Axon Customer Experience Improvement Program Appendix
1. Axon Customer Experience Improvement Program (ACEIP). The ACEIP is designed to accelerate Axon’s development of technology, such as building and supporting automated features, to ultimately increase safety within communities and drive efficiency in public safety. To this end, subject to the limitations on Axon as described below, Axon, where allowed by law, may make limited use of Customer Content from all of its customers to provide, develop, improve, and support current and future Axon products (collectively, "ACEIP Purposes"). However, at all times, Axon will comply with its obligations pursuant to the Axon Cloud Services Terms of Use Appendix to maintain a comprehensive data security program (including compliance with the CJIS Security Policy for Criminal Justice Information), privacy program, and data governance policy, including high industry standards of de-identifying Personal Data, to enforce its security and privacy obligations for the ACEIP. ACEIP has 2 tiers of participation, Tier 1 and Tier 2. By default, Customer will be a participant in ACEIP Tier 1. If Customer does not want to participate in ACEIP Tier 1, Customer can revoke its consent at any time. If Customer wants to participate in Tier 2, as detailed below, Customer can check the ACEIP Tier 2 box below. If Customer does not want to participate in ACEIP Tier 2, Customer should leave box unchecked. At any time, Customer may revoke its consent to ACEIP Tier 1, Tier 2, or both Tiers.
2. ACEIP Tier 1.
2.1. When Axon uses Customer Content for the ACEIP Purposes, Axon will extract from Customer Content and may store separately copies of certain segments or elements of the Customer Content (collectively, "ACEIP Content"). When extracting ACEIP Content, Axon will use commercially reasonable efforts to aggregate, transform or de-identify Customer Content so that the extracted ACEIP Content is no longer reasonably capable of being associated with, or could reasonably be linked directly or indirectly to a particular individual ("Privacy Preserving Technique(s)"). For illustrative purposes, some examples are described in footnote 11 .
For clarity, ACEIP Content will still be linked indirectly, with an attribution, to the Customer from which it was extracted. This attribution will be stored separately from the data itself, but is necessary for and will be solely used to enable Axon to identify and delete all ACEIP Content upon Customer request. Once de-identified, ACEIP Content may then be further modified, analyzed, and used to create derivative works. At any time, Customer may revoke the consent granted herein to Axon to access and use Customer Content for ACEIP Purposes. Within 30 days of receiving the Customer’s request, Axon will no longer access or use Customer Content for ACEIP Purposes and will delete any and all ACEIP Content. Axon will also delete any derivative works which may reasonably be capable of being associated with, or could reasonably be linked directly or indirectly to Customer. In addition, if Axon uses Customer Content for the ACEIP Purposes, upon request, Axon will make available to Customer a list of the specific type of Customer Content being used to generate ACEIP Content, the purpose of such use, and the retention, privacy preserving extraction technique, and relevant data protection practices applicable to the Customer Content or ACEIP Content ("Use Case"). From time to time, Axon may develop and deploy new Use Cases. At least 30 days prior to authorizing the deployment of any new Use Case, Axon will provide Customer notice (by updating the list of Use Case at https://www.axon.com/aceip and providing Customer with a mechanism to obtain notice of that update or another commercially reasonable method to Customer designated contact) ("New Use Case").
2.2. Expiration of ACEIP Tier 1. Customer consent granted herein will expire upon termination of the Agreement.
In accordance with section 1.1.1, within 30 days of receiving the Customer’s request, Axon will no longer access or use Customer Content for ACEIP Purposes and will delete ACEIP Content. Axon will also delete any derivative works which may reasonably be capable of being associated with, or could reasonably be linked directly or indirectly to, Customer.
3. ACEIP Tier 2. In addition to ACEIP Tier 1, if Customer wants to help further improve Axon’s services, Customer may choose to participate in Tier 2 of the ACEIP. ACEIP Tier 2 grants Axon certain additional rights to use Customer 1 For example; (a) when extracting specific text to improve automated transcription capabilities, text that could be used to directly identify a particular individual would not be extracted, and extracted text would be disassociated from identifying metadata of any speakers, and the extracted text would be split into individual words and aggregated with other data sources (including publicly available data) to remove any reasonable ability to link any specific text directly or indirectly back to a particular individual; (b) when extracting license plate data to improve Automated License Plate Recognition (ALPR) capabilities, individual license plate characters would be extracted and disassociated from each other so a complete plate could not be reconstituted, and all association to other elements of the source video, such as the vehicle, location, time, and the surrounding environment would also be removed; (c) when extracting audio of potential acoustic events (such as glass breaking or gun shots), very short segments (<1 second) of audio that only contains the likely acoustic events would be extracted and all human utterances would be removed.

Content, in addition to those set forth in Tier 1 above, without the guaranteed deployment of a Privacy Preserving Technique to enable product development, improvement, and support that cannot be accomplished with aggregated, transformed, or de-identified data.
տ Check this box if Customer wants to help further improve Axon’s services by participating in ACEIP Tier 2 in addition to Tier 1. Axon will not enroll Customer into ACEIP Tier 2 until Axon and Customer agree to terms in writing providing for such participation in ACEIP Tier 2.

Agenda No. 13 C
CITY OF PACIFIC GROVE
300 Forest Avenue, Pacific Grove, California 93950
TO: Honorable Mayor and Members of the City Council
FROM: Debby Beck, Council Member
MEETING DATE: August 21, 2024
SUBJECT: Reinstallation of Crosswalks and Stop Sign at Fountain Avenue and Pine Avenue CEQA: Categorical Exemption, CEQA Guidelines Section 15301, Class I, Existing Facilities
RECOMMENDATION
1. Discussion and action on the reinstallation of crosswalks at the intersection of Fountain Avenue and Pine Avenue, where a previously existing crosswalk has been removed.
2. Before the Council takes action to direct the reinstallation of the crosswalks at the intersection of Fountain Avenue and Pine Avenue, the Council should find that this action is exempt from CEQA pursuant to Class 1 categorical exemption in CEQA Guidlines Section 15301 and also the Common Sense Exemption in CEQA Guidelines Section 15061 (b)(3)
DISCUSSION
The intersection currently spans four lanes of traffic, presenting a safety concern for middle school children who walk along Fountain Avenue to and from school. The absence of a crosswalk at this key intersection puts students at risk, as they are forced to cross multiple lanes of traffic without proper pedestrian infrastructure.
**Proposal:**
1. **Reinstallation of Crosswalks:** - Install crosswalks on both the West and East sides crossing Pine Avenue. Ensure that the crosswalks are clearly marked and visible to both pedestrians and drivers.
2. **Installation of Light-Up Crossings:** - Consider installing light-up pedestrian crossings at the four-way intersection to increase visibility, particularly during school hours and low-light conditions.
3. **Reinstallation of Stop Sign:** - Reinstall a stop sign at the intersection to regulate traffic flow and enhance pedestrian safety.
**Rationale:**
The reinstallation of crosswalks and a stop sign at this intersection is essential to ensure the safety of our middle school students and other pedestrians. With a crossing at every other intersection along Fountain Avenue, it is critical to provide consistent and safe crossing points throughout the area, particularly near the school zone. These measures will help prevent accidents and make the journey to and from school safer for our youth.
**Action Required:** - Approval of the proposed reinstallation of crosswalks and the stop signs PGCC 8-21-24
OPTIONS
Allocate a budget for the installation of light-up crossings, if deemed necessary and schedule the installation work to minimize disruption during the school year. Or take alternative action.
FINANCIAL IMPACT:
Financial impacts include the costs to install any new infrastructure, street markings, signs or other traffic control devices
FOCUSED PRIORITY AREA: Not Applicable.

• Pacific Grove Is home to black-tailed deer, a
species native to Monterey County and they
have adaptive strategies that allow them to use
human spaces for their own needs.
• The start of rutting season generally begins in
mid-October and lasts through early
December. The rut can also start as early as the
end of September.
• The rut is the peak-breeding season for deer,
their behavior changes. Rutting activities include
rubbing their antlers on trees and rocks causing
the velvet covering to come off. They will also
spar with each other to establish dominance.
• Does often go into heat within a consistent
24–72 hour period each year. The buck will
stay with the doe for 1-3 days and then leave.

These are two
separate does
that stood by while
their fawn was
taken away. Both
had been hit by
vehicles.
This young buck just showed up and hung
around for a couple of weeks. He was
monitored by the residents at Canterbury
Woods, Urban Trapping, CA Department of
Fish & Wildlife, and PG Deer Awareness/
Resource. He had been hit by a vehicle and
his entire rack was crushed. The poor guy
died a few days later in a nearby yard.

The process by Urban Trapping
Wildlife Control for removal:
** They examine and photograph
the carcass
** They remove the carcass
** Disinfect the area and
surrounding ground where the
carcass was lying
** They contact the local CA
Dept. of Fish and Wildlife to
discuss the carcass
** If requested, will transport the
carcass to the local CDFW
** CDFW may have a necropsy
done to determine cause of death
** If warranted those results are
sent to the State
** Urban Trapping Wildlife
Control then completes a report

RESOURCE WELCOMES
EVERYONE TO THE 2024 CAR
WEEK
Pacific Grove’s fawning season is
wrapping up. We ask that you
drive carefully while visiting.
Please keep in mind if you see
one deer there are likely more
around it. Our fawns are
walking and playing around now.
They are not quite tuned into
moving vehicles, so please drive
carefully. We thank you for caring
and wish you
all a wonderful time during the
2024 Car Week.

MOVING FORWARD
Our major goal for the 2024-2025 fawning season, is contacting as many as we can, major delivery services/companies that services Pacific Grove, including but not limited to:
UPS, AMAZON, FED EX, USPS, DHL, GREEN WASTE,
CONSTRUCTION COMPANIES, LANDSCAPING COMPANIES,
TREE SERVICE COMPANIES, UBER, INSTACART, DOORDASH, TAXI,
ROOFING, LYFT
We plan to achieve this goal by contacting these companies and arranging a “Meet and Greet” to provide information about Pacific Grove’s Native Deer. Letters will be sent, use of social media, and we will approach local papers to print articles regarding the fawning season. Our presence at the Monday Farmer’s Market, Good Ol’ Days, and other events
will continue.

Another goal is to raise funds for narrative Image Credit Ron Henry signage for residents and tourists alike to
learn about our deer. Signs could be
placed in areas where deer are commonly
seen. 6

CAUSE OF DEATH
LUNGWORM
IT’S A PARASITE
Adult deer are somewhat resistant, but they can still get lungworm if they are stressed or don't have good nutrition.
Lungworm can cause health issues and even death in deer.
Deer can get lungworm by eating infective larvae that are passed in the feces of other deer.
The larvae can also be found on pasture or in snails and slugs that deer eat.
In severe cases, the worms can become so abundant that they make it difficult for the deer to breathe, a condition known as "lungworm pneumonia". This can and most often develops into Chronic Wasting Disease.
Once consumed, the larvae pass through the deer's stomach and intestines, and then migrate to the lungs through the lymphatic and blood systems.
In the lungs, the larvae develop into adult worms that live in the airways and lay eggs.
The eggs are then coughed up and swallowed by the deer, where they hatch into larvae and are passed in their feces again.
Deer that are weaned in the fall are most susceptible to lungworm because they haven't yet developed immunity, and the autumn environment is favorable for the parasite's survival.

The food source for the deer this year was scarce. Natural habitat like yards that the deer rely on for a food source are disappearing due to construction (old and new). Tall fences are being built that keep deer out of yards.
Pacific Grove has the highest mortality rate in all of Monterey County. 8 PGCC 8-21-24
