1 SUBJECT:
Resolution authorizing a Side letter agreement between the City of Pacifica and Teamsters Management 350 regarding labor representation and compensation for Deputy Fire Chief and Paramedic Coordinator classifications.
RECOMMENDED ACTION:
1. Adopt a resolution authorizing the City Manager to enter into a side letter between the City of Pacifica and Teamsters Local 350 to move the Deputy Fire Chief and Paramedic Coordinator classifications to the Unrepresented Management and Confidential Employees Group.
2. Amend the benefit structure for these positions to include holiday pay compensation consistent with other fire classifications to make total compensation for these positions closer to market and make the positions more attractive for future recruitment.

BACKGROUND/DISCUSSION:
Like many Bay Area agencies, the City has been experiencing critical recruitment and retention challenges, having to conduct multiple recruitments for critical professional and management positions. To that extent, another recent recruitment that failed was the replacement of the Deputy Fire Chief, who had rendered his retirement notice to go into effect on October 27, 2022. Due to failed recruitment efforts and in preparation for a new recruitment next year, staff is recommending preparing a side letter to provide the Deputy Fire Chief and Paramedic Coordinator classifications with 7.5% of base salary in lieu of observing City Holidays effective the second full pay period in October 2022 after the adoption of this resolution.
The proposed side letter is in recognition of the essential nature of services provided by these classifications and to coincide with the City’s efforts of bringing consistencies in compensation structure with other fire classifications. Currently, other City of Pacifica Fire classifications, including Firefighters and Battalion Chiefs, receive holiday pay. Extending this benefit to these two classifications will bring consistency and equity within the department and bring the compensation level for these two classifications closer to comparable positions in the recruitment market.
This action may also help retain the incumbent Deputy Fire Chief for another year, provide stability at the Fire Department management level, and benefit the City's future recruitment Pacifica City Council 2

and retention efforts.
Additionally, the affected employees of this side letter will be moved to the Unrepresented Management and Confidential Employees Group and will be subject to compensation, benefits, and specific provisions as currently provided by the Unrepresented Management and Confidential Employees Group benefit resolution.
ALTERNATIVE ACTION:
Do not approve the recommended action and / or provide alternative direction to staff. Not approving this side letter will create operational hardship within the fire department and present future recruitment challenges.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
The recommended action is consistent with the following Council goal:
"A Strong City Workforce Infrastructure" includes strategies to address employee retention and attraction challenges, engaging staff in decision-making, and recognizing staff.
FISCAL IMPACT:
The budget impact of adding 7.5% Holiday in lieu pay for the Deputy Fire Chief and Paramedic Coordinator positions and moving them to the Unrepresented Management group will be approximately $45,800 for the full year or $29,900 for the remainder of the current FY 2022-23, which will be absorbed by the savings in the Fire department's budget, so no budget amendment is being requested at this time. If approved, this cost will be factored into the salary and benefits projections for the FY 2023-24 Base Budget.
