CITY OF PACIFICA

COUNCIL AGENDA SUMMARY REPORT
1/8/2024
1 SUBJECT:

Consultant Services Agreement for Housing Related Activities and Assignments Between the City of Pacifica and the Housing Endowment and Regional Trust (HEART) of San Mateo County.

RECOMMENDED ACTION:

Move to adopt a Resolution approving a Consultant Services Agreement with the Housing Endowment and Regional Trust (“HEART”) of San Mateo County for housing related activities assignments and related services with a fixed monthly rate of $3,166.64 until June 30, 2026, for a total of 358 hours of consultants services each year for approximately 30 months and to authorize the City Manager to execute the Agreement.

STAFF CONTACT:

Christian Murdock, AICP, Planning Director

BACKGROUND/DISCUSSION:

The Planning Department is planning and implementing various programs outlined in the Draft Housing Element to be undertaken by the City during the 6th cycle planning period (2023-2031) in order to further the City’s Housing Element goals and policies and make measurable progress toward objectives, constraints, and fair housing issues, as well as compliance with state law.

However, due to limited staffing and the City’s budgetary constraints, the Planning Department does not have dedicated staff assigned to housing policy-related work. As a result, existing Planning Department staff cannot dedicate sufficient time to accomplish all anticipated housingrelated activities in upcoming years.

The City is a member of the Housing Endowment and Regional Trust of San Mateo County (hereinafter “HEART”)1, which is a Joint Powers Authority (“JPA”) established by the County of San Mateo and cities and towns within the County (“Member Agencies”) dated May 13, 2003.

The JPA was amended by the First Amended Joint Exercise of Powers Agreement (“First Amended JPA Agreement”) on September 9, 2008.

The City and other Member Agencies are looking for ways to manage the workload relating to establishing and carrying out new housing programs identified in housing elements. The First Amended JPA Agreement authorizes HEART to facilitate and assist Member Agencies to operate, regulate, maintain, facilitate the planning and study of appropriate housing programs, projects and housing management practices.

The City, as a Member Agency of HEART, may utilize Heart’s services and staffing to obtain assistance in carrying out its housing programs. The Agreement for Consultant Services (“Agreement”) would provide expert housing staff services from the Housing Endowment and Regional Trust of San Mateo County (HEART of SMC) to augment Planning Department staff.

HEART of SMC partners with the business, nonprofit, education, and labor communities to create more affordable housing in San Mateo County. The proposed Agreement would establish a fixed monthly rate of $3,166.64 to be paid by the City to HEART for the services of Heart staff. 1 Please refer to HEART of SMC’s webpage for further details about the organization.

The Agreement would terminate on June 30, 2026, unless terminated sooner by the parties. If approved, HEART staff would perform these services for the City as an independent contractor and be supervised and directed by HEART. HEART would provide a total of 358 hours per year for approximately 30 months or until June 30, 2026, which equates to services of a 0.2 full time equivalent (FTE) employee. The services provided with the Agreement are critical to accomplishing the robust work program set forth in the Draft Housing Element.

ENVIRONMENTAL REVIEW:

Approval of the proposed Agreement is not subject to review under the California Environmental Quality Act (CEQA) pursuant to Public Resources Code Section 21000, et seq. and the CEQA Guidelines (14 Cal. Code Regs. §§ 15000 et. seq.), including without limitation, Public Resources Code section 21065 and California Code of Regulations 15378 as this is not a “project” that may cause a direct, or reasonably foreseeable indirect, physical change in the environment as it is an administrative action.

ALTERNATIVE ACTION:

The Council could choose to not approve the proposed Agreement or Authorize a different amount for the proposed Agreement and direct staff to present a modified agreement to the consultants and other participating San Mateo County cities. Authorization of a modified contract amount whether reduced or increased will require the Planning Department staff to discuss a new contract amount with HEART of San Mateo County and participating San Mateo County Cities. However, the contract amount was reviewed and considered sufficient by multiple San Mateo County Cities and the consultants as the amount was based on the estimated annual cost of a new 0.2 full time employee (FTE) of a HEART employee and a new estimated contract amount would need further fiscal evaluation by HEART of San Mateo County. In addition, if the proposed agreement would be denied then potential delays in program implementation action for the Housing Element would be probable, which would effect timely progress reports to the State.

RELATION TO CITY COUNCIL GOALS AND WORK PLAN:

The proposed Agreement for consultant services to perform housing-related assistance is consistent with the following item(s) in the Council-adopted Strategic Plan and Priority Work Plan for FY 2023-2030:
• Goal 3: Prioritize protection and development of affordable housing. o Strategy C: Prioritize Housing Element program implementation.

FISCAL IMPACT:

The total cost of this Agreement is approximately $100,000 over 30 months between execution and June 30, 2026. Funds for this Agreement are already included in the Planning Department’s Fiscal Year 2023-2024 (FY 2023-24) budget for housing-related activities. The City Council will need to appropriate funding in subsequent fiscal years to allow continued participation in the Agreement.
