1 AGREEMENT FOR TEMPORARY EMPLOYMENT OF RETIRED ANNUITANT AS INTERIM

Government Code Section 21221(h)
THIS AGREEMENT, made and entered into this 5th day of February 2025, by and between the City of Pacific Grove, State of California, a municipal corporation (“City”) and Jon Biggs (“Biggs”) (collectively referred to as “the Parties”) both of whom understand as follows:
FACTS
1. The City is in need to fill a vacancy on a temporary basis for a limited duration to assist with Community Development Director duties due to the vacancy of the Development Director position. This position has oversight and manages the Community Development Department.
2. Biggs is a retired annuitant under the California Public Employees’ Retirement System (“CalPERS”) and is limited in his ability to accept public employment without reinstatement pursuant to Government Code section 21221(h), and may not work more than 960 hours within a fiscal year;
3. Prior to his retirement, Biggs served as the Community Development Director for the City of Los Altos, and therefore possesses the specialized skills and training required to perform the duties of the temporary assignment as described in Paragraph 1;
4. Biggs desires to provide temporary services to City under the terms of this Agreement and within the constraints of Government Code sections 21221(h) as a CalPERS retired annuitant, and City desires to temporarily hire Biggs on these terms to provide specialized services of a limited duration, subject to the terms and conditions set forth in this Agreement;
NOW, THEREFORE, in consideration of the mutual covenants herein contained, the Parties agree as follows:
Section 1. Powers. Duties and Responsibility during the Temporary Employment A. As a retired CalPERS annuitant, the City shall employ Biggs on a work schedule determined by the City Manager, or designee not to exceed 300 hours for fiscal year 2024/2025.

PGCC 2-5-25
2 B. Biggs is appointed as a temporary employee and shall temporarily provide highlyspecialized skills in connection with provision of Community Development Director services to City staff, City officials, and the community.

C. Biggs hereby agrees to faithfully and diligently perform the assigned duties as specified by this Agreement. Biggs is expected to devote reasonable and necessary time outside normal office hours to the business of the City. Any time spent working outside normal office hours must be tracked and reported to the City and will count towards the 960 hour limit as set forth in Government Code section 21221(h) and the 300 hour limit as set forth in this Agreement.
D. The City hereby agrees to employ Biggs as a temporary employee of the City of Pacific Grove. Employment shall commence on the 6th of February 2025 and shall end no later than June 30, 2025.
Section 2. Term & Termination
A. The employment of Biggs under this Agreement is at will. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the Biggs to resign at any time from his position with the City. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of the City to terminate the services of Biggs. Biggs has no property interest in this position.
B. Unless terminated sooner by either Biggs or the City as provided in Sub-section
2.A. of this Agreement, this Agreement shall expire automatically as of the first of the following to occur: (i) completion of the temporary assignment due to the appointment of a permanent Community Development Director; (ii); upon Biggs working the 300th hour for the City pursuant to the terms of this Agreement, or upon Biggs working the 960th hour pursuant to Government Code section 21221(h) inclusive of hours worked for other CalPERS Agencies during the City’s 2024-2025 fiscal year; or (iii) June 30, 2025.
C. Biggs serves at the pleasure of the City and nothing herein shall be taken to imply or suggest a guaranteed term or tenure.
D. Biggs agrees to remain in the exclusive employ of the City of Pacific Grove while employed by the City, and to avoid any conflicting interests. Exclusive employment, however, shall not be construed to preclude occasional teaching, writing, speaking or consulting performed on the Biggs's time off, even if outside compensation is provided for such services. Said activities are expressly allowed, provided that in no case is any activity allowed which would present a PGCC 2-5-25
3 conflict of interest with the City. Biggs agrees to provide written notification of any outside activity within the meaning of this provision. If Biggs works for any other CalPERS employer during the term of this Agreement, Biggs must notify City of this employment and disclose to the City on a periodic basis (at a frequency to be determined by City) the number of hours Biggs is performing work for the other employer to ensure that the maximum number of hours he may work each fiscal year is not exceeded.
E. As a CalPERS retired annuitant, hours paid for Biggs’s services shall not exceed 960 hours for the fiscal year 2024/2025. Weekly hours will vary to ensure total hours worked will not exceed 960 hours for the fiscal year limit set by Government Code 21221(h) or 300 hours as set by this Agreement. The City will have discretion and control over the amount of weekly work hours, hours scheduled to work, and days scheduled.
F. The position held temporarily by Biggs is not part of a represented bargaining unit and he is not covered by the terms of any collective bargaining agreement with any represented or unrepresented group of City employees.
G. The operative date of this Agreement shall be the date first written above and in this Agreement. This Agreement shall expire no later than the June 30, 2025, but may expire sooner based upon the City's needs, as determined in its sole discretion.

Section 6. Conflict of Interest Prohibition.
PGCC 2-5-25
5 It is understood and agreed that because of the nature of the duties to be performed under this Agreement within and on behalf of the City of Pacific Grove and its citizenry, Biggs shall not, during the term of this Agreement, individually, as a partner, joint venture, officer or shareholder, invest or participate in any business venture conducting business in the corporate limits of the City, except for stock ownership in any company whose capital stock is publicly held and regularly traded, without prior approval of the City Council. For and during the term of this Agreement, Biggs further agrees, except for a personal residence or residential property acquired or held for future use as his personal residence, not to invest in any other real estate or property improvements within the corporate limits of the City, without the prior written consent of the City Council.
Section 7. General Provisions.
A. The text herein shall constitute the entire Agreement between the parties with respect to the subject matter of this Agreement and shall supersede all prior negotiations, representations, or agreements, either written or oral, between City and Biggs as of the effective date of this Agreement. City and Biggs agree that each has fully participated in the review and revision of this Agreement and that any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in the interpretation of this Agreement or any amendment to this Agreement.
B. This Agreement may be amended or modified only by an instrument in writing signed by the City and Biggs.
C. This Agreement shall be binding upon and inure to the benefit of the heirs at law and executors of Biggs.
D. Any waiver of any terms or conditions of this Agreement must be in writing and signed by the City and Biggs. A waiver of any term or condition of this Agreement shall not be construed as a waiver of any other term or condition in this Agreement.
E. In performing this Agreement, the parties shall comply with all applicable federal, state, and local laws and regulations.
F. If any provisions, or any portion thereof, contained in this Agreement is held unconstitutional, invalid or unenforceable, the remainder of this Agreement, or portion thereof, shall not be affected and shall remain in full force and effect.
G. This Agreement shall be interpreted according to the laws of the State of California. Venue for any action or proceeding regarding this contract shall be in Monterey County, California.
PGCC 2-5-25
