BACKGROUND/DISCUSSION:

Commercial and Industrial Stormwater Inspections is a requirement of the San Francisco Bay Municipal Regional Stormwater NPDES Permit Order No. R2-2022-0018 (MRP). Each permittee is required to conduct inspections, effective follow-up, and enforcement to abate potential and actual non-stormwater discharges. These efforts prevent the discharge of pollutants and impacts to beneficial uses of receiving waters.

On December 11, 2017, City Council approved the agreement with Eisenberg, Olivieri & Associates, Inc. (EOA) to conduct Commercial and Industrial Stormwater Inspections and Related Services. On April 5, 2022, the City approved Amendment No. 1 for the agreement to remain in full force and effect through July 2023. The Amendment allows for the Agreement to be renewed annually through July of 2025.

EOA has a unique understanding of the City of Pacifica’s Commercial and Industrial Stormwater Control Program. EOA has been assisting the San Mateo Countywide Water Pollution Prevention Program (SMCWPPP) and its member agencies with implementation of the MRP Provision C.4 Industrial and Commercial Site Control for over 20 years. EOA developed many of the tools and guidance provided to the SMCWPPP members.

The City Manager recommends adopting the resolution and approving the Second Amendment Pacifica City Council 2
August 14, 2023
(Attachment 1) to the Consultant Services Agreement between the City of Pacifica and EOA.

ALTERNATIVE ACTION:

The Council may choose not to approve the amendment. This could result in the City not meeting Municipal Regional Stormwater Permit requirements. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
• Preserve and Enhance Natural Resources includes mapping out parks and open space, preserving hillsides and beaches, paying attention to flora and fauna needs, and environmental health.

Approving the Consultant Services Amendment will provide needed inspections services that will continue to protect the environment and assist the City with MRP compliance.

FISCAL IMPACT:

Use of Funds
Inspection services $50,000.00
Total Use of Funds $50,000.00
Source of Funds
NPDES Fund 16 $50,000.00
Total Source of Funds $50,000.00
Fiscal Impact will be in the amount of $50,000 in contractual services and is partly offset by Stormwater Inspection fees. No additional budget authority is required as enough funds was budgeted in the NPDES Stormwater fund during the adoption of the City’s annual fiscal budget.
