Amendment No. 4 To Sublease Agreement between the City of Pacifica and the Art Guild of Pacifica
RECOMMENDED ACTION:
Move to Adopt Resolution Approving Amendment No. 4 to Sublease Agreement between the City of Pacifica and the Art Guild of Pacifica (AGP). In addition to the Original Premises located at 1220 Linda Mar Boulevard, the AGP desires to lease the former Credit Union space, consisting of 770 rentable square feet located in the building on terms and conditions set forth within the amendment.

BACKGROUND/DISCUSSION:
The City of Pacifica (Lessor) and the Art Guild of Pacifica (Lesee) entered into a sublease agreement, dated October 3, 1996, as amended by that certain Amendment No. 1 to the Sublease Agreement, dated March 1, 2000, by and between Lessor and Lessee, and as amended by that certain Amendment No. 2 to Sublease Agreement, dated December 1, 2005, by and between Lessor and Lessee, and as amended by that certain Amendment No. 3 to Sublease Agreement, dated December 14, 2009, by and between Lessor and Lessee (collectively, the “Original Lease”) pursuant to which Lessor has agreed to lease to Lessee and Lessee has agreed to lease from Lessor an approximately 22,283 contiguous square foot portion of that certain approximately 31,091 square foot building located at 1220 Linda Mar Boulevard, Pacifica, California 94044 (the “Building”), as more particularly described in the Original Lease (the “Original Premises”).
In addition to the Original Premises, Lessee desires to lease from Lessor and Lessor desires to lease to Lessee the former "credit union space", consisting of approximately 770 rentable square feet located in the Building (the “Expansion Space”) on the terms and conditions set forth herein. The Original Premises and the Expansion Space are collectively referred to herein as the “Premises.” The Original Lease together with this Amendment are collectively referred to herein as the “Lease.”
The Art Guild of Pacifica intends to offer public art classes, community programming, art education, community meetings, and small workshops within the 770 square foot requested additional space. The AGP will be paying additional rent and utilities identified within the amended agreement.
ALTERNATIVE ACTION:
Do not approve of Amendment NO. 4. The City of Pacifica would then need to begin a search Pacifica City Council 2

for another potential Lesee. The AGP would not be able to expand program.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
“An Engaged Community” includes creating opportunities to expand public participation, increase communication, and build community post-COVID.
FISCAL IMPACT:
The City of Pacifca will receive an additional $77 per month in the year 2023, an additional $79 per month in the year 2024, and an additional $81 per month in the year 2025.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PACIFICA APPROVING AMENDMENT NO. 4 TO THE SUBLEASE AGREEMENT BETWEEN THE CITY OF PACIFICA
AND THE ART GUILD OF PACIFICA TO EXPAND THE CURRENT LEASED SPACE IN THE BUILDING LOCATED AT 1220 LINDA MAR BOULEVARD BY 770 SQ FT WHEREAS, the Art Guild of Pacifica desires to expand the leased space by an additional 770 square feet within the Sanchez Art Center building located at 1220 Linda Mar Boulevard; and
WHEREAS, the Art Guild of Pacifica is a long standing non-profit that provides art programs to the greater Pacifica community; and
WHEREAS, the Art Guild of Pacifica will fulfill the terms and conditions of the agreement including updated monthly payment amounts.
NOW, THEREFORE, THE CITY COUNCIL HEREBY RESOLVES:
The City Council of the City of Pacifica hereby approves Amendment No. 4 to the Sublease Agreement between the City of Pacifica and the Art Guild of Pacifica to expand the current leased space in the building located at 1220 Linda Mar Boulevard by 770 square feet per the terms and conditions of the amended agreement.
