BACKGROUND/DISCUSSION:

The City Council approved the FY 2021-2026 Capital Improvement Program (CIP) in June of 2021. The CIP included the Playground Equipment Improvement Project meant to improve outdated citywide parks playground equipment. The City manages and maintains nineteen (19) total parks throughout the City of Pacifica and over the last several years Public Works (PW) and Parks, Beaches and Recreation (PB&R) staff have been working on assessment of the City parks needs due to aging infrastructure. This included a consultant playground equipment assessment study that was presented and discussed at a Parks, Beaches and Recreation Commission study session in September of 2019. Based on the assessment study and discussions between PW and PB&R staff, a priority list was created. In March 2022, staff had another study session with the PB&R Commission to review the status of the parks. The assessment and inspection found that the play structure at the Pacifica Co-Op Nursery School/Pomo Park needs to be replaced as it has exceeded it's useful life. In addition, the large eucalyptus tree adjacent to the structure will need to be removed. The play structure can be used safely, however, staff recommends the replacement of the play structure this year.

Staff recommends executing a construction services agreement with Miracle Recreation Equipment Company (dba Miracle Playsystems) to order the equipment (5-7 month delivery; supply-chain delays). Staff has also worked with the Nursery to pick a suitable replacement play structure.

Procurement and pricing comply with the public purchasing process as Miracle Recreation Equipment Company (dba Miracle Playsystems) is a vendor of the State of California Multiple Pacifica City Council 2

Award Schedule (CMAS Contract 4-17-78-0006B) and Sourcewell (Contract #010521-LTS), cooperative purchasing organizations dedicated to public sector procurement. CMAS and Sourcewell have completed the bidding process on products and services, which public agencies can utilize and receive competitive pricing. The City Manager recommends approval of the Construction Services Agreements with Miracle Recreation Equipment Company (dba Miracle Playsystems) for the purchase and installation of the play structure replacement equipment.

ALTERNATIVE ACTION:

Council may choose not to approve the construction agreements. However, this will result in delays in obtaining the replacement play structure. Staff does not recommend this alternate action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Approval of the construction contract is consistent with the following Council adopted Goal:
• Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as playground equipment. This construction project will replace deteriorating play equipment, improving the condition of the play structures for children using the facilities.

FISCAL IMPACT:

City staff recommends including a 10% contingency to the Project Costs for any unforeseen conditions during construction. The following is the source and use of funds for the project:

Total Project Source and Use of Funds
Construction Services Agreement $ 97,624.23
Contingency (10%) $ 9,762.42
Consultant Cost (with 10% Contingency) $ 107,386.65
Total Use of Funds $(107,386.65)
Total Source of Funds (Roy Davies Fund 27) $ 221,379.34 Estimated Project End Balance $ 113,992.69

The City Manager recommends approving a budget authority in the amount of $107,386.65.

The use of the contingency will be reviewed and approved by City staff. The remaining funds would allow City staff to evaluate other parks and replace other play structures in the City.
