BACKGROUND/DISCUSSION:

The Planning Department refocused its efforts to comprehensively update the General Plan and Local Coastal Land Use Plan (LCLUP), as well as to create a new Sharp Park Specific Plan, in 2019. To support these three major work items, the City Council authorized the City Manager to execute a consultant services agreement (CSA) with Dyett & Bhatia Urban and Regional Planners on January 28, 2019. The CSA amount of $660,000 reflected Dyett & Bhatia’s judgment of the anticipated level of effort to complete these three work items, as well as the associated California Environmental Quality Act (CEQA) review, based on its extensive experience performing similar work in jurisdictions across California.

While the City Council adopted the LCLUP update in February 2020, work on the General Plan update and new Sharp Park Specific Plan (SPSP) continued into 2022. Notably, the City received extensive public comments during the draft environmental impact report (DEIR) public review period which required a much greater level of effort to review and respond to comments than anticipated by Dyett & Bhatia in 2019. Moreover, the adoption processes for the General Plan update and SPSP required multiple public hearings that were not anticipated.

On account of the additional work required to comply with CEQA and complete the public hearing process for adoption of the plans, services provided by Dyett & Bhatia exceeded the initial contract amount and requires an amendment to the CSA. The proposed amendment to increase the cost ceiling of the CSA by $132,000 also includes a small amount of additional funding to support the interim rezoning work the City must perform to ensure its zoning map is consistent with the adopted General Plan and SPSP and would extend the term of the CSA through June 30, 2023, to ensure uninterrupted support of the interim zoning process.

ALTERNATIVE ACTION:

No alternative action has been identified.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

The General Plan update, new SPSP, and CEQA review authorized in the First Amendment would support completion of the following Council-adopted Work Plan initiatives from Fiscal Year 2021-2022:
● Item 10: Complete a Sharp Park Specific Plan.
● Item 11: Complete a comprehensive General Plan update.

FISCAL IMPACT:

The City imposes a General Plan maintenance fee on building permits to support the funding of periodic General Plan updates. Since FY 2018-2019 when the original CSA was executed, the City has received more than $43,000 in additional General Plan maintenance fee revenue that will be used to offset the additional costs of the First Amendment. The FY 2022-2023 adopted budget also projects an additional $18,000 in General Plan maintenance fee revenue in the current fiscal year.

Although the approximately $71,000 additional cost of the First Amendment was not included in the FY 2022-23 adopted budget, staff anticipates the cost to be covered by the salary savings in the Planning Department resulting from position vacancies and, therefore, is not requesting a budget amendment at this time. Staff will revisit this matter during the mid-year budget review to include any necessary amendment at that time if needed.
