BACKGROUND/DISCUSSION:
The City of Pacifica Risk Management program protects City assets, provides adequate insurance coverage and claims management services, promotes and implements safety policies and best practices to mitigate the City’s risk exposures. The program includes two components: General Liability and Workers compensation.
1. PLAN JPA - General Liability
The City is a member of the Pooled Liability Assurance Network Joint Powers Authority (PLAN JPA), which provides the City with general liability, auto and property insurance through participation in a self-funded insurance pool serving public agencies. The PLAN JPA consists of twenty-eight-member Bay Area municipal agencies and is currently administered by Sedgwick staff governed by a Board of Directors, consisting of representative from each member agency. As a member the City receives General Liability coverage for $5 million with an SIR (Self Insured Retention) of $50,000 on liability claims.
The governing documents of the Pooled Liability Assurance Network Joint Powers Authority require the governing body of each member city to appoint one Board member and one alternate Board member to the Board of Directors of the City.
Previously, the City of Pacifica’s designated representative has been the City Manager and Assistant City Manager. The Pacifica’s Assistant City Manager is currently serving on the PLAN JPA’s Executive and Risk Management Committees and together with the Burlingame’s Board member represents the PLAN on the Board of Directors for California Affiliated Risk Management Authorities (CARMA) excess liability pool (coverage over $5 million) consisting Pacifica City Council 2

of six member JPAs with over 160 underlying public agency members. To allow for continuing effective representation and to avoid any potential scheduling conflicts, the City Manager recommends that the City Council revise the PLAN JPA Board appointees as follows:
Title Designation
Assistant City Manager Director (no change)
Financial Analyst Voting Alternate Director (replacing the City Manager) To make the recommended changes, City Council must adopt a resolution that states the new designations (attached).
2. MPA - Workers Compensation
The Municipal Pooling Authority of Northern California provides the City with worker's compensation insurance coverage through participation in a self-funded insurance pool serving 20 public agencies.
The operations of the Municipal Pooling Authority of Northern California programs are governed by a Board of Directors consisting of one representative from each member agency.
The governing documents of the Municipal Pooling Authority of Northern California require the City Council of each member city to appoint one Board member and one alternate Board member to the Board of Directors representing the City.
Previously, the City of Pacifica’s designated representative are the Assistant City Manager and Human Resources Manager, per Resolution No. 30-2019 (Attachment A). In order to effectively manage the staff’s capacity and to allow for continuing representation without scheduling conflicts the City Manager recommends that the City Council revise the Board appointments as follows:
Title Designation
Human Resources Manager Director (no change)
Human Resources Analyst Voting Alternate Director (replacing the Assistant City Manager) To make the recommended changes, City Council must adopt a resolution that states the new designations (attached).
Participation on the Board of Directors for either insurance pool has been carried out by City Staff as part of regular duties and does not result in any remuneration to the employee.
FISCAL IMPACT:
There is no fiscal impact associated with adoption of this resolution.
