BACKGROUND/DISCUSSION:

On October 25, 2021, the City Council approved the Master Agreement and Task Order No. 1 between the City of Pacifica and NCE for Design and Engineering Services related to the FY 2022-23 Pavement Resurfacing Project. The project will resurface streets generally in the northern part of Pacifica. As part of the FY 2022-23 Pavement Resurfacing Project, new ADA curb ramps must be installed within the limits of the project as specified in the City’s ADA Transition Plan and by federal ADA law

ramps, sidewalks, and other miscellaneous related work within the limits of the pavement resurfacing work. The project will be funded by Measure W and the Highway Safety Improvement Program (HSIP) Grant.

Engineering Staff applied for and was awarded a HSIP Cycle 10 grant in the amount of $249,200 for the construction phase. The focal point of the submitted HSIP grant application was the northern area of Pacifica, namely installing pedestrian safety features such as ADAcompliant curb ramps and high-visibility crosswalk striping. The Highway Safety Improvement Program is one of the core federal-aid programs. The purpose of the HSIP program is to achieve a significant reduction in traffic fatalities and serious injuries on all public roads, including non-State-owned public roads and roads on tribal land. The HSIP funds are eligible for work on any public road or publicly owned bicycle or pedestrian pathway or trail. It is the intent of the HSIP program that the HSIP funds be expended on safety projects that can be designed and constructed expeditiously.

The Project was advertised on February 9, 2022, and February 16, 2022, in accordance with the formal bid process. Twenty-seven (27) companies requested plans and specifications and seven (7) companies submitted bids. On March 3, 2022, the bid opening was held via Zoom by the City Clerk and the result is as follows:

Company Base Bid
DRYCO Construction, Inc. $ 305,500.00
Rosas Brothers Construction $ 317,200.00
JJR Construction, Inc. $ 317,961.00
Golden Bay Construction, Inc. $ 398,513.00
Kerex Engineering $ 424,900.00
Ray's Electric $ 508,450.00
MG & JC Concrete $ 602,910.00
The apparent low bidder is DRYCO Construction, Inc. with a base bid amount of $305,500.00.

All required documentation was submitted with their bid. DRYCO Construction, Inc. has performed several of the City’s projects in the past and their work has been satisfactory. As there are sufficient project funds approved as part of the FY 2021-2022 budget, the City Manager recommends the award of contract to the apparent low bidder, DRYCO Construction, Inc. In addition, a 15% contingency is recommended to allow enough funding to handle any additional improvements that are identified during construction. Staff recommends authorizing a budget authority for construction in the amount of $351,325.00, which includes contingencies in an amount not to exceed fifteen percent (15%) of the Construction Contract amount for any unforeseen conditions.
4 Leaf, Inc. is a full-service engineering firm that specializes in local agency staff augmentation work, including construction management and inspection work. As this project is funded with HSIP federal funds and administered by Caltrans, there are special reporting requirements imposed on this project. Not only does 4 Leaf, Inc. have the expertise in construction inspection and management for this type of project, they are also familiar with the special Caltrans procedures and reporting requirements. Therefore, staff recommends approval of the Master Agreement and Task Order No. 1 between the City of Pacifica and 4 Leaf, Inc. for the construction management, inspections and material testing of this project in the amount of $50,534.00. Staff recommends authorizing a budget authority for construction management in an amount not to exceed $55,389.00, which includes contingencies in the amount not to exceed ten percent (10%) of Task Order No. 1 for any unforeseen conditions.

ALTERNATIVE ACTION:

Council may choose not to approve the construction contract and master agreement. However, this will result in project delays and possible increase in construction cost. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Approval of the construction contract is consistent with the following Council adopted Goals:
• Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise. This construction project will improve the existing pedestrian network by installing ADA-compliant curb ramps.

FISCAL IMPACT:

The following is the source and use of funds for the project:

Total Project Source and Use of Funds
Measure W $ 450,000.00
Highway Safety Improvement Program (HSIP) Grant $ 249,200.00 Total Source of Funds $ 699,200.00
