BACKGROUND/DISCUSSION:

On June 12, 2023, the City Council adopted the FY2023-24 Operating and Capital Budget that included creation of the Senior Code Enforcement Officer position to increase the staff’s capacity to manage complex code enforcement issues including the short-term-rental (STR) program.

The new Sr. Code Enforcement Officer will provide a higher level of code enforcement expertise and will work on establishing the City’s STR compliance program, improving enforcement and compliance. This position will supervise the Code Enforcement Officer classification and focus significant investigative and enforcement resources on oversight of the expanded operating requirements for individual STRs that exist in the current STR ordinance and future ordinance updates, which is a part the City’s current work plan. Increased code enforcement resources at the Senior Code Enforcement Officer level dedicated to investigating STR complaints and ensuring compliance will improve quality-of-life in neighborhoods across the city.

Chapter 5 Article 4 - Personnel system of the Pacifica Municipal Code, establishes the procedures for the City Manager, as Personnel Officer that require the Council’s approval of any revisions to a position classification plan covering all positions in the City service. Any new or revised classification is established upon adoption by the City Council. After the Council’s approval of a new job classification and salary schedule, the City could proceed with the recruitment.

The new classification title is consistent with the organizational structure in other departments citywide and will fall under the Teamsters Management 350 employees' group. The City completed the meet and confer process with the Teamsters Management 350 collective Pacifica City Council 2

bargaining representative regarding this classification and compensation schedule.

The salary range for the classification was established by applying the City’s methodology of benchmarking against the 12 previously negotiated and agreed upon comparison agencies in San Mateo County, adjusted by the internal alignment to the City’s Compensation Plan, and included a 2% contractual cost of living increase that went into effect on July 1, 2023, as listed in the table below.

The Council has already approved the addition of this class to the City’s position control as part of the FY2023-24 Budget, and the action tonight is simply establishing the position’s job classification in order to start the recruitment.

FISCAL IMPACT:

There is no additional fiscal impact related to the approval of the Senior Code Enforcement Officer Classification, as addition of this position has been already included in the Adopted FY 2023-24 Budget. The actual fiscal impact will be dependent on the future employee’s placement within the positions’ salary range.
