BACKGROUND/DISCUSSION:

California Vehicle Code section 22507 authorizes the City to adopt ordinances or resolutions, to prohibit or restrict the stopping, parking, or standing of vehicles and to authorize preferential parking for designated groups. The California Vehicle Code also provides peace officers the authority to tow vehicles under certain circumstances. Vehicle Code section 22651(n) states the following:
“A peace officer, as defined in Chapter 4.5 (commencing with Section 830) of Title 3 of Part 2 of the Penal Code, or a regularly employed and salaried employee, who is engaged in directing traffic or enforcing parking laws and regulations, of a city, county, or jurisdiction of a state agency in which a vehicle is located, may remove a vehicle located within the territorial limits in which the officer or employee may act, under the following circumstances:
(n) Whenever a vehicle is parked or left standing where local authorities, by resolution or ordinance, have prohibited parking and have authorized the removal of vehicles. Except as provided in subdivisions (v) and (w), a vehicle shall not be removed unless signs are Pacifica City Council 2

posted giving notice of the removal.”
The City’s Municipal Code designates specific circumstances under which a vehicle may be towed. Pacifica Municipal Code section 4-7.1901 currently provides that a police officer may remove or cause to be removed a vehicle from any public street or public alley within the City limits to the nearest public garage or other place of safety, or to a garage designated or maintained by the City, under certain circumstances. Those circumstances include when a vehicle is illegally parked on a public street or public alley in violation of a City ordinance forbidding standing or parking and the use of the public street or public alley is necessary for the cleaning, repair, or construction, among others.

Staff is proposing that PMC section 4-7.1901 be amended to allow towing for any vehicle that illegally parks in a parking space designated for preferential parking, including but not limited to the Temporary Safe Parking Program as set forth in Section 4-7.1207. These types of preferential parking programs, established by ordinance or resolution in accordance with Vehicle Code 22507, cannot be effective if the parking spaces are not actually available to the program participants. As a result, staff is recommending that PMC section 4-7.1901 be amended to specify that if a vehicle is parked in a space designated as part of a preferential parking program, without clear display of a valid permit, that vehicle can be removed. The proposed amendment would also require that signs be posted indicating that an illegally parked vehicle would be towed.

CEQA:

Introduction of the proposed ordinance is exempt from the provisions of the California Environmental Quality Act (CEQA), under Section 15061(b)(3) of the CEQA Guidelines (14 Cal.

Code Regs. 15000 et seq.) because it can be seen with certainty that there is no possibility that the adoption of this ordinance may have a significant effect on the environment.

ALTERNATIVE ACTION:

The City Council could choose not to introduce the proposed amendments to the ordinance, and provide staff further direction.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
“A Healthy and Compassionate Community” includes addressing health and safety issues created by parking of motorhomes in City streets as well as continuing to work with homeless community members to connect them with services.
“Maintaining a Safe Community” includes addressing health and safety issues created by parking of motorhomes in City streets.

FISCAL IMPACT:

This action will not result in any direct fiscal impact.
