnard is very flat, so much so that the average gradient (slope) from Riverpark in the north to the Oxnard Wastewater Treatment Plant in the south is only 0.2%. By comparison, the generally accepted ideal slope for gravity utility systems is 2%, which is significantly steeper and allows for faster flow and better concentration.
Consequently, sometimes during long or heavy rain events, the existing drainage infrastructure cannot carry the water away faster than it is deposited, simply because of the flatness of the area and the design of existing drainage infrastructure (see below for more information). This effect is sometimes exacerbated by the occurrence of higher-than-normal ocean tides (called “King Tides”). These factors all may result in localized flooding of streets and private property, as has been experienced during past rainy seasons.
Over the last several months, a renewed focus on the impacts of excessive rain and stormwater has been rooted in the forecasted, and well-advertised, 2026/27 El Niño (termed “Super El Niño”) event. El Niño (formally called the El Niño Southern Oscillation, “ENSO”) is a climate phenomenon associated with anomalously higher than normal equatorial sea temperatures in the Pacific Ocean that have the effect of altering the normal seasonal patterns on a global level. At the time of this report’s preparation, it is predicted that the upcoming fall and winter has a high probability of bringing unusually large and intense periods of rain to the Southern California area.
233
Storms are categorized into X-year events, such as the “10- year event” or the “100- year event”. An example of a commonly used metric is the 10-year event, which is a statistical measurement that describes a certain volume of rainfall over a 24-hour period that has a 10% chance of occurring at a specific location over a given year. This size rain storm is what the majority of existing underground storm drain infrastructure is designed to handle. Therefore, event sizes up to a 100-year storm are typically conveyed within the roadway system (i.e. the curb/gutter and streets). This is why higher-intensity rain events typically overwhelm the underground system and result in water in the streets, usually leaving only a single lane to allow emergency vehicles to use.
Meaning, water in the streets is the intended outcome for more intense storm events. To design and construct (or reconstruct) an underground system to handle the 100-year event intensity would be cost-prohibitive, requiring millions, if not billions, of dollars.
It should be kept in mind that the notion of a 10-year or 100-year event is not predictive of when the storm will happen. Also, it is important to understand that when such an event occurs, there’s no guarantee that it won’t happen again within the event’s timeframe; indeed, such storms can occur back-to-back over multiple years. It is also very possible that a storm larger than the 10-year or 100-year event may occur during any given year and, when it does, the flow would exceed the design criteria for most of Oxnard’s stormwater infrastructure. For example, a storm exceeding the intensity of a 1,000-year event occurred in Oxnard in 2023.
From the National Oceanic and Atmospheric Administration (NOAA) website, the rain intensity during the 2 AM one-hour period at the Oxnard Civic Center rain gauge on December 21, 2023 exceeded the 1,000-year estimate by nearly double.
Capital Improvement Program (CIP) Reference:
This is an informational report only. There are several existing CIP projects that address stormwater infrastructure needs.
DISCUSSION
The City of Oxnard manages its existing storm drain infrastructure via in-house and contracted maintenance resources, and identifies and delivers needed improvements to the system through projects contained in the Capital Improvement Program (CIP). Guidance for future improvement of the system is provided by the Master Plan of Drainage (MPD), and this document is presently in the process of being updated by an engineering consulting firm.
Key Stormwater Project Updates:
Sutter Drive Wall and Swale–This project involves improving an existing drainage system along the backside of the residential properties along Sutter Drive. The channel will be made of reinforced concrete and includes the replacement of concrete block property walls that are adjacent and integral to the drainage channel. Presently, Public Works (PW) Administration staff are assembling the bid specifications to accompany the completed construction plans, and the PW Department plans to solicit bids for this project in the fall of 2026.
Hill Street Stormwater Project–Somewhat belying its name, this street and immediate area is very flat and hosts a known flooding problem during larger rainstorm events. This, combined with few existing drain inlets, makes for flooded streets and sidewalks that sometimes even temporarily inhibit access to portions of the adjacent school. Currently, Engineering staff are working on engineering plans to intercept the stormwater, before it has a chance to pond, and divert it to a nearby existing stormwater collection area, as a temporary solution until a full storm drain design can be analyzed. This stop-gap work is anticipated to occur as part of the Durley Park Rehabilitation project, presently being prepared for solicitation.
Yucca Street Phase II Stormwater Drainage Project–Similar to the Hill Street project, this area has been 234
identified in previous versions of the MPD as a priority area to address. The project involves installing new subsurface drain lines and associated drain inlets to areas along Samuel Avenue (from Channel Islands Blvd. to Yucca St.) that presently have none. This work is an extension of the previously constructed Yucca Street Storm Drain Phase I that is located along Yucca Street from J Street Drain to Samuel Avenue. This project is presently in the design phase, and is technically challenging in that there are many buried utilities (gas, water, etc.) that are in conflict with the route of the gravity-dependent new storm drain line. Owing to the flatness of this area, the new storm drain line has few gravity-dependent routing options that will provide enough slope for the water to flow. As such, some of the existing buried utilities will need to be relocated, which will require close coordination with the utility owners. It is because of these complex utility coordination needs that progress towards the construction phase of this project is taking longer than anticipated. Currently, construction is anticipated to occur in the summer of 2027.
Doris Avenue Between A Street and M Street–This segment of Doris Avenue has a history of resident complaints regarding stormwater accumulating over the height of the curb and onto the sidewalk during heavy rain events. The primary cause of this, besides being very flat, is that the main stormwater pipe that collects water from the drain inlets in this area becomes overwhelmed, and the water has nowhere to go until the stormwater flow subsides (see above for design criteria). An identified solution is found in the MPD, where an additional collector pipe would be installed to essentially double the capacity of the original pipe. Engineering staff is presently working to evaluate the area (including the development of the new, revised MPD), and to identify the best technical options for the addition of a new storm drain pipe.
Oxnard’s Preparation for the Anticipated “Super El Niño”:
Catch Basin Cleaning - The City contracts with a third-party vendor to inspect and clean every publicly owned catch basin twice per year. The catch basin cleaning contract includes an option to clean additional catch basins, if needed. In preparation for the upcoming wet season, staff are evaluating the amount and location of trash and debris removed during the ongoing cleaning operation. As applicable, additional cleanings will be ordered in flood-prone and high trash areas.
Drainage Ditch Maintenance - The City owns and maintains approximately 50 miles of open channel drainage ditches. These ditches are maintained throughout the year to limit the amount of vegetation growth, which can inhibit the water flow and reduce the stormwater carrying capacity of the channel. In preparation for the wet season, all of these ditches will be inspected and cleaned.
Sandbag Stations - Ahead of the rainy season, the PW Department sets up sandbag stations at several locations across the City where residents may fill sandbags to take back to their properties for flood protection purposes. The locations of these are announced via different outlets (e.g. social media platforms).
Tree Maintenance - The City is responsible for over 41,000 trees, per the most recent tree inventory in 2026.
With the passing of Measure E in 2020, the City Council approved funding for contract tree services that include a Grid Pruning Contract and an On-Call Tree Maintenance Services Contract. The Grid Pruning Contract provides cost-effective tree pruning, at bulk rates, citywide to achieve the objective of an industrystandard five-year pruning cycle for all City trees (palm trees are pruned at least once per year). The On-call Tree Maintenance Services Contract supplements the in-house five member City Tree Crew and provides additional capacity to address emergency tree work, tree removals, stump grinding, root pruning, aesthetic pruning, work associated with the Capital Improvement Program (CIP), and storm event preparation and response. The use of these two Measure E funded contract services has also allowed the tree maintenance program to include the assessment and removal of diseased and dead trees to occur and thereby, reducing the risk of tree related incidents (e.g. trees falling) during storm events.

RECOMMENDATION
That the Public Works and Transportation Committee (PWTC) receive and file this report.
2 238
BACKGROUND
It was requested at the June 23, 2026, 2026 PWTC meeting to provide an update on CIP and maintenance activities for storm drain repair and maintenance
• Oxnard is geographically flat
• Rainwater drains very slowly
• The coming rainy season is anticipated to be potentially higher than normal due to the El Niño phenomenon
• This is predicted to be a strong or “Super El Nino” event 3 239
BACKGROUND
• Storms are categorized into X-year events
• An example is the “10-year event”
• This means a 10% chance of a certain rainfall amount over 24-hours, at a specific location over a year period
• This does not mean that such an event will only happen once in a year.
• In fact, 10, 100, or even 1000-year events can happen back-to-back!
4 240
DISCUSSION
The City has both Capital (CIP) projects and maintenance programs in place to address stormwater runoff.
Key CIP Projects:
• Sutter Drive Wall and Swale–Improving an existing drainage system along the backside of the residential properties along Sutter Drive. • Hill Street Stormwater Project–Intercept water before it has a chance to pond, and divert it to a nearby existing stormwater collection area, as a temporary solution until a full storm drain design can be analyzed • Yucca Street Phase II Stormwater Drainage Project–Extension of the previously constructed Yucca Street Storm Drain Phase I that is located along Yucca Street from J Street Drain to Samuel Avenue. • Doris Avenue between A Street and M Street–Addition of a collector pipe to essentially double the capacity of the original pipe. 5 241
DISCUSSION
Oxnard’s Preparation for the Anticipated El Niño Event
1. Catch Basin Cleaning–Third-party contractor to inspect and clean every publicly owned catch basin twice per year
2. Drainage Ditch Maintenance–All 50 miles of these ditches will be inspected and cleaned.
3. Sandbag Stations–Sandbag stations are set up at several locations across the City where residents may fill sandbags to take back to their properties for flood protection purposes
4. Tree Maintenance–On-call Tree Maintenance Services Contract supplements the in-house five member City Tree Crew to service the 41,000 City trees.
