Purchase Agreement with JM Squared Associates, Inc. to furnish two (2) new pumps at the Linda Mar Pump Station
RECOMMENDED ACTION:
Approve Purchase Agreement between the City of Pacifica and JM Squared Associates, Inc., via sole source, in the amount of $430,819.44 for the purchase of two Pentair Fairbanks Nijhuis pumps for the Linda Mar Pump Station; approve budget authority in the amount of $473,901.38 which includes 10% contingency in the amount of $43,081.94; authorize the City Manager to execute all documents related to the project.

BACKGROUND/DISCUSSION:
During the FY 2022-23 Capital Improvements Program (CIP) budget approval process, the Council approved funding for the Linda Mar Pump Station Repair Project. Purchase of new electric pumps was included in the funding approval for the Linda Mar Pump Station Repair Project.
The Linda Mar Pump Station’s (LMPS’s) existing electric-driven pumps are the workhorse pumps for the Linda Mar Basin, conveying wastewater from this Basin to the Calera Creek Water Recycling Plant for treatment. The two LMPS electric-driven pumps are approaching 50- years old and are at the end of their useful service life. They have performed admirably during their lifetime, with City Staff performing standard preventative maintenance and replacement of small component parts. During the storm event of October 23rd, 2021 and October 24th, 2021, when over 6.8-inches of rainfall was recorded at the Weather Underground’s Linda Mar Weather Station, these two pumps operated at full capacity for well over 24-hours without any glitches. But due to their age and importance to the collection system, they require replacement.
The existing pumps were manufactured by Fairbanks Morse Pumps who has been furnishing wastewater pumps for over 100 years. Fairbanks Morse Pumps was purchased by Pentair Nijhuis and now goes by the name of Pentair Fairbanks Nijhuis. The replacement pumps would be manufactured by Pentair Fairbanks Nijhuis and have the exact same dimensions as the original pumps, and therefore will not require costly changes to the existing suction and discharge piping. As part of prior work done by City consultants, other manufactures of this pump type could be installed but this would require costly changes to the suction and discharge piping and could delay the pump installations. Additionally, purchasing the Pentair pumps will reduce the complexity of operations and maintenance requirements due to staff familiarity with Pacifica City Council 2

this type of pump that is already on-site. Therefore, staff recommends replacement with the same sized Pentair Fairbanks Nijhuis pumps.
The following show the need to purchase the two new electric-driven pumps from Pentair Fairbanks Nijhuis from JM Squared Associates, Inc., which have been determined to be Sole Source commodities:
• JM Squared Associates, Inc. is the exclusive authorized Pentair Fairbanks Nijhuis distributor for municipal pumps and pump parts for Northern California. • JM Squared Associates, Inc. is the exclusive authorized Pentair Fairbanks Nijhuis distributor for field installation, service and repair facility for Fairbanks Nijhuis pump products.
• JM Squared Associates, Inc. is the exclusive authorized Pentair Fairbanks Nijhuis distributor to sell Pentair Fairbanks Nijhuis pumping equipment products, OEM parts, and services.
For these reasons, the City Manager is recommending the approval of the Purchase Agreement between the City of Pacifica and JM Squared Associates, Inc., via sole source, in the amount of $430,819.44 for the purchase of two Pentair Fairbanks Nijhuis electric-driven pumps and appurtenances for the Linda Mar Pump Station.
ALTERNATIVE ACTION:
The Council may choose not to approve the purchase agreement with JM Squared Associates, Inc. via sole source and direct staff to issue a Request For Proposal (RFP). However, doing so would delay project delivery and will increase project cost and the pumps are needed to assure workability of the Linda Mar Pump Station during winter storm events. The City Manager does not recommend this alternate action.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
Approval of the Purchase Agreement with JM Squared Associates, Inc. is consistent with the following Council adopted Goals:
• Stewardship of City Infrastructure: This project will replace end of service life electricdriven pumps at the Linda Mar Pump Station.
FISCAL IMPACT:
The cost of purchasing the two pumps and appurtenances for the Linda Mar Pump Station is $430,819.44. City staff recommends including a 10% contingency for any additional parts or services needed to complete the project. The Source and Use of Funds spreadsheet is shown below.

No additional budget authority is necessary as sufficient funds have been allocated in the Wastewater Enterprise Fund FY 2022-23 budget for this project. The total cost of $473,901.38 is within the project budget of $590,000 allocated for this project.
