BACKGROUND/DISCUSSION:
On April 28, 2017, the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017).
To address basic road maintenance, rehabilitation, and critical safety needs on both the state highway and local streets and road system, SB 1 increases per gallon fuel excise taxes, increases diesel fuel sales taxes and vehicle registration fees, and provides for inflationary adjustments to tax rates in future years.
The State Controller (Controller) deposits various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new Road Maintenance and Rehabilitation Account funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.
SB 1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. Therefore, to be eligible for Road Maintenance and Rehabilitation Account funding, statute requires cities and counties to annually provide basic project reporting to the Commission for projects anticipated for and funded through the Road Maintenance and Rehabilitation Account. The City will receive approximately $863,690 for street rehabilitation for FY 2022-23.

The Streets and Highways Code requires that prior to receiving an apportionment of RMRA funds from the Controller in a fiscal year, all eligible cities or counties shall submit to the California Transportation Commission (Commission) a list of projects proposed to be funded with these funds pursuant to an adopted resolution by the applicable City Council or County Board of Supervisors at a regular public meeting. The attached resolution is in the strict format provided by the Commission and includes a list of all streets that are eligible for SB1 funding.
These streets are part of the City’s 5-Year Street Maintenance program for FY 2022-23.
This year, the City Manager recommends the following project for SB1 funding for Fiscal Year 2022-23:
• FY 2022-23 Pavement Resurfacing Project. The project will follow the City’s approved 5- year street maintenance program and resurface approximately 4.5 miles (19 street sections) of City pavement and includes asphalt overlay, cape seal, double slurry seal, slurry seal, microsurfacing, base repair, pavement striping and markings and other miscellaneous related work.
ALTERNATIVE ACTION:
If the Council chooses not to adopt the Resolution, it will result in the City not meeting statutory requirements for the SB1 Funds. Therefore, staff does not recommend this alternative action.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
• Fiscal Sustainability: includes investing in economic development to increase revenues, funding a reserve/emergency fund, and being well prepared for grant opportunities.
Adopting the resolution and approving the Proposed Project List meets statutory requirements that will allow the City to receive SB1 Funds. • Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise. Adopting the resolution and approving the Proposed Project List meets statutory requirements that will allow the City to receive SB1 Funds and repair City infrastructure.
FISCAL IMPACT:
There is no Fiscal Impact associated with the Adoption the Resolution. Separate Council action is required for appropriation of funds for each of the projects listed.
