BACKGROUND/DISCUSSION:

The City Council approved the 2023-28 Capital Improvement Program (CIP) on June 26th, 2023.

The proposed projects in the 2023-28 CIP included the Frontierland Park ADA Improvement Project. The project was included in the City’s CIP program following complaints related to ADA access into the park.

The Frontierland Park ADA (Americans with Disabilities Act) Improvement Project will construct an ADA compliant asphalt trail with ADA compliant handrails in Frontierland Park. This ADA complaint path of travel will be located at the north end of the Frontierland Park parking lot. To install the project, 22 trees will need to be protected based on an arborist’s report. The arborist report with the tree protection plan have been included as part of the bid documents. In assessing locations where the ADA ramp could be placed with the consultant engineering firm and Public Works staff, it was determined that the north end of the parking lot was the only feasible location for the ramp. The project plans and specifications are also available to view on the City's website at: <https://www.cityofpacifica.org/departments/publicworks/engineering/capital-improvement-projects/frontierland-park-ada-improvement-project> Pacifica City Council 2

The Project was advertised on October 4, 2023 and October 11, 2023 in accordance with the formal bid process. Sixteen (16) companies requested plans and specifications and three (3) companies submitted bids. On October 31, 2023, the bid opening was held via Zoom by the City Clerk and the result is as follows:

Company Base Bid
DRYCO Construction, Inc. $99,994.00
Mercoza $109,000.00
Innovate Concrete Inc. $126,650.00
The apparent low bidder is DRYCO Construction, Inc., with a base bid amount of $99,994.00.

This is approximately 33% over the Engineer’s Estimate. The higher cost for the Engineer’s estimate is due to the tree protection that needs to take place that was determined following the design. Staff found the bid reasonable based on the current construction industry market, high inflation rates, and responsive to the bid documents.

As Dryco is the low bidder, has performed well on past contracts with the City, and no bid protests have been received by the City, the City Manager recommends the award of contract (Attachment "A") to the apparent low bidder, DRYCO Construction, Inc. In addition, a 15% contingency is recommended to allow enough funding to handle any unforeseen conditions and/or additional improvements that are identified during construction.

ALTERNATIVE ACTION:

The City Council may choose not to adopt the resolution and not approve the construction contract. However, this will result in project delays and possible increase in construction cost.

Additionally, Dryco’s bid is responsive and as the low bidder the City does not have a basis for not awarding the contract to Dryco. Staff does not recommend this alternative action.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

Approval of the construction contract is consistent with the following Council adopted Goals:
• Improve and steward City infrastructure, streets, and facilities; includes developing facilities for public safety. This construction project will improve Frontierland Park ADA access.
