BACKGROUND/DISCUSSION:

During the Federally Declared Disaster of 1998, the City of Pacifica installed rock revetment along the beach adjacent to the 500 block of Esplanade. The purpose of the rock revetment is to protect the roadway and utilities along Esplanade from eroding into the ocean. Portions of said rock revetment are within the jurisdiction of the State Lands Commission (SLC) and SLC requires a General Lease - Public Agency Lease Agreement for the City to keep and maintain the rock revetment at its current location.

On December 16, 2002, the City entered into a 10 year General Lease - Public Agency Use Agreement with SLC for the rock revetment. The authorization was for a period of 10 years and expired November 30, 2012.

On December 12, 2012, the City renewed the 10 year General Lease - Public Agency Use Agreement with SLC for the rock revetment. The authorization was for a period of 10 years and has now expired. The City has to renew its General Lease Agreement with SLC to keep and maintain the rock revetment at its current location.

Attached is the General Lease Agreement No. 8438 between the City of Pacifica and the Pacifica City Council 2
August 14, 2023
California State Lands Commission to renew the authorization for another 10 years commencing on December 1, 2022. City Manager recommends approval of General Lease No. 8438.

ALTERNATIVE ACTION:

Alternative Action would be to not adopt the resolution which would cancel the lease and possibly require the City to remove the existing rock revetment. Staff does not support this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
· Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise.

Adopting the resolution will allow the City to keep the existing rock revetment and protect the roadway and utilities along Esplanade.

FISCAL IMPACT:
$140.00 per year; with an annual Consumer Price Index adjustment.
